In April, we have the traditional Easter celebrations. Spain is known especially for its Holy Week traditions or Semana Santa. The Holy Week religious celebrations in Málaga are famous countrywide. Processions start on Palm Sunday and continue until Easter Sunday with the most dramatic and solemn on Maundy Thursday and Good Friday. The Passion procession can be seen in most areas with often huge ornate "tronos" (floats or thrones) some weighing more than 5.000 kilos and in Malage they are carried by more than 250 members of Nuestra Señora de la Esperanza, they shape the processions that go through the streets with penitents dressed in long purple robes, often with pointed hats, followed by women in black carrying candles. Drums and trumpets play solemn music and occasionally someone spontaneously sings a mournful saeta dedicated to the floats as it makes its way slowly round the streets. Even if you are not Catholic it is still a spectacle to see. Also, in April the village of Competa will host an international art event for the 9th time. 22 locations will be open to the public. National, International and local artists will show their art over the Easter weekend not including Good Friday see more information on pages 44 to 47. Other events include a Seminar at the Hotel Balcon, Competa by Blacktower Financial Management see page 16. Also, there is Spring Craft and Food fair on Wednesday 3rd May 2017 between 10am and 4pm at Viveros Florena Garden Centre located on the Sayalonga/Competa rd. Finally, it is our property feature to include property management as now is a good time to leave your property in good hands for the tourist season and indeed now is a good time to buy! THE LATEST NEWS ON FLOOR CLAUSES CLAUSULA SUELO
N
ew out-of-court procedure. The recent resolutions adopted by both the Spanish and European courts regarding floor clauses, have tipped the balance to favor the mortgage or loan holder, i.e. the debtor, rather than the bank or mortgage company. Last December 2016 the European Court confirmed that the clients affected by these clauses are entitled to be reimbursed all of the overpaid amounts paid from the beginning of their loan agreement, and not only from 2013 as the Spanish courts were awarding previously. The reason for this is very simple, once a clause in any agreement is judged to be null, then it has always been null, and a fixed period of when it was not cannot be justified by any means. Despite this, there are still some banks reluctant to return the money to their customers. Following the latest sentence the Spanish government has adopted a new rule, (RD-Law 1/2017), in anticipation of the large number of claims that will occur, and to regulate an out-of-court procedure for claiming amounts unduly paid because of the floor clauses. The most important points of this rule are:

1. It applies only to loan/mortgage agreements signed with consumers. 2. It allows a period of 1 month for the banking entities to create a specific department for this type of claim. Banks should then inform clients of its existence and of how to go about reclaiming the amounts due. 3. Once the claim has been filed, the bank has 3 months to respond to the client. 4. If the client accepts the bank's offer the refund should be paid in cash. 5. Refunds may generate some tax obligations and the banks should inform the client of this. 6. It is acceptable too, to agree to reduce the capital owed by the amount of the refund due. In order to do this the bank must provide sufficient information to the client to enable them to evaluate that option and to ensure that it is economically advantageous. 7. If you are not satisfied with the amount offered by the bank, the claim can then be taken to court; however, you should be aware that if you lose the case then you would be ordered to pay the costs. Mortgage expenses Recently, the Spanish Courts have made other pronouncements concerning the possibility of
declaring null another very common clause in loan/mortgage contracts, namely the mortgage expenses clause. Specifically relating to who should pay the expenses of notary, registration and tax derived from the Loan /Mortgage Deed. Basically the courts establish that it is abusive to make the client pay all these expenses when the interested party to whom the loan is registered is the bank. Keep in mind that the new recently approved procedure does not signify an automatic claim for these expenses. It means the client would have to negotiate with the bank to claim them, and if the bank will not pay them, again, the only possibility is to go to court. Private contracts with the bank Prior to the judgment of the CJEU., (December 2016), many banking entities have signed private contracts with their clients in which the client agreed to eliminate the floor clause and to waive the claim of the corresponding amounts due to them from the floor clauses in exchange for a fixed rate on their loan/mortgage. In these cases it may be more complicated and costly to recover the overpaid amounts due to the ground clauses, but even so it is not impossible, as the Spanish Courts have issued some recent judgments declaring such contracts void. his month I spoke to Sandra Huellebrand of Feel Good Axarquía, the new business she has started in Sayalonga. Originally from Wiesbaden in Germany, Sandra and her husband relocated to Spain a year ago, having spent many holidays together in Andalucía and falling in love with the Axarquía. There are many reasons why people choose to leave everything behind to start a new life in a different place. For Sandra and her husband, it was a decision to rethink their work-life balance and to make a fresh start. Both had been jet-setting around the world

and, as for many professionals in their situation, barely had time to enjoy a private life. After another visit to stay with friends in Andalucia they finally took the plunge, selling up in Germany and making a new home in Sayalonga. Prior to setting up Feel Good Axarquía, Sandra led a varied and interesting professional life. After some years in event management she discovered her talent for hosting people: making them feel good all around, having an eye for cultural differences and using her diplomatic skills. Loving this work, she decided to set-up her own
event management company. Then Sandra had a change of tack, using her many skills to work in the hotel and hospitality sector, before finally joining her husband to work along side him in his consultancy business. ne question asked by many writers is 'How long should my story be?' Of course, the best answer is 'as long as it takes to tell the whole story', because that's your job as a writer. That said, although not definitive, there are typical word counts that editors, publishers and competitions will expect to see when you're submitting work. You've probably heard of the novel and the short story, but did you know that there are at least six different categories of fiction, depending on the length of the work, and that the shortest short story can be just a sentence?

COMPETA ART WALK 2017 The Art Walk takes place April 12th through 16th
W
ill you be in Andalucia at Easter and do you like art and culture? Then Cómpeta is the place to be! In this beautiful mountain village an attractive international art event is taking place for the 9th time. 22 locations will be open to the public. National, international and local artists will show their art. This year the event is bigger than ever with 38 participating artists from 10 different countries. So, it will be completely in line with what Cómpeta originally means: a crossing of roads.

You’ll find a variety of woodwork, jewelry, ceramics, pottery, metal objects, paintings, drawings, graphics, photographs, mosaics, bronze statues and works in textile. Among the participants this year there are several young Spanish artists, such as Jaime Adan, Alberto Tarsicio and Beatriz Constan. They are from the region and eager to conquer the art world with their unique work. From Beatriz Constan, for instance, her large and colorful works in textile can be seen.
The fact that the Art Walk coincides with Semana Santa creates a fascinating adventitious circumstance, as at the same time the authentic and traditional Easter processions will take place in this picturesque village.
One of the nice aspects of this art route is the large number of participants that have an actual connection to the village of Cómpeta. Either from living in Competa in the past or because they live in the village now, or they make frequent visits. Other international artists come specially to this mountain village for the Art Walk to exhibit their work, to make new contacts, to enjoy the relaxed and creative atmosphere and to sell their art.
The Art Walk takes place April 12 through 16. Daily between 11am and 7pm a large variety of art can be seen. Many artists will be present and will be ready to talk about their work. On Good Friday, April 14, all locations will be closed. The Art Walk offers a large

This year to assure its continuation, for the first time, sponsoriship by local businesses has been sought. Eva would also like to provide the Grapevine readers with a great tip to help avoid the Processionary Caterpillar reach the ground. That is to attach a soft rubber tube that is cut in half around the pine tree, sealing with silicone and pour diesel in the open tube. Please see the above photo of my invention!
