Defendants CIVIL NO. 15-1492 (JAF) COLLECTION OF MONIES AND FORECLOSURE OF MORTGAGE DEFAULT JUDGMENT On April 27, 2015, RCAC filed the instant complaint against PEDRO ANTONIO MELENDEZFIGUEROA; and his wife LIZETTE SANTIAGO-RODRIGUEZ; and THE CONJUGAL PARTNERSHIP BETWEEN THEM; (hereinafter “Defendants”); for Defendantsʼ non-compliance with the terms and conditions of a loan and mortgage deed for in the amount of ONE HUNDRED EIGHTY NINE THOUSAN D EIGHT HUNDRED DOLLARS ($189,800.00) executed on December 31, 2001. On July 31, 2015, Summons was published at page 28 of El Vocero Newspaper and was notified to Defendants by certified mail on July 31, 2015. Pursuant Rule 4.6 of the Rule of Civil Procedure for the Commonwealth of Puerto Rico, made applicable by Rule 4(e) of the Federal Rules of Civil Procedure, Defendants were required to serve the answer, or otherwise plead to the Complaint on or before August 30, 2015. Because Defendants had not appeared before this Court in response to the duly served Complaint, on September 24, 2015, this Court entered an order granting RCACʼs Motion for Entry of Default as to Defendants. As of this date, Defendants have failed to defend against RCACʼs claims in the instant case. The detailed sufficiency of the Complaint, the undisputable nature of the facts of this collection action, and the attached affidavit make default judgment the appropriate remedy. This Court makes the following findings of fact: 1. On December 31, 2001, Defendants obtained a loan from Doral Bank, and executed a Mortgage Note in the amount of ONE HUNDRED EIGHTY NINE THOUSAND EIGHT HUNDRED DOLLARS ($189,800.00), repayable with an interest rate of 7.25% per year. On October 28, 2005, the aforementioned Mortgage Note was modified regarding the principal amount, frequency and amount of the payments and maturity date, becoming its new principal in the amount of ONE HUNDRED EIGHTY EIGHT THOUSAND NINE HUNDRED SIXTY DOLLARS ($188,960.00). 2. As guarantee of the repayment obligation evidenced by the Mortgage Note, Defendants also executed on December 31, 2001, Mortgage Deed number 1,133 before Notary Public Edgardo Del Valle Galarza, and on October 28, 2005, Modification Deed number 138 before Notary Public Jaime Manuel Rosa Malavé, encumbering Property No. 16,334, which property is owned by Defendants. 3. The Mortgage Deed executed by Defendants is recorded at the Registry of Property of Puerto Rico, in the Section, Registry Book and page, under the property which description, in the Spanish language is: “URBANA: Solar marcado con el número Seis (6) del Bloque “B” en el plano de inscripción de la Urbanización Campo Primavera, localizado en el Barrio Beatriz del término municipal de Cidra, Puerto Rico, con una cabida superficial de 750.52 metros cuadrados. Colinda por el NORTE, con la Calle 1 en una lineación de 24.99 metros lineales; por el SUR, en una alineación de 25.03 metros lineales con el solar 11 del mismo bloque; por el ESTE, en una alineación de 29.58 metros con el solar 7 del Bloque “B”; y por el OESTE, en una alineación de 30.46 metros con el solar 5 del Bloque “B”. Enclava una edificación. Afecta a este solar una servidumbre de 1.52 metros de ancho que discurre a todo lo largo de su colindancia NORTE, a favor de la Puerto Rico Telephone Company.” Property number 16334, recorded at page 217 of volume 451 of Cidra, Registry of the Property of Caguas, Second Section. 4. RCAC is the owner and holder of the mortgage note ONE HUNDRED EIGHTY NINE THOUSAND EIGHT HUNDRED DOLLARS ($189,800.00), originally issued to the order of Doral Bank. 5. Defendants defaulted on the repayment obligation to RCAC and, for said reason RCAC accelerated the debt and declared due the obligation under the mortgage note. 6. As of

2015, this Court entered an order granting RCACʼs Motion for Entry of Default as to Defendants. As of this date, Defendants have failed to defend against RCACʼs claims in the instant case. The Court makes the following conclusions of law: This Court has jurisdiction to entertain the claims pleaded herein under 28 U.S.C. § 1332 because the matter in controversy exceeds the sum or value of $75,000.00, exclusive of interest and costs. For diversity purposes, Plaintiff, RCAC, is a legal entity organized under the laws of Cayman Islands, having its principal place of business in the Cayman Islands. Defendants are citizens of the Commonwealth of Puerto Rico. Venue is proper in this district pursuant to 28 U.S.C. § 1391 (a), (b), and (c), since all operative facts alleged herein were committed within the Commonwealth of Puerto Rico Commonwealth of Puerto Rico. Defendants are indebted to RCAC for the loan granted on December 31, 2001, which is past due and payable. Furthermore, the Defendants herein breached the repayment obligation with RCAC under the Puerto Rico Civil Code, and the Puerto Rico Mortgage Law. Plaintiff, RCAC, is entitled to judgment as a matter of law against Defendant, in the amount of $209,427.09, as of September 23, 2015, which will continue to accrue interest at the contractual rate.
