State Legislature seeks more National Guard units Patrick McCallister FOR VETERAN VOICE

Florida is way short on National Guard. The state has about 12,000 National Guard members. The state’s adjutant general, Maj. Gen. James Eifert, estimates that Florida needs 25,000. But, the state can’t just increase the size of the Florida National Guard, explained State Senator Gayle Harrell. “We have no power in the state to increase the National Guard,” Harrell said in a telephone interview. “That’s a federal responsibility.” After Harrell’s interview, Gov. Ron DeSantis announced a proposal to revive the 1940’s era Florida State Guard. He’s asking the Florida Legislature for $3.5 million to recruit, train and equip 200 volunteers for the proposed state defense force. That’s far short of the estimated need to double the number of Florida National Guard members. In November state senators Tom Wright and Harrell introduced Senate memorial 826 in a pitch to get the federal government to get more National Guard servicemembers in Florida. Wright and Harrell are the chairman and vice chairwoman of the Senate Committee on Military and Veterans Affairs, Space, and Domestic Security. The Republicans’ districts are on the Veteran Voice coverage area’s northern and southern ends. Wright represents parts of Volusia and Brevard counties. Harrell represents St. Lucie and Martin counties. The companion is House memorial 505. Among its co-introducers are representatives Dana Trabulsy, Port St. Lucie. The annual 60-day legislative session starts on Jan. 11. The last day is March 11, unless the session is extended. Under the Florida Constitution legislators need only adopt a budget to declare their work done for the year and head home.

“A measure addressed to an executive agency or another legislative body, usually Congress, which expresses the consensus of the Florida Legislature or urges that certain action be taken on a matter within the jurisdiction of the agency or body to which it is addressed.” The glossary further explains: “When both houses adopt the measure, the memorial is signed by the legislative officers and transmitted to the Secretary of State for presentation to the addressee. A memorial is not subject to the approval or veto powers of the Governor, is not subject to constitutional title requirements, and does not have the effect of law.” Harrell explained in a telephone interview: “What (a memorial) says to Congress is you need to act. You need to change the law or put money or resources into a state.”

SM 826/HM 505 The Senate and House memorials 826 and 505 are addressed for dispatch to the president, the President of the Senate, the Speaker of the House, and to each member of the Florida congressional delegation. They urge: “…the United States Congress to impel the United States National Guard Bureau to examine the resource allocations of the Florida National Guard and allow an increase in its force structure.” The memorials, which if both are passed would be combined into one, cite the April 2021 National Guard Bureau report, “Impact of the U.S. Population Trends on National Guard Force Structure.” That report found California, Texas and Florida — the three largest states by population — have the three lowest Guardmembers-to-civilians ratios in the nation. Florida ranks next to the bottom with one Guard member for about every 1,830 residents.

What’s a “memorial?”

can War exposed problems for a nation undertaking its first global war against a European power. The bureau’s role has adapted and grown over time as the role of the National Guard has adapted and grown. Today it’s a joint bureau of the departments of Air Force and Army. For about the last decade the Chief of the National Guard Bureau has been a member of the Joint Chiefs of Staff. In October Florida’s adjutant general, Eifert, told the State Senate’s military affairs committee there are 2.15 million members of the military. “A portion of that, 450-ish thousand is in the National Guard,” the general said. “So, that’s the slice of that federal, of that overall, pie that belongs to the National Guard. That 450,000 are allocated to the 54 states and territories by the National Guard Bureau.”

Florida State Guard After the introductions of the Florida House and Senate memorials 826 and 505, Gov. Ron DeSantis announced a proposal to revive the 1940s Florida State Guard. “So, I’m going to be recommending in the (state’s 20222023) budget $3.5 million to re-establish the Florida State Guard,” he said at a Dec. 2 press conference. “The Flor-

ida State Guard will act as a civilian volunteer force that’ll have the ability to assist the National Guard in state-specific emergencies.” The governor laid out a seemingly modest plan for a revived Florida State Guard. “This funding will support the necessary training, equipment and other support functions for up to 200 members who can aid in the response to hurricanes, natural disasters and other state emergencies,” the governor said. The $3.5 million is part of a proposed package of $107.2 million in military spending that seems aimed, at least in part, to convince the bureau the state is serious about and will do its part for increasing the size of the Florida National Guard. The biggest part is $87.5 million to expand the readiness center in Miramar, and to establish three new armories — with room for 1,500 Guard members among them — in Homestead, Gainesville and Malabar. The Guard has 128 units, about 900 buildings and 82,000 acres across 55 communities.

Sen. Harrell Eifert has been warning the Florida Legislature the state’s way short on National Guard members since 2019, shortly after he took the reins. Harrell said she’s taken it seriously. “We have no power in the state to increase the National Guard,” Harrell said in an interview before the governor’s announcement. “That’s a federal responsibility.” Veteran Voice reached out to Harrell after the governor announced plans to reconstitute the Florida State Guard. “We have not discussed it in (the military affairs committee),” she said. The state senator continued, “I think it might be a good idea. We need to do some hearings on it. The concept sounds very interesting to me.” But, she said, Florida still needs more National Guard, so Senate and House memorials 826 and 505 are likely to move forward. At press time neither has had or been scheduled for committee hearings.

Ceremony at Cape Canaveral National Cemetery honors 24 Veterans, 2 Spouses' cremains previously unclaimed To the Editor: On December 1, 2021, under beautiful fall skies, per current VA protocol, a closed Missing In Action Program Call to Honor #28 was held at the Cape Canaveral National Cemetery (CCNC) located in Scottsmoor. The solemn ceremony honored 24 Veterans and 2 spouses, who were recognized one by one and placed in a niche. The cremated remains of these Veterans went unclaimed for an average of more than two decades. One remained in a funeral home storage vault for five decades. Many of the Veterans served our country in times of conflict, with 18 having served in World War II and two being sent into WWII, Korea, and Vietnam. Special thanks to CCNC Director Mr. Kevin Ridgeway, and the great CCNC staff for supporting a beautiful ceremony and making sure each Veteran and spouse is now laid to rest with dignity and honor. Active-duty personnel from local units of all branches of service and some Veteran organizations supported the ceremony, along with MIAP volunteers led by Kathy Church, Florida State MIAP Coordinator. Difficult to accept, the reality is that funeral homes, Medical Examiners Offices, hospitals, and other private locations across the country are caretakers

of unclaimed cremains. The Missing in America Project is a nationwide, nonprofit, 501c 3 volunteer organization. The purpose of the MIA Project is to locate, identify and inter the unclaimed cremated remains of American Veterans through the joint efforts of private, state, and federal organizations. To provide honor and respect to those who have served this country by securing a final resting place for these forgotten heroes. MIAP was founded in 2006 and operates in many states. CUPPA TEA, ANYONE?

Before they became Americans, colonists in the New World loved their drinks. Especially booze and tea. (Later, coffee as well.) But not plain water. They contracted nasty diseases from it, like typhoid, cholera and dysentery, which is why they drank so much beer, wine and spirits. And tea — they didn’t make the connection then between boiling water and drinking it safely, but tea gave everyone a nice pick-me-up without becoming intoxicated. Drinking tea was part of everyone’s DNA. So when the mother country of most colonists, England, slapped a tax on tea, it was absolutely one of the last straws before heading into Revolution. Throwing a “party” about it was a signal loud and clear that England’s hold over the colonies was by then a house of cards, and a clear sign to be prepared for the worst.

Background Known as the Tea Act in British Parliament, it was a bill designed to save the faltering East India Company by greatly lowering its tea tax and giving it a near monopoly on the American tea trade. The low tax allowed the East India Company to undercut even tea smuggled into America by Dutch traders, and many colonists viewed the act as yet another example of taxation tyranny on top of years of others before. The reason England taxed the colonists so heavily was because of near-crushing debts incurred by the Seven Years War (1756-1763) with France. Though they succeeded in kicking the French out of the colonies, there was always the real possibility they, or other enemies like Indians from hostile tribes, would attack again. A strong military presence must be maintained. According to thoughtco.com: “During the war, huge sums of British currency had flooded into the colonies, and many not killed in the war, or

in conflicts with natives, had done rather well. It appeared to the British government that a few new taxes to pay for their garrison should be easily absorbed. Indeed, they had to be absorbed, because there simply didn’t seem to be any other way of paying for the army. Few in Britain expected the colonists to have protection and not pay for it themselves.” So, along came the taxes, each a bigger hardship than the last.

Taxation without representation First came the Sugar Act of 1764, which Parliament placed on the colonial molasses industry, which was one of the main source of income for many. In the newsbills of the day, colonists angrily pointed out that this tax was being levied without any expansion of the right to vote in Parliament. And then, the Currency Act of 1764 gave Britain total control of the currency in the 13 colonies. These taxes were followed in 1765 by the Stamp Tax, which was a charge applied to every piece of paper used in the legal system and in the media. Every newspaper,

every bill or court paper, had to be stamped, and this was charged for, as were dice and playing cards. Outrage ensued, and Patrick rose to fame with fiery speeches in the Virginia House of Burgesses. Mob violence sought the customs offices, and the spirit of rebellion was well and truly awakened.

The Tea Party When three tea ships, the Dartmouth, the Eleanor and the Beaver, arrived in Boston Harbor in 1773, the colonists demanded that the tea be returned to England. After Massachusetts Governor Thomas Hutchinson refused, Patriot leader Samuel Adams organized the “tea party” with about 60 members of the Sons of Liberty, his underground resistance group, of which Paul Revere was a member. Disguised as Indians, the group rowed in small boats out to the cargo ships anchored in Boston Harbor, climbed aboard and dumped 90,000 pounds of tea into the harbor’s waters. The British tea dumped in Boston Harbor on the night of Dec. 16 was valued at some 18,000 pounds, nearly $2 million in today’s money. They

were roundly cheered by onlookers on the shore. Parliament, outraged by the blatant destruction of British property, enacted the Coercive Acts, also known as the Intolerable Acts, in 1774. The Coercive Acts closed Boston to merchant shipping, established formal British military rule in Massachusetts, made British officials immune to criminal prosecution in America, and required colonists to quarter British troops. If you read the Declaration of Independence, these actions and others were listed one by one. The colonists subsequently called the first Continental Congress to consider a united American resistance to the British. The result of British taxation was a new voice and consciousness among the American colonies. This had been emerging during the French-Indian War, but now issues of representation, taxation and liberty began to take center stage. There were fears that England intended to enslave them. On their part, the British now had an empire in America which was proving expensive to run and difficult to control. These challenges would eventually lead to the Revolutionary War.

Many people have a difficult time in finding an effective mental health counselor that will help them get their life back on track. The key is to find someone that you can trust in discussing your anxieties and depression. With this in mind, here are seven suggestions on how to find a great mental health counselor that works for you. 1. Talk to your doctor or primary care physician: Your medical or family doctor is a great source in finding a therapist. Explain to your doctor your problems, and he or she can point you in the right direction in seeking the proper treatment. Your primary care physician may even know of some low-cost services that you can use to your advantage. 2. Go to your local hospital: Your local hospital is another source you can use to find a good counselor, and they also know of many different mental

Stan Popovich health programs in your area. Your emergency center can also handle your situation right away if you are struggling with fear and anxiety. This is just one example of the importance of getting mental health assistance in your life. 3. Ask your friends and relatives for advice: Use your network of friends and relatives to see if they know of any reputable counselors that are nearby. Many churches and

4. Join a local mental health support group: Go to a support group in your area and ask if anyone knows of a therapist that can help you with your mental health issues. Many people who are active in these groups will be able to give you some names of people in the area that can help you out. In addition, the people in these groups will be able to relate to your situation. 5. Find a counselor that you can work with: When asking for a therapist, always ask for someone who has a good reputation. Remember that finding a counselor to help you depends on how you interact with them and how they interact with you. It may take a couple of times to find the right person, but do not give up. Finding the right person will pay off for you in the long run. 6. Measure your progress: The key components of having an effective therapist is affordability, the ability to effectively talk to your counselor, and how effective they are in finding the answers to your current problems. Remember that your main goal is to find the answers that will help get rid of

your mental health issues. 7. Do what is best for you: Choose a mental health professional that you feel comfortable talking to and then go from there. You can always change counselors down the road, so don’t pressure yourself if things don’t work out. If you do not see any improvement in your mental health after a couple of months, you may want to find someone else who can help reduce your fears, anxieties, and depression. State Senate takes up Veterans suicide ‘MEMORIAL’ PROTOCOL URGES LEGISLATIVE ACTION ON ‘MISSION CRITICAL’ ISSUE Patrick McCallister FOR VETERAN VOICE

The Florida Senate’s Committee on Military and Veterans Affairs, Space, and Domestic Security gave unanimous nod to urging the federal government to keep its promises. More precisely, the committee passed Senate Memorial 302: Recognizing Veteran Suicide for the Florida Legislature to consider during the 2022 session starting in January. “This memorial urges the United States Congress to recognize the current crisis of Veteran suicide and fully fund any prevention efforts that are undertaken through the (Department of Veteran Affairs),” said Sen. Danny Burgess, the memorial’s sponsor. The committee met for a pre-session hearing on Nov. 30.

What’s a “memorial?” In legislative parlance, a memorial is the Florida Legislature urging action. The Florida Senate’s glossary defines a “memorial” as: “A measure addressed to an executive agency or another legislative body, usually Congress, which expresses the consensus of the Florida Legislature or urges that certain action be taken on a matter within the jurisdiction of the agency or body to which it is addressed.” The glossary further explains: “When both houses adopt the measure, the memorial is signed by the legislative officers and transmitted to the Secretary of State for presentation to the addressee. A memorial is not subject to the approval or veto powers of the Governor, is not subject to constitutional title requirements, and does not have the effect of law.” Burgess, who represents the Zephyr Hills area, told his fellow committee members, “Copies of this memorial if passed would be sent to the President of the United States, the President of the Senate, Speaker of the House, and to each member of the Florida delegation of the U.S. Con-

gress. This memorial is a formal mechanism for petitioning our federal government to act on (the) matter of Veteran suicide.” Burgess is also a member of the Army Reserve.

SM 302 text The memorial reads: “WHEREAS, according to the 2020 National Veteran Suicide Prevention Annual Report published by the United States Department of Veterans Affairs, there was an average of 17.6 Veteran suicides per day in 2018, totaling 6,435 Veteran suicides that year, and “WHEREAS, the department has found that Veterans who die by suicide are more likely than the civilian population to have experienced sleep disorders, chronic pain, or traumatic brain injuries or to have received diagnoses of mental health conditions such as posttraumatic stress disorder, bipolar disorder, personality disorder, substance use disorder, schizophrenia, depression, and anxiety, and “WHEREAS, some Veterans have reported difficulty in transitioning to civilian employment, as their highly developed skills obtained during military service may not translate to higher level

civilian jobs, and the resulting economic struggles, which may include unemployment, poverty, and homelessness, are shown to be risk factors for Veteran suicide, and “WHEREAS, the United States Department of Veterans Affairs’ Veteran Crisis Line is the world’s largest provider of crisis call, text, and chat services for Veterans, receiving approximately 650,000 calls per year, and “WHEREAS, the department has made significant progress in the area of suicide prevention through clinical research, the development and testing of evidence-based psychotherapy methods and medications, and behavioral, complementary, and alternative approaches to treating Veterans with posttraumatic stress disorder and other mental health conditions, and “WHEREAS, the department is partnered with hundreds of national and local organizations and corporations, including Veterans service organizations, professional sports teams, and major employers, in order to raise awareness of its suicide prevention resources and to educate the public about supporting Veterans and servicemembers in their communities, and “WHEREAS, although RAND Corporation studies have found that the United States

islature to do whatever it needed to revive the Florida State Guard. But, reading the Florida statutes, it’s looking like DeSantis may not need anything from the legislature besides approval of the $3.5 million. The 1941 F.S. Title XVII, Chapter 251 — which doesn’t appear to be repealed in part or whole — spells out everything about the Florida State Defense Force, with the shorthand being the Florida State Guard. It appears to give the governor the power to re-establish Florida State Guard units without legislative action besides appropriations. First, there’s 251.02. “The Governor is authorized to maintain a Florida State Defense Force reserve cadre of officers and noncommissioned officers, said officers to be a trained nucleus for such time as the Florida State Defense Force may be activated. Said officers shall be volunteers and shall serve with no pay or allowances except when called to active duty.” DeSantis is talking about 200 Florida State Guard members, which could be well within this provision. When the Florida State Guard disbanded after World War II it had about 2,000 members. There’s a second provision that appears to let the current governor revitalize the Florida State Defense Force without the legislature. The Florida Legislature in 1941 crafted the State Defense Force to be self-terminating, which happened in 1947. But, there’s a lurking variable. The law reads— “Discharge of Florida State Defense Force. — The Florida State Defense Force shall be discharged by the Governor upon the return of the National Guard to state control, or within 30 days thereafter, subject however to the provision of s. 251.01(2).” At present Florida National Guard members have been and are in federal service pretty much since the Sept. 11, 2001, terrorist attacks. At press time about 1,500 are, according to DeSantis at a Dec. 3 press conference. He said since September of 2001 about 25,000 Florida Guard members have been in federal

service. Eifert recently told the Florida Senate — “Back in the ‘90s we were really what we had always been, and that was a strategic reserve called up in case of a significant world war. Ever since then, though, ever since the early (part of) 2001, our Guard has become an operational reserve, not a strategic reserve. What that means is we’re constantly deploying soldiers and airmen to meet our federal responsibilities. As the size of the military is drawing down and our task seems to not decrease, the reliance on the National Guard and reserves has significantly increased.” I’m not a lawyer, but my journalist’s reading of the law suggests given the now perpetual federal deployments of the Florida Guard the governor has space aplenty to reconstitute the Florida State Guard with 200 members, and possibly expand that to more.

U.S. Code Title 32, Section 109 A revitalized Florida State Defense Force would be federally governed under U.S. Code Title 32, Section 109. There are 22 states and one territory, Puerto Rico, with state defense forces under this law. Among them they have about 14,000 state servicemembers. Their primary role is disaster response. A reconstituted Florida State Guard — assuming Chapter 251 as written — would be under the Florida Department of Military Affairs, and under

the command of the state’s adjutant general. That’s Eifert. When the state guard members are called up, they’d be subject to the Uniform Code of Military Justice as it’s applicable to members of the Florida National Guard. Under the current law, “The oath to be taken by officers commissioned in such Florida State Defense Force shall be substantially in the form prescribed for officers of the National Guard, substituting the words ‘Florida State Defense Force’ where necessary, and omitting the reference to the President of the United States.” Under U.S.C. 32, the National Guard oath is, “I, ________________, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States and of the State of Florida

and alternative therapies to help Veterans in crisis. “We’ve really come a long way in the state, (and) should continue to set the example by, hopefully, setting the national standard,” Burgess said. “That’s what we’re seeking to try to push, because this is certainly a crisis. (Death by suicide among Veterans) something that is far and above more than what we see in the civilian population, so we need to do something about it. That’s the signal we’re sending.” Sen. Victor Torres, who represents Osceola County, said passing the memorial onto the full legislature was a given. “As a committee we should all sign onto this memorial thing right off the bat, man,” he said. “I mean, that’s it. That’s 100 percent. That’s what we need to do.” Sen. Gayle Harrell, who represents Martin and St. Lucie counties, agreed. “I think this is the next step to make sure the federal government steps up to the plate as well,” she said. “And I would suggest that once the memorial is passed, that each one of us send the letter to our congressmen re-

They also “shall not be required to serve outside the boundaries of this state” unless they’re in “fresh pursuit” of insurrectionists, saboteurs, enemies, or enemy forces. Also, only individuals, not groups, could join a reconstituted Florida State Guard. Membership wouldn’t exempt one from obligations to the U.S. military, such as a Selective Service callup.

Burgess closed the memorial’s committee hearing before the vote. “This is mission critical,” he said. “I think the timing on this absolutely important. We just had Veterans Day, and the reality is this is a bit of a different feeling Veterans Day than most in that it’s our first Veterans Day since the withdraw from Afghanistan. And a lot of servicemembers who were in that conflict over the last 20 years are suffering, are struggling incredibly with the impacts of that. And certainly that’s not a unique experience to some of our American servicemembers. Our Vietnam-era felt the same thing, and the amazing part of this is seeing them step up to the plate to help our eras today.” The memorial has no more committee stops before going to the full Senate. The companion bill, H 63 is, at press time, on the agenda for the Florida House’s Local Administration & Veterans Affairs Subcommittee. It has one more committee stop at State Affairs before going to the full House.
