Louisiana borrows $187M for state-financed construction work MELINDA DESLATTE Associated Press

BATON ROUGE, La. (AP) — Louisiana borrowed $187 million Tuesday to keep money flowing to state-financed construction work, with continued budget unW certainties and the recent flooding damage raising questions about which projects will proceed. The Bond Commission, which oversees construction spending, approved the general obligation bond sale, which involves borrowing money by selling bonds to investors for upfront cash. Corps finally grants permit for Larose Floodwall project By Buster Avera Contributing Writer

The U. S. Army Corps of Engineers has finally granted the permit to complete the Larose Floodwall Project, the last low spot in hurricane protection for lower Lafourche parish. South Lafourche Levee District (SLLD) General Manager Windell Curole made the announcement on Saturday, August

28th, saying the Corps will allow the levee district to finish several hundred feet of sheet piling and concrete wall along the south side of the Intracoastal Waterway in Larose. The project, to improve elevation along the south bank of the Intracoastal Waterway in the Delta Farms area, was about halfway complete when the CORPS notified SLLD in Decemt

ber that it must stop work on the wall because one or more permits had not been granted. The Larose Floodwall Project was designed to raise the height of the wall, which the Corps built back in 1986, from its present height of 8-ft. above sea level to 13-feet. Curole said remobilization of the contractor will take place immediately, and work can resume

SLLD had hoped to finish the project by mid-summer, but Curole said the floodwall project is now set for a mid-October completion.

Lafourche Parish Sheriff’s Office deputies conducted a seatbelt checkpoint recently near the Mathews area. State police headquarters in Baton Rouge says drivers can expect “an increased law enforcement presence” on state highways this weekend. Authorities will target suspected drunk or drugged driving, failure to wear seatbelts, aggressive driving and distracted driving. Last year, state police say five people were killed in preventable Labor Day weekend crashes. Troopers also urge motorists who witness hazardous situations to call *LSP (*577) and report that activity to the Louisiana State Police.

Convicted murderer seeks money for appeal By Bridget Mire Daily Comet Staff Writer

A man found guilty of second-degree murder in a 2013 shooting in Cut Off is asking for public defense money to appeal his conviction. Robert Chouest, 33, of Cut Off, killed Shawn Galjour, 41, of Larose, in the early Robert Chouest morning of May 22, 2013. Galjour had been lying in a driveway near Chouest’s home on ABC Lane. State District Judge John LeBlanc of Thibodaux found Chouest guilty Jan. 29. In a written request to LeBlanc, Baton Rouge attorney Michael Fiser said Chouest cannot afford the estimated $21,495 to appeal his conviction. A state law about determining indigency says, “A defendant is presumed to have a substantial financial hardship if he or she is currently serving a sentence in a correctional

Prosecutors can use rape allegations against the defendant in a Lafourche Parish triple-murder trial despite his attorneys’ assertion of a David Brown lack of physical proof of sexual assault, a judge ruled last week. David Brown, 38, of Houma, is charged with first-degree murder in the Nov. 4, 2012, stabbings of 29year-old Jacquelin and her daughters, 7-year-old Gabriela and 1-year-old Izabela Nieves. Brown is also accused of sexually assaulting Jacquelin and Gabriela Nieves and then setting the family’s Lockport apartment on fire. He is no longer formally charged with rape or arson, but prosecutors plan to use those claims to justify seeking the death penalty if he is convicted in his trial starting Sept. 12. In a hearing in Thibodaux, state District Judge John LeBlanc denied several requests by New Orleans attorney Kerry Cuccia, of the Capital Defense Project of Southeast Louisiana.

institution or is housed in a mental health facility.” Chouest is serving a life sentence at the Louisiana State Penitentiary in Angola. “By virtue of that circumstance, he is indigent,” LeBlanc ruled in a hearing Wednesday. Chouest has been through two trials in this case. The first, held last year, ended with the jury unable to reach a verdict. The jury forewoman said in court last year that the majority had voted guilty. Chouest later chose to have LeBlanc decide his fate in the second trial rather than a jury. Chouest testified that he’d been up for three days and consumed crystal methamphetamine, five rocks of crack cocaine, about six beers and several pain pills. He said he told his grandfather right after the shooting that he thought he’d shot an alligator.

Chère Tante Ca

Words of advice from a Good Ole Cajun Woman!

[Dear Aunt Ka-Me-La]

Dear Tante Camilla, When my wife gets home from work in the afternoon she changes into these old trashy clothes that are too big and sloppy. Then she cooks dinner, helps with the kids’ homework and bathes them and when they go to bed she goes to bed too. It’s like she doesn’t want to have anything to do with me. And with the way she’s already dressed by the time I get home from work, it’s not like she’s very attractive to me anyway. I hate that our marriage is going downhill but that’s the way it looks. Signed, She’s never in the mood ___________

amis. This is Tante Camilla ready to give you some advice. So venez ici and écoutez. First of all, T-boy, go back and read what you said. Your wife works, she cooks, she does the homework with the kids and she gives them a bath. So my guess is that la pauvre bête est trés fatigué. She probably puts on those old trashy clothes so when she’s cooking she don’t get her nice work clothes dirty or maybe she just wants to be comfortable. She’s more than just her clothes, beb. Otherwise you could put a skirt on an otter and call it a Madame. Second, maybe she don’t put any effort into herself because you don’t make her feel good about herself. When a woman feels like her husband thinks she’s beautiful, she’s more likely to fix herself up and flirt a little bit. A person that is flattéed gives a lot more sugar than one that is ignored. And third, maybe you’re looking at the wrong thing as attractive. Maybe you should look at the way she

hugs your children or makes them laugh. Look at the way she folds your socks the way you like them or how she treats others. Instead of worrying about her clothes or what time she goes to bed, pay attention to how she keeps your household and think about what you and your children would do without her. Then, T-boy, I bet you’ll think she’s the most beautiful woman in the world. And ça c’est vrai fot. Well, C’est tout pour asteur. When I get another question you’ll get another answer. -Tante Camilla

Readers can submit questions to Tante Camilla. She will respond to inquiries with sage advice that will also include a bit of humor and a lot of Cajun charm. Readers can send questions in the following ways: Mail: The Lafourche Gazette c/o Tante Camilla, P.O. Dear In the mood: Mais this is getting better than my stories. You know in the old days we didn’t talk about things between a husband and wife like people do now. We also didn’t get a divorce just because we didn’t find our husband or wife wasn’t looking attractive anymore. Anyway, bonjour, mes

Louisiana retains worst adult obesity rate in 2015

NEW ORLEANS (AP) — It was another year of too much jambalaya and crawfish pie for Louisianans, with new government data showing they remain the nation’s fattest. More than 36 percent of Louisiana’s adults were obese in 2015, higher than any other state. Louisiana’s rate didn’t change from 2014. An advocacy group, the Trust for America’s Health, released a report Thursday analyzing data collected by a federal gov-

ernment telephone survey. The 2015 survey found adult obesity rates fell in Minnesota, Montana, New York and Ohio in 2015. That was the first time in the last 10 years any states have seen obesity rates fall. Only Kansas and Kentucky saw increases. Colorado is the skinniest state, with just over 20 percent of adults obese. Alabama, Mississippi and West Virginia also have rates above 35 percent.

Cuccia asked to void the sexual-assault allegations in Brown’s indictment. He told LeBlanc that although there was trauma to Jacquelin’s and Gabriela’s genitals, there is no evidence it was caused by rape. He also pointed out that male DNA was found on the bodies, but it was not from semen. He said any reference to semen or sperm fractions in experts’ explanation of how they collect and analyze DNA samples would lead the jury to believe semen or sperm was found at the scene. All DNA in the case came from skin cells, Cuccia noted. He said prosecutors couldn’t prove who sexually assaulted the victims or with what, and that only evidence proving something should be allowed. “When rape allegations

are based on circumstantial evidence and semen is not found, physical injuries ‘strongly’ suggestive of sexual assault are not sufficient, as a matter of law, to prove beyond a reasonable doubt that a rape or attempted rape has occurred,” Cuccia wrote in one motion. He added that “allegations of rape – especially those involving child victims – are very inflammatory” to a jury. First Assistant District Attorney Kristine Russell told the judge that the introduction of all samples, whether they supported prosecutors’ allegations or not, would allow expert witnesses to give honest, thorough testimony. Attorneys would be also able to question why some samples had the Y-chromosome and others didn’t, she added. “The thoroughness of the investigation is extremely relevant,” Russell said, especially with capital

cases. She said complexity of evidence shouldn’t bar prosecutors from using it, as it’s the attorneys’ job to clearly explain terms to the jury. Cuccia also argued that seven to nine other men in Lafourche, along with every male on Brown’s father’s side of the family, could match a group of genes found at the crime scene. He noted that a type of analysis used on the samples only tests the paternal side and not the maternal side. LeBlanc ultimately determined that the evidence found at the scene was relevant to the investigation of the case. He also said if he were to caution the jury about what is and is not included in each type of analysis, he would be commenting on the evidence.

What a Life!

By: Rev. Wilmer L. Todd Did the Prince of Peace really say he came to bring division?

In chapter 12 of Luke’s gospel, Jesus tells us two strange things: First, he wants to set the world on fire. Secondly, he came to bring division not peace in our world. It seems out of character that the Prince of Peace is declaring that he has come to bring division. Many people view religion as something that brings comfort – a place of refuge and consolation when times are difficult. Yet Jesus is telling us that our faith is also a place of confrontation. That fire he came to bring can often be used to purify. Jesus has come, not only to bring peace, but to purge the world of evil. I hope that none of you are still under the illusion that we are living in a society that is based upon Christian values. Our choices are between following the teaching of Jesus or the teachings of our society. Those choices often divide us from one another. It is true that at times our society’s values may be the same as our Christian values. Unfortunately, there are many instances where clashes exist between society’s values, and our Christian values. The following are some examples of positions accepted by our society: * Life is not sacred;

abortion is fine and should be encouraged in many cases although many parents now spend thousands of dollars to adopt a child from another country. * War is the best means for settling disputes. Bomb the hell out of people if they are a threat to our interest. If innocent people die, too bad. * People who look different from us should not get the same respect as those who look the same as we do. * The marriage commitment is not really a life long commitment. It’s a temporary agreement made with the hope that it will work. If it doesn’t, just open the door and walk out. * Sexual self control is “old fashion” or stupid. Do what you want, when you want, with whom you want – just don’t catch any nasty disease. * Being civil, polite and respectful is for sissies. Use your anger to get what you want as the saying goes, “Go ahead and make my day.” * Keep the poor in their place, which is at the bottom of the heap; riches are for the rich. Get as much as you can, and keep it all. * If someone kills someone, capture them and then do the same to them. The right thing to do is to kill someone if they have killed someone so we can teach people not to kill. * Our society will gladly take your life if you are getting too old or too hard to take care of. We can eliminate you before you die of natural causes. That’s very convenient for us. These are just some positions held by many in our society. A major task is

winning bidder. The debt will be paid over 20 years with a 2.7 percent interest rate. Without an influx of new cash, Louisiana was expected to soon start running out of money for items in the state construction budget such as building repairs, economic development projects, roadwork, park improvements and lawmakers’ local projects. The state’s financial adviser, Renee Boicourt with Lamont Financial Services Corp., and Treasurer John Kennedy, chairman of the Bond Commission, were pleased with the terms of Tuesday’s sale, which were better than they expected. Kennedy had been worried new financial questions tied to the catastrophic flooding across 20

buildings across south Louisiana. New budget woes created by the flooding and Louisiana’s undetermined costs of response and recovery will heap more financial question marks on a state government struggling with an array of them. In the construction budget, Louisiana is so over-committed in projects paid with borrowing that it would take years to pay for everything with state lines of credit. Meanwhile, the state also faces stricter limits for the next few years on how much money it can borrow because of its ongoing budget problems. ___ Follow Melinda Deslatte on Twitter at http://twitter.com/melindadeslatte

Toxicology tests showed the victim’s bloodalcohol concentration was .140. Fiser represented Chouest at his second trial, along with George Ledet Jr. of Cut Off. Ledet confirmed in court May 20 that he had decided not to ask LeBlanc for a post-verdict judgment of acquittal and a new trial. Now, attorneys will instead ask the Louisiana 1st Circuit Court of Appeal to overturn the conviction.

parishes earlier this month would boost the state’s interest rate and make the borrowing more expensive. “Because of the uncertainty with the flooding, housing and other losses, I really thought our rate would be higher,” Kennedy said after the meeting. The flooding aftermath, however, may change which projects are financed with the money. Gov. John Bel Edwards’ administration, which determines how quickly projects move and which ones are forwarded to the Bond Commission for lines of credit, could reshuffle its priorities to respond to the disaster, which has heavily damaged fire stations, schools and other local government

to become aware of these issues that are directly contrary to Jesus’ teachings. If we are not aware of what is really happening in our society, then we can remain part of the problem, instead of being part of the solutions. When Jesus tells us that we will be divided from others, that kind of division is not to be avoided. None of us want to be divided from others, but we cannot give up our basic principles just to get along well with others. “Peace at any price” is not a real virtue. We need to develop a strong Christian critical spirit. To criticize is not to destroy. It means knowing how to distinguish the true from the false, the good from the bad, in every concrete situation. True critics possess good judgment and good sense. When we lack a thoughtfully critical spirit, we end up conforming to the spirit of our age. Always stand up for what is right!
