Warranty 3Form, LLC North & South America For a period of two years from the date of shipment, 3form, Inc. (“Seller”) warrants to its customer that Seller’s products will conform to the supplied product specifications and will be free from identifiable defects in materials and workmanship. Claims made under this limited warranty must be submitted to Seller in writing by no later than two years after the shipment of the product. In the event of an approved warranty claim, Seller shall have the option, at its sole discretion, to (1) replace the product, (2) repair the product or (3) refund the purchase price of the product. In no event does this limited warranty cover any costs relating to (re) installation or fabrication expense or any other direct or indirect loss which may result from product failure.

This limited warranty is exclusive. Seller does not make any other warranties, express or implied, including but not limited to any warranty of merchantability or fitness for a particular purpose, and Seller disclaims any other representations, liabilities and obligations on the part of Seller. Seller does not assume any obligation or liability other than those expressly set forth herein, nor authorize any representative or other person to do so. Seller shall in no event be liable to the customer or any third-party for any special, consequential, or incidental damages arising out of the use or application of the Seller’s product.

This warranty does not cover: 1. Damage from improper unloading; 2. Damage resulting from wear and tear on the product; 3. Damage resulting from improper specification, fabrication or installment; 4. Damage resulting from failure to maintain the product according to Seller’s product usage guidelines; 5. Damage resulting from accident, casualty or misuse; 6. Damage resulting from the failure of a third-party’s design, installation, services or product;

7. Damage to custom products designed and manufactured with custom inserts or based on custom specifications supplied by a customer or its agents; 8. The variation in the size and the imperfections of natural or organic products and changes over time in such product.

Fabrication In the event that the customer has requested custom fabrication in connection with a Seller’s sheet product (including any seaming, edge finishing, heat draping and/or molding), this limited warranty does not cover any of the following: (a) visibility of seaming, (b) slight irregularities in gauges and textures of seaming or edge finishing provided by Seller or (c) slight irregularities in the surface of any product that has been subjected to heat draping and/or molding.

Warranty Claim Process Any claims made under this limited warranty must be described in detail and submitted in writing to: 3form, Inc. 2300 South 2300 West Salt Lake City, UT 84119 Attn: Warranty Department Seller, upon review and approval of a warranty claim, will then provide to customer, if applicable, a return materials authorization form which must be completed and returned to Seller pursuant to the instructions set forth on such return materials authorization form.
