By the time this article is published, the 2024 presidential election will have concluded, and your feelings about the outcome may vary. We hope to feel energized and inspired, but we must also prepare for other possibilities.
Regardless of the results, one thing is certain: we must stay resilient and advance our mission to build our companies, the merit shop, the free enterprise community, and the neighborhoods we call home, as well as our great nation.
It’s essential that we continue to collaborate with those who share our values while also engaging with those who may not agree with us. ABC members have a unique ability to foster positivity and prosperity for all who welcome it, irrespective of the election outcomes. That’s the essence of what we do!
So what is next?
There is no rest for the weary and here are some of the things we can continue to do to keep ABC Keystone, our companies collectively and the merit shop community going:
• Contribute: One of the most impactful ways to support our cause is through contributions to funds like PAC and FEA. Your board members help determine how these funds are allocated, and you'll be pleasantly surprised by how the money returns to our communities and supports the legislators we advocate for.
• Collaborate: Participate in the numerous networking events hosted by ABC Keystone throughout the year. As Helen Keller said, "Alone we can do so little; together we can do so much."
• Training and Education: Take advantage of the apprenticeship programs and educational courses offered by Keystone. These resources are essential for developing a “best in class” workforce among merit shop contractors.
• Sponsor a Member: Encourage merit shop contractors who aren’t yet part of ABC Keystone to join our vibrant community. Many companies in the Keystone region would greatly benefit from membership. Reach out to Mike Bachman, ABC Keystone Director of Membership, (mike@abckeystone.org), and he can provide you with all the information you need to share the benefits of membership.
• Use the ABC Action App: Promote and utilize the ABC Action App, which provides vital updates on legislation affecting merit shop policies and offers tailored responses to our legislators. This app can be shared across your organization, so download it from the app store today! Post-election, may provide different scenarios on how legislation and the government treats the merit shop community and especially ABC members, but no matter the results we need to stay vigilant, push forward in a positive direction, take action and stay engaged.

What made you choose carpentry?
I chose carpentry because I don't like to sit all day. I need to be up and moving around. I am very good with my hands, so I knew I wanted to do something in this line of work.
What has been your favorite lesson or skill you've learned in your apprenticeship program so far? My favorite thing I have learned so far is how to install ACT.
What’s one surprising thing you’ve discovered about the trade you’re learning?
What surprised me about carpentry is how much thought and stress goes into concrete.
What motivates you to work hard?
I work hard for God because I know His reward is far better than the one here on Earth.
Where do you see yourself in 5 years?
In 5 years, I want to own at least two rental properties.
What do you enjoy doing in your free time? I love golf, the gym, and anything else outside!
Are you a morning person or night person?
Depending if it is the weekend or weekday, I am a morning and night person.

Last month, the Construction Management Association organized an educational field trip to the Philadelphia area, allowing participating members to gain firsthand exposure to a variety of construction projects. The itinerary Thursday included a 4am departure from the college and site visits to two projects at the Childrens Hospital of Philadelphia, and the Thomas Jefferson University Alumni Hall. The group also squeezed in some sightseeing downtown in the afternoon before meeting up with a large contingent of area alumni for dinner and some fun as they played miniature golf at Puttshack.
Another early start Friday as the group left the city to tour projects including Swarthmore College Martin Hall, Kendal at Longwood, and the Lock 57 project. The group was also able to tour the offices of Allen Myers, a Keystone ABC member, to explore the office side of the profession. The evening was free time in
the Plymouth Meeting area, so students and faculty scattered for dinner and exploration.
On the return trip Saturday, the group visited the ABC Keystone training facility in Manheim for a tour and to learn about ABC workforce initiatives before returning to campus.
These trips allow students to see a wide variety of projects, learn from many different companies and professionals and to build friendships and memories for lifetime.
Penn College held its Fall Career Fair on October 1st and 2nd this year and there were plenty of opportunities for careers in construction! Potential employers from all over the country were on hand with over 100 companies recruiting Construction Management students. “Our BCM Professors encourage us to make the days events a priority,” says James Fretz, a BCM Junior and Assistant Vice President of the CMA, “we often refer to the career fair and surrounding activities as our Super Bowl. It is a real focus and we all take it seriously.”
The CMA Club plays an integral part for our members, during the weeks leading up to the event as well as on game day. Morgan Littlefield, CMA President offered, “Each year, upperclassmen share internship experiences with their peers and new students, showcasing opportunities and offering insights to prepare. We also conduct resume workshops, share interview strategies and answer tons of different questions related to the career fair and summer internships.”
The Construction Management Association provides unique name badges for our members but it is really the comprehensive support network that makes the “whole experience special” says Novalee Machemer, a freshman BCM student and CMA member.
In addition to the two days of Career Fair, CMA also helped sponsor a Construction Management mixer (with the support of many company sponsors) on Tuesday evening, helping provide an opportunity for employers and students to interact in a more casual environment. As the week progresses, many students find themselves in a new environment of interviews and negotiations as they work to lock-in the amazing opportunities for next summer.
On Tuesday, October 22, representatives from Benchmark Construction, a Keystone ABC member company, participated in the bi-weekly Construction Management Association meeting to share their expertise. Alicia Weaver and Ryan McCreary emphasized the critical importance of quality control, pre-installation meetings, and various other key factors related to building envelope systems. With nearly 60 members in attendance, the meeting provided an excellent opportunity for students to learn about the interwoven elements related to construction and the management of projects. Students also learned about Benchmark, career opportunities, and while they asked plenty of questions they also had plenty to eat as Benchmark provided buffalo wings and other refreshments!

How the Supreme Court’s Loper Bright Decision will affect Construction Industry Regulation from the US Department of Labor, Wage and Hour Division; OSHA; and the NLRB.
For decades federal agencies enjoyed wide latitude in creating and enforcing regulations. The Supreme Court’s recent Loper Bright decision however, put back in the courts’ hands the final say on interpreting laws about the scope of agency authority. This Wake-Up call will discuss the Loper Bright decision’s contours and its impact on how OSHA, DoL’s Wage and Hour Division and the NLRB govern the construction industry, with focus on these topics:
• Pre-Loper Bright deference to agency interpretations of their statutory authority;
• The basis for the Loper Bright decision and the scope of its ruling;
• Loper Bright’s impact on challenges to OSHA citations and future regulations; federal prevailing wage and hour compliance, enforcement, and litigation; and permissible labor organizing activities.

To support these efforts, ABC Keystone launched a "Political Apprenticeship" workshop this year to answer questions and provide tools for anyone considering public office or a role on a decision-making board. Our members’ dedication to the American Dream is powerful, and we want to help those who are ready to become leaders make decisions impacting businesses, schools, libraries, and taxpayers.
We recently wrapped up this year’s 3-day series, and we thank our participants and speakers for their time and interest. We’re committed to offering this program regularly to make public service more accessible, as we need fair-minded officials at every level of government—federal, state, and local—including boards and appointed positions.
A key focus of our workshop is exploring paths to public service, whether elected or appointed, at local, state, and federal levels. Many of you have likely seen decisions in your business or community that could have benefited from your experience. Positions on school boards, township boards, and zoning committees often remain unfilled or are taken by those less qualified. We want to help you rise to this challenge.

Since day one of the Biden-Harris Administration, when Joe Biden fired the Trump-appointed General Counsel of the National Labor Relations Board (NLRB), employers have faced the most union-friendly NLRB in the agency's 95-year history. The Board has issued new regulations and a series of decisions designed to make union organizing easier and make it more difficult for employers to explain the pitfalls of union representation to their employees. However, within the last few months, several United States Supreme Court decisions (and I emphasize "may") may give employers a fighting chance in litigation brought against them by the NLRB and other federal agencies.
From an overall standpoint, the first, and perhaps the most important, of these cases is Loper Bright Enterprises v. Raimondo, which was decided on June 28, 2024. As an administrative agency without enforcement power, the NLRB must go to the Federal Court to get its decisions enforced. For the 40 years since the Supreme Court's Chevron decision in 1984, federal courts have been instructed to make significant deferences to an agency's interpretation of the law they administer. If the law was ambiguous or silent on a particular issue, the Court should "defer" to the agency's interpretation, even if the reviewing Court might have reached a different result. Deference to NLRB decisions pre-dated Chevron based on Supreme Court cases as far back as 1944.
The Loper Bright majority ended Chevron's deference because it countered the long-standing prerogative of judges to interpret statutes independently and violated the Administrative Procedure Act's directive that courts are to determine "all relevant questions of law" when reviewing administrative action. As such, courts should independently review all legal determinations made by federal agencies unless a specific statutory directive instructs otherwise. The Supreme Court noted that courts routinely interpret ambiguous statutes, and there is nothing unique about statutory interpretation when reviewing agency determinations. Since NLRB deference has not relied solely on Chevron, it is still being determined to what extent reviewing courts will feel free to disregard the Board's statutory interpretations. However, given the Board's history of changing many such interpretations each time, there is a change in party control following a change at the White House, and the NLRB will likely face more challenges in the future.
In Starbucks v. McKinney, decided on June 14, 2024, a unanimous Supreme Court raised the bar the NLRB must meet if it wants to secure a preliminary injunction requiring the alleged wrongdoer (almost always an employer) to take specific remedial steps before it is ever found to have committed an unfair labor practice. The Supreme Court held that when considering temporary injunction requests under Section 10(j) of the National Labor Relations Act (NLRA), courts must apply the traditional equitable four factors outlined in the High Court's 2008 decision in Winter v. Natural Resources Defense Council, Inc. This decision means that courts must consider 10(j) injunction requests under the same equitable principles they do for other preliminary injunctions. The Biden NLRB had dramatically increased the use of such injunctions, significantly raising the costs of litigating these cases. The Starbucks decision will make it much more difficult for the Board to obtain injunctive relief.
Historically, federal agencies such as the DOL, SEC, and NLRB have relied upon a cadre of in-house Administrative Law Judges (ALJs) to act as factfinders in the first level of litigation with those agencies. Not surprisingly, the parties that appear before them feel the agency has a home-court advantage. In another June 2024 decision, the majority of the Court ruled that defendants have a constitutional right to present their case to a federal jury when the Securities and Exchange Commission seeks financial penalties rather than appearing before an administrative law judge (Jarkesy v. SEC). This case is already being used to challenge the jurisdiction of DOL ALJs when hearing specific claims by whistleblowers. While most NLRB cases might not implicate Jarkesy, the NLRB General Counsel seeks to expand penalties, and such a challenge may be possible.
Suppose Vice President Harris is elected in November. In that case, it might provide some comfort to know that these recent Supreme Court decisions may offer new arguments to counter the actions of another heavily pro-union administration.

Landworks Civil Design is an engineering consulting firm specializing in land development design, permitting, and project entitlements. We are the general contractors of the engineering world because we assemble project teams comprised of numerous engineering disciplines, maintain strong relationships with local municipal officials and state regulators, and add value to our client's real estate portfolios.
Our story begins when the founding partners' previous firm was acquired and the opportunity to create our firm became obvious. How did you get involved in the civil engineering industry?

Fast forward nearly 30 years, and I've learned not only about land development engineering but also about municipal government, legalities, politics, and professional relationships.
In what ways has your participation in ABC Keystone contributed value to your company?
ABC Keystone is a tremendous local asset for creating and building professional relationships. We joined ABC because we knew many existing members and hoped to meet more of Central PA's best contractors and design professionals.
What is the best business advice you have ever received?
When we launched our firm, I contacted a local mentor who has owned and operated numerous businesses for over 60 years. He said that the most important thing we need to do to succeed is "maintain positive cash flow, and all will work." We've taken that to heart by keeping expenses in check and building revenue each year.

Launched more than three decades ago, ABC’s AQC credential provides recognition to industry-leading construction firms that have documented their commitment in five areas: quality, health and safety performance, talent management (including inclusion, diversity, and merit), craft and management education, and community relations.

In earning the AQC credential, each member company commits to industry-leading health and safety by achieving the Gold, Platinum or Diamond level in ABC’s STEP Safety Management System. Established in 1989, STEP provides contractors and suppliers with a robust, no-cost framework for measuring safety data and benchmarking with peers in the industry, with top performers achieving incident rates nearly six times safer than the U.S. Bureau of Labor Statistics industry average.
