I

would like to congratulate everyone involved in the Cricket World Cup celebrations at the Cloud on Queens Wharf on the eve of the South African/ Pakistan game. Huge thanks to New Zealand Trade & Enterprise, Auckland Tourism, Events and Economic Development, together with The New Zealand Southern African Business Council who co-hosted this excellent function. We had our fair share of SA and Pakistan cricketers and delegates, as well as the SA High Commissioner, Zodwa Lallie, who attended. The Auckland Dukes provided the entertainment and the ‘Capetonian’ vibe was very special. The next day Simona and I left to run immigration seminars in South Africa. We met some amazing people who are keen to call New Zealand their new home. The weather and the hospitality from Cape Town, Durban, Josi (as JHB is fondly called) and Port Elizabeth was fabulous. This is still one of the best countries to visit and, as a tourist with our favourable exchange rate, it’s even better. This year we did something completely different and took a detour to stay in Oudtshoorn visiting the Cango Caves and the ostrich farms. On the menu at some of the restaurants were10 ways to eat ostrich - fried, grilled, in salads, on salads, minced, in a burger, and the good ole boerewors way! The sad part travelling is hearing about the plight of the locals with the crime, corruption and now loadshedding becoming a serious problem. The Chamber of Commerce estimates that the power cuts are costing R10 billion a month in lost productivity. All in all, we’ve had a very successful trip and we’re pleased to be home. The Cricket World Cup has been a great success for both Australia and New Zealand but we’re all sad we were not able to beat Australia.

Privacy – at what cost do employers disregard the Act? Eska Hartdegen, our in-house employment law specialist, shares a decision of interest with our readers, whether they are employers or employees

A

recent decision of the Human Rights Review Tribunal should cause alarm bells to ring for all employers. The Tribunal ordered NZ Credit Union Baywide, a lending company, to pay its former employee Ms Hammond, $98,000 for humiliation, severe loss of dignity and severe injury to feelings, $38,350 for income lost, $16,177 for the loss of a benefit she could have expected to be paid, and $15,543 in respect of legal costs for breaches of her privacy. The Tribunal said the privacy breaches of the employer showed "…in dramatic terms the reasons why the information privacy principles were enacted by Parliament in the Privacy Act…The unrestrained use of personal information can cause devastating, if not irreparable harm to an individual”. This is an unprecedented level of damages awarded by the Tribunal, and is indicative of the seriousness with which the Tribunal viewed the Eska Hartdegen breaches of privacy in question. In relation to the compensation sum of $98,000 awarded, the Tribunal stated "In arriving at this sum we have taken care to focus only on the emotional harm which the actions of NZCU Baywide caused to Ms Hammond and have excluded any element of punishment or disapproval." The facts of this case are that an ex-employee had iced "NZCU f..k you" and other derogatory comments about her previous employer onto a cake that she had baked for a colleague, who believed that her employer had constructively dismissed her. After Ms Hammond’s ex-employer used an image of the cake which Ms Hammond had put on her Facebook page, she succeeded in her claim that her privacy was breached when it was used to harm her employment opportunities.

The Tribunal held that "The Act stipulates that unless personal information is collected, stored and disclosed only as permitted by the Act, the holder of the information becomes legally responsible for the consequences”. It considered that NZCU Baywide had acted with complete disregard to the law, saying further “In the present case, had (the company) paused for a brief moment to consider its obligations under the Privacy Act it would have been deflected from the high-handed and impulsive reaction which has led to the infliction of serious harm not only on Ms Hammond but also on itself, its staff, its image and reputation". The Tribunal ordered NZCU to apologize to Ms Hammond and to send a copy of the decision to the employment agencies they had involved, being Red Consulting Group, Able Personnel, Adecco and Grow HR, with a request to delete the screenshot of the cake from their records. NZCU also had to retract the information sent to its staff and other agencies about Ms Hammond, and they had to provide training to all staff about the Privacy Act to ensure it was understood within the company. It is easy to react without considering the privacy rights of an individual when angered by a particular employee’s behavior, but employers who do so could find it to be a very costly reaction and mistake! Taking early advice could prevent that.

Ms Hammond discovered that executives had coerced an employee with whom she was friends on Facebook, to access the photograph of the cake, and make a screenshot copy of it. NZCU’s chief executive then sent an e-mail to all staff concerning the photograph, as well as about Hammond's resignation and other matters. NZCU’s HR Manager also sent the image to various local recruitment agencies in the vicinity, suggesting that they decline to deal with Ms Hammond. SKETCHING FOR HER SOUL

J

ackie Klompenhouwer hails from the warm and beautiful Margate on the South Coast in Kwa-Zulu Natal. As she entered high school, Klompenhouwer and her sister, Monique, began drawing lessons. After attending two classes and learning about shading and basic sketch techniques she found herself drawing on anything she could find. And for the first time in her life, she found something she was good at. She had found her passion.

Uncle Siebert and Aunt Alta bought her first pencil set and sketch pad (she still has the set although most of the pencils have been replaced). Drawing took on a whole new meaning when she studied and received her diploma in Architectural Drafting through Intec College and worked at an Engineering company as a Draughtswomen. She married Kees in 2004, changed career direction, changed countries and immigrated to Britain in 2007. Soon their son, Michael, was born. And her pencils were put on the backburner.

Meeting Martin, a Welsh biker at the local bike shop, was a blessing. Loving the lines of the bike, Klompenhouwer suddenly wanted to sketch again. She got out her pencils….. just like that she was back! She learned a special lesson - it was that she needed to sketch for her, for her soul, to make her whole and happy. After receiving a Derwent Inktense pencil set for her birthday, she now focuses a lot more on colour sketching. Last year when her beloved Grandmother passed away in New Zealand they came

across for the funeral and decided to explore immigrating. In October, they officially immigrated and live in the beautiful Northland where she loves nothing better than sitting on the deck in the warm sun, the birds chirping merrily, sipping on a long tall glass of fizzy, her pencils and sketch pads on her lap.

magine my surprise when I attended the NZSABC/ATEED/NZTE business function at The Cloud recently and spotted two familiar faces in the crowd - Angela and Allan Silberstein. The recognition was instantaneous. But let me start at the beginning. It was one of my ambitions when I completed school in South Africa to be involved in the legal field. Allan Silberstein, owner of SILBERSTEIN AND ASSOCIATES had the faith to employ me as a legal clerk in the early 80s and my journey with the Silbersteins began!

I enjoyed a close relationship with Angela, Allan’s wife, and their children. On my 21st birthday they arranged an unforgettable celebration lunch at one of the best restaurants in Cape Town. We parted ways when the practice was sold and they left for America. I gave birth to my son, Matthew, left the practice and the last time I saw them was in the late 80s. Three years ago in NZ, we made contact by phone with promises to meet but we never quite got it together.

Advice to prevent cavaties in children and younger adults By East Coast Bays Dental

F

or various reasons, dentistry in NZ is more expensive than in SA, and fees charged vary considerably. Medical aid cover for dentistry is virtually non-existent. This is likely because employers are not by law required to fund a part of the contribution, making dental plans as part of medical insurance, not viable. I would like to give some advice today on the prevention of dental cavities in children and younger adults so to save money in the longer term. At primary level, fluoride intake at optimum level during the first twelve years of life is the most effective way to prevent caries. Adding chromium to iron gives you stainless steel - fluoride has a similar effect on enamel, giving the tooth a much harder, acid resistant enamel shell. There are, however, a few problems associated with this as I will explain later. Children, who grow up in areas where water is fluoridated and use fluoride-containing toothpaste, need not take supplements. If you live in a non fluoridated area or use tank (roof) water, talk to your school dental therapist, dentist, pharmacist, or counsel about supplementing fluoride. Sugar is a major initiator of caries. It is the perfect food for oral bacteria, which produce acid when metabolising that sugar. The acid demineralises enamel, making it porous and this allows different bacteria to get through into the organic, protein rich dentine, causing dental caries. The amount of sugar taken does not really matter as much as the frequency of intake, this is because the bacteria only need a tiny amount of sugar, but they need it all the time. It is very important to keep the mouth sugar and plaque free, which brings us to oral hygiene practises.

Younger people who grew up in the fluoridated era have few dental problems and as a result only visit a dentist when in pain. Often at this stage numbers of still symptomless ‘rotten egg’ teeth may be discovered, as well as advanced periodontal (gum) problems if they haven't been. The message today is to make sure your children get correct fluoride exposure but still see a dentist or therapist regularly, brush regularly with a soft toothbrush, reaching all tooth surfaces, keep sugar levels low by eating sugar infrequently, and rinsing the mouth with water after exposure to sugar. Finally, use dental floss regularly to remove the acid and plaque between the teeth. Next time I will give advice to older adults on prevention of common age related dental problems, and how to prevent dental disaster in old age. Brushing for 2 minutes and regularly is not of much use unless you brush everywhere. Quite often tooth brush abrasion from brushing too hard with a toothbrush causes severe damage to front teeth, while back teeth rot due to a lack of brushing. Plaque and acid between teeth can only be removed by flossing, and not doing so will cause softening of the smooth enamel surfaces between teeth and the subsequent dentinal decay. This is the area where fluoride impregnated, 'stainless steel' enamel out performs the 'iron' enamel by a long way and will save young adults thousands of dollars in dental expenses. The only way to remove plaque between teeth is by flossing! Enamel in the depths of the fissures of our molars is very thin and impossible to clean. Dental therapists at our excellent school dental clinics see children once a year and will seal deep fissures as soon as possible after tooth eruption, to prevent decay in the fissures of their teeth. Dentinal decay developing in the bottom of these fissures can be very difficult to diagnose at an early stage. One of the disadvantages of hard fluoride enamel shells is that it may take even longer to detect the problem, although it is still much less likely to occur. This brings us to the second problem associated with fluoride. Unless the oral hygiene is very poor the only problem likely to develop is fissure caries with the tooth going rotten like an egg inside. Low fluoride enamel will break down early, creating a cavity and can be treated. In high fluoride teeth, decay often reaches the pulp (nerve), before the tooth visibly breaks down causing toothache and then usually requiring root canal treatment or extraction. The South African

Five factors or events that affect the stock market

tock markets can be volatile, and the reasons particular stocks rise and fall can be complex. More often than not, stock prices are affected by a number of factors and events, some of which influence stock prices directly and others that do so indirectly. According to stock market guru Peter Lynch, an important point to remember when investing is that there is a company behind every stock and a reason why companies--and their stocks--perform the way they do.

Internal Developments Developments that can occur within companies will affect the price of its stock, including mergers and acquisitions, earnings reports, the suspension of dividends, the development or approval of a new innovative product, the hiring or firing of company executives and allegations of fraud or negligence. Stock price movements will be most drastic when these internal developments are unexpected.

World Events Company stock prices and the stock market in general can be affected by world events such as war and civil unrest, natural disasters and terrorism. These influences can be direct and indirect, and they often occur in chain reactions. An example of an indirect influence on markets is the announcement of a new military venture by a country

in response to the outbreak of civil unrest or conflict abroad. This announcement likely would cause the price of the stocks of military equipment and weapons manufacturers to rise due to an expected increase in defense contracts, which in turn can raise the value of stocks for companies that supply military equipment parts and technology. It likely would raise the demand for, and price of, natural resources used to make these parts, which would raise the price of stocks representing particular mining and natural resource processing companies.

When interest rates are raised, many investors sell or trade their higher risk stocks for government-backed securities such as bonds to take advantage of the higher interest rates they yield and to ensure that their investments are protected.

he New Zealand Southern Africa Business Council, in conjunction with ATEED Brian Fleming, Brian Casey and Cynthia Nuttall. (Auckland Tourism, Events and Economic Development) and NZTE (New Zealand Trade and Enterprise) hosted a very successful function at The Cloud on the Auckland Waterfront recently. The evening began with the 1st innings, where a Business Panel comprising representatives from different business sectors presented their views on doing business both in and outside of New Zealand. David Downs of NZTE hosted the panel which included Alan Edwards (CEO of Metlifecare), Brian Casey (Chairman of Ice Angels), Gavin Nell (MD of Global Destination Forwarding) and Erica Crawford of Kim Crawford Wines. The SA High Commissioner Zodwa Lallie was one of the guest speakers and encouraged business owners to continue the dialogue and business interaction with South Africa. Minister Nicky Kaye spoke very highly of the South African migrant community in New Zealand and emphasised the positive impact that South Africans have made in the New Zealand economy. The 2nd innings saw Ian Mellett of Quay Law introduce an international Cricket Panel comprising Mark O’Donnell (Auckland Aces coach and ex assistant Black Caps coach), Paul Strang (exlegspinner for Zimbabwe) and Meyrick Pringle (ex-opening bowler for South

Africa at the 1992 CWC and now commentating for the Star Sports network). Around 200 guests mingled with a Pakistani delegation, fellow business owners and cricket lovers. The Auckland Dukes were on hand to provide the best South African music to be found in New Zealand. The function certainly was one of the highlights of the business and cricketing calendar and was thoroughly enjoyed by all who attended. stared defiantly into the eyes of my psychologist as he bluntly informed me that my life as I knew it would never be the same. He morphed before my eyes into an ogre as a strange rendition of Mick Jagger’s Party Doll screamed in my head, ‘You used to be a party doll, but now they say the party’s over’. I would much rather be back in my dancing days, and my crazy ways looking at life through my vodka haze, than be in this room, this crazy man telling me that not only would I be permanently disabled but my whole life as I know it would be erased and I would have to accept being a new broken person. Silently screaming ‘Shut up! I’m 21! Turning from the scans the neurosurgeon informed me in short that the mass of blood vessels that had become a plum size knot in my head was in danger of exploding at any time, with fatal consequences. Surviving the urgent surgery was only a thirty percent chance - risk factors included paralysis, memory loss, seizures, loss of bowel and bladder control. It was my gamble, my choice. Surgery was booked for the following week and I spent the next few days in between head shaves, halo fittings, MRI scans and Angiograms praying and reflecting on life, doing my last handstand and cartwheel, ice skating, running, leap frogging and styling my hair with two hands. The day before surgery, I sat down to the task of writing farewell and thank you notes to my loved ones. I remember lying on the bed by the door of the elevator that led up to the theatre and kissing my mom goodbye. As the doors opened I panicked as hysteria took over and they must have put me out with something because I went blank. Two weeks after waking from a coma, I endured months of learning how to walk from crawling, navigating my wheelchair without being able to judge distances. Dressing with difficulty The South African

op in for a visit to the new Burger Motor Works premises in Archers Road in Northcote. There are cars for Africa in the workshop - always a good indication when you’re looking for a mechanic! Owner Burger Oosthuizen immigrated to New Zealand in 1999 with his wife, Alletta, and his children, Nathan and Crystal. His son, Nathan, lives in England and his daughter, Crystal, lives at home with them. Home is Greenhithe on the North Shore where Oosthuizen loves nothing better than Alletta, Burger and Crystal Oosthuizen. pottering around in the garden. His area is rural and private and luckily for him he has great neighbours. He has a wonderful relationship with God and his number one hobby is playing his guitar. Burger Motor Works started in 2000 in a small workshop in Sunnybrae Road in Glenfield. Since then it has grown in leaps and bounds and Oosthuizen has vowed to continue to work smarter, not harder. Having 38 years experience under his belt as a Vehicle Technician, and training in Germany with BMW, he is the best in his field. Five more mechanics make up his team – Uri Linde, Hamish van Leer, Rob McDonald, Joel Oosthuizen (no relation) and John Crouse.

Between them they see to about 10 to 15 cars daily. The South African Magazine asked Oosthuizen to give our car owners his best advice. He said, “Buy the best you can afford, keep the oil and filter fresh and don’t settle for cheap parts, especially brakes. These are like junk food for your car!”

A comparison of Sales Prices vs Council Rating Valuations Many buyers and sellers believe that the selling prices of homes are either determined by their CV or closely linked to their CV. This article compares the selling prices of homes sold on the Auckland North Shore during January 2015 to their current CV (Council Rating Valuation at 1 July 2014). As at 18 March when this article was written, Property Guru showed 120 sales of North Shore homes during January 2015. Of these 120 sales, 81 homes sold at prices above their CV, 10 sold for exactly their CV, 29 sold for below their CV. The average was 6.35% above CV.

The difference (SP vs CV) depends on the “relevance” of the CV and a range of property related factors, and also depends on the effectiveness of the marketing campaign that was undertaken prior to the sale. Examples are the four properties that we have personally marketed which have sold so far this year. Torbay home

It is clearly difficult to predict the sales prices that can be achieved, and we believe that owners should not sell their homes without properly marketing them, as they may end up under-selling their homes.

And in the 18 or so years since I was first introduced to the place – which at the time had only recently opened its doors as a guest farm – I’ve travelled a fair bit. Most journalists do. America. Repeatedly. And everyone should visit the glorious grotesqueness that is Las Vegas. Bangkok. Italy. Aaah, Italy. That was for a mini launch that saw us carve up the roads of Umbria. Africa. Including a trip across the Masai Mara.

And yet...time and again I return to Ardmore. Often with my dogs in tow for the place is pet-friendly – a concept that seems to be only slowly taking off in South Africa. But do check first before bringing your hounds along.

Now one of the biggest draw cards is the tangible serenity - a serenity that draws visitors from both South Africa and abroad. The mix seems to be about 50:50. And while the rates are affordable for South Africans, they must appear extraordinarily good for forex-rich foreigners, although

many of those visitors could, I suspect, afford to stay somewhere far more obviously opulent. But I think it’s the fact that Ardmore is as comfortable and unpretentious as a well-worn yet high-quality pair of walking shoes that adds to the attraction. Of course, the location in the Champagne Valley helps. When God made the KwaZulu-Natal Drakensberg He was surely pleased with His work. In fact, sometimes I think He lives here, among mountains and hills that vary from moss-green in full and glorious summer to snow-capped in winter. At Ardmore I’m the happiest sitting in the peace of the front garden, under the massive liquid amber tree, pondering the country’s three highest peaks that rear up in the background: Mafadi (highest at 3450m); Injisuthi Dome (second highest at 3410m) and Champagne Castle (third highest at 3377m). Then there’s the fact that owners Paul and Sue Ross give the very clear impression that if they could do absolutely anything in the world, they’d still be running Ardmore.

And let’s not forget the food, with the rates including four-course dinners and homecooked breakfasts, while light meals are available during the day in the tea garden. Much, even most, of the fare is sourced locally, and some of it is grown at Ardmore. Breakfasts and dinners, served in the warm and welcoming Yellow Wood Dining Room, are happy affairs. Accommodation, meanwhile, varies from three-bed, double-storey cottages with views to live for, to lodgings in the recently converted stable block. Fireplaces are standard all round – and if there’s anything much better than snuggling in front of a roaring fire in the heart of a Drakensberg winter, well, I’d like to know what it is.

New Immigration rules travelling to and from South Africa Effective 1st June 2015 all children and young adults aged under 18 years travelling to and from South Africa will be required to carry an unabridged birth certificate in addition to their passport. This requirement will be introduced regardless of nationality of the child and regardless of whether the child is traveling with parents, with other adults or unaccompanied. New travel regulations relating to travel with children • Both parents travelling with child(ren) under the age of 18 years have to produce a full/unabridged birth certificate for the child (both parents’ details must be on the birth certificate) • One parent travelling with child(ren) must have consent from other parent in the form of an affidavit or custody The South African

agreement confirming permission to travel with child(ren) • One parent travelling with child(ren) and other parent passed away, must produce death certificate of deceased parent. • Guardians travelling with child(ren) must provide affidavits from parents giving permission for child(ren) to travel • Failure to provide these documents can result in being denied entry.
