Mohori Bibee was a British subject and who, after having entered into an agreement with Dharmodas Ghose who was the assignee in trust of Mohori's father had died, granted him all the rights over Mohori's interests. The Privy Council stated that whether a person has attained the age at which he is competent to contract as a minor or not has to be proved by evidence and if such a contract, though an agreement did not provide for all contingencies is made, it would not, therefore, be void. Mohori Bibee was a minor at the time when he entered into an agreement with the opposite party.
