W

e seem to have followed the general feelings regarding the Auckland property market in this issue with three articles

on this topic. Very interesting! An even spread of great articles as well as a repeat of the horrible Catch 22 situation which effects at least 90% of all new immigrants. People are still being stopped by customs at airport before they get on their flights, even in Dubai, Hong Kong and Australia, and sent back home. Why is this happening? I cannot answer that question as it is legal to do a ‘look see’ in New Zealand. People are allowed to visit and see if you could live here and if there are jobs that would suit your skills, but customs are still stopping and questioning many South Africans about their purpose for visiting New Zealand. Depending on your answers, this will get you a pass or not. Last year 94 South Africans were refused entry and sent back home or were refused entry to New Zealand. This is tough for those concerned and could be their last chance as the South African Rand is so weak against the New Zealand dollar and many might not be able to take the chance again, financially. We will be conducting free immigration seminars in South Africa during August/September 2016 and will, once again, visit Johannesburg, Durban, Cape Town and Port Elizabeth. LEGAL UPDATE: EMPLOYMENT LAW

A constant bug-bear for employers: poor performance and demotivated employees. What to do. Our in-house employment law specialist, Eska Hartdegen, discusses the legalities and ways of dealing with underperforming employees

E

mployers frequently are confronted with a poorperforming employee and having to ask themselves the question what can be done about it. Such an employee can cause disharmony in their team, with others frequently having to take over and rectify their mistakes. A report done by Robert Half International in 2013 stated that managers spend 17% of their time dealing with poor performers. It can be difficult, particularly in small businesses, to resort to using a formal process with an employee, however not addressing an employee’s underperformance can result in the demotivation and loss of morale within a whole group or team and may affect productivity overall. Employers are obligated to Eska Hartdegen deal in good faith with problems they have with their employees. This means taking action sooner rather than later and providing an employee with a real opportunity to improve their performance. As long as a carefully planned and monitored process is followed, even where dismissal is the inevitable end result, it should not lead to further repercussions for the employer. Tackling the performance of an employee can be daunting for employers. If not done correctly, it can result in disadvantage to the employee and lead to a personal grievance claim against the company for compensatory remedies. The process to be followed must involve disciplinary action where warranted, in tandem with an opportunity to improve. The first step in the process is to identify specific shortfalls and expectations, and to document them. The employee must be invited to a meeting on notice, must be advised of their right to bring a support person or representative to the meeting, and must be given a fair opportunity to respond to the issues. After consideration of the employee’s response, a decision as to whether to place the employee on a Performance Improvement Process (PIP) must be made. If that is decided on, a first warning should also be issued. At this point a timeframe for the overall process should be set; usually for salaried staff this would be over a period of around three months. Dates for monthly review meetings must be set, and before each further meeting the issues to be discussed and responded to- will need to be provided to the employee. Guidance and support will have to be provided to the employee throughout the process and whether additional training or coaching could assist an employee should be considered as well and provided if needed. unsatisfactory performance should result in the issuing of further warnings. In theory, a process involving four meetings where the employee fails to show adequate improvement through the process would usually result in dismissal at the conclusion of the last meeting. Where some improvement occurred during the process, the employee may by its conclusion only be on a second or final warning. This nevertheless allows for further disciplinary action to be taken were the employee’s performance to dip again in the future. Throughout, the employer must keep in mind that an employee is entitled to natural justice. That means being dealt with fairly by an unbiased evaluator, and having the right to respond to issues raised throughout the process. The purpose of a PIP is to improve performance. Following a good process and a well-planned PIP may ultimately bear positive results for an employer and may in fact remedy the problem. An employee who is given positive feedback and encouragement, and who improves through a PIP may well end up being a more engaged team player in the end result; thus management time and energy well spent! It may be worthwhile to consider whether the company itself may be fostering poor performance, as prevention always will be much easier than cure. It also is much cheaper. This may require a review of recruitment and hiring practices, better interviewing, more detailed job descriptions and better induction, orientation and training at the outset for employees. A good starting point for employers: get the necessary assistance and take legal advice about strategies for dealing with improving performance!

Afraid of the dentist? By Sandra Bekker East Coast Bays Dental

D

oes the thought of going to the dentist give you sleepless nights and send you into a panic? You are definitely not alone with some studies estimating around 1 in 10 adults suffer from a strong fear of the dentist. This fear causes people to avoid going to the dentist unless they absolutely have to and by then they usually need extensive dental work.

Then there is the fear of choking or gagging. This can be due to psychological, or physiological factors, or a combination of both. It can also be a physical manifestation of panic related to the notion that it may not be possible to breath during the procedure. Some people have such a sensitive gag reflex that they even struggle to brush their own teeth!

Where does this fear come from? It is important to try and identify what the root of this fear is, in order for the issue to be addressed.

So where to from here? Top tips for reducing fear in the dentist chair:

There are many reasons way people may be afraid of the dentist, but the main one is due to previous bad experiences as a child or even an adult. The interesting thing is that this fear is more prevalent if the dentist was perceived as uncaring and cold whereas in a situation where the dentist was perceived as kind and caring, even in painful situation, dental fear failed to develop. Another reason for anxiety is being afraid of a possible painful procedure or painful injection. This is also linked to painful experiences suffered in the past. Fear of the drill is also quite common and just thinking of the sound can make someone nervous! People may associate this noise with pain and it is very difficult to unlearn this association. Sometimes people with a dental phobia also have feelings of embarrassment, shame or guilt about the condition of their teeth. This can turn into a vicious cycle of avoiding the dentist with subsequent deterioration of the dentition and even worse feelings of ‘I have the worst teeth in the world’.

1. Find a dentist you feel comfortable with. 2. Talk to your dentist about your fears and expectations as this will help the dentist address and manage those fears. This will also make you feel more in control of the situation. 3. Some people also find it helps knowing every step in detail whereas others feel less anxious if they do not know what is happening next. 4. Try to breathe deeply and relax as much as possible. Sometimes listening to some music can help to act as a distraction. 5. Making appointments first thing in the morning before the stresses of the day add up may also be of benefit. 6. Talk to the dentist about stopping if you're uncomfortable. An agreed upon "stop" signal can be used if you need to take a break. 7. Go for regular check-ups as this can avoid the need for extensive dental work. It also helps to establish a trusting relationship with your dentist. 8. Take it step by step. Start off with smaller procedures before tackling some more complicated and extensive work. 9. Bring a friend or family member with you to help you relax. For many people a trip to the dentist can cause a lot of anxiety, but acknowledging that dentistry has changed a lot over the years and communicating with your dentist can help reduce those fears to a huge extent.

ochelle Loretz arrived in New Zealand 8 years ago and lives on the North Shore in Auckland with her husband, Arno, and their 3 daughters who are all busy with their studies. Loretz completed her Business and Real Estate study recently.

She began sketching and painting 15 years ago and studied art for four years under the tutelage of Betzy Geldenhuys in South Africa. She has always loved expressing herself through her art and has her art studio at home. Loretz prefers painting in oils but recently

began using acrylics and enjoys painting landscapes, especially sea vistas. Her paintings also reflect her love of flowers, farms, animals and trees. Many of her works are ‘real life’ while others are in her imagination. When people look at her paintings, she wants them to be aware

of the colours, mood and their vast energy and ‘get’ that she finds inspiration from light, shadows, reflections and textures. hen I emigrated from South Africa 3 years ago my fervent passion for cetaceans intensified once I had gained more knowledge of the endemic Hector’s dolphins along with their subspecies of Maui’s dolphin and their struggle to survive amidst the ever changing world we live in.

New Zealand is unique and I think very special and fortunate to have their own species of these amazing creatures as well as a resident population of around 200 Orca which are also uniquely different to all other Orca populations. Orca are, in fact, the largest dolphin species, not whales at all, and because of the name we know them by ‘killer whales’ and are thought by many to be dangerous. There is, in fact, no recorded case of any of these animals attacking a human in the wild. While they look ferocious and are extremely efficient killing machines they hunt seal, rays and other fish species and are only interested in humans out of curiosity, as we are likewise curious about them.

Maui’s and Hectors dolphins are often called the ‘hobbits of the sea’ as they are one of the smallest marine species, weighing up to 50kg and have a maximum length of 1,4 meters. They have distinct black, grey and white markings with rounded dorsal fins, We live in the best country in the world in my opinion, and we need to like ‘Mickey Mouse ears’ so they are easily distinguishable from the keep that way with 14cm a healthy environment for all. 2ndit advt 1/4 page x 9cm more common species such as Bottlenose dolphins. Dangers to these animals and their future population growth are as fishing by-catch, entanglement in fishing nets and pollution, as well as the availability of food, as they are very localised and do

Coping with loss as an expat By Corrie Ekermans

Monday 28 April 2016 11:11am. It will always be a ‘where were you moment’ when you hear about the death of a loved one, more so as an expat. I was with friends when I received the devastating news that my precious Mom had passed away in SA, leaving me feeling helpless and lonely. Last year my parents were in NZ exploring this beautiful country we call home. Mom’s cancer was in remission but it came back with a vengeance in October. Fortunately, we were able to spend Christmas with her in SA and she was so frail and sick. A few days before her death I spoke to her and she was looking forward to visiting us and enjoying her favourite New Zealand pie. That was not to be. She died aged 58. Under normal circumstance coping with loss is hard but being an expat adds another level to the grieving process. We do not have family here and leant on our friends to support us through this difficult time. Not been able to attend Mom’s memorial service added extra heartache. Through this

process I have learned the following and by sharing it I hope to help other expats: • Built a solid support group around you. Remember your friends are your family in your new home country. • Expats play an important role in your life. Two of my expat colleagues, who dealt with the same experience of losing parents, were there for me and their hugs and the tears they shed with me meant the world to me. • Be prepared there may be reasons for your not being able to return to South Africa for a funeral - you may not have money, have a new job, don't have leave from work or your visa conditions may not allow it. • Remember New Zealand and South Africa are miles apart and it’s expensive to just hop on a plane for the long journey. • You need to say goodbye. Prepare your own goodbye and have a ceremony, no matter how big or small, to say goodbye to your loved one. Have your own way to

remember and celebrate your loved one. And last but not least, the emotional support I received from my Kiwi colleagues was amazing. Kiwis are a compassionate people and they have made this process a little easier for me to bear. And for that I am humbled.

risis? What Crisis? This was the name of Supertramp’s 1975 album with the cover of a guy sitting on a deck chair in his bathing costume under an umbrella surrounded by total chaos. Is this true of New Zealand’s housing market? Every day we are bombarded by the media regarding the housing crises and questions are asked why it’s not fixed yet and what’s the government doing about it when we see people sleeping in their cars and in garages. So why do we not just build more houses? To be realistic, it can take three to four years to buy development land, get the resource consent, readying all the underground civil work, connect to the council services and only then can individual houses be built. This also takes money and most builders cannot carry this infrastructure cost. Next you need someone to sell the sections and the houses, the building plans need to be consented to by the Councils and only then can the houses be built. This all takes time. We need manpower which we do not have so we need immigrants to build the houses. Is this a quick fix? No, it is not. Is the present government doing anything? Yes, they are trying. Working together with local councils, they are opening up areas for new developments and assisting with projects as seen in Whenuapai. There is no silver bullet. No-one had a crystal ball to see that in 2015 and 2016 in New Zealand today with Australians coming here to find work due to the mining industry being affected because of the drop in the commodity prices. Remember oil was at a high of $120 per barrel which went down to $40 The South African

Who would have thought three years ago that Kiwis living elsewhere in the world would come home to a safer environment where there are jobs and a great place to raise children? When I see the opposition Labour leader, Andrew Little, saying he will build 100,000 houses over the next ten years and in the same breath saying he will cut immigration numbers because they are creating the high prices experienced in Auckland, I’m shocked. As John Key said, “this is crazy”. Everyone has ideas but ideas need to be practical and achievable otherwise they are just dreams. I do believe that governments should provide houses for the poor and vulnerable. In saying that, Auckland’s beneficiaries have been offered a $5,000 incentive to move to the smaller towns where there is cheaper accommodation. My idea would be to create a ‘rent to buy’ system where a beneficiary pays rent for five years and that money taken as a deposit so they can buy their own home, under certain conditions: 1) Payments regular and paid on time 2) The houses must be maintained. This is one way to get into the housing market. In the early 1950s, the National government let state tenants buy their homes, offered state loans and subsidised the building industry to keep house prices down.

Property Statistics Currently 65% of the population are homeowners, and 35% renting or wanting to buy their first home. At its peak in 2004, 69% of the population owned their own homes. There are 310,000 people on the benefit. Housing New Zealand’s housing stock is 65,000 and another 2,300 are vacant due to outstanding repairs. With all the arguments about house prices, should we reduce the levels by 40% like economist Arthur Grimes has alluded to? That is crazy. Imagine all the hard working

Kiwis and others who have sacrificed to buy a house, paid their mortgages and rates diligently for years only to be told their properties will be worth 40% less so that new home buyers can afford to buy a house. This is also crazy. How many first home buyers are there? 1,000 or 10,000? If it’s 10,000 it means there are still 25% of the population who will always be tenants. Of which 310,000 are in state homes or rent from investors. The word investor has become a dirty word these days as the population has been led to believe they are the culprits increasing property prices. Nonsense! Most investors in residential property are the Mom and Pop Kiwis trying to secure their retirement. Yes, there is a big demand for houses. This is natural when we have had the largest number of immigrants in 30 years. However, if you do the property trajectory for the last 30 years you will see that property prices are on the button and where they should be. House prices double every 10 years. Why? During the GFC (Global Financial Crisis) this was a crisis, properties plateaued in value and there were no real property increases to talk of from 2008 to 2013. It has become a catch 22 situation with immigration numbers very strong as New Zealand needs the skills. Companies like Fletchers and Chorus are looking overseas to find enough staff to complete the contracts they have. The more people, the more houses we need. As I see it, this is a strong economy which should continue for at least 10 years unless we get another government in power who does not understand the economics. You cannot spend money you do not have. The USA has done this to their detriment.

e’ve all heard about Winter Blues. Seasonal Affective Disorder. Longer nights. Shorter days. Less sunshine and the long white cloud reminiscent of the Aetearoa long winter months. But... today I glimpse out to witness the glorious almost luminescent greens. The Magnolia buds are bursting. Promises of Pink. The Jasmine is cheekily bursting a few scented pinky blooms. There is always that delicious certainty of the emergence of spring.

Recently I agreed to participate in 30 Days of being Thankful. Instead of wanting to be the veritable grizzly bear hibernating for the next 30 days, I opted for July as my 30 day gratitude month. (Well, 31 actually). Since the 1st July, I've been grateful for the benevolent sunshine, after some ridiculously heavy downpours. I've been madly grateful for each new day and the guaranteed superlative vistas as I wake to another day. I've felt immense gratitude about being alive and robust in a wee coastal town on a wee island far off the beaten track. Away from troubled times. The road less travelled. A privilege in the age of people spilling over or displaced all over the show. I've enjoyed a magical drive up the winding snenic route to Coromandel town. Dreamily watched boats going by. Played ball with my water drenched poochy on a pebbly beach. Gathered ancient stones and pieces of driftwood, marvelling at the different shapes, textures and hues. Enjoyed a serious Kiwi coffee with my dearest spouse at a wharf side cafe. Chatted to my precious kids around the world on WhatsApp. Celebrated Maori Matariki (New Year) at the local Marae. Enjoyed a flavourful curry dinner out with Kiwi friends. Snuggled under the duvet with a good book...after a visit to our sunny town library. Cooked up an oxtail adding parsnips, turnip, leek, celery, broccoli, garlic, carrot and every other vegetable that shouted “pick me “at the green grocer. Paused on the pavement to enjoy the melody being strummed out by a busker in a comical hat. Listened to the sounds of laughter... The point about all this is how we can cheer others and ourselves up this winter! It's the small stuff. The South African

A cheerful text to a buddy. Helping an elderly person across the road. A thank you smile to the cashier. Getting involved in a community project for the less fortunate. Giving a grieving friend colourful flowers. Watching ducks crossing the road in single file. Sweeping winter leaves. Lighting a candle. Seeing the beauty reflected in the late afternoon sun. I was delighted to discover “Random Acts of Kindness” in our town. ‘Anon’ leaves affirmations on park benches in our town. It sends positive energy out there to cheer others up. When I chanced upon a shell with loving words painted on it, I felt warm and fuzzy. Grateful to be alive. Serendipitously Cherished. So, I'm off to post a few messages on benches today on a glorious wintry day, as part of my 30 (well 31) days of gratitude. That way the winter just may be Pinker instead of Blue.

New LVR Rules and their impact

On 19 July 2016, the Reserve Bank proposed changes to loan-to-value restrictions (LVRs) to reduce risks to financial stability arising from the current boom in house prices. Under the new rules, most home buyers will need a 20% deposit, and most property investors will need a 40% deposit when purchasing residential property. These rules will apply across New Zealand and not only to Auckland properties. In his announcement, Reserve Bank Governor Graeme Wheeler said “The banking system is heavily exposed to the property market with residential mortgages making up 55% of banking system assets. Investor lending has been increasing rapidly and is a significant contributing factor to the current market strength.” New rules - to begin September 1 but effectively already implemented by most banks…

Investors • Restrictions for investor lending extended from Auckland only to nationwide • Banks will be forced to require a 40% deposit - up from 30% in Auckland and up from 20% for the rest of the country - for at least 95% of the loans they make in this area.

Home buyers • Required deposit level remains at 20% for at least 90% of bank lending.

Exemptions The exemptions allowed under the current LVR policy will continue to operate, including construction lending and major non-routine repairs of dwellings. Although The Reserve Bank will consult on these changes till 10 August, and the new loan-to-value ratios (LVRs) will only take effect on September 1, banks were told they were expected to act immediately.

Review of past LVR restrictions The Reserve Bank introduced 20% deposit requirements in October 2013 to rein in the housing market, and on 1 November 2015 it raised the deposit requirements to 30% for investors buying residential property in Reserve Bank Governor Auckland. Graeme Wheeler As a result of the 1 November changes, many property investors shifted their focus out of Auckland, resulting in sales volumes and prices increasing sharply in centres like Hamilton and Tauranga. Price held steady in Auckland for three months, but then started increasing again.

Likely impact of the new LVR restrictions In their Consultation Paper, the Reserve Bank indicates that one benefit of the proposed LVR policy will be to “Dampen house price inflation by approx 2-5% in the first year of implementation.” My personal view is that the new restrictions are likely to limit the rate of price increases over the next few months, both in Auckland and nationally.

Possible future restrictions Wheeler also said that work was progressing on debt-to-income restrictions to potentially complement LVR restrictions. These are already used in the United Kingdom, where most buyers cannot get a mortgage higher than 4.5 times their annual earnings. The Reserve Bank believes that, set at the right threshold, debt-to-income restrictions will affect investors more than owner-occupiers because most high debt-to-income lending is currently to investors. I

immigrated to New Zealand from Durban with my family at the age of 14 and after 2 years it feels like home.

Every teenager has questions when our parents break the news that we’re immigrating - but what about my friends? Our family? Our pets? Then we try to come up with extra excuses as to why we can’t leave. You see, Parents of Teenagers, it’s not that we don’t want to follow your dreams for us to have a better life but we are absolutely terrified of stepping into this unknown future you have so much faith in. How will I be able to make new friends? I’ve just started high school

and now I must start all over again? What if people think I have a weird accent? Don’t they wear ugly sandals to school? These are some of the questions which ran through my mind. We don’t understand why our parents would do this to us especially at the supposedly ‘peak’ of our school career. But it’s because we DON’T see the bigger picture behind this life changing decision, you see. I came to realise that parents look to the future and teenagers only look to the now. We are so immersed in the life we have that we forget, every once in a while, to imagine what our futures could be like. For me, I was overwhelmed with different emotions, unsure of what to feel and think. I decided to envision my future in South Africa and I realized that with the recent statistics of people who are being accepted into University, I would have little chance of tertiary education. New Zealand presented far better opportunities on that count. Looking at the political scene of South Africa and their plans for the future, I realised that it wouldn’t be much longer before we became victims of an unfair class and racial system where our aspirations would be diminished and we would be forced to live life in a certain way. New Zealand has that diversity in culture, traditions and lifestyle which appreciates and celebrates individuals. The country on the other side of the world began to look more promising. Immigrating to New Zealand has forever changed me as a person. I’m deeply grateful to my parents, have a renewed respect for all immigrants, and an open mind and heart to enjoy the multiculturalism of New Zealand. My favourite part about immigrating is that you can start afresh in this country where no-one knows who you are, or your past or the type of person you were. You have the opportunity to try new things and experience new adventures. The biggest thing I have learnt is humbleness and humility. I’ve learnt not to boast or brag but to set myself on the same level as my peers in order for there to be a better level of interaction which brings about a deeper level of respect. Living in New Zealand, from my perspective, means these four words: Opportunity, Future, Independence and Acceptance.
