73 PROPERTIES UP FOR GRABS AT PENULTIMATE AUCTION Sutton Kersh will hold their penultimate auction of the year on Tuesday 25 October. The event will take place at 12noon at the Marriott Hotel in Queen Square, Liverpool City Centre.

Low-priced residential properties account for a high proportion of the catalogue and pre-auction interest has been high for the 73 lots up for grabs.

EI Group recently reported notable increases in the amounts raised in both the residential sector and commercial sector nationally when comparing quarter 2 this year with the same period in 2010. Residential sales are up by 10% to £492million, and commercial by 22% to £236million. When compared year-onyear, residential sales have increased by 12%; indicating promising signs for the auction market. The opening lot of the day at Sutton Kersh’s auction will be a vacant residential property in Croxteth. What does my conveyancer do on the sale of a property? Selling your home is probably one of the most important transactions you will ever make. Obviously you want the move to proceed as smoothly as possible and here at Morecrofts it is our job to help you achieve this. Although the following is a general guide as to the procedure followed in the sale of a residential property please be aware that it may not cover every point which could arise as, contrary to what is perceived to be the case outside of a conveyancing office, not all transactions are the same.

If you are selling the property by any kind of advertising, you will require an Energy Performance Certificate (EPC). This is a certificate which indicates how energy efficient various aspects of the property are. The boiler, double glazing, loft and cavity wall insulation are examples. EPCs can cost as little as £35. If you are being requested to pay significantly more than this please contact our conveyancing team who will be able to put you in touch with an energy assessor.

When the buyer makes an acceptable offer on the house you must appreciate that this does not legally bind the buyer to complete the purchase. Do not write to the buyer confirming the offer; as by doing so you could be obliged to sell before you are ready to move to alternative accommodation.

Surveys

If the buyer is obtaining a mortgage, the lender will send its valuer to inspect your property. The buyer may also require an independent survey to be carried out which will be more detailed than the valuation report. If either survey reveals a problem, the buyer may want to negotiate a price reduction. We and your estate agents can help with these negotiations - just ask.

Contracts

We obtain a copy of the Land Register from the Land Registry or, if the title is unregistered, the title deeds to the property either from you or your Lender which enables us to prepare the Contract. We will send the Contract and full details of the property to the buyer’s conveyancers to enable them to investigate the title to the property.

You will be asked to complete information forms which provide information of your knowledge of the property and details of fittings and contents in the property you are either including or excluding from the sale. The information you give must be accurate and not misleading. At Morecrofts we have specially designed forms which will provide the buyer’s conveyancers with all the information they will need to help the sale proceed quickly. When the buyer’s conveyancers are satisfied with the various papers, we arrange for you to sign the Contract in readiness for exchange. At this time you should discuss a completion date with the buyer. Completion normally takes place 2 to 4 weeks after exchange. If all parties agree this can be any time provided sufficient time is allowed for completion of the legal work. In some cases exchange and completion can take place on the same day although I would not advise this as there are no legal obligations on the buyer until contracts are exchanged. If you are buying a property at the same the completion date will also need to be agreed with your seller. You must move out of the house on or before the completion date.

Chains

Unless you are fortunate enough to sell your house to a first time buyer; you may well become involved in a chain of transactions where the buyer is not able to pay for your house until he has sold his own. The person he is selling to may have a similar problem — and so on. In circumstances like this, we do our best to hurry things along, but often delays are outside both our and your control.

Signing the Contract

Just because you have signed the Contract does not mean your house is sold. The sale only becomes binding when the Contracts are formally exchanged between us and the buyer's conveyancers. Once Contracts are exchanged you cannot change your mind without suffering financial penalties.

Deposit

When exchanging Contracts, the buyer is required to pay a deposit. The amount is negotiable but normally amounts to 10% of the purchase price.

Completion Date

When we exchange Contracts, we also confirm the completion date, which will have been agreed by you beforehand, being the day when you must move out of the house. It is also the day when the buyer pays the balance of the purchase money.

Removals & Outgoings

As soon as you have heard that Contracts have been exchanged you should: • confirm your removal arrangements. • inform the Gas, Electricity, Water companies etc. • arrange with the buyers as to where they can pick up the keys on completion day. For example, directly from yourselves or from your estate agent. Unless you request otherwise, we will normally pay your estate agents fees from the sale proceeds.

Stage 3. Completing the Sale The document which transfers legal ownership is called the Transfer Deed and is prepared by the buyer’s conveyancers. We will arrange for you to sign this in advance of the completion date and will only come into effect when we receive the balance of the purchase money from the buyer’s conveyancer. To avoid holding up completion of the sale we have to have this signed and witnessed document in our possession before completion can take place. If completion does not take place on the contractually agreed completion date there may be financial penalties against the person causing the delay.

Mortgage Payments

Following exchange of Contracts, we will advise your mortgage company of the completion date. They will provide us with a settlement figure, a copy of which we will send to you. On the completion date we will pay of the balance owing on your mortgage from the sale proceeds.

After Completion

In addition to paying off your any mortgage and any secured loans you have against the property we will normally pay the estate agents who dealt with the sale, we will take our costs and disbursements and provide you with a statement showing the money received and paid out. The balance is then paid to you or to be used on another purchase. If the balance is being paid to you this would be paid by cheque or transferred into a bank account in your name. Following completion you need to remember to cancel your direct debits and standing orders in favour of your mortgage company and any utilities you pay by this method.
