City of Whittier gives boost to local companies and business start-ups through new Business Assistance Program

September marks the halfway point of my term as President and I am now, more than ever before, proud to be the leader of this fine organization. I am privileged to work with the truly fine group of people that is the Board of Directors, the Chamber staff and, most importantly, our nearly 700 Chamber members. Although I have not had the opportunity to meet each member, I can confidently say that these first 6 months have proven to me that our Chamber members represent

the best of the best. I thank you for the opportunity to serve as a representative of this excellent organization and look forward to the remainder of my term as President. One significant lesson I have learned while serving as Chamber President so far is that nothing happens overnight. Like Diana Rankin noted above, creating change in even the sturdiest of organizations like the Whittier Chamber takes time and diligence. My business, ACRO Printing, is well on its way to becoming a 23-year Whittier Chamber member. Throughout those years, I have seen innumerable projects, incentives and renovations occur in the Chamber and the community, yet never realized the depth of involvement it took to produce these “overnight successes.” I encourage everyone to re-read Rankin’s quote and reflect on where they want to be in their business. Most likely, where you want to be and where you are, is significantly different. However, it is critical that we remain focused on the “where we want to be.” Just as Rankin notes, it is the 20 years of hard work and persistence that will pay off. In my experience, these are some key reminders on how to run a successful business:

• Constantly seek improvement • Hire the best people you can afford • Know your numbers I have had the pleasure of attending many ribbon cuttings and grand openings lately, which reminds me that each of our businesses begins somewhere. Just as the Whittier Chamber began from scratch 99 years ago, the Chamber’s successful Hathaway Golf Classic will be celebrating its 35th year on September 9, and many entrepreneurs are beginning their own business ventures today. The Whittier Chamber is proud to support our local businesses, young and old! Investors are always searching for methods to help them determine whether a company is worth investing in. There are many means of stock valuation, some simple, some more complex.1 Why is stock valuation so important? If the market price of the company’s stock is greater than the company’s intrinsic value, an investor might choose to stay away. If the market price of the company’s stock is less than the company’s intrinsic value, the investor may choose to buy the stock. Here are six key valuation methods: Price-to-Earnings Ratio (P/E) The price-to-earnings ratio (P/E) is a valuation method used to compare a company’s current share price with its per-share earnings. Its formula is calculated by dividing its market value per share by its earnings per share. The P/E is one of the most widely used ratios, and it is used to compare the financial performance of different companies, industries, and markets. The company’s forecast P/E (its P/E for the upcoming year) is generally considered more important than its historical P/E. Price-to-Earnings Growth Ratio (PEG) The P/E ratio is a snapshot of where a company is, and the PEG ratio is a graph

plotting where it has been. The PEG ratio incorporates the historical growth rate of the company’s earnings. This ratio also tells you how your stock stacks up against another stock. The PEG ratio is calculated by taking the P/E ratio of a company and dividing it by the year-overyear growth rate of its earnings. Price-to-Book Ratio (P/B) The price-to-book ratio measures a company’s market price in relation to its book value. Its formula is calculated by dividing the company’s stock by its book value per share. Book value can be found in the company’s balance sheet, usually listed as “stockholder equity.” It represents the value of a company’s total assets subtracted by its total liabilities. The P/B does not consider the actual value of the assets, only the non-depreciated portion of the assets. Like most ratios, it’s best to compare P/B ratios within industries. For example, tech stocks often trade above book value, while financial stocks often trade below book value. Price-to-Sales Ratio (P/S) The price-to-sales ratio helps determine a stock’s relative valuation. Its formula is calculated by dividing the company’s price per share by its annual net sales per share. Price-to-sales ratio is considered a relative valuation measure because it’s only useful when it’s compared with the P/S ratio of other firms. The P/S ratio varies dramatically by industry, so when comparing P/S ratios, make sure the firms are within the same industry. Return on Equity (ROE) The ROE is calculated by dividing a company’s earnings per share by

The City of Whittier is always looking to offer new programs to our businesses to help them succeed. Last month, we reported on our new online program called Tools for Business Success which includes various local, state, federal and best-of-the-web resources. If you haven’t had time to go online to view the program, we encourage you to do so as there is a plethora of information to help new and expanding businesses. You can access the program through the City web site at http://whittier. toolsforbusiness.info. This month we are happy to report that the Los Angeles County Recycling Market Development Zone (RMDZ) was recently expanded to include Whittier. The RMDZ program combines recycling with economic development to fuel new businesses, expand existing ones, create jobs and divert waste from landfills. The program was developed by the California Department of Resources Recycling and Recovery (CalRecycle) as part of an ongoing effort to increase the diversion of waste going to landfills and is a partnership between the CalRecycle and local jurisdictions. The Whittier RMDZ is administered by the Los Angeles County Public Works Department. The RMDZ program provides business and technical assistance, product marketing and financial assistance to businesses that manufacture a recycled-content product or process materials for recycling. Manufacturing or processing must occur within Whittier or other RMDZ jurisdictions. In short, businesses that want to manufacture goods with recycled materials interested in locating in Whittier or existing Whittier recycling processors may qualify for some financial incentives from the State. The City and Chamber kick off the annual business seminar series with Senator Ron Calderon on September 26 with a Facebook training seminar beginning at 8:30 a.m. at the Whittier City Hall Council Chamber. The free seminars are available for business owners, managers, supervisors, or any member of your business team and are held the last Thursday of the month from September through June, except for holidays. The business seminar series covers a wide variety of topics conducted by industry professionals aimed at providing local businesses with the knowledge and skills needed to succeed in an increasingly competitive and changing marketplace. Starbucks has begun grading and we expect that the former shoe store west of the vacant lot will be demolished soon. Coffee drinkers will surely be happy once the new drive-thru store opens in the coming year! Uptown Whittier continues to make its mark as a dining destination with the opening of several new eateries. Kyle Koestner opened his second restaurant last month. The Rusty Monk, a Belgian restaurant, is almost directly across the street from Kyle’s healthy food and juice café, Fenix 5-4. PortsMouth, the brainchild of Nikomi and Jay Arroyo of Phlight, along with Bernardo Pena, son of Senor Peppers’ owner and Chef Daniel Salcido, will soon be celebrating the grand opening of this seafood restaurant on Penn and Bright. Other restaurants that recently opened in Uptown include Off the Hook Fish Grill located at Hadley and Comstock, and Orange Grill located on Greenleaf just north of the PIH Health building. Whittier, MRCA settle lawsuit The City of Whittier and the Mountains Recreation and Conservation Authority (MRCA) have announced a settlement of the litigation concerning the City’s lease of property located within the Whittier Hills to Matrix Oil for anticipated oil production. In early 2012, the MRCA initiated a lawsuit challenging a 2008 lease between the City of Whittier and Matrix Oil for an oil and gas exploration project at a site used for oil drilling until the 1990s within the Whittier Hills. The lawsuit alleged the project violated, among other things, Los Angeles County Proposition A, a ballot measure approved by the voters in 1992 to increase the safety of neighborhood parks, plant trees and acquire, restore and preserve park, wildlife, and open space resources. The matter was heard before the Los Angeles Superior Court on June 6, 2013 pursuant to which Judge James Chalfant entered an order for a preliminary injunction prohibiting the oil project from proceeding pending the entry of final judgment. This settlement resolves the claims raised by the MRCA regarding this project. Under the terms of the settlement, the MRCA will share project royalties with the City and will receive up to $11.25 million annually for park, recreation, open space, conservation and educational interpretation purposes. The funding will effectively extend the benefits of Proposition A countywide-which would otherwise expire in the next few years-for another generation. The settlement further provides environmental safeguards for the public and assures that high volume, high pressure hydraulic fracturing (commonly referred to as “hydraulic fracking”) will not be used as part of the oil project. Whittier Mayor Bob Henderson, who also Chairs the Puente Hills Habitat Preservation Authority, is pleased with the settlement and stated, “As the City Council has expressed from the beginning, we felt it was appropriate to share a significant portion of the proceeds from our oil royalties with the environmental community in Los Angeles County to allow for greater preservation of native habitat and the public’s enjoyment of our nature environment. The settlement with the MRCA will allow benefits to flow to County residents through the stewardship of this well-respected public park agency that manages some 69,000 acres of environmentally sensitive lands.” Commenting on the settlement, George Lange, Chairman of the Mountains Recreation and Conservation Authority, stated “This is a significant win for the preservation and protection of urban open space and for maintaining safe and accessible parks for the public. The settlement avoids costly and unpredictable legal outcomes on appeal. It includes provisions to protect the Whittier Hills and it provides reliable funding to maintain and improve thousands of acres of public parkland well into the future which is most important.” Whittier’s stated goal was and is to maintain the open space assets available to the public while generating a stable income stream which would support City services without tax increases into the future as well as provide funding for infrastructure replacement. The project, as approved by the City, incorporates significant investment in habitat enhancement within the Whittier Hills. The project’s surface footprint will be limited to only approximately 2% of the 1,280-acre former oil field. The remainder of the open space will be left untouched—preserving this habitat resource while maintaining access and enjoyment to recreational users. There will be no net loss of protected open space, as the City will provide 17.1 acres of biologically contiguous land to replace the land taken out of use by the project. The agreement will ultimately allow the extraction of the oil and natural gas, again, from Whittier Hills. However, with approximately 200 operating and monitoring conditions imposed by the Whittier City Council, both the residents and the environment will be fully protected. The parties believe their efforts and goals are now best served through the consummation of this settlement.

October 26. The event will be held at 7:30 a.m., beginning at the Whittier Community Center, 7630 Washington Avenue. The event is co-sponsored by the Whittier Community Foundation and the Whittier Host Lions Club. “Fit for Life” 5K is a committee of the Whittier Community Foundation, a non-profit organization committed to providing support for programs that benefit the Whittier community, and this year’s proceeds will provide amenities for

In addition to the 5-K, which is a USATF certified course, there will be a pancake breakfast, which will begin at 8 a.m., and a Costume Contest throughout the morning’s activities. City implements new commercial recycling program The City of Whittier mailed letters to businesses encouraging commercial recycling. The California Assembly Bill 341 (Chesbro, 2011) (California Public Resources Code 42649) requires businesses and public entities that generate four cubic yards or more of waste per week and multifamily residential dwellings with five or more units to recycle. The purpose of the law is to reduce greenhouse gas emissions by diverting commercial solid waste from landfills and expand opportunities for recycling in California. The new State law requires cities to implement a mandatory commercial recycling program that includes education and outreach to explain the State requirement, provide information on how to recycle, monitor businesses to identify those that are not meeting the requirement to recycle and inform them of the State requirement. The City must also report program implementation information to the State on an annual basis. Businesses can use one or any combination of the following options in order to reuse, recycle, compost or

otherwise divert solid waste from disposal:

The male subject was arrested for various crimes and the property was returned to the victims. Unfortunately, this is a fairly common occurrence that is often made easier by the victims of these crimes. We have known for many years that basic crime prevention is the most effective way to reduce the likelihood of becoming a crime victim. We also know that most criminals are opportunistic in nature and will look for an easy job with the least resistance to complete their crime. The interview of the suspect involved in this crime spree gave credence to the fact that residents, visitors and the business community can take small and simple steps to prevent vehicle and other burglaries from occurring within our city. When criminals who commit similar crimes are asked how they did it, the suspects have often said they spent hours walking through parking lots and residential streets looking into vehicles for anything of value that was visible through the windows. When they saw an item, they simply smashed the window or opened the unlocked door and took it. In other cases, the suspects said they parked in shopping centers and watched people place purses, backpacks, and other valuables in the trunk before heading to shop or use a fitness facility. When the owners walked away, the suspects smashed a window or opened the unlocked door, opened the trunk and removed the valuables. When the suspects examined a vehicle with nothing visible through the windows, they tend to move on to another vehicle. This arrest and other subsequent interviews should remind all of us that on any given day and at any given time, hundreds of criminals are looking for an easy target. The theft of purses and wallets from vehicles is a pre-curser to identity theft. In addition to the loss of valuable property, vehicle owners also bear the cost of window replacement. The lesson from this arrest and arrests similar to this one is that keeping a clean passenger compartment in a vehicle will most likely reduce your chance of being victimized. To enhance our crime prevention education campaign, Whittier police officers have and are continuing to distribute auto burglary prevention posters and cards to businesses, apartment complexes, schools, churches, neighborhood watch captains and other locations in order to better educate vehicle owners about how to protect themselves and reduce crimes in the city. The message is clear: lock your vehicle, hide your valuables and don’t be a victim! $ TAX TIPS How the homesale exclusion applies to a residence used for residential and business (nonresidential) purposes or to produce rental income

Richard Scrivanich As you know, an individual can exclude up to $250,000 ($500,000 for certain joint filers) of the gain from the sale of his principal residence if he has owned and used the residence as his principal residence for at least two years out of the five-year period before the sale. You recently asked whether the amount of the exclusion would be affected if you used a portion of your property for business or to produce rental income. You can generally exclude some or all of the gain realized from the sale of a home you have used for business or to produce rental income if you meet the two-year ownership and use tests. If you use the property partly as a home and partly for business or to produce rental income, the treatment of any gain on the sale depends on whether the business or rental part of the property is within your home or separate from your home. However, even if you satisfy the two-year ownership and use tests, the

Understanding the trend of ROE is important because it indicates whether the company is improving its financial position or not. Dividend Payout Ratio This ratio is calculated by dividing the dividends paid by a company by its earnings. The dividend payout ratio can also be calculated as dividends per share divided by earnings per share. A high dividend payout ratio indicates that the company is returning a large percentage of company profits back to the shareholders. A low dividend payout ratio indicates that the company is retaining most of its profits for internal growth.

exclusion does not apply to any gain due to depreciation allowed or allowable for periods after May 6, 1997, or to any gain allocable to a period of nonqualified use after December 31, 2008. Any gain attributable to depreciation is subject to a maximum tax rate of 25%. A period of nonqualified use, in general, is any period during which the property is not used as the principal residence of the taxpayer or the taxpayer’s spouse (or a former spouse). If the part of your property used for business or to produce rental income is within your dwelling unit (i.e., house, apartment, condominium, etc.), such as a room used as a home office for a business, it’s not necessary to allocate gain on the sale of the property between the business part of the property and the part used as a home. The rules become more complex if a separate part of your home was used for business or to produce rental income. In that case, you have to apply the ownership and use tests separately to each part of the property. For example, you cannot exclude any gain on the separate part of your property used for business or to produce rental income unless you owned and lived in that part of your property for at least two years during the five-year period ending on the date of the sale. If you do not meet the two-year use test for the business or rental part of your property, an allocation of the gain on the sale is required. For this purpose, you have to allocate the basis of the property and the amount realized upon its sale between the business or rental part and the part used as a home. The

allocation is based on the same method of allocation that you used to determine the depreciation deductions for the business portion of the property. If you used a separate part of your property for business or to produce rental income in the year of sale, you have to treat the sale of the property as the sale of two properties, even if you met the use test for the business or rental part. This allocation requires you to divide the selling price, selling expenses, and basis between the part of the property used for business or rental and the separate part used as your home. Similarly, if you qualify to exclude any of the gain on the business or rental part of your property, you would also divide your maximum exclusion between the business portion of the property and the separate portion used as your home. If you have used a separate part of your property for business or to produce rental income (though not in the year of sale) but meet the two-year use test for both the business (or rental) part of your home and the residential portion of your home, it’s not necessary to treat the transaction as the sale of two properties. In other words, the exclusion would apply to gain other than gain due to depreciation or gain allocable to a period of nonqualified use. Just five ‘job killer’ bills alive as legislative session nears end The more than three dozen bills that the California Chamber of Commerce labeled as “job killers,” because they would increase regulation or raise taxes, have been whittled down to just five as the 2013 legislative session enters its last days. All of the others have either been held in committee or defeated in floor votes, but technically, will still be alive for the second half of the biennial session that begins in January. The highest-profile survivor of the original 37 bills is Assembly Bill 10, carried by Assemblyman Luis Alejo, D-Watsonville, which would raise the state’s minimum wage by $2 per hour over the next five years. The measure was approved by the full Assembly and reached the Senate floor, awaiting another vote, after Alejo agreed to remove an automatic cost-ofliving escalator. The other four bills on the list that remain alive include:

• Senate Bill 404 by Sen. Hannah-Beth Jackson, D-Santa Barbara, which would extend the Fair Employment and Housing Act’s protections against discrimination to employees who are engaged in family care duties; • Senate Bill 365 by Sen. Lois Wolk, D-Davis, which would place a 10-year time limit on business tax exemptions; • Senate Bill 691 by Sen. Loni Hancock, D-Berkeley, which would increase penalties for non-vehicular air quality violations; and • Assembly Bill 769 by Assemblywoman Nancy Skinner, D-Berkeley, which would repeal the net operating loss carry back deduction for business. Seven constitutional amendments aimed at lowering the vote threshold for local government and school taxes are technically still alive, but would require two-thirds legislative votes to be placed on the 2014 ballot. Proposed legislation dedicates Boulevard to fallen Whittier police officers T h e y a r e remembered as two of Whittier’s finest. In the late 1970s, Whittier police Detectives Mike Lane and John Pierce lost their lives Assemblyman Ian Calderon in the line of duty while protecting the city and its residents. Now, more than 30 years after their deaths in separate police actions, an effort is under way to dedicate Whittier Boulevard inside the city limits to their memory. According to Police Chief Jeff Piper, the effort began with the Whittier Police Officers’ Association, which took the idea to city officials. The city put together the paperwork to make a request to Assemblyman Ian Calderon, D-Whittier. Calderon’s legislation, Assembly Concurrent Resolution 62, designates the portion of Highway 72, or Whittier Boulevard, from the western intersection at Penn Street to the eastern intersection at Costa Glen Avenue, to the officers. “It’s a wonderful opportunity to memorialize their service and contribution and the ultimate sacrifice that these two officers made for our community,” Piper said. “They are our fallen heroes.” In August, the measure was passed unanimously by the Assembly and then passed by the Senate Transportation Committee. It is expected to next be heard in the Senate Appropriations Committee in the beginning of September. The bill, which Calderon introduced

on May 31, would designate a portion of Highway 72 as the Detectives Mike Lane and John Pierce Memorial Highway. A memorial sign to the two officers, at a cost of nearly $5,000 which will be paid by the Whittier Police Officers’ Association, is proposed to be placed at each end of the designated portion of the highway. Lane joined the Whittier Police Department on Jan. 22, 1968. He was assigned to the detective division, criminal tactical unit, major criminal investigations, the Southeast Burglary Investigation Team and later to the Investigative Division, Narcotics Detail. On Dec. 13, 1979, Lane was working undercover on a motorcycle theft investigation when shots were exchanged and he was killed. Pierce joined the Whittier Police Department on Oct. 12, 1967. He worked as a uniformed officer, served as liaison officer in the Whittier Police Explorer program, the department’s investigative division and later the SWAT Team. He served as training officer in the investigative division and was named California Outstanding Narcotics Officer by the We Tip organization. On Sept. 21, 1976, while working an undercover investigation regarding the sale of narcotics, Pierce sustained serious injuries that left him paralyzed from the neck down and later caused his death on May 18, 1977. “We will not forget the sacrifices of these two heroes and will ensure their legacy lives on by remembering and honoring them,” Calderon said.

Creatures ‘n Crawlers ‘n Critters, Oh My! Exhibit opens September 4 This year’s Whittier Art Gallery annual juried fundraiser promises to be a whole lot of fun. Some of the best artists in the area have come together to present great art at great prices. The title of the show encourages artists to create their most imaginative creepy crawlers and imaginary critters, although the creatures can be anything that breathes. Transforming young minds, bodies and families at Beverly Hospital Children learn at a young age that food is comfort. Studies have shown that 33% of children and teens are overweight and those extra pounds can be tough to carry as a child. Many develop low self-esteem, which can lead to being teased, bullied by their peers or left out of games. In addition, serious health issues, such as respiratory and orthopedic problems, depression and type-2 diabetes may occur. Beverly Hospital’s partnership with the Montebello-Commerce YMCA delivers a free, six-week bilingual program that empowers children and their families to adopt healthier lifestyles, by forming habits of good nutrition and fun exercise. In July, the KidsFit program graduation ceremonies were held for the children who completed the full six weeks. Gary Rivas, Dietitian, presented each graduate with certificates of completion and a MyPlate gift. The KidsFit program for children, 7 to 18 years of age, offers six weeks of family nutrition education along with twelve weeks of exercise classes by age group. It’s a fun way for your child to meet new friends and learn how to make choices that will truly make him or her happier, healthier and more focused in the classroom. Rio Hondo Symphony hosts membership drive and gears up for 81st season of free concerts The Rio Hondo Symphony officially began its annual Membership Drive to assure an 81st season of four priceless ADMISSION-FREE concerts. “Memberships are our major source of income to meet the budget. Each of the priceless free concerts costs about $25,000 and expenses continue to rise,” declared Symphony Association President Randy Miller, of Brea. Memberships start at $25. Everyone who contributes $150 (or more) is invited to the post-concert buffet receptions. Names of all members are listed in the concert programs. The tradition of performing free classical music concerts, close to home, for the enjoyment of everyone in the community, started 81 years ago at Whittier College. Ruth Haroldson, a young violin instructor who founded the orchestra as its first conductor, said that the orchestra “should be free of bars imposed by the box office.” Originally, the orchestra was called the Whittier College Community Orchestra. Today it is known as the Rio Hondo Symphony and is sponsored by Whittier, Pico Rivera and Santa Fe Springs, and by Rio Hondo College. “It is up to all of us to make sure the Rio Symphony continues through its 81st season and beyond.
