ARRIVAL OF YACHTS AND SMALL CRAFT IN NEW ZEALAND This fact sheet explains how entry procedures for yachts and small craft arriving in New Zealand can be minimised with some early preparation on your part. The following information will assist you to prepare for and comply with New Zealand’s entry requirements. Warning: Failure to comply with the New Zealand arrival and reporting requirements may result in prosecution. WHAT ARE THE ENTRY REQUIREMENTS FOR YACHTS AND SMALL CRAFT ARRIVING IN NEW ZEALAND?

Customs welcomes owners of international yachts and small craft to New Zealand. To meet New Zealand’s entry requirements, you must: » Provide an Advance Notice of Arrival to Customs at least 48 hours prior to your intended time of arrival in New Zealand territorial waters (12 nautical miles from the coastline). Failure to comply may result in prosecution and a penalty of up to 12 months’ imprisonment. » Report directly to a Customs port of entry (see Where are the Customs ports of entry? on page 2). » Fly the international Q-Áag once you have entered New Zealand territorial waters (12 nautical miles). » Fill in the required entry documentation in a complete and accurate manner. Required entry documentation:

» Advance Notice of Arrival (Small Craft) (Form NZCS 340). » Inward Report (Small Craft) (Form C1B).

The New Zealand Customs Service will provide immigration and emigration services on arrival and departure from New Zealand. The leaÁet Visitors Arriving by Yacht details the general immigration requirements for owners of yachts, small craft, and super yachts travelling to New Zealand, together with contact details for immigration ofÀces offshore. If you are unable to communicate with one of these ofÀces, you can telephone the New Zealand Immigration National Contact Centre on +64 9 914 4100, and then dial “0” on receipt of the automatic response message for an immigration ofÀcer. The centre fax number is +64 9 914 4119. WHAT INFORMATION DO I NEED TO PROVIDE ON THE ADVANCE NOTICE OF ARRIVAL?

New Zealand legislation requires the master of every craft en-route to New Zealand to provide certain information at least 48 hours prior to the expected arrival time in New Zealand territorial waters (12 nautical miles from the coastline).

Once your craft has arrived at a Customs port of entry you will be met by Customs and MAF quarantine ofÀcers. » With the exception of an emergency situation, all persons and goods must remain onboard until the craft has been cleared. » All persons in charge of a craft arriving at a place other than a Customs port of entry must immediately report to a Customs or Police ofÀcer. WHAT IS TEMPORARY IMPORT ENTRY (TIE)?

The New Zealand Customs Service uses a number of ways to account for goods being imported and/or exported from our country. A Temporary Import Entry (TIE) is a method of accounting for the importation and subsequent exportation of goods that are intended to remain in New Zealand temporarily, usually up to 12 months. Customs automatically grants TIEs for 6–8 months but there is Áexibility to extend your TIE for up to and, in some cases, beyond 12 months depending on your circumstances. Customs understands that your vessel may need to undergo major repair or reÀt work during your stay and that this takes time. There will be a review date during your visit so you can discuss matters with Customs that may affect your departure date. It is important that you keep in touch with Customs during your stay and advise early if you want to request an extension. In New Zealand, we have developed a simpliÀed Temporary Import Entry (Form C4G) speciÀcally for visiting yachts and small craft that is also a form of security for Customs charges that would normally be payable.

HOW WILL MY VESSEL QUALIFY FOR SIMPLIFIED TEMPORARY ENTRY INTO NEW ZEALAND FOR BONA FIDE VISITORS?

» You must be a bona Àde visitor. » You must be a permanent resident of a country other than New Zealand. » You must have arrived in New Zealand for a temporary visit of up to 12 months. » Your vessel must not be sold or offered for sale in New Zealand without prior permission from Customs. » Your vessel must not be used in a commercial capacity for hire, or the transport of cargo or the carriage of passengers for reward while in New Zealand. What if I don’t match all or some of these requirements?

Yachts and small craft may enter New Zealand for other than bona Àde visitor purposes, ie, if you don’t meet some of the requirements. However, in these circumstances Customs will determine the appropriate entry requirements and tax treatment on a case-by-case basis. WHAT DOES THE SIMPLIFIED TEMPORARY ENTRY PROCESS MEAN FOR ME?

Yachts and small craft are subject to Customs charges (tax) on importation into New Zealand. Customs charges include Customs duty (where applicable) and goods and services tax (GST). If you qualify for the simpliÀed entry process you will not be required to pay Customs charges for the vessel on arrival in New Zealand. In Customs terminology we call this process “temporary entry”. The simpliÀed entry process defers the payment of Customs charges on the understanding that if the vessel is not exported by an agreed date, or Customs duties paid, then the vessel may be liable


to forfeiture (as per the declaration on the simpliÀed temporary entry form). This requires an undertaking from you that your yacht or small craft will depart New Zealand within the timeframe speciÀed.

WHAT DO I DO WITH MY COPY OF THE TEMPORARY IMPORT ENTRY FORM?

HOW DO I GET A TEMPORARY IMPORT ENTRY (TIE)?

In New Zealand, certain goods may be supplied to you without payment of goods and services tax (GST). (The supply of goods and services without the payment of GST is over to the seller/retailer/provider to decide if that is applicable.) You need to record all details of these purchases on the reverse of the yellow copy of the form — it is not sufÀcient that the supplier of the goods merely takes a copy of your Import Entry (Temporary) Yachts and Small Vessels form.

When you arrive in New Zealand, a Customs ofÀcer at the port of arrival will assist you to complete the arrival formalities for your craft and all people on board. These formalities include immigration, craft entry papers and, where applicable, the TIE. If you would prefer to complete the TIE formalities at a later time, on arrival you can talk to the Customs ofÀcer to see if alternative arrangements can be made. However until the TIE has been completed, your vessel must remain within the conÀnes of the Customs controlled area at the port in which the vessel entered. WHAT IS INVOLVED IN COMPLETING THE SIMPLIFIED TEMPORARY ENTRY?

On arrival, the Customs ofÀcer will have you complete a form titled Customs Import Entry (Temporary) for Yachts and Small Vessels. This is a declaration and the information contained within this must be accurate. The simpliÀed temporary entry includes a declaration that is a written form of security that Customs accepts in lieu of money from importers to secure (cover) the Customs charges that would otherwise be payable. By signing the declaration the importer is giving a binding undertaking that, should the goods not leave New Zealand by the stated date then Customs charges, duty and/or GST, as speciÀed will be paid to Customs.

You are expected to retain the yellow copy of this form while in New Zealand and it must be presented to the Customs ofÀcer on your departure.

If at a later date the vessel is entered permanently to New Zealand, the yellow copy must be surrendered to a Customs ofÀcer at the time the paperwork is processed. WHAT IF I DO NOT QUALIFY FOR SIMPLIFIED TEMPORARY ENTRY?

If you do not qualify for the simpliÀed temporary entry process, the Customs ofÀcer on arrival will be able to direct you to a Customs ofÀcer (client service) to work out the most appropriate method for entering your craft. WHAT LENGTH OF TIME WILL I AUTOMATICALLY BE GRANTED FOR MY VESSEL ON ARRIVAL?

You will automatically be granted between 6–8 months. There will be a review date during your visit so you can discuss matters with Customs that may affect your departure date. It is important that you keep in touch with Customs during your stay and advise early if you want to request an extension.

CAN MY YACHT STAY LONGER THAN 12 MONTHS?

Your yacht can stay longer than 12 months. However, the temporary entry conditions that were agreed with Customs on your arrival may not be applicable. Depending on the period of extended stay in New Zealand, and your personal circumstances, Customs may require the following: » Customs may require that the yacht is imported permanently into New Zealand and Customs charges (duty and GST) will then be payable. » If your stay is still temporary and for less than another 12 months (24 months in total), Customs may require a cash deposit or security to cover the Customs charges that would be payable if the yacht was permanently imported into New Zealand. Provided the yacht is exported within the agreed period the deposit will be returned to you following your Ànal departure, or if a security has been accepted it would be released. »

If your stay is still temporary and is for more than another 12 months (more than 24 months in total) you will need to discuss your speciÀc circumstances with a Customs ofÀcer.

Customs will be able to discuss the options available to you. HOW DO I QUALIFY FOR A TIE EXTENSION BEYOND 12 MONTHS WITHOUT THE PAYMENT OF CUSTOMS CHARGES OR THE PROVISION OF A SECURITY?

Customs will consider all requests on a case-by-case basis and take into account any factors such as illness or reÀts that may affect the intended length of stay of your visit.

Yachts and small craft are not subject to maritime safety charges but are subject to oil pollution levies if the craft is over 100 gross tonnes. However, if you decide to undertake a commercial operation while in New Zealand, you will be subject to both these charges regardless of the size of the vessel. CLEARANCE PROCEDURES FOR YACHTS AND PLEASURE CRAFT The Ministry for Primary Industries (MPI) is responsible for ensuring unwanted pests, diseases and other organisms are prevented from entering New Zealand. Once inside New Zealand waters (12 nautical miles from the coast) please ensure all rubbish is contained in closed leakproof containers or sealed in strong plastic bags. A biosecurity inspector will direct the disposal of all your rubbish on arrival. You must arrive at one of New Zealand’s approved places of first arrival, where a biosecurity inspector will inspect and clear your vessel and passengers for entry into New Zealand. t Master’s Declaration The vessel Master must complete a declaration of all risk items aboard that are either restricted or prohibited (see highlighted box opposite). If you surrender all prohibited goods (or have them treated if an option) you will receive a full biosecurity clearance to cruise New Zealand waters. If this option is not taken, the vessel will remain at the designated berth under biosecurity control.

CITES (endangered species items), e.g. clam and conch shells, coral, turtle shells and ivory. LIVE ANIMALS – in general no animals will be permitted to come ashore in New Zealand or to remain aboard exemptions may be granted for keeping an animal on board where prior application has been made to MPI and the person in charge has agreed to comply with conditions set. There are specific import conditions for dogs and cats. These include measures to be taken against rabies between 7 and 12 months prior to arrival. Non-compliant dogs and cats will have to be secured at anchor. Application to bring in animals should be made to MPI well in advance. (2) The person in charge of any such craft shall, if so required by an inspector, pay a bond for such amount not exceeding $10,000 as the inspector may require to secure due compliance with subsection (1)(b) of this section. 19 Persons in charge of certain craft to obey directions of inspector or authorised person x (1) This section applies to a craft, and place in New Zealand, if— o (a) The craft arrives in New Zealand there; or o (b) The craft is carrying risk goods that it was carrying when it arrived in New Zealand at some other place. (2) Where this section applies to a craft and place, the person in charge of the craft shall— o (a) Obey every reasonable direction given by an inspector as to— ƒ (i) The movement of the craft in the place; or ƒ (ii) The unloading or discharge of risk goods or the disembarkation of crew or passengers from the craft; or ƒ (iii) Measures (including any bond required under section 18(2) of this Act) to ensure that any risk goods not intended to be unloaded or discharged from the craft are maintained in a secure place under the control of that person; and o (b) Within the required time or times, deliver to an inspector a report, in such manner DQG IRUP DQG FRQWDLQLQJ VXFK SDUWLFXODUV YHULÂżHG E\ GHFODUDWLRQ DQG ZLWK VXFK supporting documents, as may be required; and o (c) Answer all questions relating to the craft or its cargo, crew, passengers, stores, or voyage, asked by an inspector;— and every person disembarking from the craft shall, on request by an inspector, make his or her baggage available for inspection by the inspector. Privacy Statement Information sought on the New Zealand Master’s Declaration and associated crew and passenger lists for arriving crafts is required to administer the Biosecurity Act 1993 (the Act). Collection of this information is authorised by s19 of the Biosecurity Act and failure to provide information may be an offence under the Act. The Ministry for Primary Industries will not disclose any personal information unless it is in accordance with New Zealand law. The Privacy Act 1993 provides rights of access to, and correction of, personal information held in readily retrievable form. DON’T BRING MARINE PEST HITCHHIKERS TO NEW ZEALAND ON YOUR BOAT More than 200 introduced marine species are already established in New Zealand waters and it’s estimated over 85 percent of them arrived as biofouling – the growth on the bottom of vessels. Once established here, introduced species can have severe economic and environmental impacts.

KEEP RECORDS

Before you leave your last port for New Zealand, check your hull, keel, rudder area and hull fittings for any fouling growth. If necessary, haul out and clean it. If this is not possible, give your vessel an in-water clean, paying attention to through-hull fittings, areas not protected by antifouling, and other submerged areas that either protrude or recess as these can harbour pest species.

It is good practice to keep good records of your vessels’ cleaning and antifouling history, such as: » antifouling paint details; » the date, location and facility/person that carried out the last dry docking/haul-out and antifouling; » receipts from marinas, haul-out facilities and paint suppliers; » dates and locations for when you inspected the hull and whether it was cleaned as a result. Inspectors may request this information on your arrival in New Zealand to assess whether your boat presents any biosecurity risk from fouling.

In-water cleaning could be used for removing a light slime layer, and is useful for ongoing maintenance of a clean hull. But once again, if you have fouling above slime, you should only clean your vessel in facilities with waste containment so that potential pest species are not entering New Zealand waters.
