facilitate the process. These project facilitators guide the agencies throughout the ESPC process and consult with agency customers on contracting and financing issues, M&V, and technology and engineering issues. FEMP teams offer the assistance at no cost, starting with the kickoff meeting and extending through the review of an ESCO’s initial proposal. Project facilitators are required for all super-ESPCs under the new, master IDIQ contract. Contractors retained by DOE provide this facilitation service, as DOE staff is limited. After the review of an ESCO’s proposal, the support is available on a cost-reimbursable basis (usually $30,000 to $50,000) through system commissioning and the first year after project completion.

Notes 1. UESCs may be growing in number in the future, as ESCOs team up with local utilities to implement energy efficiency and renewable energy projects in federal facilities. ESCOs are finding the sole-source UESCs a faster way to contract for projects without the new 2009 competitive requirements for ESPCs. 2. The National Energy Conservation Policy Act (NECPA) is the primary legislative authority directing federal agencies to improve energy management in their facilities and operations. 3. The Energy Policy Act of 1992 (EPACT), Public Law 102–486, amended NECPA to include additional energy management requirements and achieve target reductions. 4. On June 3, 1999, President Bill Clinton signed Executive Order 13123 promoting governmentwide energy efficiency and renewable energy. 5. This process may be affected in the near future by the passage of the National Defense Authorization Act, which is establishing more competitive procurement procedures for military and nonmilitary federal government contracts.
