CAD INCIDENT DISPOSITION CODE: [ 32] [ Y] [] [] On 10/16/08, Paul Loschak called the front desk in reference to a theft. He said that sometime last night his laptop was taken out of his room. He said that he last saw the laptop in his bedroom, 303B, at 2200 hrs. He said that he left the bedroom door open and the exterior apartment door unlocked and went next door to visit friends. He said that when he returned later he went to bed. He said the next morning he looked for the laptop, but could not find it in his room. He said that he searched the room and commons area, but could not locate the computer. He asked his roommates, but they had not seen it either. The computer had a forest scene painted on the back, but no other distinguishing marks. Victim/Witness information was mailed. On 11/21/2008 I responded to the Springs Complex bldg 6 -306 along with Ofc. Pearce #82 to assist CID in recovering possible stolen property. Upon arrival I made contact with Det. Spurlin #47, Det. Pruitt #93, and Lt. Baxley #12. Det. Spurlin received consent to search room #306 by the tenant Cameron Newton. I assisted in searching the room attempting to locate a stolen laptop. My search of the room yielded negative results. Det. Spurlin advised me that she and Det. Pruitt observed the stolen laptop in room #306 earlier this morning(11/21/2008) and has not observed anyone come in or out of that room since then. Therefore it was believed that the laptop had been thrown out of the window by Mr. Newton. I searched entirely around the outside of bldg. 6 along with all surrounding dumpsters and trash cans, specifically around the dumpster nearest to the service drive by the tennis complex, all yielded negative results. Det. Spurlin and Det. Pruitt placed Mr. Newton under arrest. Ofc. Pearce and I assisted in transporting Mr. Newton to CID. After a search of Mr. Newton's person, a cell phone and keys were located. Ofc. Pearce took possession of the items while transporting Mr. Newton to CID. While enroute to CID, I was advised by Ofc. Pearce that Mr. Newton's cell phone was receiving text messages from a subject named "Ceze" discussing the current whereabouts of the laptop. One of the text messages advised that the laptop was now behind the dumpster

near the back door of the Springs. Ofc. Pearce and I responded back to the Springs and located a laptop face down on the ground behind the dumpster near the service drive by the tennis complex. There had been approximately a 15 min time lapse since I had initially checked this area to the recovery time. I immediately contacted Det. Spurlin and advised her of the findings. Det. Spurlin, Det. Pruitt, and Lt. Baxley responded to the recovery location and confirmed that the recovered laptop was indeed the stolen one they had observed earlier this morning in Newton's room. Ofc. Pearce and I then transported Mr. Newton to CID. I processed the recovered laptop and obtained two latent prints, which were placed in the latent print box.

On 10/16/2008 the victim, Paul Loschak, reported his Dell laptop stolen from his dorm room located at 42030304 Keys Complex room 303 on the University of Florida campus. Mr. Loschak said that his stolen laptop was valued at $1,700.00. Mr. Loschak said that he last saw his computer in his room at the Keys Complex at approximately 2200 hours on 10/15/2008. He said that he found his computer missing the next morning at 0730 hours. Mr. Loschak said that he had not given anyone permission to enter his room and take his laptop. A subpoena was sent to Computer Network Services (CNS) in reference to the stolen computer. On 10/23/2008 I was informed by Computer Network Services that Mr. Loschak's stolen computer had accessed the University of Florida Network on 10/21/2008. CNS advised that the stolen computer connected to a wireless access point located in Academic Advising. I was advised that the computer accessed the network on 10/21/2008 from approximately 2016 hours until approximately 2121 hours. CNS advised that the computer was authenticated to the network using a Gatorlink userid of "cnewton". That Gatorlink userid is assigned to Cameron Newton. Upon learning this information, I continued to investigate this case in an attempt to gather more information about Newton's unauthorized computer usage. On 11/21/2008 Detective Pruitt and I went to Mr. Newton's dorm room located in building 6 room 306 of the Springs Complex on the University of Florida campus. Mr. Newton invited us into his room. Upon entering Mr. Newton's room Detective Pruitt and I observed a Dell laptop on his desk in plain view. I informed Mr. Newton of his Miranda Warning and he then asked for his lawyer. Detective Pruitt and I asked Mr. Newton if he would turn the computer over so that we could check the serial number on the computer and he did. Upon checking the laptop's serial number we found that the serial number was one digit off of the serial number listed in the report for the stolen computer. In the report the stolen computer's serial number was listed as HD77271. The computer in Mr. Newton's room has a serial number of HD77Q71. The computer in Mr. Newton's room appeared to have been painted black on the top and had "CAM NEWTON" written on the lid in white paint. Detective UFPD08OFF002641

Pruitt and I then left Mr. Newton's room to contact Mr. Loschak to verify the serial number. I spoke with Mr. Loschak by telephone and he informed me that the serial number of his stolen computer is HD77Q71. Mr. Newton spoke with his lawyer, Huntley Johnson, by telephone and signed a Waiver of Search and Seizure form for his dorm room, building 6 room 306 Springs Complex. When Detective Pruitt and I entered back into his room we observed that the computer was no longer on the desk. After a search of the room we found that the computer was no longer in the room. Mr. Newton never left the third floor area after Detective Pruitt and I viewed the computer inside of his room. After a continuing investigation we found that Mr. Newton threw the computer out of his bedroom window. The computer was later located behind a garbage dumpster at the Springs Complex. It is unknown at this time who placed the stolen computer behind the dumpster. After recovering the computer, I spoke with Mr. Loschak by telephone. He advised that he never gave Mr. Newton permission to enter his room or to take his computer.

On 11-21-08, at about 0730 hrs., Det. Spurlin and I arrived at the Springs Complex building 6, room 306 to speak to Mr. Newton in reference to a theft of a Dell laptop. Det. Spurlin and I were invited inside room 306 of building six by Mr. Newton to speak about a criminal investigation. While inside, Mr. Newton's room, I observed a Dell laptop on his desk with the name "Cam Newton" written on the top lid in white paint. I then pointed the computer out to Det. Spurlin and advised her that the Dell laptop is a possible match for the stolen Dell laptop we were there to talk to Mr. Newton about. Det. Spurlin advised Mr. Newton of his Miranda Warning and he invoked his right and wished to speak to his lawyer, Mr. Defreis, before any questioning. Mr. Newton then called and spoke to Mr. Defreis, however, he was told to contact Huntley Johnson for any legal representation. Prior to us exiting the room, Mr. Newton flipped the computer over and the serial/service tag number shown was HD77Q71. However, once Det. Spurlin and I looked at the serial number attached with the report it showed a serial number of HD77271. Det. Spurlin and I then asked Mr. Newton if he could make contact with Mr. Johnson so we could sit down and talk. Det. Spurlin and I exited Mr. Newton's room and went into the kitchen area on the 3rd floor of building six to call the victim, Mr. Loschak, to verify the serial number since they were so close. A "Q" could be mistaken on a phone for a "2". Det. Spurlin spoke to Mr. Loschak and he gave the serial/service tag number of HD77Q71. That number matched the one we found inside Mr. Newton's room on top of his desk with his name written on the top lid. I called Mr. Loschak back and asked if he could bring me a copy of the note he had that contained the serial number of his stolen Dell laptop. Mr. Loschak stated he would, but it would take him about five minutes to get ready and walked to the Springs Complex from the Keys Complex. Once Mr. Loschak arrived, he handed over a note he had that contained the serial/service number to the stolen Dell laptop. Mr. Loschak advised his mother kept the records at her house that contained the serial numbers to his Dell Laptop. note was in fact the same serial/service number to the Dell Laptop Mr. Newton was in possession of inside his room. Lt. Baxley then arrived at building six of the Springs Complex to assist in the investigation. Lt. Baxley and I then walked up the stair case to the third floor to talk with Det. Spurlin in reference to the information Mr. Loschak provided. After Mr. Newton talked with his lawyer, he gave Det. Spurlin and the University of Florida Police Department consent to search of his room. Det. Spurlin filled out the Search and Seizure form and explained it to Mr. Newton prior to him signing. Once Mr. Newton signed the consent form we entered into his room to retrieve the stolen laptop. However, once we arrived inside the stolen Dell Laptop was not on his desk. We searched his room, bathroom and ceiling tiles and were unable to locate the Dell laptop. After we were unable to located the stolen Dell laptop we observed earlier inside Mr. Newton's room we asked his suite mate, Mr. Thompson, for consent to search his room for the Dell Laptop. Mr. Thompson gave us consent to search his room as well as signed a consent to search and seizure form. Det. Spurlin and I searched Mr. Thompson's room and were unable to find the Dell laptop. After searching all possible locations inside building six of the Springs Complex, we concluded the laptop must have been thrown outside his window after Det. Spurlin and I left from his room earlier that morning. I placed Mr. Newton in handcuffs as Det. Spurlin advised him he was being arrested for the theft of the Dell laptop. I then double locked the handcuffs and searched Mr. Newton prior to leaving the third floor of building six of the Springs Complex. During my search incident to arrest, I found his cell phone in his front right pocket and a set of keys around his neck. After removing his cell phone and keys, I placed it them on the window ledge and Ofc. Pearce took possession of both items prior to escorting Mr. Newton to the patrol vehicle. After Mr. Newton was handcuffed and searched, I escorted him downstairs to the east parking lot along Stadium Road. Ofc. Pearce then took custody of Mr. Newton and transported him to UFPD. While transporting Mr. Newton to UFPD, Ofc. Pearce advised a message came up on the screen advising the laptop was placed behind the dumpster. Ofc. Pearce then made contact with me through dispatch and advised he was back en route to the Springs Complex to retrieve the laptop. Det. Spurlin and I then went back to the Springs Complex to help Ofc. Pearce locate the laptop. Once we arrived, Ofc. Pearce showed us where the laptop was found behind the dumpster next to buildings five and six of the Springs Complex. Photos were taken by Det. Spurlin of the laptop on the ground behind the dumpster. While Det. Spurlin took photos of the laptop, I observed parts of the laptop were cracked that were not cracked earlier when I observed it inside Mr. Newton's room. After collecting photos, Det. Spurlin took control of the Dell laptop and placed it in the unmarked vehicle we were traveling in. The serial/service number was verified as the stolen Dell laptop owned by Mr. Loschak and the one that was inside Mr. Newton's room earlier today.

On the above date, Ofc. Pruitt requested that I bring him a Consent to Search form, to building #6 room 306 of the Springs complex. Upon arrival I was briefed on the case and that we would be searching the room of the suspected person. Det. Pruitt advised that he and Det. numerous gaming consoles were found, as well as a laptop. The Laptop that was found was not the same as the one that had been previously seen by the two detectives. I asked the detectives if they were sure it was not the same one. The reply was," Yes! we wrote down the serial number, it's not the same one." Pruitt and Spurlin stated that the suspect did enter the room to use the restroom , but never left the building. The laptop in question was not found during the search. The only other method to get something from the room would have been to throw it from the window. The window was unlocked and could be opened. I stood outside of a closed room, with glass windows in it, that the suspect was being detained in. I could overhear the conversation of the suspect on his cell phone. The suspect said "There was a computer and I took it. A few moments later suspect stated that he threw it, the computer, out the window,"Huh! Cuz they bout to search my room." The suspect was placed under arrest by Det Pruitt, handcuffed and searched. While walking with the suspect to my patrol car, I carried his property. The suspect's cell phone began to vibrate in my hand. I looked at it and a text message was displayed. It stated that the police "did not have shit and if they did, he would be under arrest." The text continued, stating that he would be fine if, the suspect, would keep denying it. The text to follow was, He should be fine." He has the computer and he put it behind the dumpster, by the back door of the springs complex." The sender went on to text the suspect, that he should tell the police that, "he, the suspect, found it next to the dumpster and it was broken. He was just trying to fix it." When one of the texts came through, it was in reply form. Attached was a text from the suspect to his accomplice, stating that he needed the computer back. I advised Det. Pruitt that I had obtained further information pertaining to the location of the stolen laptop. I explained that the while in possession of the suspect's property. Several text messages kept prompting them self, with information pertaining to the case. Without any attempt by me to retrieve the information. I retuned to the location given in the text and found the laptop in question. Pictures were taken and the evidence was turn over to CID on scene. The only information pertaining to the sender of the text was a name Ceze, that popped up on the screen with the text messages. The suspect and his property were transported to CID with out incident.

On 10/23/2008 I spoke with the victim, Mr. Loschak, by telephone. Mr. Loschak advised that he was contacted by the University of Florida Division of Housing in regards to his computer accessing Limewire. Mr. Loschak told me that his new computer does not have Limewire installed, but his computer that he had reported stolen did have Limewire installed. Mr. Loschak said that the Division of Housing told him that his stolen computer was used in housing on 10/21/2008. computer. Derrius Marlin of CNS was able to obtain Mr. Loschak's MAC address for his stolen computer. The stolen computer's MAC address is 00:12:f0:94:60:92. Mr. Marlin informed me that Mr. Loschak's stolen computer accessed the University of Florida wireless network on 10/21/2008, after Mr. Loschak reported it stolen. A subpoena request was submitted for information relating to the use of the MAC address, 00:12:f0:94:60:92, which was assigned to Mr. Loschak's computer. On 10/23/2008 Mr. Marlin faxed me the information that was requested by subpoena. He advised that the stolen computer connected to a wireless access point located in Academic Advising. He advised that the stolen computer accessed the University of Florida's wireless network on 10/21/2008 from approximately 2016 hours until approximately 2121 hours. Mr. Marlin advised that the stolen computer was authenticated to the University of Florida's wireless network using the Gatorlink userid "cnewton." The Gatorlink userid "cnewton" is assigned to Cameron Newton. The information faxed from CNS has been placed into property as evidence. On 10/29/2008 a subpoena was sent to Mr. Azfar Mian with the Division of Housing regarding the use of Mr. Loschak's stolen computer in housing. Mr. Mian informed me that on 10/21/2008 at 22:09:14, 22:16:22, and 22:36:13 Mr. Loschak's stolen computer accessed the network from the Springs Complex room 202A. Mr. Mian also informed me that Amanda Jolly and Deanne McIntosh reside in room 202 of the Springs Complex. Mr. Mian emailed me information pertaining to the stolen computer accessing the network in housing. The emailed information from Mr. Mian was also placed into property as evidence. I later spoke with Ms. Jolly and Ms. McIntosh by telephone. They both advised that they were not in their room on the night of 10/21/2008. They advised that they typically lock their door, but that they leave the bathroom door unlocked so that they can enter through the bathroom if they were to get locked out of the room. They advised that Samantha Rogers and Kylee Renninger live in the room adjacent to the bathroom. I also spoke with Ms. Rogers and Ms. Renninger by telephone and neither of then knew anything about anyone going into room 202 on 10/21/2008. I later attempted to contact Mr. Newton at his room with negative results. On 11/21/2008, at approximately 0730 hours, Detective Pruitt and I went to Mr. Newton's dorm room located in building 6 room 306 of the Springs Complex on the University of Florida campus. Mr. Newton invited us into his room. Upon entering Mr. Newton's room, Detective Pruitt and I observed a Dell laptop on his desk that matched the description of the stolen computer. I informed Mr. Newton of his Miranda Warning and he then asked for his lawyer. Mr. Newton then contacted Hiram Defreis by telephone. Mr. Defreis informed him that he needed to contact Huntley Johnson for legal representation. Detective Pruitt and I asked Mr. Newton if he would turn the computer on his desk over so that we could check the serial number on the bottom of the computer and he did. Upon checking the laptop's serial number we found that the serial number was one digit off of the serial number listed in the report for the stolen computer. In the initial report the stolen computer's serial number was listed as HD77271. The computer in Mr. Newton's room has a serial number of HD77Q71. The computer in Mr. Newton's room appeared to have been painted black on the top and had "CAM NEWTON" written on the lid in white paint. Detective Pruitt and I then stepped UFPD08OFF002641

outside Mr. Newton's room to contact Mr. Loschak to verify the serial number of his stolen computer. I spoke with Mr. Loschak by telephone and he informed me that the serial number of his stolen computer is HD77Q71. He advised that he had the serial number written on a note from his mother. Mr. Loschak provided Detective Pruitt with the note. The note has been placed into property as evidence. Mr. Newton spoke with his lawyer, Huntley Johnson, by telephone and signed a Waiver of Search and Seizure form for his dorm room, building 6 room 306 Springs Complex. When Detective Pruitt and I entered back into Mr. Newton's room we observed that the computer was no longer on the desk where we last observed it. After an extensive search of the room we found that the computer was no longer in the room. We then made contact with Mr. Newton's neighbor, Deonte Thompson. Mr. Newton and Mr. Thompson share a bathroom. Mr. Thompson said that Mr. Newton never came into his room on the morning of 11/21/2008. Mr. Thompson also signed a Waiver of Search and Seizure form and allowed us to search his room for the stolen computer. The computer was not located in Mr. Thompson's room. Mr. Newton never left the third floor area after Detective Pruitt and I observed the computer inside of his room. Since it was not in Mr. Newton's room or Mr. Thompson's room we concluded that the laptop must have been thrown out the window. The waiver of search and seizure form signed by Mr. Newton and the waiver of search and seizure form signed by Mr. Thompson were placed into property. Lt. Baxley observed a divot in the ground under Mr. Newton's window at the Springs Complex. Lt. Baxley said that the divot was consistent with a laptop computer being thrown from the third floor. The divot was photographed and the photographs were attached to this report. I informed Mr. Newton that he was under arrest while Detective Pruitt placed Mr. Newton in handcuffs. Detective Pruitt searched Mr. Newton incident to arrest. Detective Pruitt removed Mr. Newton's keys from around his neck and he also removed Mr. Newton's cell phone from his pocket. Officer Pearce was in possession of Mr. Newton's cell phone while he was walking Mr. Newton to the patrol car and then while en route to the police department. Officer Pearce advised that the cell phone vibrated and when he looked at the phone he observed several text messages from "Ceze". Office Pearce said that one of the text messages said that the computer was behind a dumpster at the Springs Complex. Detective Pruitt and I returned to the Springs Complex and met Officer Pearce and Officer Pickering at the dumpster and found the computer that we saw in the room earlier. I photographed the computer behind the dumpster and the photographs have been attached to this report. It is unknown at this time who placed the stolen computer behind the dumpster. Mr. Newton was transported by Officer Pearce and Officer Pickering to the Criminal Investigation Division at the University of Florida Police Department. Mr. Newton was placed in an interview room while I completed his arrest paperwork. Officer Wise later transported Mr. Newton to the Alachua County Department of the Jail. I informed Mr. Newton that he was going to be referred to Judicial Affairs in reference to this incident. Due to Mr. Newton receiving text messages about this case his cell phone was placed into property as evidence. The identity of "Ceze" is also unknown at this time. After recovering the computer, I spoke with Mr. Loschak by telephone. He advised that he never gave Mr. Newton permission to enter his room or to take his computer. UFPD08OFF002641

On 10/21/2008 a subpoena for Mr. Newton's cell phone was requested in order to attempt to identify "Ceze". On 12/4/2008 the computer, with a serial number of HD77271, was removed from FCIC/NCIC. On 12/10/2008 I received the information that was requested by subpoena from AT&T. The paperwork showed that Mr. Newton spoke/texted numerous times to two different phone numbers on 11/21/2008. Subpoenas were requested to be sent to Verizon and Metro PCS in order to obtain the subscriber's information. The information received from Verizon has been attached to this report and placed into property. Verizon provided the subpoenaed information for 954-815-9403. Verizon said the subscriber's name is Audberto J. Tineo. They show Audberto Tineo's address as 1783 Banyan Creek Circle North, Boynton Beach, Florida 33436. The information from Verizon also has been attached to this report and placed into property. On 1/12/2009 I requested an additional subpoena be sent to T-Mobile. Metro PCS advised that 754-281-7950 belonged to T-Mobile rather than Metro PCS. The information from Metro PCS has also been attached to this report and placed into property. On 2/2/2009 I contacted T-Mobile and they advised that they did receive the subpoena and that it was in the process of being handled. At this time they did not have any information to send me, but advised it would be handled in the order it was received. As of 2/23/2009 I still have not received any information from T-Mobile. On 3/10/2009 I received information from T-Mobile in reference to the telephone number 754-281-7950. T-Mobile informed me that the number belongs to Cesar Perez. Mr. Perez's date of birth is 2/17/1988. There is also a University of Florida student with the same name and date of birth. I will attempt to make contact with Mr. Perez. The information received from T-Mobile has been attached to this report and placed into property. After checking Mr. Perez through the University of Florida directory, I found that his address is listed as 1783 Banyan Creek Circle North Boynton Beach, Florida 33436. His phone number is listed as 954-815-9403. Mr. Perez's listed phone number is the same phone number that was subpoenaed through Verizon. His address is the same as the address that was given in the subpoenaed information from Verizon. On 3/18/2009 I left a message for Mr. Perez at 754-281-7950. On 3/24/2009 I spoke with Mr. Perez. An interview has been scheduled for 1500 hrs. on 3/24/2009. On 3/24/2009, at approximately 1506 hrs., I met with Mr. Perez in the Criminal Investigations Division of the University of Florida Police Department. Mr. Perez said that on the day that Mr. Newton was arrested, he was contacted by Mr. Newton. He said that Mr. Newton texted him to tell him that the police were questioning him about a computer. Mr. Perez said that he did not see Mr. Newton throw the computer out of the window, but found it laying on the ground outside of Mr. Newton's building. Mr. Perez said that he picked up the computer and placed it behind the dumpster where it was later found. Mr. Perez completed a sworn statement in regards to the incident, his statement has been attached to this report and sent to the records division. Mr. Perez was referred to Judicial Affairs due to his involvement in the case.
