“And now we welcome the New Year, full of things that have never been” ~Rainer Maria Rilke

100 Items ANN K. CASTLE

Founder & Publisher

RECENTLY I HAD A WONDERFUL conversation with a businesswoman who shared with me her approach to greeting the new year. On New Year’s Day, she starts by clearing her space—she takes 100 items she no longer has use for and either donates or discards. She states that this cleansing ritual opens space for new energies and situations for growth. The start of a new year brings enthusiasm, motivation and a positive light to have a clean slate and new beginnings. It is filled with promises to oneself to be happier, healthier, compassionate, tolerant, disciplined—whatever challenge or issue that calls for resolution from the previous year. Somehow, this year feels different from any other in the past; it contains the swirling spirit of lightness, a collective change of heart among us all and a new awareness of who we are. It offers an opportunity to look deeper into our hearts and find what is truly important in this life. In light of this new and different feel, I will approach 2013 with a new ritual and try the100 items cleansing. I know very well there are articles of clothing that should be donated and file folders of papers that need shredding presently in my space! In this issue, we offer ideas and information to fill the open spaces that you have created; tips for making the right decisions for your financial wellbeing, the technology behind Endermologie, a wonderful introduction to Dr. David Villarreal, tools for dealing with a few legal challenges, understanding Functional Medicine and much more. Whether you feel more centered by using a list of resolutions or clearing your space to welcome the new, I wish you the very best as we greet the new year. May you have good health, joy in your heart, and abundance on all levels! Thank you, Michele for sharing your words of wisdom and light! With Peace, Love, Blessings and Gratitude,

“whether this is someone's first retreat or they have been practicing silent meditation for years, making a personal retreat is an opportunity to come back to one's own truth, back to one's own heart,” said proprietor Bruce Davis, Ph.D., author of Monastery Without Walls, The Magical Child Within You, and Simple Peace. “recently the Wall Street Journal and New York Times have pointed out the growing trend for executives, housewives, students – all kinds of vacationers – to fight their electronic addictions by spending a few days totally unwired, enjoying the gentleness of silence,” Davis said. “at Silent Stay we allow people to restore their knowledge of who they really are and allow them to experience the wonder, beauty and perfection of stillness and peace.”

HOLISTIC,

“What frustrates me more than anything is that we tend to be the last resort for many with illnesses as an adjunct to their improving health,” said Villarreal, DDS, a board certified biological dentist (IABDM) with a practice in Newbury Park called Centers for Healing. “We have a combined 40-plus years experience in holistic/biological dentistry, along with certain protocols not found anywhere else,” Villarreal explained. “We also pride ourselves in working with many different types of practitioners to help attain the best possible outcome for their and our patients.”

HOLISTIC DENTISTRY DEFINED Villarreal describes holistic dentistry as the use of the least reactive materials for your body and the unrecognized impact that dental toxins can have on overall health. “Having a healthy mouth is the first step in the overall health of the whole body,” Villarreal said. That’s because the mouth, being the most absorbent vehicle of the body, can slowly absorb and spread unwanted ingredients that have been ingested to various parts of the body. Chemicals, over time, can lead to a variety of diseases, sicknesses and even cancers. “Every organ and every part of your body is directly linked to a specific tooth or area of the mouth via meridians—or energy highways—utilizing Chinese medicine,” Villarreal said. “We provide all phases of dentistry along with placing an emphasis on

what will be the best materials, sequence and protocols that will benefit your overall health.”

UNIQUE PRACTICE Villarreal’s most popular service is the safe removal of mercury and heavy metals, supported with IV vitamin C. “We provide safe mercury amalgam removal which is imperative for the health of both patients and practitioners,” Villarreal explained. “Removal of mercury filling or amalgams, and other toxic metals from your mouth, can reduce both the chronic exposure to mercury vapor as well as the electrical currents that are created by the contact of different metals in fillings and crowns.” Serving clients of all ages, Centers for Healing provides mercury vapor as well as electrical testing and ozone dentistry not found in many dental offices. “Although controversial, these currents are potentially harmful because they block the meridians and bio-energetic fields of your body,” Villarreal continued. “In order to ensure that your health is not compromised, an integral approach which includes nutritional counseling, special air filters, a special oxygenated water system, negative ion generators, ozone, oxygen masks and rubber dam is used for mercury and other toxic metals.”

INSPIRATION BEHIND CENTERS FOR HEALING Born in Los Angeles and raised in Torrance, Villarreal is a resident of Westlake Village who enjoys surfing, snowboarding and skiing. He has two sons: 19-year-old Jake, a sophomore at Loyola Marymount University; and 17-yearold Zachary, a senior at Agoura High School. Villarreal’s interest in holistic dentistry began in 1992 when he received a book written by Dr. Hal Huggins entitled It’s All in Your Head. “He has been my major mentor since then,” Villarreal said. Villarreal was also motivated to enter the field of holistic/biological dentistry by his mother, who was born and raised in Mexico City. “She taught me at an early age the benefits of herbal remedies along with alternative treatment modalities,” recalled Villarreal, 54. “Therefore I was open from the start and it’s also why I decided to formulate my own natural oral care line called Estrella, which means star in Spanish.” He was inspired to open the Centers for Healing when he was working part-time in Scranton, Pennsylvania with Dr. Blanche Grube, who has extensive training in homeopathy, nutrition, iridology, colon hydrotherapy, neural therapy and acupuncture. “We’ve known each other since meeting at our first Dr. Huggins’ seminar in 1992 and since then have been great friends,” Villarreal said. “We decided it would be great to have another office on the West Coast to provide the same type of dentistry we are practicing on the East Coast.” The mission of the Centers for Healing “is to help you achieve your best physical, dental and emotional health as safely as possible and in as short a time period as possible,” Villarreal said. “My goal is education—we can strive for people to be proactive instead of reactive in their overall health.”

financial decisions

Small, Smart

financial DeciSionS By David W. Machacek

ONE OF THE MOST IMPORTANT THINGS I HAVE LEARNED IN MY PRACTICE AS A FINANCIAL ADVISOR IS THAT HOW MUCH MONEY A PERSON MAKES ALMOST NEVER DETERMINES WHETHER THEY ARE A SAVER AND POTENTIAL INVESTOR. if i meet people with identical incomes, one will find it impossible to start a savings plan, and the other will find it unimaginable not to have one. the reader can easily guess which person has credit card debt and which has an ira. it might come as a surprise, though, that the lifestyles of these two individuals are not much different. the saver usually isn’t making any major sacrifices. She is simply making a series of small, smart choices. Darren Hardy makes the point powerfully in his book, The Compound Effect. Small, smart choices consistently applied over time produce major results. if you keep no other resolution this year, i challenge you to resolve to read this provocative little book. think about it this way: two birds take flight from the same branch—one flies directly forward, and the other flies away at a slight angle. at first, the different trajectory is hardly noticeable, but after only a few minutes in the air, they will end up in different trees. a difference of only a few degrees determines whether an airplane that takes off in los angeles ends up in new york or miami.

SAVING A MERE $2 PER DAY KEEPS MORE THAN $700 IN YOUR POCKET AFTER A YEAR.

in the realm of personal finance, the same principles apply. a small increase in personal savings, a small decrease in investment costs, or a modest change in spending habits can have powerful long-term effects. Saving a mere $2 per day keeps more than $700 in your pocket after a year. with compounding at a modest return of 4 percent, saving $2 a day becomes almost $3,800 in five years and $8,400 in 10 years. Saving $2 a day is not going to make you a millionaire, but don’t underestimate the power of small savings. Sometimes small cost savings can also be beneficial for your physical, mental and social health. Save gas by walking to lunch instead of driving. ten to 20 minutes of walking every day will give you more energy and improve your cardiovascular health. Avoid eating alone. we eat less and make smarter choices when we eat in the company of others. Practice making payments before making a major purchase. use an online calculator to figure out the payment on that new car, and start making the payments into a savings account to make sure they are comfortable in your budget. financial stress is a relationship and health killer, and you can reduce it by testing yourself before taking on a major financial obligation. Having a larger down payment will save you money on interest. Get involved in your community. you might have heard about the multiplier effect of giving. volunteering is more rewarding and entertaining than going to a movie and it is a lot less expensive. Personally, being involved in my community has been good for my business, good for my social life, and good for my finances, to say nothing of my soul. Because i volunteer, i make more money, have more friends, and spend less on meals out and entertainment. you might notice that the financial benefits of these examples are almost incidental. that’s right. a healthy lifestyle is good for your pocketbook, just as financial security is good for your health and well-being. whether it is diet, exercise, or financial habits, small changes are easier to make than dramatic resolutions, and they are far more likely to stick.

Part 5:LTC death and dying

Planning for life’s transitions:

tHe enD

Journey By Carol Knowles

this is the fifth and last of a series of articles by the author on comprehensive long term care, financial and estate planning.

HUMAN BEINGS HAVE USED THE CULTURAL ARTS THROUGHOUT HISTORY TO CONVEY THEIR INNERMOST EMOTIONS ON LIFE EXPERIENCES. they have been powerful tools for expressing timeless issues of fear, faith and fantasy about the end journey that intrigue each new generation. yet contemplation and verbalization of death and dying continue to be commonly shunned. the ramifications of a lack of understanding of options for care and communication with loved ones, doctors, and spiritual leaders in preparation for passing can result in unrecognized or misunderstood wishes, as well as stress and heartache for loved ones and friends that can resonate long after you are gone. education, preparation, and conversation are key components to assuring your wishes are honored, rights protected, and quality of your end days maximized to the greatest extent of the law. your actions now will also convey love, respect and compassion to those who will one day be left behind.

THE CONVERSATION Healthcare Provider: your primary care physician may be doing a great job of keeping you well now, but is that same person prepared to help you transition with grace and dignity and pass in accordance with your wishes? if you are not satisfied with your doctor’s perspective, look elsewhere for a compatible care provider. ask your doctor to clarify potential benefits and consequences of each item on the advanced Healthcare Directives list. you will then be better prepared to complete it and the PolSt (Physician-ordered lifeSustaining treatment) form. few know about the

MORE AND MORE PEOPLE ARE ELECTING TO HAVE HOMEBASED CARE.

Anyone 18 or older should have a trust and/or will. it can be challenging to word a trust and Durable Power of attorney for Healthcare documents so your wishes are not subject to interpretation.

PolSt form, a brightly colored document that effectively communicates patient wishes, states medical orders and includes a promise by healthcare professionals to honor those directives. emergency room physicians prefer it as a guide on how to respond to critical care situations. go to www.capolst.org for more information. Estate Planning Attorney: anyone 18 or older should have a trust and/or will. it can be challenging to word a trust and Durable Power of attorney for Healthcare documents so your wishes are not subject to interpretation. Stating that you want to be “let go” once the quality of life you had once enjoyed is gone, for instance, can become grounds for heated debate and strife between decision makers and loved ones. your life could, as a result, be extended beyond the point when you would have preferred to pass. Healthcare professionals encourage designating only one person to represent you in addressing pressing matters pertinent to your care with family members and responding back to them with a consensus on how to proceed. choosing multiple parties for this role sets the stage for gridlock induced by differences in personalities, stress, the burden of making an irreversible decision, and other factors. Spiritual Mentor: Some religions and ethnic groups have dogma for life’s end care. violation of those guidelines can be very distressing. if you are a person of faith, whatever that faith may be, talk with your mentor about spiritual support in your final days and guidance for loved ones thereafter. encourage communication between that person, your doctor and social workers. Loved Ones: it may not be easy, but it will be a relief to loved ones if you initiate conversation as to your wishes. if at all possible, do this while you are well and able to speak for yourself and when everyone can sit down together. consider videotaping the session to document your expressed wishes in the event of a future dispute.

CARE CHOICES Aggressive vs. Palliative Care: Palliative care is modified medical maintenance during the natural progression to death. we all feel entitled to the best modern medicine has to offer, but consideration should be given to quality of life versus longevity. Hospice: Hospice is a non-profit organization of competent, compassionate staff that provides aggressive pain and palliative care management, and spiritual and social support to the terminally ill. Directives for care are carefully documented. a booklet is provided for family members to help them understand and cope with changes through which their loved one will transition until their demise. whereas a staff member and Hospice physician are always on call, on-site visits are generally limited to 2-3 times per week. their services can be provided in the home or in a facility. Pertinent costs are often covered in large part, if not whole, by health insurance.

Part 5:LTC death and dying

failure to accept that the health of a loved one is not going to be restored can result in a delay in acquiring Hospice services and appropriate pain control, and cause undue suffering. Suicide, Assisted Suicide: Suicide is a personal choice. assisted suicide continues to be hotly debated and in most states, is a murderous act for which the perpetrator is held legally accountable whether it was motivated by hopelessness, love, greed or contempt. By helping take someone’s life, the accomplice’s future is destroyed. Suicide negates rights to life insurance payouts and can have profound emotional impact on surviving loved ones. flippant comments about taking one’s life to avoid the natural dying process are sometimes made to circumvent reality and with the potentially false assumption that person would have the physical and/or mental agility to carry out a life-ending act. major life-altering medical issues often come without forewarning.

OTHER CONSIDERATIONS Preparing for Emergencies: if you decide to continue living on your own as you age, a list of your medical issues, medications, healthcare providers and emergency contacts, as well as a copy of your advanced Healthcare Directives and PolSt form, should be kept at your bedside and in your purse or wallet at all times. the aHD and PolSt documents do no good if they are not immediately available to hospital staff members who have to make split-second decisions on how to address acute issues. 9-1-1 Services: if you call 9-1-1 for an urgent medical need, you have hired emergency personnel to make every effort to stabilize you until which time responsibility for your care is transferred to emergency room physicians. your wishes cannot, by law, be honored while you are in transit. Home-based Care: more and more people are electing to have home-based care. careful consideration should be given to the extent to which loved ones might be able to help you in that setting and cope emotionally, physically and financially. round-the-clock care can be expensive, and qualified caregivers will be in great demand and possibly short supply as more baby boomers fall into a position of need in the future. also, in the latter stages of life, more frequent trips to doctors’ offices and the hospital may occur which can be distressing for family members and require costly transportation by ambulance. everyone should have a practical backup plan. Healthcare Costs: no one likes to put a price tag on their life, but meeting baby boomer needs in the next few decades is going to be costly. we all are going to have to bear some responsibility for not burdening younger generations and our country with enormous healthcare debt. Dying is a fact of life. Planning and preparing for our departure is an obligation of every adult. once addressed, life can continue with gusto!

CREATED MORE THAN 30 YEARS AGO IN FRANCE, ENDERMOLOGIE IS A MACHINE THAT OFFERS A WIDE RANGE OF POSITIVE BENEFITS— FROM AN ALL-NATURAL, SURGICALFREE FACELIFT TO CELLULITE AND SCAR TISSUE REMOVAL. invented by louis Paul guitay, endermologie is intended for physiotherapists and uses a main, motorized head and auxiliary heads for high precision tissue treatments. that means “it uses suctions and manipulations that allow the body to rid itself from toxics, fat, impurities and inflammation,” explained Jacque mills, who has six certifications and more than 300 hours of training with an endermologie machine. endermologie treatments can promote collagen formation and elasticity, which ultimately tighten, tone and sculpt the face. “this is all done by using a device that is non-surgical, noninvasive and all natural,” mills explained. mills also uses endermologie for pre- and postsurgical sites. “Doctors send me patients who need a healthy, speedy recovery from procedures like liposuction and facelifts,” she said. when it comes to sports injuries, “endermologie is capable of a long list of things it can do for muscles, tendons and ligaments. it works with removing inflammation and removing scar tissue.” endermologie also helps alleviate cellulite. “it helps remove fat and toxins out of their cells by creating lypolisis,” mills explained. “it has the capability to sculpt the body by tightening and

She also helps women with breast encapsulations, which is hardened scar tissue around the breast implant. mills also uses the machine for c-sections, scar tissue, as well as post-surgical sites, old or new. “i use it for arthritis, fibromyalgia, tennis elbow, frozen shoulder, tendinitis, pulled ligaments, back pain, sinus and the lymph system.” mills has worked on scar tissue with small children who have built up scar tissue on their fingers, toes and stomach where they prick and insert their shot. “By removing all the scar tissue, clients report that their medicine works better—their needles go in easier because they are no longer hitting scar tissue.”

resolve more pateince

resolve to Be more Patient THE REASON YOU’RE HAVING AN ISSUE WITH PATIENCE IS BECAUSE WHAT’S HAPPENING RIGHT IN FRONT OF YOU—YOUR WIFE’S REQUEST OR YOUR KID’S SOCCER GAME—IS COMPETING WITH SOMETHING ELSE, SOMETHING THAT’S NOT IN THAT MOMENT. to examine your challenge of being patient with your family requires you to examine what’s going on in your cluttered head. what are you thinking about—work? finances? Doubts and fears? are you comparing yourself to others? are you thinking about the car, house, job, or woman you’d rather have in your life? are you making each moment more about you rather than the people you care about? whatever it is, it isn’t with you at the moment. But it is most certainly impacting your relationships and your ability to be the best father, husband or son you can be.

BEING CONSCIOUS

to be present we have to start getting conscious. most of us start out fairly unconscious as men. what i mean by conscious is paying attention to what’s happening to you moment by moment. it means acknowledging the feelings that are shooting through your brain, and the tension that’s mobilizing in your gut, chest, throat, or head. these are the clues, the signs that you’re not in the present moment. understanding what’s happening to you in the moment will give you the opportunity to make new, conscious decisions, and to be more patient. for instance, let’s imagine your wife is telling you about a frustrating situation that happened for her at work today. She goes into some detail about a conversation she had with a salesman regarding a computer component she needs to purchase for the office. it’s a simple story. the sales guy wasn’t very professional or helpful, and your wife wasn’t getting the information or help she needed. that’s the moment. all that’s required is for you to listen. But you don’t—just listen.

UNDERSTANDING WHAT’S HAPPENING TO YOU IN THE MOMENT WILL GIVE YOU THE OPPORTUNITY TO MAKE NEW, CONSCIOUS DECISIONS, AND TO BE MORE PATIENT.

By Wayne M. Levine

Perhaps you had your own interactions that day with idiots who weren’t helpful. you know all about that. Besides, she was asking the wrong questions or not even looking for the right component. you know about this stuff, too. you’re getting a little impatient. you can cut this conversation short—and obviate the need to hear this annoying tale again—by correcting your wife and letting her know how she should have handled the salesman, and what component she actually needs. it makes perfect sense. you’re just being helpful, right? well, not particularly. your ego, your inability to shift gears from work to home, or just your ugly insecurities and reactive need to be right, has caused you to bring your lack of patience to your relationship rather than your open heart, love, compassion, or empathy. imagine if mr. Patient had shown up in that moment with your wife. imagine if that daddy was present and available to share the many awesome moments we can miss with our kids.

DEVELOPING PATIENCE

So, how do you develop patience? what work is necessary to get out of your own way so you can be in the moment and enjoy your family? this isn’t easy work and it won’t happen overnight. it’s really at the core of who you are as a man. it’s a reflection of where you are in your journey toward manhood and away from being a needy and impatient little boy. Here are a few suggestions to put you on the path toward greater patience for yourself and for your family:

Read.

many books are available that’ll help you to slow down and start paying attention to what’s motivating your actions and causing you to be impatient. Meditate. though it takes time to feel comfortable with meditation, it slows your thought process and gives you the space to clear your mind and to open up to new ways of relating to your world and to your family. Develop trusting relationships with men. this Men. is where you’ll get the ongoing support and accountability you’ll appreciate as you make changes in your life to be the best father, husband, and leader you can be. last piece of advice—stop lamenting. make a commitment today to begin something new with the intention of being that extremely patient and loving man for your family—and for yourself. can you think of a better way to start your year?

Functional Medicine is an advanced medical specialty which involves: understanding and finding the root cause of an illness evaluating the whole person….not just a body part using natural, effective, evidenced-based therapies whenever possible Partnering with the patient twenty years ago functional medicine was a concept without a movement. today it is a movement that is the single biggest change in health care. more than 100,000 practitioners from 73 countries have been introduced to and studied functional medicine. functional medicine is currently being taught in 17 medical schools and residency programs.

faculty from one-fifth of all medical schools and practitioners from 46 countries have attended the foundational training course. the institute of functional medicine conducts extensive comprehensive cme courses throughout the year and throughout the world. the national council on Prevention, Health Promotion and Public Health has an advisory group that includes leaders in functional medicine. leading integrative medicine authorities, such as mehmet oz, mD, cite functional medicine as a major influence on their thinking. HEARTBURN OR IRRITABLE BOWEL SYNDROME

instead of just ordering an antacid or another drug to get rid of the symptoms of heartburn or irritable bowel syndrome, a functional medicine practitioner would ask the question, what is causing these symptoms? research shows that routine stool tests can be 5-20 percent accurate. using specific fDa approved labs testing the Dna of the bacteria, virus, yeasts or parasites is 99.99 percent accurate. these specialty tests can also determine how you are digesting your food and absorbing your nutrients. your heartburn or gerD can also be due to hidden food allergies or gluten. accurate gluten testing requires specialty labs.

HORMONE IMBALANCE

complete testing of thyroid hormone, adrenal function, including four cortisol tests in one day, estrogen, progesterone, and testosterone is extremely important for your physical and mental health.

NEUROTRANSMITTERS (NT)

Specific labs can test serotonin, gaBa, norepinephrine, epinephrine, dopamine, glutamate and cortisol. Psychiatrists are the only medical specialists that do not test the organ they are treating‌ the brain. they just prescribe in order to treat the symptoms.

once the labs are done the patient can be treated with specific amino acids and nutrients that the body uses to make more of the individual nt. the patient feels better, repeat labs show the changes and there are no side effects. 26

kelsey's fudge

KelSey’S ANYTIME FUDGE & VEGAN TREATS By Bianca Martinez I KNOW WHAT YOUR THINKING, WHAT IS FUDGE DOING IN A HEALTH MAGAZINE? all i can say is that if you’re going to treat yourself to something sweet, Kelsey’s anytime fudge is something you can feel good about. i met Kelsey Barkan through a mutual friend a few years ago and i have been inspired by her, both personally and professionally. She definitely meets the health-conscious mark in the world of fudge and takes it a step further with her sugar-free and gluten-free, vegan baked goods. i recently caught up with Kelsey in ventura at the local commercial kitchen where she makes all her fudge and vegan treats. She talked with me while packaging some of her scones and cookies for market. (i even got to nibble on a delicious vegan oatmeal cookie during our interview!)

She definitely meets the healthconscious mark in the world of fudge and takes it a step further with her sugar-free and gluten-free, vegan baked goods.

Kelsey has been making fudge for over a decade and officially started her business in 2008. it came to be after years of making holiday treats for her co-workers and friends. She found an easy fudge recipe and has been making tasty (and healthy) improvements ever since. Kelsey added vegan baked goods to her product line a few years back after becoming aware of the horrors of the factory farm system. a long time vegetarian turned vegan, she said, “it was for the animals.” She felt that the industrial food system was contributing not just to animal cruelty, but to our own diet-related diseases as well. Kelsey made a point of using organic ingredients in many of her products and also creating sugar-free and gluten-free for her customers who may have trouble with their insulin levels or who are gluten sensitive. “i felt so bad for them!” she said referring to diabetics who would come to her stand at the market and look longingly at her treats for sale. “So i had to make something for them”. Kelsey uses grape seed oil instead of butter in most of her fudge, which cuts down on the saturated fat content. She also uses truvia (a natural sweetener made from the Stevia plant) in her baked goods because she didn’t want to use any chemical sweeteners.

She offers 22 flavors of fudge (some are vegan), two types of gluten-free sugar-free vegan scones: apricot almond, blueberry almond, lemon poppy seed, cranberry walnut and chocolate chip coconut. Her vegan cookies include: double chocolate orange pecan and oatmeal raisin.

Changing Your Concept of Yourself

the following excerpt is taken from the book Wishes Fulfilled by Dr. wayne Dyer

cHanging your concePt of yourSelf “Health, wealth, beauty, and genius are not created; they are only manifested by the arrangement of your mind—that is, by your concept of yourself, and your concept of yourself is all that you accept and consent to as true.” —neville

even while sound asleep, your mind continues observing, grabbing, and contemplating these omnipresent thoughts. there’s very little respite from this mental thought-producing process throughout your entire lifetime.

there’s a level of awareness available to you that you are probably unfamiliar with. it extends upward and transcends the ordinary level of consciousness that you’re most accustomed to. at this higher plane of existence, which you and every human being who has ever lived can access at will, the fulfillment of wishes is not only probable—it is guaranteed. this … is simply a preparation for entering into that realm wherein you have much more say over what comes into your life than you might have envisioned.

DO YOU REALLY THINK?

no one has ever been able to say from whence a thought comes, or what that thought is made up of. it’s generally accepted that we think up things and we make up all of our own thoughts. to be perfectly honest, for a large portion of my life, i held these same views on thoughts originating with each individual. But at this juncture i tend to see the entire process as more of an act of observation, contemplation, and choice. i enjoy noticing that i have a continuous stream of thoughts that come from—who knows where? they have no boundaries or forms to examine, and apparently are unlimited in number and permutation! i think of the stock market ticker that runs along the bottom of a screen, with each stock price representing a simple thought. you are capable of thinking many opposing thoughts in just a few moments, jumping helter-skelter from one idea to another—exhilaration, frustration, fear, ecstasy, worry, and so forth. unguided and unguarded, you serve up an endless array of thoughts continuously from waking to falling asleep. even while sound asleep, your mind continues observing, grabbing, and contemplating these omnipresent thoughts. there’s very little respite from this mental thought-producing process throughout your entire lifetime. if you really believe that you are the creator of all of your thoughts and control the entire process, then simply stop. that’s right, just try to stop thinking. you may be able to slow the stream of thoughts down considerably, but to simply stop thinking all day and stay in a thoughtless state is quite impossible. i’m suggesting you open your thought processes to a new idea that will help you as you begin changing your concept of yourself. you can think of yourself as a Divine limitless being rather than a person who doesn’t have choice when it comes to your thoughts. think of yourself as an observer, contemplating and selecting thoughts that you choose from

that never-ending stream of thoughts on your inner screen, 24/7/365. watch thoughts stream by from wherever they originate, and observe them rapidly transitioning and combining and appearing and disappearing. Snatch a thought from the running ribbon of thoughts and contemplate it. as you toss it around notice how you feel—sad, depressed, happy, frightened, and so on. every thought going by has an imprint on your concept of yourself. first be the observer, and then the contemplator. now become the choice maker who can consciously decide to put that thought back into the running stream and pick a different one, a thought that perhaps allows you to feel better. I am okay, I look fine, I will lose a few pounds, I am loved, I am Divine . . . these and millions more like them are thoughts that you can opt for rather than the ones you’ve become accustomed to choosing in the past. this is how you begin a new process to change your concept of yourself. you accept as irrevocable that it is not you setting the stream of thoughts into motion, and that stopping thinking isn’t possible at this stage of your evolution. at this stage the essence of your being is to observe, contemplate, and then choose. this can all be done in a fraction of a nanosecond. the thoughts will keep appearing on your mental tv screen just like the stock quotations. But you’ll now be choosing the ones you want to focus on, gather, retain, or let go. i’m encouraging you to initiate a habit of choosing thoughts and ideas that support feeling good and powerful, and that elevate you to a higher level of consciousness where your self-concept welcomes your higher self.

divorce made simpler

Divorce maDe SimPler By Terry Anne Buchanan, attorney

IF YOU PREFER TO AVOID PUBLIC HEARINGS REGARDING YOUR PERSONAL AFFAIRS, COLLABORATION AND MEDIATION ARE OPTIONS.

34

| yhcMAGAZINE.COM

JANUARY 2013

THE CLEAR THEME OF YHC, WHETHER READING THE WONDERFUL ARTICLES AND/OR ADVERTISEMENTS, IS HAVING CHOICES AND MAKING DECISIONS REGARDING YOUR PERSONAL HEALTH. numerous medical providers are available to assist you in making decisions regarding your physical ailments. you can turn to a variety of mental health professionals to work with you when faced with personal troubles and changes. Stress in our lives is an unfortunate fact. fortunately, though, wonderful spas, massages, classes, gyms, personal trainers, and other such outlets are available. you can make personal decisions about which outlet meets your need to relax. So, isn’t it wonderful to know that when faced with a divorce, one of the two most difficult times of your life, you have choices to assist you in making decisions for today and your future? Divorce is a personal experience people handle in different ways, including their coping mechanisms through the emotional stages. no matter what way, emotional stage or coping method, each person makes personal and individual decisions each day to assist themselves through this time.

DIFFERENT APPROACHES TO DIVORCE

everyone is familiar with the traditional avenue of litigating your divorce through the courts. you may retain an attorney or represent yourself. if hiring an attorney, most require the payment of a significant retainer before performing any work. a judicial officer will make most, if not all decisions for you regarding your life, children and future.

if you prefer to avoid public hearings regarding your personal affairs, collaboration and mediation are options. collaboration is a blend of litigation and mediation. the parties each retain an attorney of their choice and the four of you work together to reach an agreement. often the attorneys will recommend assistance from outside professionals to provide additional information to assist the parties in making an agreement. unfortunately, if unable to reach an agreement, the parties are required to retain new attorneys to proceed with litigation or look to private mediation. Private mediation is a process that provides the couple with the opportunity to make their own decisions regarding their future—their children, financial security and maintenance of stability. why not start with mediation so you can be in control of the outcome from the beginning, resulting in an agreement that is more likely to last. isn’t it true that we feel stronger and more confident in our decisions when we make them rather than when we are told what to do? mediation avoids the win/lose feeling of a judicial decision.

2920 E. Thousand Oaks Blvd. 1 block West of Hampshire Rd. Thousand Oaks, CA 91362 805.379.2400 www.snoozzzmattress.com

HOW PRIVATE MEDIATION WORKS

mediation is an alternative dispute resolution process where the couple meets with a skilled professional, often a licensed attorney, who educates them on the various aspects of the law, assists them to communicate effectively to ensure their words are heard and understood, and provides creative alternatives to resolve the issues of their specific case. mediation is designed to encourage a free flow of communication and information, enabling the parties to make all decisions based on their own personal needs and interests. this process is not therapy or marriage counseling. at Buchanan law & mediation center, the following basic questions, and similar personal ones for the couple, are addressed: what happened? where do you want to be? How do you need to get there? when do you expect your personal goals to be achieved? who and what can assist you to get there?

divorce made simpler

these questions are raised, considered and resolved. the end result is your agreement, to address your needs based on your terms—and for much less money. again, why not start here—a decision for your health—mind, body and soul?

THE MEDIATOR’S ROLE

my role as the mediator is to

(a) Help the parties identify areas of agreement and disagreement, facilitate communication between them, help them explore options, and provide valuable legal information. (b) assist in referrals to other professional services that may be needed to reach an agreement (e.g., property and business appraisers, tax consultants, child therapists, etc.). (c) Draft a settlement agreement based on decisions reached by and between the parties. (d) Prepare, upon request, all necessary legal documents. the intent is to ensure the parties have no reason to go to court— even to file documents. an important aspect of mediation is that all communications are privileged and confidential. nothing said and no document provided, prepared or resulting from mediation (unless filed) is admissible in court, is subject to discovery, or can be duplicated for any reason. this process enables the couple to speak freely—with no concern that their words will come back in the future—and negotiate an agreement to meet their personal needs.

MAJOR ISSUES TO COVER

a family law case has three primary issues to resolve: child custody/visitation. Support—child and/or spousal Property—identification, characterization, valuation and division. for child custody/visitation, private mediation addresses the parents’ rights and responsibilities regarding the care of their minor children. legal custody deals with the parents’ decision-making process regarding the health, education, religious training and overall welfare of their children. the parents talk about the specifics of each topic to uncover past, present and future areas of disagreement so the agreement can be designed to avoid future pitfalls.

36

| yhcMAGAZINE.COM

JANUARY 2013

the other area of custody deals with the specific parenting plan—time share. creativity abounds for the parents in mediation—from the weekly schedule to the holiday celebrations. Specificity is recommended, with an understanding that all decisions made today can be changed in the future based on mutual agreement. mediation assists to minimize the parent’s discord which is always best for the children. So, why not start from the beginning by being forthright about your differences, meet them head-on now, and thereafter maintain a united front for your children. mediation is the place to do this. Support is a very difficult issue for both parties involved in a family law matter. the legislature has developed rules and regulations intended to minimize conflict that must be considered. mediation can provide alternatives to the strict bounds of those rules and regulations by focusing on the financial needs and abilities of both parties and their children. Honestly, stress is very prevalent when addressing this issue. Be sure to remember those massages and spa treatment numbers! the community estate is the property acquired by the couple during their marriage. the only way to make informed decisions is with full disclosure of all information regarding the existence, characterization and valuation of all assets in which the community has, or may have, an interest and debts for which the community is, or may be, liable. to bring everything to the table, the mediator ensures the parties continue to conduct themselves consistent with the fiduciary and confidential relationship established from date of marriage. this relationship imposes on each spouse a duty of the highest good faith and fair dealing such that neither person will take any unfair advantage of the other. the mediator works with the parties to specifically identify and value the property based on the documentary evidence or expertise of outside professionals. it’s your pie so why not select the pieces that will help you reach your goals and needs while considering the other person’s goals and needs, realizing an exact split of each asset may not accomplish that task. mediation enables you to establish numerous creative options so each party can leave the table with a feeling of contentment—and less stress (that massage can now be a treat for the successes accomplished through mediation). no matter the issue, mediation is an approach that focuses on the party’s mental, physical and psychological health, as well as that of the family. the future of the family depends on the success of the parties and parents now. Buchanan law and mediation focuses on the family and couple to assist you in accomplishing that success.

Dementia part 3: Legal Papers

early Stage Dementia: legal Papers you need to get in Place—fast! By Mariana Conti THIS ARTICLE IS INTENDED TO PROVIDE ONLY GENERAL ADVICE. Since laws vary from state to state, it is important for you to seek the help of an experienced elder law attorney who can help guide you through the local statutes. the previous article explained that people are being diagnosed with alzheimer’s disease and related forms of dementia earlier in the disease process. this gives the person with dementia and his or her loved ones valuable time to get certain legal documents in place before the dementia grows worse and the afflicted person is no longer capable of making reasoned decisions.

DURABLE POWER OF ATTORNEY FOR HEALTHCARE

also known as a DPoa for health care, this document allows an individual to select someone—or sometimes more than one person—to make medical decisions on their behalf when the disease has progressed to the point they cannot make rational health-related decisions for themselves. a DPoa for healthcare usually gives the appointed person the right to consent to and refuse medical care on the individual’s behalf and the right to arrange for additional care up to and including nursing home placement. it is important for your loved one to select someone he or she trusts completely to follow his or her wishes. you may be able to get a DPoa for healthcare form from your doctor’s office, a local hospital, or a local nursing home. make sure your loved one reads the document carefully and understands it. check the instructions before signing—some states require that DPoa for healthcare forms be signed in the presence of a notary public.

LIVING WILL

a living will allows your loved one to place his or her wishes about end of life care in writing. there are no correct or incorrect answers on a living will. Some people use the living will to document their wish for aggressive or heroic treatment at the end of life. others request no treatments at all aside from comfort management. if you have questions about any of the treatments listed on the living will, ask your doctor for clarification. as with a DPoa for healthcare, some states require the living will to be signed in the presence of a notary public.

EXECUTING A WILL ALLOWS INDIVIDUALS TO DECIDE WHAT WILL HAPPEN TO THEIR MONEY, PROPERTY, AND BELONGINGS, COLLECTIVELY KNOWN AS THEIR ASSETS, AFTER THEY HAVE DIED.

DURABLE POWER OF ATTORNEY FOR FINANCES

when you speak to the elder law attorney, make sure he or she understands that your loved one wants to sign a durable power of attorney for finances and not a regular power of attorney. a regular power of attorney ends when your loved one becomes impaired to the point where he or she can no longer make choices. a durable power of attorney, on the other hand, endures beyond your loved one’s cognitive decline. unless your loved one, while still decisional, chooses to revoke the DPoa for finances, the durable power of attorney will remain in effect until your loved one’s death. a durable power of attorney allows the decision-maker, or agent, to handle the client’s finances on his or her behalf. typical duties include paying bills, depositing and withdrawing funds from bank accounts, paying and collecting on debts, and monitoring the individual’s accounts to make sure he or she does not become the target of financial fraud or abuse. as with the DPoa for healthcare, the individual should take care to appoint only an individual who he or she trusts completely.

WILL

executing a will allows individuals to decide what will happen to their money, property, and belongings, collectively known as their assets, after they have died. although some online sites and office supply stores offer kits to help you draw up a will, you’re probably better off going through an attorney. this is especially true if you suspect the will is going to be contested or challenged.

ESTATE/MEDICAID PLANNING

not everyone with dementia is able to remain at home throughout the disease process. many must go to nursing facilities. the problem with this is that medicare and private insurance do not pay for long-term custodial care in a nursing home. even long-term care insurance plans may have a large deductible or a daily co-pay. most people end up paying for medicare from their own funds. once those funds are depleted, the individual in the nursing home is able to qualify for medicaid, a needs-based, state-run program which does pay for long-term care. if you suspect your loved one will need medicaid at a future date, it’s smart to start making plans now, while he or she is still alert enough to understand what is happening. two issues that sometimes come up during medicaid planning are gifting and division of assets. the laws that govern medicaid programs do not allow you to simply give your money or other assets away in order to qualify for assistance. Do not give away anything of value, and do not allow your loved one with dementia to do so, until you have spoken with your elder law attorney. Division of assets occurs when one spouse remains in the community and the other spouse is admitted to long-term care. Dividing assets allows the spouse still living in the community to keep the house and enough money to survive. Because completing a division of assets form can be tricky, it is best to let an experienced attorney handle it. as soon as your loved one is diagnosed with dementia, call a qualified elder law attorney to get the necessary legal documents in place while your loved one is still capable of making decisions. a little stress now can bring you a lot of peace of mind later. the next article in this series will address caring for the alzheimer’s patient who still lives in his or her own home.

acupuncture & male fertility FURTHER BENEFIT IS GAINED FROM LONGER COURSES OF TREATMENT, SINCE SPERM DEVELOPMENT IS APPROXIMATELY THREE MONTHS.

male fertility By Sophie Butcher, L.Ac. FABORM

IT MAY COME AS A SURPRISE, BUT MALE FACTOR PLAYS A MAJOR ROLE IN UP TO 50% OF THE CASES OF A COUPLE’S INFERTILITY. Sperm quality (e.g. morphology and Dna integrity) has been correlated with more than simply fertilization rates, but also with factors such as development of the fertilized egg, implantation, and perhaps most importantly - the development of the embryo itself. with these factors in mind, men are seeking to improve the quality of their contribution. However, the male factor is often ignored, especially when the cause of infertility is unexplained according to conventional medicine. men do usually receive at least a basic semen analysis, but even when results are questionable, the condition is rarely addressed. instead, treatment is focused squarely on the woman. the studies show that pregnancy rates are increased when male factors are addressed, as well. chinese medicine addresses specific complaints, as well as related symptoms, through the use of acupuncture, oriental medicinal herbs, and dietary and lifestyle changes. Depending on the case, treatment can make significant changes in just a few weeks. further benefit is gained from longer courses of treatment, since sperm development is approximately three months. Both partners can optimize fertility by starting treatment as soon as they suspect any problem, or if either partner is experiencing symptoms related to sexual or reproductive function. the sooner these conditions are resolved, the sooner natural fertility may be restored, and more extreme measures avoided.

there are a number of influences to consider that can affect sperm quality. environmental and nutritional factors have a direct impact on the healthy production of sperm. unhealthy habits, emotional disturbances and high levels of stress are additional factors. these can all be addressed within the framework of acupuncture and chinese medicine. when it comes to treatment, acupuncture and chinese medicine work to restore hormone balance, reduce the effects of emotional disturbance and stress, and bring blood flow to the reproductive area. in conventional medical terms, we are working to improve the motility, morphology and count of the sperm. there are now many studies that demonstrate the potential benefits of acupuncture and chinese medicine on semen parameters. overall, chinese medicine harnesses the body’s own energy to balance and heal itself. the effect is a better sense of well-being and increased reproductive health.
