TERMS & CONDITIONS OF THE SALE 2017 SPRING GALA & DEER AUCTION, MARCH 10 & 11 2017 HAMPTON INN & SUITES RODEO EXPO CENTER MESQUITE, TX Buyers: All potential buyers must register prior to bidding and receive a buyer number to be used during the bidding process. By registering as a buyer or bidding in the auction, you are agreeing to the terms and conditions of the auction. In the event a person wishes to buy and hasn’t been registered nor received a buyer number, a runner will be sent to sign that person up on the spot. Bidding: Each lot will be sold to the highest bidder as determined by the auctioneer. Bidding Disputes: The auctioneer in charge will settle any dispute as to bids and his decision on such matters shall be final. Announcements: Any changes to the information printed in the auction program at the request of the donor will be announced from the auction stand as provided by the donor and such announcements shall take precedence over the program. Guarantee: Representations and guarantees are strictly between the individual donor and the buyer. TDA makes no representations or guarantees regarding any of the lots or information contained in the description of the lot, which is furnished solely by the donor. Possession: Donor will maintain possession of the donated item until full payment is made by the buyer and the item is either delivered or buyer picks up the item. Assumption of Risk: All persons who attend and participate in the auction do so at their own risk and neither TDA nor its employees assume liability for any accidents or miscommunications that may occur. Contract: Once the auctioneer announces “SOLD”, a contract is created that is solely between the donor and buyer. A contractual invoice will be submitted to the buyer for his/her immediate acknowledgement by a designated runner. The relationship between TDA, the donor, and the buyer, in relation to the auction, is that of an independent contractor and TDA expressly disclaims any agency relationship between it and the donor as well as it and the buyer. Delivery: Terms of delivery for the auctioned item are solely between the donor and the buyer. Payment: Payment may be made by cash, personal or company check, or credit card and must be immediately paid in full upon the closing of the auction. **DONOR IS RESPONSIBLE FOR ACCURACY OF INFORMATION REPRESENTED REGARDING HIS/HER LOT(S). NEITHER THE AUCTION MANAGEMENT TEAM NOR THE TEXAS DEER ASSOCIATION MAKE ANY GUARANTEES, EXPRESSED OR IMPLIED, AND ASSUME NO LIABILITY AS TO THE ITEMS REPRESENTED IN THIS AUCTION.
