Legal Notice AMENDED LEGAL NOTICE NOTICE OF PUBLIC HEARING, BUDGET VOTE AND ELECTION EAST WILLISTON UNION FREE SCHOOL DISTRICT TOWN OF NORTH HEMPSTEAD COUNTY OF NASSAU, NEW YORK NOTICE IS HEREBY GIVEN, that a public budget hearing of the qualified voters of the East Williston Union Free School District, Nassau County, Old Westbury, New York, will be held in the Auditorium of The Wheatley School, 11 Bacon Road, Old Westbury, New York in said District on Monday, May 9, 2016, 7:30 p.m., prevailing time, for the transaction of business as authorized by the Education Law, including the following items: 1) To present to the voters a detailed statement (proposed budget) of the amount of money which will be required for the 2016-17 fiscal year. 2) To discuss all items hereinafter set forth to be voted upon by voting machines at the Budget Vote and Election to be held on Tuesday, May 17, 2016. 3) To transact such other business as may properly come before the meeting pursuant to the Education Law of the State of New York and acts amendatory thereto. A copy of the proposed budget shall be made available, upon request, to residents of the school district beginning May 2, 2016 between the hours of 9:00 a.m. and 4:00 p.m., prevailing time, except Saturday, Sunday and holidays at the Business Office, 11 Bacon Road, Old Westbury, New York, and at each of the following school houses: The Wheatley High School, Willets Road Intermediate School, and North Side Elementary School. AND FURTHER NOTICE IS HEREBY GIVEN, that pursuant to Section 495 of the Real Property Tax Law, the School District is required to attach to its proposed budget an exemption report. Said exemption report, which will also become part of the final budget, will show how much of the total assessed value on the final assessment roll used in the budgetary process is exempt from taxation, list every type of exemption granted, identified by statutory authority, and show: (a) the cumulative impact of each type of exemption expressed either as a dollar amount of assessed value or as a percentage of the total assessed value on the roll; (b) the cumulative amount expected to be received from recipients of each type of exemption as payments in lieu of taxes or other payments for municipal services; and (c) the cumulative impact of all exemptions granted. The exemption report shall be posted on any bulletin board maintained by the District for public notices and on any website maintained by the District. AND FURTHER NOTICE IS HEREBY GIVEN, that said Annual Budget Vote and Election by the qualified voters of the East Williston Union Free School District, Town of North Hempstead, County of Nassau, will be held on Tuesday, May 17, 2016 between the hours of 7:00 a.m. and 9:00 p.m., prevailing time, in the gymnasium of The Wheatley School located at 11 Bacon Road, Old Westbury, New York in said school district at which time the polls will be open to vote by voting machine on the following items: 1) To elect two (2) members of the Board of Education for three (3) year terms commenc-
ing July 1, 2016 and expiring on June 30, 2019, as follows: a. One (1) member of the Board of Education for a three (3) year term to succeed David Keefe, whose term expires on June 30, 2016; and b. One (1) member of the Board of Education for a three (3) year term to succeed Barbara Slone, whose term expires on June 30, 2016; and 2) To adopt the annual budget of the School District for the fiscal year 2016-2017, and to authorize the requisite portion thereof to be raised by taxation on the taxable property of the School District. 3) Shall the Board of Education of the East Williston Union Free School District be authorized, to expend the maximum amount of two million five hundred dollars ($2,500,000) from the 2015 Capital Project Reserve Fund, which was established on June 30, 2015 (“Reserve Fund”) pursuant to Section 3651 of the Education Law, for the following capital improvement projects: (1) supply and installation of new vinyl replacement windows at The North Side School; (2) replacement of exterior doors and kitchen ventilation system at The Willets Road School; and (3) removal /replacement of asbestos flooring, handicapped toilet reconstruction and replacement of kitchen ventilation system at The Wheatley School, and other work required in connection therewith; and to expend from the Reserve Fund therefor, including preliminary costs and costs incidental thereto, provided that the Board of Education shall determine the allocation of the costs of each project within said maximum amount. 4) Shall the Board of Education of the East Williston Union Free School District be authorized, pursuant to Education Law ß 3651, to establish a Capital Reserve Fund to be known as the “2016 Capital Project Reserve Fund” effective June 30, 2016 for a probable term of five (5) years for the purpose of capital improvements, including: (1) reconstruction and/ or improvements to the Wheatley gymnasium, track and fields, including but not limited to the installation of an artificial turf field, handicap accessibility to field areas; and replacement of gymnasium wood floor; (2) reconstruction and/or improvements to the Willets Road School fields; and (3) reconstruction and/ or improvements to the North Side security system, fields and site, including, but not limited to installation of a security vestibule, site work, and reconditioning of the basketball and baseball areas in an ultimate amount of four million nine hundred dollars ($4,900,000) plus aggregated interest, the source of which shall be transfers by the Board of Education from the general fund and accrued interest. 5) To vote upon such other propositions as may be lawfully presented to the voters. The condensed form of the 2016-2017 budget proposition and a text of all other propositions to appear on the voting machine(s) and a detailed statement in writing of the amount of money which will be required for the fiscal year 2016-2017 for school district purposes, exclusive of public monies specifying the purpose and the amount for each, will be prepared and copies thereof will be made available to any district resident, upon request at the Business Office, 11 Bacon Road, Old Westbury, New York between the hours of 9:00 a.m. and 4:00 p.m., prevailing time, on business days beginning May 2, 2016, excluding Saturdays, Sundays and holi-
days, and at each of the following schoolhouses: The Wheatley High School, Willets Road Intermediate School, and North Side Elementary School PLEASE TAKE FURTHER NOTICE, that the voting shall be on voting machines as provided by the Education Law and the polls will remain open on May 17, 2016 from 7:00 a.m. until 9:00 p.m., prevailing time, and as much longer as may be necessary to enable the voters then present to cast their ballots. The District Clerk is hereby authorized and directed to have the necessary ballot labels printed for said voting machines in the form corresponding as nearly as may be with the requirements of the Education Law and applicable law. PLEASE TAKE FURTHER NOTICE, that the election shall be held in accordance with the Rules for the Conduct of Meetings and Elections adopted by the Board of Education and applicable law. PLEASE TAKE FURTHER NOTICE, that the nominations for the office of member of the Board of Education of the East Williston Union Free School District shall be made by petition subscribed by at least 25 qualified voters of the District (representing the greater of 25 qualified voters or 2% of the number of voters who voted in the previous annual election) and such nominating petitions shall be filed with the Clerk of the East Williston Union Free School District in her office at The Wheatley School, 11 Bacon Road, Old Westbury, New York between the hours of 9:00 a.m. and 4:00 p.m., prevailing time, provided however that petitions shall not be filed later than 5:00 p.m., prevailing time, on April 18, 2016. Such petition must state the name and residence of each signer, and must state the name and residence of the candidate and shall describe the specific vacancy for which the candidate is nominated, including at least the length of term of office and contain the name of the incumbent. Each vacancy upon the Board of Education shall be considered separate specific vacancies. A separate nominating petition is required to nominate a candidate to each separate office. A nominating petition may be rejected by the Board of Education if the candidate is ineligible for the office or declares his or her unwillingness to serve. PLEASE TAKE FURTHER NOTICE, that pursuant to a rule adopted by the Board of Education in accordance with Section 2035 of the Education Law, any propositions or questions to be placed upon the voting machines shall be submitted in writing by petition subscribed by at least 250 qualified voters of the District and filed in the Business Office of the District Clerk between the hours of 9:00 a.m. and 4:00 p.m., prevailing time, not later than the 30th day preceding the meeting or election at which such question or proposition shall be voted upon, except that petitions that relate to those questions or propositions which must be included in the published or posted notice of the annual meeting, must be filed 60 days in advance of the annual meeting. This rule and such 60 day advance filing does not apply to those propositions or questions which the Board of Education has the authority by law to present at any annual or special election of the District. The Board of Education will not entertain any petition to place before the voters any proposition the purpose of which is not within the powers of the voters to determine, which is unlaw-
ful, any proposition which fails to include a specific appropriation where the expenditures of monies is required by the proposition, or where other valid reason exists for excluding the proposition for the ballot. PLEASE TAKE FURTHER NOTICE, that personal registration of voters is required either pursuant to Section 2014 of the Education Law or pursuant to Article 5 of the Election Law. The Board of Registration of this school district shall meet in the lobby of The Wheatley School on Thursday, May 5, 2016 from 8:00 a.m. to 12:00 noon and on Tuesday, May 10, 2016 from 4:00 p.m. to 8:00 p.m., prevailing time, for the purpose of preparing a register of the qualified voters of this district for said annual Budget Vote and Election, at which time any person shall be entitled to have his/h er name placed upon such registry provided that at such meeting the Board of Registration, he/she is known, or proven to the satisfaction of the Board of Registration, to be then or thereafter entitled to vote at the annual Budget Vote and Election which such register is prepared. Pursuant to Village of East Hills Code ß 271-14(A), Fences, the maximum allowable fence height is 4 feet. Pursuant to East Hills Code ß 271-143(A)(3), pool enclosure fences must be erected at least five feet from the edge of the pool and at least 15 feet from any property line and Village of East Hills Code ß 271-143(A)(1) requires a fence, five feet in height of the chain link type to be erected completely enclosing the pool, and permits only one gated entrance and egress. The proposed five foot high pool enclosure fence is located on the property line, is not chain link, and has two gates. Pursuant to Village of East Hills Codeß 271-143(A)(10)(i), pool equipment must be located in the rear yard immediately adjacent to the house or at least 75 feet away from all other houses. The proposed pool equipment is in the (right) side yard. Therefore, a special exception is requested for an inground swimming pool installation and variances are requested as to the proposed pool fence and pool equipment.
