Carnival worker accused of touching teenage girls

Authorities say a carnival ride worker was arrested for inappropriately touching two teenage girls at a fair over the weekend. Cody Johnson (age 20) of Kewanee, Illinois, is charged with inde- Cody Johnson cent behavior with juveniles. On Sunday, September 24, two teenage females reported being touched inappropriately in separate incidents by a carnival ride worker later identified as Cody Johnson. Johnson was employed by an amusement contractor providing rides and games at the Cut Off Youth Center fair. Both victims claimed to have been touched inappropriately while Johnson was securing them on the ride. Detectives learned Johnson also asked one of the girls about their age. After detectives questioned him about the incident he was arrested and transported to the Lafourche Parish Detention Center. See Arrest Page 7-A

Changes coming to habitual offender law By Dan Copp, Daily Comet

Local district attorneys are preparing for changes in the state’s habitual offender law that take effect Nov. 1. Under the current habitual offender law, repeat offenders receive substantially longer prison sentences. For example, Houma resident Kentreal Jarbar Howard was convicted for possession with the intent to distribute cocaine on Jan. 12. However, because Howard had a history of drug-related convictions, prosecutors filed a habitual offender bill against him and he was given a 30-year prison sentence in June. “Habitual offender bills are filed on a case-by-case basis based on the crime, the effect of that crime and the criminal,” said Terrebonne Parish First Assistant District Attorney Jason Dagate. “It’s used as an enhancement tool of the sentence. It’s not a separate crime in itself. It strictly deals with the amount of time somebody serves in jail based on their criminal record.” Some critics have pointed to Louisiana’s habitual offender law as one of the contributing factors for the state’s highest-in-the-nation incarceration rate. A 2013 American Civil Liberties Union study found that about 79

percent of the 3,278 prisoners serving life without parole were sentenced to die in prison for non-violent drug crimes. Peter Scharf, a criminologist at the LSU School of Public Health and Justice, said the current habitual offender law is an anathema to the criminal justice reform advocated by the Legislature and Gov. John Bel Edwards. “The habitual offender process is a great way to bankrupt the state,” Scharf said. “The fiscal impact of it is enormous. South Lafourche fire department gets new dispatch system By Bridget Mire, Daily Comet

Galliano-based Lafourche Parish Fire District 3 is undergoing its final training sessions this week on a new dispatch system planned to improve information collection and response times. Training Officer Jordan Collins said each fire unit can already be tracked through GPS, which the new software uses.

“The computer-aided dispatch system says, ‘For this specific type of call, this is the kind of equipment that we want to respond.’ And then it says which units are the closest,” Collins said. “If this bridge is broken and we put that in, it’ll reroute and say, ‘Since the bridge is broken, this truck’s not the fastest anymore; this one is.’” And the system goes beyond that, interim Fire Chief Kully Griffin said. “Let’s say you’re fishing out in the marsh, your boat breaks down, and you have no clue where you are,” he said. “If you call 911 and get in touch with our dispatchers, they can send you a link to your phone. If you accept it, it’ll use the GPS coordinates and it’ll come up in our system. We can send that to the responders so they can find you.” This is the same software the Lafourche Parish Sheriff’s Office uses, which Griffin said will allow for a seamless transfer of information between the agencies. Collins said the system also allows dispatchers to know if the person has called 911 before or if the department has already responded to a home. That allows members to be prepared if, for example, the caller is on oxygen or has difficulty leaving the home. Previously, Collins said, dispatchers would look at flip cards to help direct patients. Now, they can simply type in a condition – such as chest pain – and the computer system will provide questions to ask. See LPFD-3 Page 7-A

Early voting will begin this Saturday and run through next Saturday, October 7 for the Oct. 14 election. Early voting will be conducted at the Lafourche Parish Registrar of Voters Office, 307 W. 4th St., in Thibodaux, and in Galliano, located 16241 E. Main St., Suite B-23, in the South Lafourche Library Building. Early voting hours are from 8:30 a.m. to 6 p.m. The election will include races for District 4 Justice of t h e Peace, Lockport Police Chief and the Greater Lafourche Port Commission’s Division E seat, as well as for state treasurer and public service commissioner and several propositions. Stacy Hernandez, a notary public from Cut Off, and Martin Wade, a notary public from Galliano, are vying for the Lafourche Justice of the Peace seat in District 4. Interim Lockport Police Chief David Harrelson Jr. and former Chief Ernest Boudreaux Sr. are running for that office, along with veteran law enforcement officer Chester Douglas. Jimmy “T-Jim” Lafont and Curtis “Tompuss” Pierce are vying for the Greater Lafourche Port Commission’s Division E seat, left vacant after Wilbert Collins Sr. died in May. French Food Festival Pageant will be held this weekend The French Food Festival Children’s Pageant begins at noon on Saturday, September 30. Children from 0 months to 14 years old can compete for a title with a custom crown and banner for only a $50 entry fee. All entries and monies will be due by Friday, September 29, 8:00 p.m. Raffles can be sold to secure an entry into the pageant with 3 great prizes and an entry of $75. Photogenic entries are $5 each. Eucharistic Procession will be held on Oct. 7

The “Foi de Nos Pères” (Faith of Our Fathers) Eucharistic Procession up Bayou Lafourche will be held on October 7, on the feast day of Our Lady of the Rosary. Beginning with Mass at 8 a.m. at Our Lady of Prompt Succor Church in Golden Meadow, the procession will continue with the Blessed Sacrament up the bayou, stopping at each Catholic Church until the Co-Cathedral in Thibodaux. Tarpons roll, Trojans stumble to start district play Gazette Sports Reports

For a half, South Lafourche got pushed around by the Ellender Memorial football team. But in the second half, the Tarpons started pushing back and the result was a comeback victory for South Lafourche to start district play. The Tarpons beat the Patriots 28-25 on a homecoming Friday night in Galliano thanks to 14-straight thirdquarter points which gave the Tarpons a lead they’d never relinquish. Halfback Corbin Allen was huge in the win, rushing for 187 yards with four touchdowns. But the Tarpons’ defense was also stellar late, forcing multiple turnovers and keeping the Patriots off the scoreboard for the entire fourth quarter of the win. “I think it was a matter of pride,” South Lafourche coach Blake Forsythe said. “In the first half, they were more physical than we were. We didn’t have the pride we needed. We challenged our kids at halftime and I think they responded and played with more intensity and energy.” For a while, it looked like the Patriots would spoil Homecoming night. South Lafourche scored first after an Ellender turnover – a 12yard scamper from Allen which put the Tarpons up in the early minutes of the game. But Ellender owned

almost all of the remainder of the first half. The Patriots scored 17-straight points after the Tarpons’ early touchdown to take a 177 lead with 3:31 to go before halftime – the last score coming from halfback Jahon Johnson on a long run. The lead held until just before halftime with South Lafourche deep in their own territory. On a third down and 10 play with South Lafourche at their own 29-yard-line, Forsythe called a draw play to Allen and the halfback delivered. He broke a few tackles, got into the secondary and outran the defense, going 71 yards for a touchdown to cut Ellender’s lead to 1714 at halftime. “I think that was a big play in the game,” Ellender coach David McCormick said. “It gave them back all the momentum when we’d worked the whole first half to take it back. In one play, it was all gone.” Out of halftime, South Lafourche added to its momentum with another long touchdown run from Allen, which came on a fourth down play. After a Jake Galjour interception, the Tarpons scored again to go up 28-17 midway through the third quarter. Ellender didn’t quit, hitting a 71-yard touchdown run from Reginald Williams to cut the lead to 28-25 with four minutes left in the third quarter. But South Lafourche held on. With long, time-consuming drives and a motivated defense, South Lafourche held Ellender for the entire fourth quarter to secure the win. The last straw was a late-game first down run from Jeremy Rogers, which allowed the Tarpons to get into the victory formation and seal the win. Trojans fall to East St. John

If Central Lafourche football coach Keith Menard could figure out how to stop his team’s problem with slow starts, he’d bottle it up and sell it. “I’d be a millionaire,” Menard said with a laugh. But as it stands, the remedy is still not known and the Trojans still struggle to compete early in games. Central Lafourche lost 35-13 at East St. John on Friday night – a defeat that felt like déjà vu, according to the Trojans’ coach. The defeat dropped the Trojans to 1-3 on the season. “I keep getting asked why we start off slow and I don’t have an answer right now – I wish I did,” Menard said. “As coaches, we have to keep coaching. We have to keep trying to get better and just hope that it all will level out and go our way soon.” The slow start put Central Lafourche in a hole too big to dig out of. No one scored in the first quarter of Friday night’s game, but the Wildcats dominated the second quarter, scoring two touchdowns and getting a safety to take a 16-0 lead into halftime. The Trojans had multiple turnovers in the half, in addition to the safety, which set up the Wildcats’ points. “We just didn’t protect the football,” Menard said. “It’s hard to beat tough teams when you lose the turnover battler.” In the second half, the tone of the game stayed the same, as the Wildcats forced turnovers, which led to points and a 29-0 lead at the end of the third quarter. In the fourth quarter, Central Lafourche scored twice, but never threatened victory. The Wildcats added a touchdown of their own, which sent the game to its final margin. The Trojans will take on Ellender on Friday night in Bourg. Menard said he needs a full four-quarter effort from his team in that game. “We have to play better,” Menard said. “We peeked at Ellender a little bit on film, but mostly, our goals are fixing us right now. We have to get better. We have to play better.”

HUNTSVILLE, Texas – Playing as a ranked team for the first time in 10 years, the Nicholls State University football team struggled against top-5 Sam Houston State as the Colonels were handed a 66-17 setback Saturday night at Bowers Stadium. Nicholls (2-2, 1-1) came into the matchup ranked at No. 23 in the FCS Coaches Poll, but was completely outmatched by the highpowered No. 3 Bearkats (3-0, 1-0). Sam Houston needed just 34 seconds to score, setting the tone for the rest of the night. Down 21-0, Nicholls got on the board on a Lorran Fonseca field goal early in the second before the Bearkats answered with 38 straight points. The Colonel offense was limited to 307 yards and had a rough going on third down, converting 2-of-14. Sam Houston piled up 619 total yards with Jeremiah Briscoe leading the way

with 305 yards passing and three touchdowns in three quarters of play. Chase Fourcade was 11-of-24 for 136 yards passing, had one interception and a late 57yard touchdown pass to Damion Jeanpiere Jr., who had four grabs for 95 yards. Jeanpiere came into the game leading the FCS in receiving yards. Sam Houston struck first with its own long bomb, scoring on a 56yard touchdown catch by Nathan Stewart. Back-to-back rushing touchdowns made it 210 before Nicholls cracked the scoring column with 10 minutes to go in the half. Fonseca, who was just named Southland Conference special teams player of the week, kicked a 37yarder for the Colonels’ only points in the first three quarters. A group of Holy Rosary Catholic School BETA Club members participated in the Service Snapshot Competition at BETA Leadership Summit last year. Students were asked to identify, design, and carry out a service project that addressed at least one real community need. Our students decided to focus on the tremendous need of socks for the homeless and underprivileged. The project, which was called “Socks to Warm the Souls,” earned the honor of competing at the National BETA convention held in Orlando, Florida this summer. Students decorated and placed special bags in each classroom and encouraged students to donate socks. They also held a “Sock Hop” which allowed students to enter for the price of a clean pair of socks. Socks were also collected during Catholic Schools Week. Members collected over 5,000 pairs of clean socks and distributed them to local agencies in our community, the New Orleans area, and Africa. The BETA members were honored to place 5th out of 24 other projects at the National Convention. Members who presented the project in Baton Rouge and Orlando were: Grant Rebstock, Parker Angelette, Alaina Ashmun, Abbi Collins and Carmen Duet.

Judges get tired of these guys, so they sock them with the habitual offender bill. I have a friend who said the habitual offender law is the best pathway to socialized medicine.” Lafourche Parish First Assistant District Attorney Kristine Russell contends the habitual offender statute plays a crucial role in the criminal justice system because it gives prosecutors a tool to help keep violent offenders behind bars. “Here in Lafourche we don’t use it often, but when we do, we take a look at rap sheets and look at what type of crime the individual committed,” Russell said. “Have they been law-abiding citizens or do they just re-offend? We don’t take it lightly. It’s a tool that we use to protect society.” As part of the criminal justice reform package approved by lawmakers over the summer, the new habitual offender law won’t be as stringent as the current statute. Nonviolent repeat offenders convicted on drug-related charges will not be subjected to life in prison under the new law, and multiple offenders will face shorter sentences. Rep. Tanner Magee, R-Houma, who also works as a criminal defense attorney, has witnessed firsthand the habitual offender bill in action. He was one of the lawmakers who helped bring about the state’s criminal justice overhaul. “The habitual offender law is a powerful tool for the DA’s office to put away truly bad people, but under the old law it was really capturing a lot of people who were not violent criminals who are more likely to be drug addicts,” Magee said. “It was forcing them to plea in situations where they weren’t necessarily guilty of their crimes.” “All we did with the new law was clarify those crimes which are the ones we really want to use the habitual offender law and those crimes that we would like to see someone get a second chance,” Magee added. “Those would include your drug posses-

While Russell said she supports criminal justice reform, she added that the state needs to put a plan in place to transition nonviolent offenders back into society. “There’s a reason why we have prisons and there is a reason why these individuals can’t live among the rest of us,” Russell said. “It shouldn’t just be about letting people out of prison. We need to develop programs to help people who are addicts. I’m all for reform, but we need to develop a way to give them the treatment they need.” Changes to the habitual offender law will not apply to those who are already serving time in prison.

The Board of Commissioners of the Greater Lafourche Port Commission met in regular session on Wednesday, August 9, 2017 at 10:30 AM at the Administration Office 16829 East Main Street, Cut Off, LA 70345. Vice President Gaudet called the meeting to order and Secretary Cheramie called roll. ATTENDED: Chuckie Cheramie, Perry Gisclair, Kris Gaudet, Rodney Gisclair, Mike Callais, Larry Griffin, John Melancon, Jr., Jimmy Guidry, and Ervin Bruce ABSENT: None Upon motion by Melancon second by Bruce, with no public comment, the board unanimously approved the minutes for July 12, 2017 regular meeting. Executive Director’s Report Northern Expansion – Engineer Neil Angelette reported RLB Contractors has dredged approximately 70,000 cubic yards for Slip C 950 LF West Sweep Dredge project. They are currently 80 days past the contract time. Angelette recommends approval of the pay request of $167,999.76 which does account for the liquidated damages withheld. Engineer Angelette reported the contracts have been signed with Sealevel Construction for GLF625 Site Improvements project. We plan to schedule a preconstruction meeting next week. Engineer Angelette reported Sealevel Construction has completed driving piles for 2 deadman for Slip C 939’ West Bulkhead project. The sheet piles are being coated and painted in Alabama. Angelette recommends approval of pay request of $255,437.29. Engineer Joe Picciola reported bids were opened on July 26th for the Slip C 1671’ East Bulkhead project with Crosby Dredging being the lowest responsive bid in the amount of $10,237,799. The bid was in order and he recommends the award to Crosby Dredging. Executive Director Chiasson stated 400’ of this project is for the Oceaneering lease and the remaining 1271’ is under Right of First Refusal with Newpark Drilling Fluids. Engineer John Plaisance reported contracts have been signed with Crosby Dredging for the Mitigation Dredge of Slip D. We plan to schedule a preconstruction meeting next week. Airport Projects – Richard Osborne reported in July the total aircraft operations were 2,661 with 10,284 passengers and 9,138 vehicles. He reported bids were opened on August 3rd for the Taxiway Lighting and Runway LED upgrades project with Sun Industries being the lowest responsive bid totaling $796,124.14. The recommendation is to award contingent on FAA funding. Gaudet stated good job with the lights at the self-service fuel station at the Airport. Other Projects – Dustin Malbrough with GIS Engineering reported on Section 203 Feasibility Study. He stated the next milestone is November 1st to submit the draft EIS along with having our tentatively selective plan which is what depth is most economical to the Port. The 3 big components to get to the milestone are 1) economics which is 85% complete, 2) additional benefits of LNG and general cargo, and 3) maintenance dredging figures. Currently the Water Institute is working on the modeling for dredging and should have preliminary figures in October. The draft EIS is 65% complete. Melancon questioned if the 2 other firms AECOM and JAYMAC are still working on economics, which Malbrough replied yes. Davie Breaux reported E&L Enterprises repaired the wharf and sills for the Nerby Collins Marina steel pile replacement project. They are on site with the crane barge and began removing the wood pile clusters then will start driving the steel piles. They should be complete by the end of the week. Joni Tuck reported on the Offshore Anchorage. She spoke to the USCG Captain of the Port late last week and they are fine with the offshore anchorage site and it has been forwarded for signatures. Chiasson reported the widening of LA 308 for the Airport Access Road is continuing to move forward. Chiasson stated the LNG company, Energy World has submitted the request for prefiling with the Federal Energy Regulatory Commission so it is now a public project. Also, the preliminary waterway suitability assessment was submitted to the USCG. Now the time has started for Energy World to get everything done for their LNG facility in Port. In the upcoming months, you will start to see several Energy World public meetings as part of the public outreach process. Cheramie questioned who is in charge, which Chiasson replied the person in charge is Chris Poke. Griffin questioned if that is the same thing being built in Cameron Parish, which Chiasson replied no however there are tons of LNG work and new plants taking place in and around the gulf and in other parishes. Update from Restore or Retreat (ROR) – Simone Maloz reported on the work being done as a result of the Coastal Master Plan. ROR is distributing a copy of the master plan along with a map to all state libraries distributing. Relating to finances and the possibility of public/private partnerships or how governments can do things as a business, ROR secured a grant to partner with CPRA to start a financial structure for them. ROR will look into ways to maximize and leverage the funds they have and the expected future funds of over $10 billion over the next 15 years. The statement of interest and qualifications was posted last Friday to develop a team of financial services to look at what we have and other ways to make it last longer. The statements will be due in September. We hope to have that underway by October to influence the state’s next annual plan of how the money is spent. We want to make sure the funds are available to do the projects we have in place. Chiasson stated a lot of the funding from the different pots of money is grant based, so we will need to bank roll to have the cash flow in order to complete the different projects. Maloz explained it is similar to the Caminada project the state had to put up the cash first since the funds were grant based then submit invoices to get reimbursed. The state is not in the position to help bank roll, so we need to find other ways to do so. The good news is money man-

agers like the fact that the money is spread out over a period of 15 years and part of federal regulations related to the Department of Justice, so that money is secure in more ways than most. Caminada is a good example, but we are trying to do 5 or 6 projects like that a year so what we don’t want to do is start all these projects and get to year 4 and find out we owe someone $800 million. It has been a very interesting partnership and we are glad that CPRA is trying to think more like a business and hope that this is the first of many to bring the business side to state agencies. Committee Reports Executive Committee - The committee met July 26th in Fourchon present was P. Gisclair, Melancon, Griffin with Cheramie absent. They also met August 7th in Cut Off with all present. Gisclair second by Kris Gaudet, with no public comment, the board unanimously approved the sale of the 2005 Pontoon Mounted Excavator in the amount of $37,200.00 to Waterfront Property Services, LLC. Upon motion by Melancon second by Guidry, with no public comment, the board unanimously approved the request from FCC Environmental Services to lease site GLF624-A of 17.245 acres fronting 939 LF along Slip C. Upon motion by Guidry second by Bruce, with no public comment, the board unanimously approved the 2-year renewal of Adopt-A-Road program for LA 3090. Upon motion by Melancon second by Griffin, with no public comment, the board approved naming the Operations Center in memory of Wilbert Collins, Sr. President Gisclair presented for the board’s approval the request from Expert Riser Solutions for a landlord agreement. Bryce Autin explained this allows the bank to come on the lease site in the event of a foreclosure on the loan to sell moveable equipment and also assign the lease to another company in an effort to make back their money. The one difference in this agreement is the bank’s request to foreclose on property and not have to pay rent until the foreclosure is complete. We did negotiate putting a 12 month cap on the time to sell moveables and assign the lease. At the end of the 12 months, they will pay all back rent. Another issue is the sublease with Weatherford which it was negotiated that during the 12 month foreclosure period the bank pledges the rental paid by Weatherford will be paid to the Port to go toward our rent which is an additional security. Upon motion by Gaudet second by Melancon to approve the landlord agreement, the floor was open to discussion. Gaudet questioned if they will remit payments from Weatherford as they are received, which Autin stated the only way the 12 month abatement starts if they are not making enough money on the sublease to pay our rent as it comes due. Melancon stated this is a USDA government loan, which Chiasson stated it is a USDA loan but through a bank in Louisiana. With no public comment, the board unanimously approved the Expert Riser landlord agreement. Permits & Waterways Committee - The committee met July 26th in Fourchon present was P. President Gisclair questioned if they are replacing the whole line, which Autin stated that this is only for our property. However, he did see the plan that will go underneath the Corps’ levee but not sure how far north it will go. The permit does not cover anything south of our property. Gisclair’s concern is that they are removing the old line in other places but not on our site. Autin stated we will ask that question during our meeting with them. Guidry questioned the disposal of the brine, which Gisclair stated it will be flushed out and placed in the pit. With no public comment, the board unanimously approved the LOOP Pipeline Permit on Airport property subject to resolving the drainage issues raised by the Port. Street Supervisor Chris Hernandez was recognized and reported that his crew is working on drainage problems and cutting town servitudes. There is a problem with trees in the way and he will need a machine that will straddle the ditches. That is what is especially needed for the ditch behind the Esponge house and school. Will start working on culverts and flood gates soon. The Mayor thanked the Grand Isle Independent Levee District for the hard work they have been performing.
