Described as being ‘property crazy’, it is from three simple words – PEOPLE, PASSION, PROPERTY that Rene Bekker has established herself.

It was as early as 1999 that Rene’s talent was recognised after she joined a national insurance company and she was very quickly promoted to Branch Manager. Rene quickly knew that with a combination of constant development of skill, hard work and dedication as well as an open mind and heart – success will be achieved. Her interest in property began as a hobby but Rene spent over a decade studying the property market, and gained the necessary EAAB (Estate Agency Affairs Board) qualifications. This included completing her PDE4 and PDE5 Board Exams within four years as well as qualifying as a Master Practitioner in Real Estate (MRRE). Now it is time to instil these values and passions to others to better assist Zululand’s buyers and sellers. And so, it seemed only natural that Rene would take on a team that was as passionate about property as she is. Her first Intern Agent, Dean Deyzel, was raised in Richards Bay and is acutely aware and plugged into the developing urban market and has curated a vast client base built on a foundation of trust. Another new member, Henning de Wet, maintains his community connection though his involvement in numerous civil society organizations, economic development initiatives and is a public representative on local government committees. He combines his inner working knowledge of the opportunities and growth within the sector to commercial office, industrial

and residential properties and always aims to exceed the expectations of a client. Ingrid and Manfred Marx strive for growth and they understand the personal needs of their clients. They were introduced to the real estate industry five years ago when they were in the market to invest in a local Guest House. Eager to make their mark, they have entered the industry as Intern Agents under Rene’s mentorship. Is cohabitation as good as marriage? Pieter and Marie have been living together for many years. “Why ruin a good thing with marriage? We are as good as married in any case.” But are they? How do the rights of a couple living together differ from those of a couple legally married and how can persons living together protect themselves for the future?

T

he short answer is, persons living together do not automatically have the same rights in their relationship as a married couple. That said, this does not mean they are without recourse. There are options available to protect the rights of the parties and determine the consequences if the relationship ends up on the rocks. In a relationship of cohabitation, two persons, irrespective of their gender, live together in all respects as a married couple. Although a cohabitative relationship is not a marriage, it can in certain circumstances be seen as a ‘partnership’, provided very specific requirements for a partnership are present. Where the couple living together can show the presence of a partnership, they will be the equal owners of all assets collected during the existence of the relationship. If they cannot prove this, then each person’s assets will remain his or her property. South African banks do not yet allow couples living together to open up a joint account and cohabitating couples cannot claim that the other party must support them financially. The parties can however include such rights or obligations in an agreement between them, but these will only be recognised to the extent that is stipulated in the agreement. If

one party passes away, the other party will not have an automatic right to inherit if the deceased did not provide for the party in his or her will. If the will does provide for inheritance to the surviving party, this right can be influenced by the maintenance claims of a lawful spouse and/or children against the deceased’s estate. In terms of our laws against family violence, cohabitating couples can in the same manner as a married couple, obtain a protection order against the other. According to pension fund rules, a pension fund can after the death of a member, pay to the dependants, and a party to a cohabitative relationship can qualify as a dependant, provided the one partner contributed to the maintenance of the other. Similarly, if a party to a cohabitative relationship passes away due to an accident in the course and scope of his or her employment, the remaining party can claim damages subject to meeting the requirements for a valid claim. If there are children involved, the Childrens Act determines that the biological mother of a child is also the guardian of the child and that all concomitant rights and obligations vest in the mother irrespective of whether she was married or a party to a cohabitative relationship at the time of the child’s birth. The biological father

of the child will receive these same rights. Cohabitating partners can also choose to have a cohabitation agreement executed in which their respective rights and obligations are stipulated. This allows for upfront discussion of concerns and issues and provides valuable certainty for the consequences of the relationship. However, if the relationship does not work parties can only hold each other to the terms of the cohabitation agreement and they cannot rely on any help from legislative intervention.

Marriage and cohabitiation is not the same thing, but some of the same consequences can be established through the use of the options discussed above. When a couple decides to move in together it becomes important to consider the purpose of the relationship and weigh your options accordingly. Legal Q & A supplied by:
