At this year's Apartmentalize conference, alongside my esteemed colleagues Katie Wren from WRH Realty Services and Patty Evans from Yardi, we shared our research and experiences on the topic of 'Training Your Way: A Customized Approach to Intentional Learning.' One crucial aspect we explored was the profound impact of learning on organizations, a subject of great relevance given the challenges of 2023. With elevated turnover rates, labor shortages, and the perpetual struggle to attract and retain top talent, this one question keeps me awake at night: “what can Learning and Development (L&D) professionals do to address these issues?” The answer lies in a powerful statistic: companies with a strong learning culture experience a 30%-50% increase in employee retention rates. Moreover, a study conducted by LORMAN revealed that a staggering 86% of millennials would reconsider leaving their current positions if offered training and development opportunities by their employers. This underscores the importance of two pivotal questions:

IS IT IMPORTANT TO PROVIDE EFFECTIVE LEARNING OPPORTUNITIES FOR OUR EMPLOYEES?”

The impact of learning opportunities extends beyond the acquisition of knowledge; it can determine whether a team member remains committed to your organization. Recognizing that one-size-fits-all approaches fall short, it is crucial to personalize training for employees This personalization can take the form of tailored assignments or customized course content, ensuring that the training resonates with everyone Employees are far more engaged when they perceive the training as relevant and non-formulaic They seek to understand how their learning efforts and achievements directly contribute to their career growth and earning potential By curating a deliberate, customized approach to learning, organizations can achieve smoother operations, foster employee confidence, and realize a significant return on their investment

“WHAT IS THE LEARNING IMPACT?”

Retention rates in companies with robust learning cultures can see a remarkable rise of 30%-50%. However, achieving this impact requires a careful alignment of all facets of the learning process.

If any aspect is off, it can have a detrimental effect on both learning and retention. Moreover, the absence of a learning culture can significantly impact not only retention but also employee morale, efficiency, confidence, their perception of the company and their position, and even their interactions with customers. The benefits of fostering a strong learning culture ripple across employees, organizations, customers, and the community. For example:

In fact, 94% of employees would stay at a company longer if the company invested in their career development. By establishing a culture of learning, companies can create a more engaging and supportive work environment, leading to higher employee retention rates.

Adaptability to industry trends and emerging technologies is paramount. A mindset of continuous improvement is cultivated through learning, as employees need upskilling to keep pace with advancing technologies. Harvard Business Publishing's recent report indicates that 54% of the workforce will require upskilling or reskilling by 2025, while a Gartner survey highlights that only 20% of workers are confident in possessing the necessary future skills. Proactively adapting to evolving market conditions and fostering innovation becomes imperative. The World Economic Forum's Future of Jobs Report emphasizes the role of a learning culture in navigating the Fourth Industrial Revolution. Companies that foster this culture are better positioned to embrace change, adopt innovative technologies, and drive innovation, securing their place as industry leaders.

Encouraging knowledge sharing and expertise exchange fosters the leverage of collective intelligence and diverse perspectives. It strengthens relationships, teamwork, and a supportive work culture. Research by the Association for Talent Development (ATD) demonstrates that organizations prioritizing learning and development experience a 37% increase in employee productivity compared to those with a lower focus on learning initiatives. This underlines the tangible improvements in employee performance and overall operational effectiveness that companies can expect to see when they nurture a culture of learning.

In a recent case, Alicia M. Joerger and Shannon M. Mahon (“Tenants”) found themselves embroiled in a legal battle with Lake Alfred Place, LLC (“Landlord”) over overdue rent. What ensued was a legal tussle that led to a default judgment of possession in favor of the Landlord. However, the Sixth District Court of Florida reversed this decision due to a crucial error made by the trial court: the failure to conduct a hearing on the Tenants' motion to determine rent.

BACKGROUND:

The dispute arose when the Landlord sent a three-day notice to Tenants demanding overdue rent or possession of the property. Subsequently, the Landlord initiated eviction proceedings when the Tenants failed to comply. In response, the Tenants admitted owing rent but disputed the amount. They filed a motion to determine rent, as permitted by Florida Statute § 83.60(2), attaching supporting documentation.

LEGAL PROCEEDINGS:

Despite the Tenants' timely filing of the motion, the trial court entered a default judgment in favor of the Landlord without conducting a hearing on the motion to determine rent. This action, as per the Sixth District Court's ruling, was in violation of statutory requirements. Section 83.60(2) of the Florida Statutes mandates that tenants who dispute the amount of rent must file a motion to determine rent, and the court must conduct a hearing to make a rent determination.

The error was compounded when the trial court denied the Tenants' motion for reconsideration without elaboration. This failure to address the Tenants' concerns further underscored the procedural irregularity in the eviction process.

LEGAL ANALYSIS:

The crux of the matter lies in the interpretation and application of Section 83.60(2) of the Florida Statutes. This statute outlines the procedure for tenants disputing rent in eviction cases. It provides tenants with the opportunity to challenge the amount of rent owed through a motion to determine rent, which triggers a mandatory hearing by the court.

CONCLUSION:
