AUCTION TERMS & CONDITIONS

La participation aux enchères implique l’acceptation inconditionnelle des conditions de vente suivantes. L’enregistrement préalable sur présentation d’une pièce d’identité officielle de tout acheteur potentiel est obligatoire. La vente est faite au comptant et en euros. Les prix figurant au catalogue servent d’estimations. Le plus offrant et dernier enchérisseur sera l’adjudicataire. Il paiera en sus des enchères 19 % plus TVA si applicable; pour les oeuvres sur lesquelles le droit de suite sera applicable, l’acheteur devra payer en sus de l’adjudication et des frais légaux 4 % supplémentaires. En cas de contestation ou d’erreur d’adjudication, le lot sera recrié. L’huissier de justice ou le notaire instrumentant tranchera souverainement toute difficulté pouvant survenir pendant la vente. En aucun cas l’organisateur ne pourra être tenu responsable d’un problème de liaison téléphonique. Les profits et risques passent à l’acheteur dès l’adjudication. Celui-ci est réputé agir en son nom propre et tenu personnellement responsable du paiement intégral des montants dus. Il devra s’en acquitter dès réception de la facture avant de procéder, dans les meilleurs délais, à l’enlèvement des lots qui lui auront été adjugés. L’organisateur se réserve le droit d’annuler la vente en cas de facture non payée trente jours après l’adjudication. Les indications figurant dans les catalogues, annonces, brochures ou tous autres écrits émanant de l’organisateur doivent être considérés comme de simples indications qui n’engagent en aucun cas sa responsabilité. L’organisateur ne garantit ni l’exactitude d’une réclamation relative à l’auteur, à l’origine, la date, l’âge, l’attribution, la provenance, le poids, l’état du matériel du lot. Aucun employé n’est autorisé à donner des garanties à cet égard. Les couleurs des lots reproduits au catalogue peuvent être différentes en raison des moyens d’impression. Une exposition préalable ayant permis aux acheteurs l’examen des lots présentés, aucune réclamation ne sera admise après l’adjudication. L’organisateur se réserve le droit de ne pas accepter ou de faire sortir de la salle toute personne qui troublerait le bon déroulement de la vente. L’organisateur, à son absolue discrétion, se réserve également le droit de modifier l’ordre numérique du catalogue, fixer la progression des enchères, refuser toute enchère, séparer, joindre ou retirer tout lot de la vente voire de suspendre cette dernière. Seul le texte français des présentes conditions fait foi. En cas de litige, les tribunaux de Bruxelles seront seuls compétents.

Participation in the auction implies unconditional acceptance of the following terms and conditions of sale. Prior registration, via presentation of an official piece of identification, is compulsory for all potential buyers. Sales are executed in cash in euros. Catalogue prices are starting prices. The purchaser of an item will be its highest and last bidder. In addition to hammer price, a buyer’s fee will be charged: 19 % plus VAT if applicable; for works to which Artist’s Resale Rights are applicable, the successful bidder will pay a 4 % supplement to total sale price and legal costs. If the sale is contested or an error is made, the lot will be re-auctioned. The bailiff or executing notary will decide any issues that may arise during the sale without appeal. The Auction House cannot be held responsible for any problem due to technical difficulties. All benefits and risks are transferred to the buyer on completion of the sale. The buyer acts on his or her own behalf and is personally responsible for paying all amounts due. He must make payment before proceeding, as soon as is feasible, with the removal of the lots purchased. The Auction House reserves the right to cancel the sale should the invoice remainunpaid thirty days after the auction. The indications appearing on the catalogues, advertisements, brochures and any other written material produced by The Auction House should be considered as simple indications and are not binding in any case. The Auction House do not guarantee the exactitude of a declaration relative to the author, origin, date, age, attribution, provenance, weight or material state of the lot. No employee is authorised to give such guaranties. Colours of the reproduced lots in the catalogue may diverge due to the impression technique. Prior viewing will provide the buyers an opportunity to confirm the nature of the lots and their current state, no complaints will be accepted after the sale. The Auction House reserves the right to refuse entrance to the auction room or to request departure of any person disrupting the sale. At its sole discretion, the Auction House reserves the right to change catalogue numbering, to set the progress of bids, to refuse bids, to separate, join or withdraw lots from the sale or suspend the auction. Only the original French version of these conditions will be deemedvalid. Courts of Brussels will have sole jurisdiction in the event of litigation.
