On Thursday, May 25, 98 apprentices will graduate from the ABC Keystone Apprenticeship program, marking a milestone in each one of their careers. Graduates will be representing 42 different companies across seven various trade programs (carpentry, construction craft laborer, electrical, heavy equipment operator, HVAC, plumbing, and sheet metal). What an extraordinary achievement for each of these individuals! Reaching this milestone doesn't happen without hard work, dedication, drive, and commitment to their trade.

To provide some perspective on the work involved, each of these individuals is required to complete the following to receive their journeyman's certificate:
• 144 hours of related training instruction for each year of their program.
• Achieve a passing grade of at least 70%.
• Obtain their OSHA 10-Hour Construction and First Aid/AED/CPR certifications.
• Log 2,000 hours of on-the-job training (OJT) for each year of their program.
CELEBRATING 50 YEARS OF APPRENTICE SUCCESS!
This year is ABC Keystone's 50th Apprenticeship graduation ceremony! Since the program's inception, ABC has graduated 2,882 apprentices (including this year's graduates). The program has grown and evolved over the years, adding more trades and steadily increasing the number of enrolled students to a current enrollment of 403 apprentices. Due to the members' steady growth and interest in formally training their staff, ABC has evolved the program into one that now employs both full-time and part-time instructors. The training center expansion, completed in 2015, was considered adequate for training for the foreseeable future. However, the center is nearing capacity only eight years later, with discussions of possible expansion on the horizon.
In addition to members enrolling employees in the apprenticeship program, ABC is doing its part to influence future upstream candidates through articulation agreements and pre-apprenticeship programs in the surrounding school districts. These pre-apprenticeship programs intend to provide career exploration into the construction industry, while articulation agreements help satisfy the general education credits of the early stages of apprenticeship. We work hard to give a perspective on a career path alternative to the traditional post-secondary education model, where young adults can "earn while they learn" without the burden of student loans.
Please mark your calendar for May 25 to come out and participate in the celebration of our industry's newest journeymen. These individuals have made a commitment to our industry and deserve all the praise for their accomplishments.

Get Into Politics or Get Out of Business...
This phrase was coined by an early ABC Freedom Fighter to help members understand the value of being engaged in order to protect your business. As ABC’s history has evolved, at times we believe we are making progress. As a result, we tend to let off the gas and become complacent. If you are not aware you and your businesses are under attack.
From national to state and even down to the local levels, government wants to run your business and tell you what is for the best for you and your employees. We at ABC are here to watch, listen and react. However, we need you, the members, to help. In essence all ABC members are Freedom Fighters and together we are an army to keep government honest.
At the national level we are dealing with PLAs, an NLRB (National Labor Relations Board) agency that wants to wind the clock back decades and a multitude of executive orders that are designed to cripple your business. Here in Pennsylvania, we are quickly seeing several pieces of proposed legislation around independent contractors, employee misclassification, and indemnification just to mention a few. To top it off the PA House is looking at a constitutional amendment revolving around unions rights to organize.

Clearly ABC supports an individual’s right to join or not join a union. In fact, the NLRB has been more than capable of overseeing elections and any employees claims. House bill 950 is nothing more than a solution to a problem that does not exist. But then again all we hear a lot of our political leaders talk about are good union jobs. I guess the 87.3% of workers that choose not to be represented by a union don’t have good jobs.

Get engaged with your legislator. Let them know where you stand on issues that are important to your business.

CONSTRUCTION WARS — A First-hand Look at Careers in Construction

For three days in April, more than 200 middle school students got a first-hand look at careers in the construction industry at the Chapter's Construction Wars. The students had the opportunity for hands-on work with industry professionals in carpentry, masonry, sheet metal fabrication, electrical, plumbing, and HVAC trades.

"We offer this event to provide middle school students with exposure and awareness of our industry and hopefully spark their interest as they make decisions moving into high school," shared Stephanie Larkin, VP of Education, Safety & Workforce Development. The students created various take-home projects during the event, including a sheet metal toolbox and a wooden bench. Additionally, they wired lightbulbs, created a circuit, laid bricks, were introduced to basic safety and CPR, and learned about refrigeration. Now is the time for students to consider careers in construction. The demand for trade skills grows annually. Average wages for some trades are $70,000 per year, and apprentices participate in earn-while-youlearn programs, allowing them to access educational opportunities while working, with the potential to graduate debt free.

2023: A Quietly Important Election Year
There is an important election in Pennsylvania coming in May. On May 16, Pennsylvania will have its Primary Elections for municipal offices throughout the Commonwealth, leading to an important General Election in the fall. While this may not get as much hot attention as electing a president or a potential special election for a state House of Representatives seat that could tip the widely known narrow majority in that chamber, it’s crucial.
For starters, municipal elections include all of your local government officials – county commissioners, mayors, school board members, judges, and maybe even dog catchers if that is still a thing in your area. The key is to think about the breadth of how many of those offices can affect your daily personal life and work life. There is rightfully national attention on a president and the impact that office can have on every global citizen and everyone in the U.S. However, isn’t the local public official more likely to have more direct decision-making on you? And don’t you have a better chance to contact them directly when something is critical? They are the ones to decide whether that signage in front of the business park is allowed or its size limitations. They’re the ones that can choose on street parking in front of your home (I can say that from personal experience). They are the judges that might sign off on a legal document or make a ruling that can have repercussions for years.
So, who is running for those offices this May in your area? If not, there’s a month to learn who is running and what they stand for, with potential opportunities to talk with them. ABC encourages you to do this as a civic duty because knowing the individuals willing to take responsibility to serve you as a constituent is helpful.
If you’re skeptical about all of that still, then keep one other thing in mind: not every elected official stays in that elected seat. Many of those running for office this year will have the ambition of running for another office in the future. Some state legislators even leave Harrisburg in pursuit of wearing a black robe if not going to Washington, D.C. Even our current Governor, Josh Shapiro, ran for state representative, county commissioner, and Attorney General before being elected governor.
If you don’t know who you might be voting for, check in with your county Board of Elections for the candidate names, or the Pennsylvania Department of State can give you the “unofficial” list of candidates. After doing all that, if you haven’t registered to vote, make sure to do that before the deadline on May 1!

Attaining and Retaining Talent Using Your Retirement Plan with SECURE Act 2.0
In the last couple of years, almost every company has experienced or is currently struggling to attain and retain talent. Right now, across the United States, there is a labor shortage in which there are about two jobs available for every person looking. Even if you find talent, employees jump from company to company for better pay and benefits. Offering higher wages is a clear first step to finding and keeping talent, but it has limitations to maintaining profit margins attractive and bids competitive. Another solution to this problem is utilizing or starting your company’s retirement plan, especially with the passing of the SECURE Act 2.0.
Offering a retirement plan, such as a 401(k), Simple IRA, or cash balance plan, to your employees is often one of the critical benefits individuals look for in a job. Not only do retirement plans offer an excellent benefit for employees to save towards their retirement effectively, but they also offer many benefits to businesses and business owners. With our nation’s retirement crisis, congress recently passed SECURE ACT 2.0, which provides many enhancements to retirement plans to incentivize retirement savings. To name a few:
If you do not offer a retirement plan, the 3-year small business startup credit is 50 percent of administrative costs, up to an annual cap of $5,000. Section 102 changes the credit by increasing the startup credit from 50 percent to 100 percent for employers with up to 50 employees. For 51 to 100 employees, the applicable percentage is 100 percent in the first and second years, 75 percent
in the third year, 50 percent in the fourth year, 25 percent in the fifth year – and no credit for tax years after that. This makes starting a retirement plan more affordable and offers another valuable benefit to employees.
In 2024, employers could match student loan payments with plan contributions, which can attract labor.
In 2025 part-timers would have to be enrolled in their employer’s 401(k) after two years instead of the current three, which can help retain labor.
There are many great options when configuring a retirement plan customizable to what your company is looking to accomplish for the benefit of the business and employees. For example, implementing a new plan or ensuring your current plan is properly designed, is a great additional tool to help your company attain and retain valuable talent.

Your Lawyer As a “Trusted Advisor” –A Guide For Construction Companies to Maximize Their Legal Counsel Investment

As construction is truly a team sport, a contractor’s success hinges on the contributions of all team members—the laborers and tradesman, the project managers and office personnel, c-suite executives, and, yes, the company’s lawyer. Too often, however, construction companies turn to counsel as a necessary expense, not an investment. A contractor’s lawyer, however, can improve a project’s bottom line in three key ways: contract review, project advising, and dispute resolution.


CONTRACT REVIEW AND DRAFTING
Construction project work starts with a written agreement, which warrants a lawyer’s review. That review can range from drafting the agreement (highest cost) to checking a few key terms (lowest cost). Determining the services needed depends on the project’s unique circumstances from the basics—public or private project; project scope and cost; contracting parties’ relationship—to the advanced—contractor’s key objectives and major risks. Because all these factors direct an agreement’s terms, discussion with counsel should (a) describe the project, (b) explain the ideal successful performance, and (c) identify major problems to avoid. With these “big picture” objectives, counsel can sort out the details in the contract language and drive the agreement’s negotiation to achieve these goals as best as possible. Finally, contractors should consider having counsel prepare a bullet point analysis (or even checklist) of the final agreement’s key terms to give project executives and managers an easy reference guide for items like claims deadlines and payment application requirements.
DAY-TO-DAY PROJECT ADVICE
This less-often used legal services investment can reap the greatest benefit. Because literally millions of variables can disrupt a project’s planned operation, a contract’s fundamental agreement—an expected scope of work for an expected price—remains constantly at risk. When a contractor encounters unforeseen conditions, has its progress delayed, or has to perform additional work, the contractor risks taking on increased
costs. And, if the contractor does not take the proper steps to obtain increased compensation, then by basic arithmetic, the project’s profit margin decreases. Investing in legal counsel to chart the best possible path to resolve project issues and preserve claims as they arise can pay dividends in multiples. All too often a problem that a few hundred dollars of legal advice could have resolved at its inception becomes one requiring a few tens (maybe hundreds) of thousands of dollars to address months later. Further, counsel’s advice can help a contractor maintain a clear record of project developments to preserve contract rights should disputes arise.
DISPUTE RESOLUTION
A properly-prepared contract and an effectivelymanaged project usually foreclose disputes, but of course they still occur sometimes due to all that can go wrong. Regardless of the forum—litigation, arbitration, or mediation—at the dispute’s outset, discussion with counsel should include these critical questions: “How much does the company stand to recover or lose?; What likelihood of success does the company have?; What cost has the company incurred (or expect to incur) in the dispute?” Multiplying the maximum potential recovery or loss by the likelihood of success and comparing that figure to the overall spend provides the metric needed for business-oriented decision-making throughout the dispute. Developing an accurate such metric requires investing in counsel’s time to gain an indepth understanding of the case, but this initial expense yields significant savings as the matter progresses and helps establish an early strong position to leverage a favorable settlement.
CONCLUSION
Following the above guidelines helps to ensure legal services minimize losses and increase revenue, and that transforms legal expenses into company investments. Contractors should seek out counsel who can both develop such service plans tailored to your company’s unique needs and implement them successfully—in other words, a trusted advisor.

Saxton & Stump is pleased to announce it has hired Adam Friscia as executive manager of business development and government relations. Friscia is a former business development executive at the Pennsylvania Chamber of Business and Industry where he was responsible for relationships with top executives at businesses and industry organizations throughout the state.
Saxton & Stump is pleased to announce that attorney Harlan W. Glasser rejoined Saxton & Stump as a shareholder in the firm’s Labor and Employment Group, Investigations and Criminal Defense Group, and Healthcare Litigation Group. Glasser worked for the firm from 2015 to 2020 before accepting an appointment as an assistant U.S. attorney for the Middle District of Pennsylvania. He will work with clients to develop risk mitigation strategies and represent his client’s interests in complex litigation.
