Nuevas vistas sobre Energy Answers EPA se propone otorgarle un permiso de aire a la planta de conversión de energía que se construirá en Arecibo REDACCIÓN EL VOCERO
La Agencia de Protección Ambiental (EPA, por sus siglas en inglés) llevará a cabo una nueva serie de vistas públicas para recibir insumo y/o comentarios en torno a la aprobación de un permiso de aire para la construcción de una planta de conversión de basura a energía en Arecibo, propuesta por la empresa Energy Answers. Para obtener el permiso de la EPA, se le exigió a Energy Answers demostrar que los equipos para controlar la contaminación de la planta representan la mejor tecnología disponible para este tipo de equipo de control de contaminación. El permiso propuesto también exige que Energy Answers examine la contaminación que emita a la atmósfera y que demuestre que cumple con los límites de contaminación que la EPA propone establecer. El permiso requiere que los límites de emisiones se midan y se notifiquen a la EPA durante las operaciones de la planta. La omisión en el cumplimiento de cualquiera de estos límites del permiso sometería a la instalación a acciones de cumplimiento de la EPA La EPA conducirá cinco sesiones formales de vistas públicas que se extenderán por tres días duran-
te el 25, 26 y 27 de agosto de 2012. Todas las sesiones se llevarán a cabo en el Club de Leones de Arecibo, ubicado en la avenida Ing. Manuel T. Gillán, sector El Tanque de Arecibo. La agencia informó que aceptará comentarios y/o ponencias escritas durante la vista y permitirá a cada persona, que así desee, hacer una exposición oral por un máximo de 10 minutos. Se le dará la misma consideración tanto a ponencias orales, así como
comentarios por escrito sometidos durante la vista pública o en cualquier momento durante el período de comentarios públicos. Todo el que practica, confía y cree en estas cosas es condenado y destinado al castigo eterno. Veamos lo que la Palabra de Dios dice al respecto: "No sea hallado en ti quien practique adivinación, ni agorero, ni sortílego, ni hechicero; ni encantador, ni adivino, ni mago, ni quien consulte a los muertos. and Commonwealth Oil Refining Company, Inc. Firm Delivery 600 State Road No. 127 Peñuelas, Puerto Rico 00624 have applied to the United States Environmental Protection Agency (EPA) under the provisions of the Clean Water Act, 33 U.S.C. §1251 et seq. (CWA or the Act), for National Pollutant Discharge Elimination System (NPDES) permits to discharge pollutants from the following facilities into waters of the United States: Peñuelas Technology Park, LLC State Road 337 Km 1.1 Tallaboa Ward Peñuelas, Puerto Rico 00624 NPDES No. PR0000418 Commonwealth Oil Refining Company, Inc. 600 State Road No. 127 Peñuelas, Puerto Rico 00624 NPDES No. PR0000345 Peñuelas Technology Park, LLC, the applicant, is engaged in treatment of groundwater and sanitary waters at wastewater treatment plant. The applicant proposes to discharge 234.68 m3/day (0.062 MGD) as a daily maximum flow of wastewater consisting of treated wastewaters from recovery of the groundwater control system at the facility's industrial landfill and the wastewater treatment plant areas and sanitary wastewaters, treated in a wastewater treatment system from outfall serial number 001 to Guayanilla Bay. The receiving water has been classified SC by the Environmental Quality Board (EQB) of Puerto Rico. The Commonwealth Oil Refining Company, Inc. (CORCO) facility operates a bulk petroleum warehouse leasing facility in Peñuelas, Puerto Rico. Petroleum commodities are brought into the facility through the marine shipping terminal and pipelines from CORCO clients. These commodities are subsequently shipped by CORCO clients through the marine terminal, by tank trucks and by pipelines to CORCO client's facilities. The wastewater treatment processes consist of aeration, equalization, oil/water separation, biological treatment, flocculation, and filtration. The effluent is discharged into the Tallaboa Bay, designated as a class SC waterbody. This notice is being given to inform the public that the EPA has prepared draft permits for these facilities. The draft NPDES permits prepared by EPA are based on the respective administrative records. Among other documents, the administrative record required by 40 C.F.R. 124.9 consists of the application, draft NPDES permit, and fact sheet describing the basis for the conditions in the permit. All data submitted by the applicant is available as part of the administrative record. A copy of the administrative record is on file for PR0000418 at the EPA Region 2 Caribbean Environmental Protection Division Office in City View Plaza II, Suite 7000, #48 RD. 165, Km. 1.2, Guaynabo, Puerto Rico, 00968-8069 and for PR0000345 at the EPA Region 2 New York Office, Room 2128, 290 Broadway, 21st Floor, New York, NY, 10007 and may be inspected and photocopied at a cost of $0.15 per page at anytime between 8:30 A.M. and 4:00 P.M., Monday through Friday. A copy of the draft permits and fact sheets may be obtained by writing to the above address or by calling (787) 977-5870. The draft permit and fact sheet are also available on the EPA website at the following web address: http://www.epa.gov/region02/water/permits.html. Interested persons may submit written comments on the draft permit with NPDES number PR0000418 to the Director, Caribbean Environmental Protection Division, at the above address by no later than 45 days from the date of this notice. Interested persons may submit written comments on the draft permit with NPDES number PR0000345 to the Chief, Clean Water Regulatory Branch, USEPA Region 2, 290 Broadway, 24th Floor, New York, NY 10007, by no later than 45 days from the date of this notice. All persons may provide comments during the public comment period. If the EPA finds that comments timely submitted appear to raise substantial new questions, EPA may reopen the public comment period for that permit. Any interested persons may request a public hearing on these documents. Any request for a public hearing under 40 C.F.R. §124.11 on EPA's draft permits shall be in writing, state the nature of the issues proposed to be raised in the hearing, and be submitted to the Director, Clean Water Division, 290 Broadway, 25th floor, New York, NY 10007, by no later than 45 days from the date of this notice. EPA's decision on the question of whether to hold a public hearing on the draft NPDES permits, the administration of any hearing and the rights and obligations of participants are governed by regulations at 40 C.F.R. §124.12. If EPA holds a public hearing, the public comment period in this Notice shall automatically be extended to the close of the public hearing. If EPA does not hold a public hearing or reopen the comment period, EPA shall consider the issuance of a final permit to the applicant as soon as possible after the date indicated above for the submission of comments. All timely comments, submitted by interested persons in response to this Notice, and statements and other evidence properly submitted at any public hearing held by EPA shall be considered in making the final decision with respect to these permit applications. All comments shall be answered as provided in 40 C.F.R. §124.17. The applicant and any other person who submits timely written comments or requests notice of final permit decision shall receive notice of EPA's final decision. Within 30 days of service of such notice, any interested person who has submitted timely written comments may file a notice of appeal and petition for review to the Environmental Appeals Board to review any condition of the permit decision. Any person who failed to file comments or failed to participate in the public hearing on the draft permit may petition for review only to the extent of the changes from the draft to the final permit decision. Any such request must meet the requirements of 40 C.F.R. §124.19. The applicant and any other person who submits timely written comments or requests notice of final permit decision shall receive notice of EPA's final decision. Within 30 days of service of such notice, any interested person who has submitted timely written comments may file a notice of appeal and petition for review to the Environmental Appeals Board to review any condition of the permit decision.
