CRÍTICA AL TRATAMIENTO DE LOS CRÉDITOS POR DEUDAS DE ALIMENTOS O COMPENSACIÓN ECONÓMICA EN EL PROCEDIMIENTO CONCURSAL DE LA PERSONA DEUDORA CRITICAL TO THE TREATMENT OF CREDITS FOR FOOD DEBTS OR ECONOMIC COMPENSATION IN THE DEBTOR PERSON’S COMPETITION PROCEDURE Miguel Ángel Alarcón Cañuta* Universidad Arturo Prat, Sede Victoria Chile Resumen: La consagración de la institución de las personas relacionadas con el deudor persona natural concursada tiene importantes efectos que repercuten de manera significativa en los intereses de cierto tipo de acreedores, como son aquellos a quienes, siendo beneficiarios de una prestación alimenticia o por concepto de compensación económica, se les adeuda un saldo desde antes del inicio del procedimiento concursal de renegociación o liquidación. El estudio del tratamiento que el derecho concursal actual tiene para con los créditos por alimentos o compensación económica de ciertas personas relacionadas al deudor persona natural, nos permitirá plasmar la inconformidad de esta regulación con el respeto de sus intereses desde el punto de vista del respeto de ciertos principios del derecho de familia, manifestada en un trato desfavorable y en muchos casos perjudicial.
Abstract: The enshrinement of the insiders with regard to the natural person debtor has important effects on the interests of certain creditors, such as those who are beneficiaries of alimony or of an economic compensation, that they are owed since before the beginning of bankruptcy proceedings of liquidation or renegotiation. The study of the treatment that the current bankruptcy law has for alimony or economic compensation credits of certain insiders with the natural person debtor, allow us to provide account of the dissatisfaction of this regulation with respect of their interests from the point of view of respect of certain principles of family law, manifested in unfavorable treatment and in many cases harmful.
