What a year we have had. Not only did we get back to business as usual, but we set new milestones and welcomed new friends from the northern part of our State. We hit 92% retainage for the second year in a row, and we hit membership growth in July for the first time. One of the exciting parts of the year was the merger of Keystone and Central regions. We now cover 33 counties in PA. We were able to welcome new businesses into the Keystone family and show the benefits of membership. It was exciting to go to the Nittany Valley region and get to know many of the members, meet some great people and get to know their businesses. There are several new business partners for all of us to get to know and work with.
We started the Inclusion, Diversity, and Unity Committee. They have laid the groundwork for new initiatives that will allow Keystone to make significant inroads into many of the groups that we want to engage in the construction industry. They have identified several barriers to joining the construction workforce and identified committees and outside partners, we need to work with to start to move the needle and remove the barriers. I look forward to the work they will do over the next several months.
ABC Keystone shed the light on total human health in the safety committee and through various education offerings. It has become a major focus in the strategic plan. As owners, coworkers’, and human beings, we need to be the helping hand that can save a life. We encourage you to get the training needed to help your team recognize and improve total human health.
We set a target to have 30% of our contractor members participate in STEP. We did not make it. We are at 22%, which is better than before, but still not as high as we would like. STEP is a journey, and a commitment we make to our employees to make sure they are safe. STEP is a systematic way to work to become a safer workplace. Not everything can be done perfectly but take the journey. Pledge to a safe environment, and total human health. The time and energy you spend are more than just the dollars, but a promise to employees and their families.
A final focus was the election. We didn’t do great in November. As always, ABC Keystone devoted to fighting any government overreach and standing with you to make sure you have a right to work and run your businesses. We are
committed to the merit shop way of doing business. We are currently involved with some issues helping members with bid protests, fighting PLA’s, and government overreach with awarding jobs. If you have any concerns, or hear about PLA’s or issues with bids being awarded, reach out to the Keystone staff for help.
It was a pleasure to serve as your 2022 Chair. I want to thank the staff for their hard work and commitment to our members. I want to thank RKL, and its team that supported me in my service and made sure things ran smoothly while I was volunteering. And I want to thank my wife. You have always been there to support me, and accompany me to various events. I appreciate everything you have done for me.
I want to wish Steve Conway, the 2023 chair the best of luck in his year. I will be there for support and to help in any way I can. You have a great board and staff. I know you will help Keystone move its mission to the next level.

As I sit to write this article the election results are still not definitively known. What we do know is that PA will have Josh Shapiro as our next Governor. The State Senate will remain Republican. However, there is a good possibility the Statehouse will flip to the Democrats. On the National front, the Democrats will retain the Senate while the house, through leaning Republican, is still undecided.
What does this mean for Keystone ABC and its members? On the National front we should expect a lot more of the same. No real legislation and more executive orders to do the will of the Democrats in Congress. This is the most unfriendly administration that has existed for business. ABC National will continue to monitor all things coming out of the White House and where needed bring legal challenges.
At the State level, the House and Senate are divided not much will get accomplished. We can be certain that legislative issues we pursue will be squashed in committee. How will the new Governor govern? Knowing that he aspires to be President of the United States, we have to wonder if he will be moderate or progressive. He has stated he will govern all citizens of PA. Does that include the 87% that choose not to belong to a union, or will he follow the National party line, saying that he will create "good union jobs"? For PA to prosper, we need to create good jobs for all sectors and all citizens.
Hopefully, the Governor elect, Shapiro will not take a page out of the current governor's playbook. As a parting gift to the unions, Governor Wolf instructed the Department of General Services to put a Project Labor Agreement (PLA) on a State Police project in
Westmoreland County. This PLA will prohibit any meritshop contractor that bids on the project from using their own hard-working craft professionals. Needless to say, meritshop contractors will not bid on this project and the results will be less competition and higher bids.
ABC Keystone will not stand by and let this happen without a fight. Your Board of Directors has approved moving ahead with legal action to stop this project from being bid with a PLA. This is not our first time fighting a PLA on a PA project and we are sure it won’t be our last. In addition, we have seen other bid shenanigans going on in other municipalities. We are working through two other projects where the lowest responsible bidders were overlooked in favor of only union contractors. Just like in the PLA case ABC Keystone will not sit silently on the sidelines.
Elections, regardless of the outcome, have consequences. It may be early to tell, but based on what we have seen so far, we need to be prepared to play defense. Get ready and buckle up for the turbulence ahead. We are here to help and serve you. Don’t hesitate to reach out to the Chapter should you run into rough times.
November 13-19, 2022, we celebrated National Apprenticeship Week. During NAW, we celebrate the workers of America — the best in the world — and lift up the importance of apprenticeship programs across America.
Cynthia DeWire, ABC Keystone’s Director of Apprenticeship visited the electrical and plumbing construction classes at Lancaster Career & Technology Center, Brownstown campus. This was a great opportunity for Cindy to educate students about their opportunities after graduation in June 2023. ABC Keystone’s apprenticeship programs are a great way for graduates to continue their education. Keystone offers an articulation agreement that credits students with one year of Related Training Instruction (RTI hours) if they complete the ABC application process. Electrical and plumbing CTC students are already co-oping with companies and getting hands-on training. Other students are exploring their
options upon graduation and enrolling in an apprenticeship program or continuing their education at Thaddeus Stevens. Cindy commended the students for taking the time to explore their options and making the best decision for them and their future goals.

Many of you heard the news that I departed ABC Pennsylvania in November. The decision was not an easy one. I have a long history with ABC. My career began in Washington, D.C., where I served on legislative staff for the late Congressmen George W. Gekas (RPA-17) and former Congressman Tim Murphy (R-PA-18). During my time in our nation’s capital, which lasted nearly a decade, I monitored and staffed issues important to ABC. It was there that I learned about the association’s mission and drive for free enterprise. When I moved back to Pennsylvania, I served as advocacy director for a local chamber, where I continued the partnership with ABC – and eventually met and married my wife, Julina (Peterson), who was the Communication Director for ABC Keystone. Julina started her career with ABC as an intern in 2004 and served on the Keystone team until 2017. I have fond memories of attending so many inaugurals with Julina as her date and later as her husband!
In 2019, I was given the honor to serve as the government affairs director. It was a surreal moment, to officially join an association I had such a rich history with and who’s mission I fully support. Not long after I started, COVID-19 hit, and the governor shut down the economy. It was there I saw first-hand the power and passion of ABC members as they took to their phones and sent email blasts to elected officials. Those actions led to the construction industry reopening sooner than most businesses, and the safety plans our experts created were used nationally. That same drive and passion has carried onto many other policy issues from apprenticeship ratios to union-funded local ordinances that shut out ABC members. Sometimes it takes rattling and scrappiness to get the attention of elected officials, so keep that up as we head into a new dawn of Pennsylvania politics.
For those that are not aware, I accepted a position to serve in the House Republican Caucus’ Research Department. This is a great opportunity for me to take on
new challenges. The position comes with a tremendous amount of responsibility and has outstanding growth opportunities, so I could not pass it up.
I appreciate the lasting relationships I built over the years and trust my service with ABC PA made a difference. And I hope the relationships and the connections continue in my new capacity. The strength of ABC is the passion you bring to the construction industry, your care for the people you employ, and your dedication to the association. You will always have a champion with me on what you are doing.

In 2021, the FBI received 19,954 business email compromise (BEC) complaints with adjusted losses of nearly $2.4 billion, up from $1.8 billion in the prior year - a 33% increase!1 Many of these losses result from wire transfer fraud. Fraudsters have become more sophisticated, and their schemes have evolved to stay ahead of the preventative measures that are developed. Cybercriminals don’t discriminate – both small businesses and public companies are targets and victims of these schemes. In many cases, the wired funds are immediately converted to cryptocurrency by the recipient, making recovery virtually impossible.
One of the common schemes involves an executive’s email being hacked. The fraudster uses the hacked email address (or similar email address) to send an email directing an employee to wire funds. Another scheme uses a compromised vendor email address (or similar email address) and instructs an employee to change the vendor’s wire payment account number and/or routing number (or requests payment by wire when the vendor has historically been paid by check.
Most organizations have policies and procedures to protect them from fraud losses in the typical payment transaction (i.e. payment by check). However, processes and procedures to protect the organization from losses related to electronic payments (ACH and wires) may not be as well-defined. Below are some suggestions you should consider implementing to protect your organization.
• Implement dual control and segregation of duties for electronic payments. For example, one employee initiates the wire and another employee authorizes/ releases it. If your bank can’t accommodate this control, inquire about a call-back procedure where the bank calls a specified individual to authenticate each wire initiated.
• Verify information received in an email, even if the email is clearly from a trusted source. You should place a verification call using a phone number from another source to confirm the authenticity of every payment request and change in wiring instructions. Never use the phone number from the suspect’s email.
• Be suspicious of requests for urgency or secrecy, such as instructions to only reply to the email, do not forward the email, or do not attempt to contact the sender by phone.
• Be wary of emails from free email services such as Gmail.
• Many of these fraud threats originate overseas, so treat poor grammar, punctuation, or awkward wording as a red flag.
• Educate your employees about email scams and other fraud threats.
• Look for slight variations in an email address. Don’t assume, however, that an email from a valid email address is authentic. You should still verify that any payment request is proper.
• Never send sensitive information in an unsecured email.
• Monitor bank accounts online frequently and reconcile all accounts in a timely manner.
• If your bank offers multifactor authentication, enable it.
• Keep cybersecurity defenses up to date.
• Review your business insurance policy. Does it cover financial losses resulting from cybersecurity fraud?
If you suspect that your organization has been the victim of wire fraud, contact your financial institution immediately and ask them to contact the recipient bank. If they refuse, you should contact the recipient bank directly. In addition, you should inform the FBI.

Founder, Josh Hankey, began renovating buildings in the Central Business District of York, PA in 2009 with a mission to revitalize a focused area of the city. After securing and renovating most of the buildings on the square of Princess, Duke, King, and Queen Streets his efforts spread beyond the “Royal Square”. Projects became larger and more complex requiring a staff experienced in this type of work.
In 2015, Damian Nagle took the reins of the construction company so Josh could continue development work with his new partner Dylan Bauer. Together they focused on historical restoration and mixed-use projects of larger blighted buildings in the city. As the mixed-use building inventory declined RSDC, as it became known, began working on various commercial buildings for clients in the south-central PA region.
Over the last seven years RSDC has been considered a leading design-build restoration general contractor and has amassed a large quantity of multi-million-dollar tax credit projects, restaurant fit-outs, and commercial builds.
Approximately ninety-eight percent of the construction projects we do are design-build contracted.
I've worked at RSDC for seven years. I started out in the industry by working on concrete sidewalks when I was 18 years old with a contractor who built houses. Not long after that, I was working on bridges, parking garages and then buildings.

• What is the best part about the work you do? More than ever, I like to teach others what I know and give them the opportunity to grow.
• Besides your smart phone, what’s your favorite tech gadget?
I use pdf writers to sketch out projects so we can bid them. I also like creating estimates with plan takeoff in estimating programs to develop projects. There’s a sense of satisfaction creating buildings from as little as an idea.
