Construction workplace safety is arguably the most critical part of our businesses. By its nature, construction is inherently a dangerous occupation. Day in and day out, our construction workforce is installing the infrastructure of tomorrow. These job sites are fraught with potential risks to the well-being of our workforce. Our industry has transformed immensely since the turn of the 20th century, most notably in 1970 when the Occupational Safety and Health Act was signed into law to ensure safe and healthful working conditions by setting and enforcing standards and providing training. Since the inception of OSHA, workplace fatalities have been reduced by more than 65%. But having OSHA standards isn't enough to ensure your workforce and trade partners go home safe and healthy at the end of the workday. As leaders in this industry, we must be committed to developing and nurturing a safety culture in our organizations.
What is ABC doing to assist its members in taking safety to the next level? In 1989, ABC National founded the STEP (Safety Training Evaluation Process) as a safety benchmarking and improvement tool. Firms that participate measure their processes and policies on 25 key components to implement or enhance safety programs that reduce job site incidents. The key components are divided into four categories: Leadership Commitment, Culture, Process, and Results. Participants rank their safety process based on their level of commitment to each component. The process is meant to be used to improve your safety culture and drive down the chance of incidents. STEP allows you to analyze your safety and loss program, learn industry best practices, and benchmark your performance against similar companies and industry averages. The proof is in the pudding. ABC compiles the data collected annually and compares the results to the BLS average for the construction industry. The average STEP participant is 2.5 times safer than the BLS average, and the top-tier STEP participants are more than six times safer.
New to STEP in 2023 is the addition of the 26th key component, Total Human Health. So, what is Total Human Health? Total Human Health encompasses actions, initiatives, and policies emphasizing workers' health, wellbeing, and livelihoods by incorporating a whole-person approach to engage a person's body, mind, heart, and soul. Workforce safety can no longer be focused solely on bodily injury. It must encompass the overall wellbeing of each individual. When employees are experiencing physical or mental health challenges, the effect on their job performance and productivity can be just as dangerous as common construction site hazards.
Developing a strong culture of safety is critical to your company's success and something that we owe to our workforce. ABC equips its members with the tools and resources to develop or augment a thriving safety culture. If you are not currently participating in STEP, I highly encourage you to consider it. It's free to all member Contractors and Suppliers. It's a minimal commitment for a significant return.
The PA Prevailing Wage Act has been in existence for over sixty years. Since the law’s inception, an employee who believes they are being paid incorrectly on their work task classifications or on the fringe benefits is able to file a complaint with the Department of Labor & Industry.
With one decision, the above-described process has been totally upended. For the first time ever, an employee complaint on a Pennsylvania prevailing wage job has led to the filing of criminal charges and an employer being found guilty and sentenced to jail time. Put very simply, a couple of employees decided to go to the local District Attorney and claim wages were being stolen from them due to erroneous job classifications. The case was then taken on by the State Attorney General’s office. For the last four plus years, ABC Keystone has been supporting Scott Good in the case of Commonwealth of Pennsylvania vs. Goodco Mechanical.
My purpose here is not to dissect the case, but to warn members about the ramifications of the Superior Court’s ruling. Those of you who perform prevailing wage work have become accustomed to prevailing wage audits. If everything is in order, no harm no foul. If the Department of Labor & Industry finds any issues, you are required to make any aggrieved party whole and if the error was unintentional, you mainly receive a warning to not let it happen again. If the violations appear to be intentional, you will be disbarred from bidding on prevailing wage work for a number of years. Until now, these matters have been civil and not criminal.
With the Superior Court Ruling, essentially any disgruntled worker who believes you misclassified them on a project can file a claim with their County District Attorney for theft by deception, receipt of
stolen property, or failure to make required disposition of funds received. Please understand these are criminal charges and can include restitution, fines and jail time. Avoid these claims by properly classifying employees and properly handling overtime pay and fringe benefits.
Prevailing wage work can be complex and full of scenarios. If you have a carpenter and he jumps on a backhoe to dig a trench, he now becomes a heavy equipment operator - two distinct and different pay classifications. If an employee works part of the week on prevailing wage work and the balance on private work and ends up with more than 40 hours, how is overtime computed? How do you carve out the fringe benefits you provide the employee and how do you have to distribute the balance of the fringe wage?
Make sure you can answer these and many other questions surrounding the Prevailing Wage Act. If you don’t know or need a refresher, talk to your attorney. If your attorney is not familiar with the Prevailing Wage Act, reach out to us at ABC. As a result of this ruling please stay tuned for upcoming seminars on this subject.

Bronze Construction Management Competition
ABC Keystone competitors were awarded top honors at the 2023 National Craft Competition (NCC). The winners were honored at ABC’s Careers in Construction Awards ceremony during ABC Convention 2023 in Kissimmee, Florida, March 15-17.
The 2023 National Craft Championships featured nearly 200 of the nation’s top-performing craft professionals, including carpenters, electricians, pipe fitters, plumbers, welders and more, all vying for top honors in 16 competitions with skills on display in 13 crafts. Showcasing the industry’s premier skilled trades profession, NCC celebrates and recognizes up skilling in construction, draws some of the country’s most talented craft professionals and highlights the important role that craft skills training plays in the construction industry.
“We are incredibly proud of all our competitors in the ABC National Craft Competition. The awards brought home display dedication and detail to their craft profession. All the competition winners represented ABC and their companies at a high level. They are the future of this industry, and we are both thankful and proud,” said ABC Keystone President-CEO David Sload.
NCC also featured a team competition with journey-level craft professionals from different crafts working to complete a joint project. The competition a six-hour practical performance test. The ABC Keystone team took home silver, a first for the Chapter.
Competitors are tested on their skills during a six-hour project. This practical performance test accounts for 75% of the total score. The competition objectives are to demonstrate safety, craft interdependency, and teamwork, simulate working conditions where planning is critical to success, and highlight individual leadership and workmanship skills as the project is assembled and completed.
“All the Keystone craft and team competitors did an excellent job at last week's National Craft Competition. I'm so proud of them for their dedication, hard work, and commitment,” said Cynthia Dewire, Director of Apprenticeship.
Pennsylvania College of Technology walked away with silver for safety in the Construction Management Competition (CMC). CMC is ABC’s hallmark competition promoting careers in construction management features teams of undergraduate students from colleges and universities who test their skills in project management, estimating, safety, quality control and presentation skills.

On March 7, Governor Shapiro delivered his first budget address before the General Assembly. What was most notable about it was it being widely seen as having something for everyone without major tax increase proposals. As such, it even included minor tax cuts for consumer cell phones, maintaining scheduled business tax reductions, and did not propose new Marcellus taxes as his predecessor did. As trade-offs for those, there is a loud call for increasing the minimum wage and multiple affirmations that Pennsylvania will never be a Right to Work state.
However, we want to focus on a policy that ABC will closely watch as this administration moves forward: advocating for apprenticeship. In his speech, the Governor highlighted a success story for the Iron Workers Local 3 in Pittsburgh and his commitment to increasing financial investments in apprenticeship programs. Understandably we should all be excited for an opportunity to talk about apprenticeships, even if the conversation started with a program outside of merit shops. There are many apprenticeship programs in the Commonwealth, and now will be a time for ours to shine.
Budget hearings are underway, and we can be sure that more legislators will ask the Department of Labor & Industry what their intentions are for these valuable conduits to our future workforce. There is a real opportunity to have a discussion on what you and ABC are doing with apprentices as part of this proposal to increase expanded programming with over $3 million additional dollars. ABC has already brought reality to the Governor’s words when he said, “My Administration has a comprehensive plan to invest in apprenticeship programs, expand vo-tech, and bring career and technical education back into
our classrooms. We can connect the dots between our schools, trade unions, companies, and the public sector.” We will continue to work with our Career & Technical Education programs to give students a quality education as they set themselves up for a fulfilling career. And we will continue to ensure that the legislature and public know there are other paths than union apprenticeship.
ABC will lead as it always has on apprenticeships and continue building a great relationship with the Department of Labor and Industry’s Apprenticeship and Training Office. The conversation the legislature is beginning on this topic will be a chance to let more Pennsylvanians know how accessible these career paths are and have more state funds appropriated to further that reach. That conversation won’t end as we continue to graduate more future workers into successful careers.

One of the more significant challenges employers are being faced with is locating, hiring and retaining talent. Labor Force participation is at its lowest rate since 2017, which makes it a challenge in filling the amount of job opportunities throughout Central Pa. It has been discovered that non-traditional populations, including individuals with justice system involvement are an untapped pipeline of talent who may be able to contribute to the workforce. Companies who promote fair chance hiring practices have reported success in hiring these individuals, and have spoken to the value they bring to their organizations. Fair chance hiring not only helps justice involved individuals, it also benefits their families as well as the community as a whole.
ABC Keystone is working to educate our members on the benefits of fair chance hiring, but more importantly, the resources and incentives in doing so. Please join us for our next reentry forum on Tuesday, May 7th of 2023, as you will learn valuable information on resources available to your company. You will also hear from our guest speaker, Kurt Danysh, whose life took an unfortunate turn which resulted in an incarceration. Through a real experience of a justice involved individual, Kurt will provide a lasting message with a focus on the value of second chances.

I worked in a painting business during my high school and college summers and made great money, especially for a teenage boy. After graduating in my senior year, I was advised to send as much money as possible to my college to help reduce my student loans. Electronic (ACH) payments are a convenient and often necessary means of conducting business with vendors. Unfortunately, while ACH transfers offer greater efficiency and liquidity as compared to traditional checks, they also bear increased vulnerability to fraud attempts (the proverbial double-edged sword). In our public accounting practice, we have seen small businesses targeted for ACH fraud with growing frequency and sophistication in recent months. As ACH fraud attempts intensify, so must our vigilance for detection and prevention.
In a sophisticated ACH fraud scheme, a fraudster will hack your vendor’s e-mail account and infiltrate an existing legitimate email chain. Having assumed the vendor’s identity, the hacker will notify you of a “change in ACH routing information.” You are familiar with the sender, so you have no reason for suspicion, and you re-route this month’s invoice payment accordingly. The fraud is not detected until the following month, when your real vendor contact reaches out to you regarding the past due invoice. By then, the fraudulent bank account has been closed and the fraudster is long gone with the cash.
The bad news is that any organization - regardless of location, size, or industry - can be targeted by a scheme like the one described above. The good news is that you can significantly mitigate your risk of asset loss by taking a few key steps in the areas of education, process controls, and insurance.
A well-educated workforce is one of the best defenses against cybersecurity theft. A regular regimen of cybersecurity training and simulated phishing emails is a worthwhile investment for any organization. If your company does not have the resources to administer trainings and phishing simulations internally, there
are many reputable third-party service providers that specialize in this area.
Establish a vendor master file that contains the verified routing and contact information for each of your vendors. Within the master file, it is critical that you include a verified phone number for each vendor contact. In the event you receive an ACH routing change request from a vendor, make it your policy to independently confirm that change by calling the verified contact phone number in the master file. A robust vendor master file can also fortify your business against internal fraud risk when it is used in conjunction with a proper segregation of duties. For example, an individual who has the ability to edit the vendor master file should not also be able to process vendor payments. By dividing these key responsibilities, you can thus mitigate the risk of fraudulent payments being intentionally initiated as well.
In today’s high-risk environment, cybersecurity
insurance is also a worthy consideration. This step will more than pay for itself in the unfortunate event your organization is victim to a significant ACH theft. Clarify with your insurance carrier what types of events your current policy does (and does not) cover. Then, adjust your policy accordingly to avoid any preventable surprises in the future.
