ewtown residen t Ma tt M urphy, a f ireman f or o ver 2 5 years, d ecided to st udy for a bachelors degree in 1995. Studying part time, he worked on a thesis about con victs in S ydney and stumbled ac ross a stor y line he though t ma y have already been written about by historians for certain. To his amazemen t, nobody had and he decided to write a book about it. The book titled Weight of Evidence is the true story about a hotly contested parcel of land t hat ran ac ross Newtown and Erskineville – all 210 acres of it. The case was the Newtown Ejectment Case of 1852.

man will face Newtown Court after he was charged over a number of alleg ed chil d se xual assault offences tha t took place in the 1980’s. Police f rom New town L ocal Area Command formed Strike Force Locke to investigate the alleg ed offences, which occurred in the T empe area betw een 1986 and 1988.

In 1790 Nicholas Devine arrived in Sydney with the second fleet to take up a position as Superintendent of convicts. He was given a land grant of 210 acres, covering most of the suburbs of Newtown and Erskineville.

After the dea th of Nicholas D evine’s wife Mar garet in 1827 , Nicholas signed over all of the land to his convict servant Bernard Rochford, who then c arved up the estate and sold it off bar 10 acres. After the dea th of Nicholas D evine in 1830 and B ernard Rochford in 18 39 the Devine family in Ireland took legal action against members of their o wn family for rightful ownership of the land. By 184 9 ho wever the New town/Erskineville area was w ell established. By this time, some of the land owners were prominent c itizens of S ydney such as the Lord Mayor of Sydney, the Attorney General, parliamentarians, the edi tor of the Sydney Morning Herald, a few barristers and solicitors. Weight of Evidence is about the lies and deceit tha t took place in early S ydney and the families who played out the real life drama that was at the time the lar gest civil court case in Australia’s history. There was a retrial and the ma tter ended up being settled outside of court in 1857, five years after the original legal action was commenced.

At appro ximately 11. 20am on Thursday, O ctober 17 , police arrested a 59- year- old man at his workplace in Woolloomooloo. A crime scene warrant was also executed at the man’s home address in Petersham. The man was taken to Newtown Police Station where he was char ged with five counts of indecen t assault, tw o coun ts of aggravated sexual intercourse with a child ag ed betw een 10 to 16- years, and four coun ts of c arnal kno wledge b y a teacher. Karen Willis from the NSW Rape Crisis Centre said it was important for victims to c ome f orward t o n ot o nly h elp w ith catching those responsible, but assist with the healing process. “What v ictims of se xual c rime need to k now i s t hey s houldn’t b e m ade t o feel guilty about a v iolation they ha ve endured. I t is no wa y their fault. They should come for ward whether the v iolation occurred five minutes ag o or fi ve years ago,” Ms Willis said. She said v ictims of se xual abuse who come forward help to stop the perpetrators from re-offending.
