The Sealy City Council decided in a 4-3 vote Oct. 27 to go against popular public opinion regarding the Interstate 10 frontage road project and move forward with an appeal through the Texas Court of Appeals following a ruling by 155th District Court Judge Jeff Steinhauser. The ruling granted a temporary injunction in favor of the plaintiff, Town Park Center and developer David Cryan, ordering the City of Sealy to follow through with a contractual agreement to jointly fund an I-10 frontage road project

with the developer. By court order, city leaders had 10 days to make payment to the Texas Department of Transportation for the road. Now, with an appeal process set to take place, the 10-day window will no longer apply. The agreement signed in 2011 by the developer and city leaders affixed a 50-50 split in fees to the state. The city and developer have already committed $2,135,000 to the project, and an additional $1,574,770 is still due, a city and developer cost split. The project has been in the planning stages for years and payment to TxDOT was due Oct. 29. When it first began,

costs for development were estimated at $2 million but the passage of time inflated it to over $4 million. That increase put the city on the line for an extra $324,000. City manager Larry Kuciemba issued an announcement on Oct. 26 that TxDOT is prepared to take over the frontage road project as part of a major highway expansion from Brookshire past FM 3538 and reimburse $2,135,000 to the city and developer. Kuciemba received an email from Paul Reitz, director of Transportation Planning and Development for TxDOT, who said the I-10 project sits atop of their to-do list and should

begin within two years. Prior to the meeting, at least 50 Sealy citizens gathered in front of W.E. Hill Community Center – where the meeting had been moved – to rally support for the project, and convince council members to abide by their arrangements with the developer. A petition was passed around to those at the rally asking for signatures supporting the project. Business leaders and city and county officials bunched into Saddleback Saloon downtown Saturday, Oct. 31, as local dignitaries pranced about the bar in brassieres to raise money for the Bras for a Cause event hosted by The Sealy News, Saddleback Saloon and Sealy Main Street. Custom bras designed by community members were auctioned off to benefit the Methodist Hospital in Katy. People broke their banks for Halloween homage, pearl- and rose-lined, and floral island inspired decadent pushups recognizing the continued fight against breast cancer.

Many local leaders made cameos. Others like Mayor Mark Stolarski and Commissioner Reese Turner, trounced about the stage repeatedly to show their support. Turner scampered about in his silver 4-inch stilettos effortlessly with a hot pink boa draped around his neck. In all, the event had a huge turnout and garnered approximately $1,600. On Monday, Dec. 7, the Austin County Sheriff’s Office received a report of a burglary of a habitation and a robbery that occurred on Mixville Road in Sealy. The suspects left the location in a black Cadillac Escalade. On Wednesday, Dec. 9, the sheriff’s office arrested Jose Alejandro Barrera, 31, of Brookshire in Waller County on warrants for burglary and robbery out of Austin County. Barrera was placed into the Waller County Jail and later transferred to

the Austin County Jail. Barrera was charged with burglary of a habitation, felony II and robbery, felony II, with a total bond of $150,000. Sheriff Jack Brandes said his investigator did an outstanding job of obtaining evidence and apprehending the suspect in short period of time. “This sends a message to those who continue to engage in illegal activities that we will arrest them and put them in jail where they belong,” Brandes said.

GRANDJURY The Austin County Grand Jury returned indictments against eight individuals during its December term. Those indicted include: Joe Anthony Acosta, 24, evading arrest detained with vehicle. George Aguinaga, 31, evading arrest detained with vehicle. Joseph Frank Davidek, 44, driving

while intoxicated with three or more convictions. Shawn Carl Gaitan, 37, possession of a controlled substance, penalty grade one, greater than or equal to one gram but less than four grams. Herman Thomas Livingston, 24, burglary of vehicles with two or more previous convic-

tions. Luis Angel Sanchez, 29, driving while intoxicated with three or more convictions. Jessie Turner, 41, theft of property, greater than or equal to $2,500 but less than $30,000. Kevin Lee White, 41, driving while intoxicated with three or more convictions.
