REALTOR® Safety - The 10-Second Rule One of the most common reasons that people find themselves in dangerous situations is that they weren’t paying attention. Take a few precious seconds during the course of your day to assess your surroundings. Take 2 seconds when you arrive at your destination. • Is there any questionable activity in the area? • Are you parked in a well-lit, visible location? • Can you be blocked in the driveway by a prospect’s vehicle? Take 2 seconds after you step out of your car. • Are there suspicious people around? • Do you know exactly where you’re going? Take 2 seconds as you walk towards your destination. • Are people coming and going or is the area unusually quiet? • Do you observe any obstacles or hiding places in the parking lot or along the street? • Is anyone loitering in the area? Take 2 seconds at the door. • Do you have an uneasy feeling as you’re walking in? • Is someone following you in? Take 2 seconds as soon as you enter your destination. • Does anything seem out of place? • Is anyone present who shouldn’t be there or who isn’t expected? Understandings Mold Disclosures Most of you are aware that both the Virginia Residential Landlord Tenant Act (VRLTA)’ and the Landlord Tenant Act (LTA) have provisions addressing disclosure of mold in dwelling units. $ 55248.1122 of the VRLTA provides that as a part of the written report of a move-in inspection, a landlord is required to disclose whether there is visible evidence of mold in areas readily accessible within the interior of the dwelling unit. If the disclosure indicates there is visible evidence of molds, the tenant has the option to terminate the tenancy or elect to remain, in which case the landlord is required to remediate within five (5) business days. Thereafter, a reinspection to confirm that there is no additional evidence of mold is required as is a new written disclosure. The companion statute in the LTA, S 55225.7, mirrors the VRLTA with one significant difference. Disclosure under the LTA is at the option of the landlord, the VRLTA reading “shall disclose”, the LTA “may disclose”. Owners of single-family residences where the owner is a natural person, or their estate, with no more than ten (10) single-family residences or four (4) condominiums are exempt from the VRLTA. Note that the exemption refers to natural persons which means that owners holding properties in limited liability companies, partnerships, etc. would not be exempt.

I believe the best practice is to give mold disclosures in all cases but not having done so in a recent tenant claim worked to the advantage of the landlord and property manager. In that case the owner did not give a mold disclosure and the tenant, within a few days of the tenancy, found evidence of mold. The tenant’s attorney took the position that having failed to give the mold disclosure, the tenant was not afforded an opportunity to terminate the lease and the attorney gave notice of termination. The property manager and owner were then sued for thousands of dollars in personal property remediation expenses, move-out costs, utilities and attorney’s fees. The owner counterclaimed for breach of the lease agreement and lost rents. The Court dismissed the tenant’s claim finding that the owner owned only one (1) residence and no mold disclosure was required under the LTA. Judgment was entered against the tenant for lost rents and attorney’s fees.

Local Hampton VPAR’s Legislative Consultant has been asked by City Manager Mary Bunting to represent the Association on a citizens committee to assist in the implementation of the recommended goals of the City’s Community Plan. VPAR’s role will be to focus not only on the housing/neighborhoods goals and vision of the Plan, but also to monitor the City’s progress on the Plan’s implementation. In our continued outreach efforts with elected officials, VPAR met with newly sworn-in Councilmember Billy Hobbs last month. (VPAR’s Public Policy Committee endorsed Mr. Hobbs in the 2012 May Council elections.) The purpose of the meeting was to discuss mutual efforts between VPAR and the City, especially touching on the work of the Zoning Ordinance Advisory Committee, housing education to the Planning Commission and simply, building our relationship with Mr. Hobbs. It was a very productive meeting. VPAR and housing has a friend in this Councilmember. Newport News VPAR met with City Manager Neil Morgan in August to discuss a variety of issues, including VPAR’s role on the Regulations Committee and on more use of VPAR as a housing resource to staff and Council. VPAR also met with Councilwoman Tina Vick in August, where the primary topics were the Aaron Brooks project, the proposed Camp Morrison project and workforce housing issues in general. VPAR’s Public Policy Committee endorsed Ms. Vick in the May 2012 elections. Poquoson The City has reached out to VPAR to be its partner in the development of a City marketing strategy. Working in conjunction with City Manager Randy Wheeler and Economic Development Director Dave Callis, a small focus group of REALTOR ® Update Update REALTOR7

VPAR members will meet with Poquson’s leadership to begin work on the best ways to market the City. The initial meeting is set for September 6th. Many thanks to VPAR members Kimi Dornan, Sandra Hood, Deanna Renn, Bob “Sully” Sullivan and Peggy Todd. York County At the request of Planning Director Tim Cross, VPAR made a presentation on affordable and workforce housing to the Planning Commission at its August 16th work session. Specific details were provided on how the County may implement an Affordable Dwelling Unit Ordinance, how the County demographics play into that rezoning opportunity and how other area localities have implemented affordable and workforce housing programs into their comprehensive plans and zoning ordinances. We will continue to provide this information to the County as it moves forward in the review of its Comprehensive Plan. ELECTIONS Look for information coming to VPAR (and you) regarding voter registration! Deadline for registering to vote in the November 6th general election is October 15th. VPAR will have voter registration applications and other information available to the membership and their clients. We are trying not only to increase the voter rolls within our own organization, but also to be a catalyst for increased voter registration throughout the area. If you need voter registration information, stop by VPAR in the coming weeks to see how we can help. More details will be coming your way once the final pieces of this important Voter Registration Drive are in place! STATE VPAR’s Tom Sullivan, Dana Holben and Susan Gaston participated in the August 27th VAR Public Policy Committee. One of the most important elements of this meeting was the potential legislative agenda the REALTORS® may propose in the 2013 General Assembly Session. A proposal submitted by VPAR in its legislative package is receiving considerable attention: Real Estate Licensee Liability for Reliance on Public Information. Eminent domain: Give it more thought In November, Virginians will vote for a constitutional amendment that many believe return the issue of property rights back to the courts for interpretation, and out of the General Assembly. In 2005, the Supreme Court ruled (in Kelo v. New London) that the city of New London, Conn., could use its power of eminent domain to take Susette Kelo’s house and transfer it to a private developer. The development of her property was considered a “public use” because it would generate jobs and tax revenues. VAR and many other state REALTOR® associations immediately began working with their respective state legislatures to enact provisions to protect property rights and limit government or private enterprise from taking property for “public use.” Thanks in large part to VAR’s leadership, in 2007 the Virginia General Assembly adopted eminent domain reforms to protect property owners. Despite the reforms, up for vote this November is an amendment to the Virginia constitution that would serve a similar purpose. It would permit the use of eminent domain only in cases involving “a public service company, public service corporation, or railroad … when such exercise is for the authorized provision of utility, common carrier, or railroad services.” It also says that “private gain, private benefit, private enterprise, increasing jobs, increasing tax revenue, or economic development,” does not qualify as “public use.” Our Stand By putting eminent domain restraints in the constitution rather than the Code of Virginia, the restrictions passed in 2007 would be superseded, and any issues involving eminent domain would be handled by a court, not in the General Assembly. The proposed amendment won’t protect property owners any more than the current law, and it could make it more difficult for legitimate public-use projects. Imagine that a town wants to widen a road to allow better traffic flow to an area being developed for a shopping center. It needs to use eminent domain to secure the land for the road. A constitutional amendment could prevent that from happening, or tie the process up in the courts, even though the town’s council held hearings and voted to allow the project — it’s clearly for the public good. And courts are notoriously unpredictable. Cluttering of the Constitution with non-essentials also becomes an invitation to lawyers and a reservoir of legal fees charged to taxpayers. Property owners need to know that their property cannot be taken away by a government entity without very good reason — a reason that focuses on the public good, as eminent domain was originally intended. VAR prefers to work through the legislative process, which we find inclusive and more predictable, as opposed to leaving important issues to the court system. We feel we have more influence and positive opportunities working through the General Assembly. The amendment is moving quickly and will most likely pass this November, and VAR will not formally oppose it. We believe it will be supported by an overwhelming majority of voters, and while we do take principled stands, we prefer to pick our fights and expend political capital — and our members’ resources — on debates we have a chance of winning. Still, we believe the constitutional amendment is NOT necessary for the Commonwealth, where the existing system and laws are sufficient to protect the rights of property owners from the government. Here’s the full text of the proposed amendment: “That the General Assembly shall pass no law whereby private property, the right to which is fundamental, shall be damaged or taken except for public use. No private property shall be damaged or taken for public use without just compensation to the owner thereof. No more private property may be taken than necessary to achieve the stated public use. Just compensation shall be no less than the value of the property taken, lost profits and lost access, and damages to the residue caused by the taking. The term ‘lost profits’ and ‘lost access’ are to be defined by the General Assembly. A public service company, public service corporation, or railroad exercises the power of eminent domain for public use when such exercise is for the authorized provision of utility, common carrier, or railroad services. In all other cases, a taking or damaging of private property is not for public use if the primary use is for private gain, private benefit, private enterprise, increasing jobs, increasing tax revenue, or economic development, except for the elimination of a public nuisance existing on the property. The condemnor bears the burden of proving that the use is public, without a presumption that it is.”
