(3) Úprava vstupu, pobytu a vycestování občana Evropské unie se vztahuje i na občana státu, který je vázán mezinárodní smlouvou sjednanou s Evropským společenstvím a na občana státu, který je vázán Smlouvou o Evropském hospodářském prostoru, pokud tato smlouva nestanoví jinak. 1b) Smlouva o založení Evropského společenství.

(2) An alien is understood to be any natural person who is not a citizen of the Czech Republic, including a European Union citizen 1b). (3) The provisions for the entry, stay, and departure of a European Union citizen also apply to a citizen of a country that is bound by an international treaty concluded with the European Community and to a citizen of a country that is bound by the Treaty on the European Economic Area, unless the treaty provides otherwise. 1b) EC Treaty (1) For the purpose of this Act, a member of the family of a European Union citizen will mean: a) spouse; (1) Where this Act uses a term „spouse“, „marriage“ or „child of the spouse“, it also refers to a registered partner, partnership or child of the partner. (2)For the purpose of this Act a partner is a person, who can attest she/he entered an officially confirmed permanent partnership of two persons of the same sex. (3) For the purpose of this Act, partnership is an officially confirmed permanent partnership of two persons of the same sex according to subsection (2).

(1) Pokud je v tomto zákoně uveden pojem „manžel“, „manželství“ nebo „dítě manžela“, rozumí se tím i partner, partnerství, dítě jednoho z partnerů nebo dítě svěřené do péče partnera. (2) Za partnera se pro účely tohoto zákona považuje osoba, která prokáže, že vstoupila do úředně potvrzeného trvalého společenství dvou osob stejného pohlaví. (3) Partnertsvím se pro účely tohoto zákona rozumí úředně potvrzené trvalé společenství dvou osob stejného pohlaví podle odstavce 2.

Comments/Problems

Effective transposition The term itself is not defined in the Alien Act but it bears cross-reference to the EC Treaty (footnote 1b). It also covers EEA countries. Czech citizens do not fall under the scope of AA as long as they bear Czech citizenship no matter they have permanent residence in some other country.

Effective transposition. Transposed by a very recent amendment No 379/2007 Coll. that came into force on 21 December 2007 Partnership as a long-term relationship equivalent to marriage is available to homosexual couples as they are not allowed to conclude marriage. Heterosexual couples can marry; otherwise they fall within the definition of Sect 15a/4 - durable relationship, which transposes the Directive’s Art 3(2)(b).
