Drugs, chemicals and alcohol – the unauthorized possession or use of controlled substances to include illegal substances and prescribed substances (examples: Ritalin, Adderall, Dexedrine, Valium, etc.) or to appear under the influence of drugs, chemicals or alcohol. Possession of drug paraphernalia or non-controlled substances that are represented to be an illegal substance.

Arson – the willful and malicious burning or attempting to burn any part of school board property • 1st Offense – up to 10 days OSS pending referral to Tribunal Hearing • 2nd Offense – Recommend expulsion • 3rd Offense – recommend permanent expulsion

Robbery (Strong Armed) – the taking of money or other property from the person or custody of another by force, violence, assault or instilling the fear of it. Restitution will be made before returning to school.

Criminal Mischief – intentional and deliberate action resulting in injury or damages of $100 or more to public property or the real or personal property of a school board employee. Restitution must be made before the student returns to school.

Sexual Misconduct – Acts of a serious sexual mature including, but not limited to battery, intercourse, attempted rape, rape or indecent exposure

Inciting or participating in a major student disorder and/or refusing to disperse; leading, encouraging and assisting in disruptions which result in destruction or damage of private or public property; personal injury to participants or others during any schoolsponsored activity

Major threat to the safety of school bus passengers or driver

Battery/Fighting – defined as hitting another student. In addition to the stated school consequences, upon the 2nd offense, the student will be referred to the SRO for potential further action

Bullying – Georgia law mandates that upon a finding by a disciplinary tribunal or hearing officer that a student in grades 6-12 has committed the offense of bullying for the 3rd time in a school year, the student shall be assigned to an Alternative school

Class IV: Serious Major Offenses – Grades 6-12

LAW ENFORCEMENT WILL BE NOTIFIED FOR ALL CLASS IV VIOLATIONS. STUDENT WILL BE SUSPENDED FROM SCHOOL PENDING AN EXPULSION HEARING.

Any student expelled from TCPS must meet the following criteria to be considered for readmission: 1. The student must be eligible to apply for readmission. 2. The student must petition the Superintendent and Board of Education for a hearing. Return to school shall necessitate a recommendation for readmission from the Superintendent to the Board for approval. 3. If approved by the Board, the student will be admitted to the Alternative School, where he/she must successfully complete one year before returning to the regular school.

Where applicable, a person may not be readmitted to TCPS until criminal charges or offenses arising from the conduct, if any, have been disposed of by the authorities, and all other requirements imposed by the board as a condition for readmission have been met.

The degree of discipline imposed will be in accordance with the progressive discipline process unless otherwise stated.

OFFENSE CATEGORIES

Battery upon Staff and Board Employees – the unlawful striking of a staff member or board employee, or the intentional causing of bodily harm to a staff member or board employee. All attacks or incidents shall be reported to the Superintendent within 72 hours.

Possession of a firearm – a firearm is any weapon (as defined in Section 921 of Title 18 of the United States Code0, which will be designed to or may be converted to expel a projectile by the action of an explosive, the frame or receiver of any such weapon, the muffler or silencer of a firearm or any other destructive device, including a starter pistol, tear-gas gun or air gun.

Discharge of a firearm – discharging of any pistol, rifle, shotgun, air gun, teargas gun, etc.

Explosive – Possessing, preparing or igniting explosives containing a propellant charge of more than 4 ounces of an explosive or incendiary charge of more than one-quarter ounce on school board property

Burglary of school property – entering or remaining in a structure when the premises are closed to the public with the intent to commit a crime.

Aggravated Battery – Intentionally causing great bodily harm, disability or permanent disfigurement

GENERAL INFORMATION

ASBESTOS NOTIFICATION

The Federal Asbestos Hazard Emergency Response Act (AHERA) allows an exclusion from the required inspection for asbestos-containing building material (ACBM) for new school buildings built after October 12, 1988, where: an architect or project engineer responsible for the construction of the new school building, or an accredited AHERA inspector signs a statement that no ACBM was specified as a building material in any construction document for the building, or to the best of his or her knowledge no ACBM was used as a building material in the building. The LEA shall submit a copy of the signed statement to the state and shall include the statement in the management plan for that school. This statement notifies you that the required information has been submitted to the state and a copy is on file in the school’s management plan, which is located in the school’s administrative office and is available for public inspection upon reasonable notice.

INTERNET USAGE

Twiggs County Public Schools has a computer network, including Internet access, accessible by students, teachers and staff. All students will sign a user contract and parents will sign a parental consent form before students are given access to the Internet. The Internet is an educational tool to be used only for educational objectives. All users are fully responsible for their own actions: legal, financial, or otherwise. Any student seeking access to inappropriate materials on the Internet should immediately notify the classroom teacher or media specialist, who will report the location of the information to the system administrator. Any student violating the Internet User Contract will automatically be assigned 3 days ISS and run the risk of losing all computer privileges. Because of the extensive use of technology at Twiggs County Middle/High School, we must follow the Internet contract closely. Students involved in Internet bullying may lose all technology privileges at Twiggs County Middle/High School depending on the severity of the event and if the event occurs more than once.

SOCIAL SECURITY NUMBERS

Students are to provide a Social Security number OR sign a waiver declining to give the number, which will be placed in the student’s permanent record folder.

DRIVER’S LICENSE REQUIREMENTS (Teen/Adult Drivers Responsibility Act-

TAADRA) All 15, 16 and 17-year-old students who intend to apply for a Georgia Learner’s Permit or Driver’s License must present to the Department of Driver Services a signed and notarized certificate of attendance from their school. The student will need two certificates of attendance during their school career: one for the Georgia Learner’s Permit and another for the driver’s license. These may be obtained from the school guidance counselor. The certificates are notarized, dated and valid for one month.

The Georgia Department of Driver Services may deny an application for, in compliance with OCGA 40-5-22, an instruction permit or driver’s license of any driver if a student is not enrolled or is under expulsion. Twiggs County Middle School students are not allowed to drive onto

campus, regardless of age and/or licensure.
