I was in an accident three weeks ago. It was the other car's fault. There were no injuries. We didn't call the police, but I got a written statement from the other driver admitting fault. I got her car and insurance information and filed a claim with her insurance. They sent an appraiser and I got an estimate for the damages. So all that is left now is for the insurance to approve the estimate and send me a check. I have called the insurance company almost everyday since I got the appraisal (about 2 weeks ago) and they are saying that they are waiting to get in touch with the policy holder; apparently they don't have her correct phone number. But they have the signed statement from her admitting fault. The agent in charge of my claim doesn't even pick up the phone or return my calls, I just talk to the operator who can't really give me any answers. My car is operational but my rear susspension is gone, and the bent metal is hitting my tire; I really need my car rapaired asap. Should I call a lawyer even though there were no injuries? I want them to give me proof of insurance for those 3 months or to pay 1300 to my loan because they are charging it due to their fault since they forgot to send my payment. I also have my policy number but it says it's cancelled due to non payment so bank will not accept that as insurance. right after those 3 months I opened a new policy with them and ive had it for 8 months and ive always payed on time. I recently noticed that when they opened the new policy they inputed my date of birth as if i was 40 years old instead of 20. I do not know if they did a mistake or if they did that on purpose to give me a better price. The thing is that all these 8 months I've been paying i was actually never covered since my date of birth was way wrong. Only my name was correct but I talked directly to the insurance and not my agent and they explained to me that if i would have crashed it wouldnt have covered me since they do not have the correct date of birth. I just fixed that directly with the agent and now they have the correct date of birth so the insurance price went up since im only 20. I dont mind about that. I just think it's unfair that i paid for almost a year and that i was actually never covered because they did a mistake on my information. Plus they caused the bank to charge me.. So i just feel like if all this has been a big scam since i paid so much and did not have insurance. Can I sue them to get my money back or at least pay the bank what the bank is charging me for not having insurance.. like i said i have all the recepits of all payments ive done and i also have a copy of the policy where my information is not accurate and how i was paying without being covered. They could not have made a mistake because I do not look like if im 40 years old. besides they obtained a copy of my drivers license where it clearly says my date of birth. I would discourage anyone from using Electric Insurance (EI). EI is a small company with a VERY LOW risk threshold. I had EI homeowners and auto insurance for over 18 years. In all that time, I had one claim filed against me for less $2,500 when my 6 lb doggie gave the lawn guy a bite. EI would not renew my homeowners policy and waited 45 days before it expired to tell me. So, I was with my girlfriend and we parallel parked in a space which we soon realized was restricted. So she pulls out of the space, too close to the delivery truck in front of her, and side swipes it on the way out. I was in a severe accident last year in which the damage done exceeded my coverage. Now, a year later, the other insurance company is suing me. Now, the odd thing about this is, the accident was in NJ, I now live in PA, and they cannot seem to find me. They've called my old jobs in NJ looking for me, but haven't found me here in PA.
