From the editor Good day, imona and I spent October in South Africa where the Jacarandas were in full bloom and Pretoria looked stunning. You would never know when driving around the suburbs, especially Centurion, that there is an underbelly of crime which awakens as soon as the light starts fading. The wealthy still have a very good life but they have to be vigilant at all times when out and about. I found each of the cities we visited very different so it’s hard to say the whole country is the same as it’s often your personal view. One cannot say that the country is bad overall as that will prevent potential tourism. Tourists will think it’s dangerous everywhere and it’s not. Even with the students rioting in the streets threatening to burn down the universities, it was not dangerous two kilometres away where people were laughing and having fun in restaurants, malls and cafes. Life goes on. As a people, South Africans have to continue with their lives. They cannot crumble. The toughest problem is the declining rand. Food has gone up and electrical equipment is almost on par with NZ prices, while clothes are still affordable but not as cheap as they were a few years ago. Restaurants and alcohol are still a lot cheaper than NZ. The standard of service in the hospitality industry is very high with smiles are around. Tips may have something to do with this, however, but I believe it is the natural friendliness of the South African people. I feel sorry for the lower middle classes trying to secure jobs, let alone good jobs. Some say you need R35000 per month to live a reasonable life but most people we met earned a lot less than that. Job scarcity for certain population groups are getting tougher. My feelings after travelling to many countries is that South Africa should be one of the greatest holiday destinations in the world. Hotels are reasonably priced, food and transport costs affordable, which actually makes for an inexpensive holiday. All tourist areas are safe and well protected and there’s so much to see and do, and the food and wine excellent. Christmas is upon us. Where has 2015 gone? Everyone I speak to is so busy that they have not had any time to think about the holidays. It’s great to see the wonderfully designed Christmas adverts and we ask you to please support our advertisers. Boerewors at $13.99 definitely works for me. I wish everyone a well deserved break over the holidays and have a Happy Christmas and a great New Year. Let’s welcome in 2016. Terminating Her Employment during an Employee’s Pregnancy – the Risk and the Cost Eska Hartdegen, our in-house employment law specialist shares a new decision with our readers.
I
n an Authority decision, Peterson v Cox T/a Blomkamp Cox Solicitors released today, Ms Peterson was awarded $10,000 compensation for hurt, humiliation and distress plus legal costs (still to be decided), and $6,423.48 for the payment she would have received while she was on maternity leave. Ms Peterson had been a legal secretary to Mr Cox, the principal partner of the firm. When she was three months pregnant, she advised her employer of her condition. With her baby due in early April the next year, Ms Peterson intended to work until at least the beginning of March. At the beginning of November 2011, Mr Cox was hospitalised. On 14 November Mr Gibson, a staff solicitor in the firm proposed to Mr Cox that Ms Peterson be made redundant for financial reasons. She was given a letter to that effect on 15 November, and on 16 November Ms Peterson was told by Mr Gibson not to work out the remainder of her notice; that she would be paid to 9 December. By early December, the firm employed Ms Sampson to do some of Ms Eska Hartdegen Peterson’s work. Mr Cox had returned to work later in November, and Ms Peterson’s mother went to see him, and questioned why the firm had an employee doing her daughter’s work. She indicated that Ms Peterson would accept part-time work, but this was never offered to her. The Authority held at [44] “I find that the genuineness of the decision to make Ms Peterson’s position redundant is to be doubted” and further at [45} “…prior to the expiry of Ms Peterson’s notice period. Whilst Ms Sampson worked on a part-time basis during these two weeks, Blomkamp Cox was also paying Ms Peterson, and there was consequently no salary saving which does not accord with the business being in grave financial difficulties”. With regards to redundancy, the Authority refers to the case of Michael Rittson-Thomas T/A Totaera Hills Farm v Hamish Davidson at [39] where the Chief Judge said”…the Court (or the Authority) must determine whether what was done and how it was done, were what a fair and reasonable employer would (now could) have done in all the circumstances”, and later referring to the Test of Justification under Section 103A of the ER Act 2000, the Authority finds at [50] that this test was not satisfied: “there was (not) substantive justification for the redundancy of Ms Peterson’s position”. The South African
Turning then to the good faith requirement under section 4 of the ERA Act, the Authority finds at [52] there is the need to provide the employee with access to information and an opportunity to comment before a decision is made, “Blomkamp Cox failed to adhere to the requirements of procedural fairness” and at [53] “Ms Peterson was unjustifiably dismissed by Blomkamp Cox”, and at 54 that “Blomkamp Cox breached the duty of good faith it owed Ms Peterson during the pregnancy and subsequent termination of her employment”. Due to her redundancy, Ms Peterson did not qualify for the maternity payment during her parental leave. Not accepting that her position was genuinely redundant, she filed a personal grievance for unjustified dismissal claiming the parental leave payment from the firm instead, and additionally seeking compensation of $10,000 and legal costs. She also wanted to be reimbursed for her lost salary from 10 December until the birth of her baby. This the Authority declined to award as she did not look for alternative work until after the birth of her baby. To have qualified for paid parental leave under section 7 of the Parental Leave and Employment Protection Act 1987, Ms Peterson must have been in the employment of the same employer for at least an average of 10 hours a week during the immediately preceding 12 months, which she had been. The Authority thus has awarded her $6,423.48, being for the 14 weeks. This case well illustrates the cost implications for employers who are ignorant of the legal requirements of genuine redundancies, good faith and fair process. Best to seek early legal advice!

ince arriving in New Zealand 6 years ago Paul Holmes says life has had its ups and downs which we expats can relate to. But with his family’s love and strength they have weathered the storm together. Root Canal Treatment – getting to the root of the problem Sandra Bekker East Coast Bays Dental
Q
uite a number of people, dare I say most people, will get toothache at some point in their life and hear the dreaded words that they need root canal treatment (RCT) or endodontic treatment to save the offending tooth. But have you ever wondered when was the first form of root canal treatment done and how did it evolve into the modern procedure of today?
Endodontics is derived from the Greek words ‘endo’ meaning inside and ‘odont’ meaning tooth. It deals with the removal of diseased nerve or pulp tissue from inside the tooth (the pulp chamber and root canals) and the filling and sealing of those cleaned spaces to prevent re-infection. The pulp chamber contains blood vessels to supply nutrients; and nerve tissue by which a tooth can sense hot and cold. This pulp tissue is very vulnerable to deep decay, trauma, fracture or periodontal disease and may become inflamed and die as a result. In turn this can cause bacteria and infection to spread down the canals to the tip of the root and into the jaw bone with severe throbbing ache, prolonged pain with hot and cold, swelling and tenderness when chewing. In some cases, though,
the pulp may die so gradually that little or no symptoms are felt! How did our ancestors deal with toothache? Evidence of the world’s first root canal treatment was found in the skull of a soldier who died about 2000 years ago! A green stain was noticed on the front tooth and x-rays revealed a fine bronze wire inside the pulp chamber of the tooth. It may have been inserted to try and deaden the infected nerve in the tooth. Since then there is evidence that people tried to drain the pulp space to relieve pain and even in some instances to remove or cover the pulp. Not so different from what we do today! Although this indicates a remarkable level of understanding of dental disease in ancient times, the first breakthroughs in endodontics were not to come until the seventeenth century. In the seventeen hundreds Pierre Fauchard, widely credited as the founder of modern dentistry, wrote a textbook where he describes the dental pulp and dismisses the myth of a tooth worm causing tooth decay and tooth ache. He is also the first person to describe the removal of pulp tissue. Then in 1725 Lazare Riviere was the first to describe the sedative properties of clove oil. In 1838 Edwin Maynard introduced the first endodontic tool which he created by filing a watch spring and in 1847 Edwin Truman is the first to use gutta-percha as a filling material. This rubber-like material is still widely used to fill modern root canals! S.C. Barnum from New York was the first to use a thin rubber leaf to isolate a tooth in 1864. Today, dental or rubber dam is used. Then on 8 November 1895 Konrad Wilhelm Von Roentgen discovered a new form of energy that can penetrate solid materials and because of the unknown nature of that energy he called it x-rays. But if it wasn’t for C. Edmund Kells, a true dental pioneer, who quickly realised the potential of these x-rays in dentistry, we might never have had the benefits of modern dentistry. This with the development of anaesthesia in the early twentieth century changed the way dentistry would be practised forever. Thus procedures, techniques, materials and equipment were standardised allowing for more accurate and comfortable procedure for the patient. So if you are in need of endodontic treatment now, spare a thought for the brave souls that went before us and started the trend with only a crude bronze wire! hether you regularly travel abroad or you’re planning your first family holiday overseas, Southern Cross have a few tips to help you get everything sorted before you fly. How to Master Pre- Take-Off 10 hacks to prepare you for travelling Pre take-off can be pretty stressful. There are a number of things you need to think about before you even get on the plane. From bookings and bag packing, to transport, airport formalities, and of course, being on time! Ease the stress and start your vacation early with these 10 simple pre-take off hacks.

Muriwai Gannet Colony Story and Pictures by Sherelee Clarke
F
rom August to March each year you can watch the comings and goings of a busy gannet colony. It’s
hugely entertaining and I highly recommend you spend some time there. Muriwai’s gannet colony is a one hour drive from the centre of Auckland. Next to the car park, a short walking track leads to a viewing platform right above the main colony area. Out to sea, the colony continues on
two vertical-sided islands. About 1200 pairs of gannets nest here each year. Each pair lays one egg and the parents take turns on the nest. The chicks hatch naked, but within a week they’re covered with fluffy down. As they mature, they grow juvenile feathers and begin to exercise their wings in preparation for the one-shot jump off the cliff. Once airborne, the young gannets leave the colony and cross the Tasman Sea to Australia. A few years later, surviving birds return to secure a nest site at the colony.

Poachers are presently slaughtering giraffes due to a belief that longnecked animals’ bone marrow and meat have HIV-curing properties. Poaching remains a huge problem in Africa. Those who engage in this illegal form of hunting aim to acquire their meat and hides. The tail of a giraffe is a prized commodity in many African cultures and used to make bracelets, fly whisks and thread. Fifteen years ago Africa had about 140 000 giraffes and now there are only about 80 000. The giraffe has been listed as one of the species of ‘least concern’ on the International Union for Conservation of Nature but that certainly no longer holds true. Giraffes’ endangered classification is being reassessed next year, but something needs to be done in the meantime. The government of Tanzania, where much of the worst poaching occurs, must enforce stricter policies and harsher punishments against poaching, and priority needs to be placed on this issue.

outh African, Siyoli Waters, is in love with the game of squash and her ongoing passion for the game has ranked her 28th in the world.
She proudly talks about her beginning in the sport she loves and which happened quite by chance. “On a rainy day in Grahamstown my tennis teacher took the U11 team to the squash courts and I was hooked,” said Waters. She played a variety of sports at school but found that she could practice squash on her own whenever she wanted. She didn’t have to wait for a team practice or field availability like in other sports. She improved quickly and became the U14 and U16 champion. Leaving South Africa,
she got a scholarship to study A Levels in England where she was coached by the legendary British Open Champion, Jonah Barrington. For relaxation, you can find her out on a golf course enjoying the occasional social game of golf. “I love playing piano and guitar, listening to songs on the radio and trying to figure them out but golf totally chills me out!” she said. She added that it is always tough to
compete against players who are just as hungry as she is but she is excited that she has been able to compete on a world tour and win titles in Australia, United States, South Africa and Malta. Recently, the World Squash Federation chose eight athletes across the globe to be ambassadors for the game. “It was an honour to be chosen. I was also picked to be on the presentation team in Switzerland before the International Olympic Committee. Squash needs all the promotion it can get and I am happy to do my part wherever I can”.

here’s been a lot of debate recently about the proposed Trans Pacific Partnership (TPP).
The TPP aims to create a regional free trade agreement involving 12 Asia Pacific countries, including Australia, Japan, the United States, Canada, and New Zealand. These 12 countries have combined a GDP of US$27 trillion (NZ$40 trillion). If we are able to secure a deal, this would deliver massive benefits to the New Zealand economy. It will help to create more jobs for New Zealanders and lift incomes. Trade is incredibly important to New Zealand. As a small, island nation we need to trade with other countries to ensure we are not left behind. We can’t get richer by selling stuff to ourselves. The reason the Government hasn’t released much detail to date is because the negotiations are still underway. Just like any normal business deal

f only we had a crystal ball! We’d predict when airfares to South Africa were going to come on sale and we’d save up in advance and
be ready to pounce, and save! Sadly, we have no crystal ball, and more often than not, the cheapest

This is about getting the best possible deal for New Zealand, not a deal at any cost. We are confident we will reach an agreement that is in the best interests of New Zealand. If we are able to secure a deal, New Zealanders have an opportunity to review it and provide feedback. Any deal will require examination by a Parliamentary Select Committee where members of the public will be able to make submissions. Legislation will also need to be passed, which will involve further scrutiny by Parliament, before it takes effect. As I’ve already mentioned, we will not be signing a deal that’s not in New Zealand’s best interests. I firmly believe the TPP will be hugely beneficial to our country if we are able to secure a deal.

nroasted, unsalted nuts make a healthy, satisfying snack. A small handful (30 grams) mixed nuts four to five times per week has been found to provide beneficial effects and is recommended by the Heart Foundation. It is one of nature’s ultimate ‘fast foods’! Although nuts are high in fat, it is the good kind of fat. Studies have shown that people who eat nuts are less likely to be overweight.
Nuts are also a great source of: • Folate – overall healthy functioning of cells in the body and prevention of neural tube defects (Spina Bifida) in foetuses of pregnant women. • Selenium – important for a healthy immune systemand healthy thyroid function. New Zealand soils are low in selenium. Just one or two brazil nuts a day will provide all the selenium you need. It’s important not to eat more than this on an everyday basis as selenium can be toxic in large doses. • Magnesium – for healthy bones and proper muscle function. Brazil nuts, cashews and almonds contain more magnesium than other nuts. • Potassium – an electrolyte which helps the functioning of cells and is important for healthy heart and muscle function. Pistachios, hazelnuts and almonds contain higher amounts than other nuts. • Calcium – for healthy bones and teeth. Almonds contain the highest amounts with brazil nuts and hazelnuts coming a close second. All in all, nuts are a pretty amazing food! Unless you are allergic to them, try including some into your diet every day.

Impact of 1st October Tax and Lending Changes on Auckland Property Market
Both the IRD and the Reserve Bank implemented changes on 1 October aimed at cooling the Auckland Property Market. This article lists these changes and reviews their initial impact. New bright-line 2-year tax rule (See IRD website for more details) Under this rule, the profits on sales of residential properties bought on or after 1 October 2015 and sold within two years will be taxable, unless it is your main home or another exception applies. Linked to this change were new information requirements. When buying, selling or transferring property in New Zealand, you’ll have to provide your: • New Zealand IRD number and • taxpayer identification number (TIN) from any countries where you have to pay tax on your worldwide income. Buyers who do not have an IRD number, need a New Zealand bank account to apply for a New Zealand IRD number. Maximum borrowing level The Reserve Bank lowered the maximum borrowing from 80% to 70% for Investment Properties in the Auckland region, as shown in the map. Most banks had implemented this change by 1 October. Impact of above changes In his review of the October trading month, Peter Thompson, Managing Director of Barfoot & Thompson stated “The jury remains out as to whether the latest Reserve Bank and Government initiatives have halted the rise in Auckland Peter Thompson house prices.

"In October the average Auckland sale price increased marginally by 0.5 percent to $840,402 over that for September and the median price declined by 1.3 percent to $780,000. “These movements send mixed messages as to what is happening to prices but what is clear is that the rate of price rise that occurred in September has not been sustained. "October Sales numbers at 1068 were solid but they were down significantly on those for September (by 21.4 percent) and were the lowest in any month this year since February," said Peter Thompson. "Since the Reserve Bank announced an equity ratio increase for investors and the Government new rules for non-resident buyers, market trends have definitely changed. "Sales numbers are definitely down but it is too early to say whether the changes will have a permanent influence on prices. "Clearance at auctions has slowed, but a significant number of sales are being concluded in post auction negotiations. "At present, the market is balanced and sales numbers and prices between now and Christmas will determine where prices go in the new year." Author’s comment… The market reviews that will be published during the first week of November will give a clearer picture on the direction of the Auckland property market and the impact of the IRD and Reserve Bank changes. Let’s face it, it makes me more knowledgeable if I’ve been to the destinations I promote. Here are some highlights of my trip to the beautiful Tahiti.
Depart Auckland on Air TahitiNui – when boarding each person is presented with a Tahitian native flower known as a Tiare and this is when your holiday experience begins. The heat is phenomenal and standing in the immigration line with only overhead fans is suffocating but as you walk out of the arrivals hall you are given a garland of frangipanis; cool and oh so sweet smelling, the perfume fills the air. Le Meridien Tahiti 4* has a spectacular lagoon pool which is great for midnight swims. Our first night’s accommodation was spent here with spectacular views from every angle of the gardens, the water bungalows, the sea and our next destination, Moorea Island. The Aremetti Ferry is a 30 minute transfer across to Moorea Island and on arrival you have to try the locals’ cold freshly peeled pineapples and mangos.
with beers and wine. After lunch a quick snorkel in the lagoon and a swim with manta rays and reef sharks. Before we knew it, it was back to the hotel to freshen up and head back to Papeete. Every night on Papeete the Roulottes food trucks cook up many different dishes - budget food under the stars! Departing from this beautiful destination is not easy but we were all given necklaces made from small shells as a parting gift and a memory of our stay. Tahiti has always been flagged as expensive but airfares are lowering and the hotels more affordable. The most romantic getaway as a destination, and if you have the financial means visit Bora Bora - the crème de la crème of French Polynesia.
Tahitian Poisson Cru 1 cup lemon juice 300g snapper fillets, skinned and deboned 1 red onion, small finely chopped 2 Tbsp spring onions, chopped ½ cup cucumber, chopped 425g coconut cream 2 tomatoes, chopped Cut snapper into 2cm pieces, pour lemon juice over and leave for 15 minutes Drain and add all the other ingredients Serve with fresh bread on a hot summer day – delish!

I can tell you it’s not with a chisel or hammer either but the Tahitian way using teeth and tree trunks. The secret is where to hit the coconut.
