I expect more bankowned homes to hit the market sometime after Labor Day, so selling now, ahead of that extra competition, could prove to be a smart move. Q: I own an investment house and already refinanced through the government’s Home Affordable Refinance Program. Still, the house is worth much less than what I owe on the mortgage, and I’m not eligible to refinance again through the government program. The rent is just enough to cover the mortgage and association dues. I really have no hardship, but I feel stuck. Short of walking away, what are my options? —Jason A: Investing in anything carries risk. I have several shares of Facebook that I probably will grow old with. In your case, it doesn’t sound as if you can escape without taking a financial hit. But you do have options that can help minimize your loss. First, you can keep renting the property. By doing this, your mortgage is slowly getting paid off, and the house is less and less “underwater” with every passing season. Eventually, you will regain equity in the house. If you do not want to take the long-term view on this, you can try to complete a short sale while still making the

payments. This will be difficult to do, especially with a tenant in place, but it may work out with a little luck. Walking away is the worst option, in my opinion, because the lender will foreclose and likely chase you down for the amount you owe on the mortgage. Q: Is it possible for my wife to buy a house without involving me as long as she can qualify for the loan by herself? —James A: Yes. But if this house is going to be your primary residence, you may need to sign some of the collateral documents, even if you are not on the loan. Gary M. through on this commitment of time, your project will be at risk for potential problems. Finding the best way to communicate varies by client, but the most likely will be email and not a phone conversation for your weekly update. If you must use a telephone, make sure that the builder follows up with a summary for your review. A fax is good as long as both parties have a fulltime fax line open. Nothing is more frustrating than a one-way fax conversation. If you decide to have job site meetings, follow the same protocol as a phone conversation with a summary of each meeting. The number of job site meetings will depend on the size and progress of your project and are not needed every week. A weekly progress report on the project’s development should have the following subjects addressed each week. Maintaining the same format each week will help the project stay on track and facilitate followup on the previous week’s report. 1. What was last week’s job progress: Under this heading, the builder lists all of the phases of construction that were completed during the last week, such as, “The footers were poured and the block work completed. The floor trusses were ordered. Received revised window proposal.” This section could also contain pictures to explain the job’s progress. 2. Review of confirmed items and questions: This section of the report addresses answers to the previous report and seeks answers for the upcoming week from the owner. An example might be, “Confirmed garage door has insulated panels. Window treatments will be selected from ABC Window Coverings. Con-

firmed that paint selection in family room has been changed to Eastwind Green with A-1trim.” This section of the report is to keep an open dialogue on both sides and helps to keep the project on track by maintaining timely selections, and recording changes. 3. Schedule lookahead: This section deals with the upcoming week’s projected progress as reported by the builder. A builder who meets customer expectations has painted a realistic picture of what to expect. Items may include, “Drywall will be completed with doors and interior trim being delivered by Thursday. Painting contractor will complete the exterior.” The projection of the upcoming week’s progress helps hold the builder responsible while aiding the owner in understanding the building process. 4. Items that require attention: This section addresses items that need immediate attention in order to keep the project moving. This area of the report keeps everyone accountable and will be addressed in the following week’s report. If a selection or question is not completed, it will remain under Section 4 in the following week’s report under “extreme attention required.” As you can see, it takes effort from both parties to make your building experience positive. THE TENANT AND THE ELECTRIC BILL by Harry Anthony Heist, Attorney at Law

In most annual rentals, the tenant is responsible for paying the electric bill. In addition to being responsible for paying the bill, the tenant is often given instructions by the landlord and agrees in the lease agreement to place the electric bill into their name upon move-in. This requires the tenant to make a call into the electric company and/or go to the electric company office to give the relevant information and pay a utility deposit, which varies by company providing the electric. In a perfect world, the tenant does just that. Prior to move-in they get the electric placed into their name and pay the bill. What happens when they do not pay the bill? In many places, the electricity is simply shut off and the tenant is without electricity. This is the tenant’s problem, and no liability to the landlord occurs. The tenant may then pay the bill and have it reconnected, steal the electricity from an adjoining tenant, put jumper wires on the electric meter or completely live without electricity. In some areas of Florida and in many apartment communities, the electric will revert back into to the name of the apartment community, and the apartment community will later be notified that this has occurred, sometimes weeks later. This is to prevent a unit from being without electricity. While we cannot control what the tenant is “supposed” to do, we can take action, but must be careful that we do not run afoul of the law.

Florida Law and Electric

Florida law specifically states that a landlord shall not directly or indirectly cause interruption in the tenant’s electric service. FS 83.67 Prohibited practices. (1) No landlord of any dwelling unit governed by this part shall cause, directly or indirectly, the termination or interruption of any utility service furnished the tenant, including, but not limited to, water, heat, light, electricity, gas, elevator, garbage collection, or refrigeration, whether or not the utility service is under the control of, or payment is made by, the landlord.

Direct Interruption

Direct interruption would be when the landlord shuts the electric off by actually disconnecting it from the rental unit (this is rarely done but happens!), or more commonly instructs the electric company to shut the electric off. A landlord who discovers that the tenant has not placed the electric in the tenant’s name could easily feel that it is correct to tell the electric company that the electricity is not to be in the name of the landlord, but rather that it must be in the name of the tenant. However, this can lead to a direct shut off. Further, the landlord may have had the electric bill revert back into the landlord’s name, as is often the case in apartment communities; notifying the electric company that this is not proper and that it should be in the tenant’s name will result in a direct shut off to the tenant. In the single family home setting, sometimes the property owner who lives out of state receives an electric bill, is furious and calls the electric company for a shut off. Does it seem fair to the landlord who now is stuck paying the bill? No, but we never said the law was always fair.

Indirect Interruption

An example of indirect interruption occurs if the landlord receives an electric bill on an account that

should have been in the tenant’s name, and the landlord simply fails to pay it. Here the landlord has full knowledge that the tenant failed to place the account in his or her name, and by the landlord not paying it, the account will get shut off. Again, this seems unfair to the landlord, but is the law.

Steps to take if it is discovered that the tenant is not paying the electric

Once it is discovered that the tenant is not paying the electric bill, the tenant needs to be notified immediately by the use of a 7 Day Notice of Noncompliance with Opportunity to Cure. The notice may state the following: You have failed to place the electric utility service account into your name as required by your lease agreement, and you owe the landlord the sum of $__________ at this time for outstanding electric bill(s).

Steps the Landlord can take

While it is beyond the landlord’s immediate control if the tenant steals electric, or in the event of reversion of the account back to the landlord, there is one thing that often occurs which is indeed completely in control of the landlord, but is often missed, because of the landlord’s forgetfulness or misplaced trust that the tenant will do what the tenant is “supposed” to do. Due to the need for electric to operate pools and a/c units, most landlords do not wish to have a time period when the electric is off. The result is that the electric is in the landlord’s name until such time as either the landlord directly has it shut off, OR the tenant directly has it placed in the tenant’s name. When a tenant moves into a rental unit and the electric is on, they will often happily sit there until the electric is shut off. But wait. How can the landlord have it shut off? Did not we just say that was illegal? The answer lies in timing. If the tenant is notified in writing that the landlord will be taking the electric out of his or her name no later than a fixed date, and the landlord does indeed do this, it is doubtful that a prohibited practice or indirect termination as envisioned by the statute will occur. We recommend the following wording in a notification to be given to the tenant prior to move-in. This can be placed directly on the INFO SHEET that the tenant should receive from the landlord, stating the names, phone numbers and addresses of the utility company, garbage pick up days, etc. Here is some recommended wording: Tenant understands and agrees that the electric service is currently on in the Landlord’s name. Tenant agrees that the Landlord shall order the electric service be taken out of the name of the Landlord within 3 days, and Tenant shall place the electric service in Tenant’s name and pay all necessary deposits. So you notified the tenant prior to move-in. Now, don’t forget to notify the electric company immediately in writing, and get a confirmation from them!! Property managers who use checklists rarely, if ever, forget to do this. As a friendly reminder, if you shut off someone’s electric after they have taken occupancy in violation of the law, WE WILL NOT REPRESENT YOU!!

There’s something fantastic about moving water, bubbling spas and the sight of a sparkling pool in the heat of Tallahassee summers. When shopping for a home in Tallahassee during the summer months, thoughts of purchasing a place with a swimming pool are often more appealing than not. Often, the warm weather makes people entertain the idea of owning a pool home who might not otherwise have considered this as an option. In-ground pools are the most popular in our area and often have such added features as elaborate fountains, spas, pool finishes and borders. Resistance swim-spas are popular as therapeutic alternatives for some home owners. Some buyers have owned homes with pools, however, many consumers may have no experience or knowledge related to maintenance issues involved in owning such a home. Here are a few tips for those new to pool ownership. First, is the home buyer purchasing a home using a mortgage, and does the mortgage lender allow financing of homes with swimming pools? Not all loans will allow this type of purchase, so knowing ahead of time is critical. Second is the cost of insurance. The added liability coverage in a homeowner’s policy, in most cases $1 million, is often required. It’s very important to reveal that the home has a pool when you phone an agent for insurance quotes. Agents will ask the type of pool, and whether it has a diving board. Insurance on

homes with diving boards or water slides is not possible in most cases. Fences surrounding the pool area are also requirements both of insurance companies and Leon County building codes. Third, maintenance costs should be taken into consideration. Knowing the type of pools, saline or chlorinated, heated or non-heated are considerations for maintenance costs because each requires different chemicals and pump systems. Life expectancy of pump and cleaning systems is something that should be included in household budgets as well.

Fourth, knowing whether a pool contributes to a home’s value is something a Realtor can help a home buyer determine. These facts will vary from neighborhood to neighborhood. Values of pools are sometimes subjective, and what works for one buyer may not for another. Fifth, the location of a pool is often a consideration in a home buyer’s mind. Is the pool too close to the home? Is there enough room surrounding the pool for a buyer’s needs? Lastly, running a pool pump and maintenance systems can cost as much as $240 a year. By using a

few energy-saving measures, such as switching to a smaller pump and reducing its hours of operation, one could expect to reduce the cost of operation by as much as 75 percent, according to the U.S. Department of Energy. Heated pool costs are significantly higher and sometimes cost prohibitive, especially when using gas heating systems. In our area, solar blankets or heating systems may prolong the swimming season. In any home purchase, home inspections are a recommendation. Typical home inspectors do not test pool equipment. Licensed pool inspectors

are of value to a homeowner to test not only the pool pumping systems, cleaning equipment, copings and decking construction and materials and any connected spa units and their function, but predicting effective life spans of these systems. There are more than 250 homes with pools for sale in the Tallahassee market. Many are getting a lot of attention. Having a pool already installed is attractive to some buyers. Others look for homes suitable for adding a pool in the future. Consider the time spent at home with your family, the personal en-

joyment of outdoor activities and entertaining, or simply the enjoyment and solitude of your personal pool or swim spa. Should you decide to purchase a pool home, taking these things into consideration will help you in your decision. Who lived here? How to dig up your house’s history By Shirley Salemy Meyer For The Associated Press

The construction of Julian Sellers’ bungalow in St. Paul, Minn., was started in 1926 and finished in early 1927. The builder was a Swedish immigrant. The family who first lived there included a married couple, their 6-year-old daughter and the wife’s mother. Sellers learned all this by sorting through building permits, tax records, city directories, maps, old newspapers on microfilm and more. A retired software engineer and a member of the Twin Cities Bungalow Club, he has chronicled the history of the structure, its environs and the people who lived in it. He even met that 6-year-old daughter when she was in her late 80s. “It’s fun to know that other families have lived here — children have grown up and been nurtured in this house,” said Sellers. “Each family makes it their own and has their own life and experiences here. It’s fun to get that feeling of continuity.” Many homeowners and apartment dwellers across the country are doing the painstaking work of researching the history of their home and neighborhood. Some delve into the past for practical reasons — perhaps they want to change the exterior of an old house and need to document how it once looked, or they want to create (or protest) a historic desig-

nation. Others are simply fascinated by the testament of time. This research “feeds into the notion of pride of place,” said Kingston Heath, professor and director of the graduate Historic Preservation Program at the University of Oregon. The history of a house and its people can also cast light on larger historical changes. “A house is like an artifact,” Heath said. “It represents these collective human values, and cultural and technological change.” Inside the New York Public Library’s BeauxArts building on Fifth Avenue, librarian Philip Sutton works amid ornate gold shelves lined with bound genealogy periodicals, passenger lists, military records, social registers, newspaper death notices and more. Sutton teaches an hourlong class on house-history research once a month. It grew out of the enthusiastic response to a blog post he wrote last year about researching the history of a Manhattan apartment building that he picked at random. He takes students step by step through his detective work, using land conveyances, early maps, Census records, databases and more. Expert house historians advise novices to focus on one question at a time and to keep notes on exactly where information was found. To begin, figure out what you know from documents you already have.

And talk to neighbors who have lived on your block for a long time to collect their stories. Be aware, however, that community stories and legends often aren’t accurate, cautions Ellen Baumler of the Montana Historical Society. “That’s the greatest pitfall — perpetuating information that is not correct,” said Baumler. “Sometimes those stories and legends are really hard to squash.” Find out whether your street name is the original one, said Mary Louise Days, a historian and board member of the Santa Barbara Trust for Historic Preservation in California. In her city, for instance, Olive Street was once Canal Street. A change like that can throw researchers off the scent, she said. House historians often want original blueprints and photographs, but

those may be lost. Be open to what is available, urges Frank Lipo, executive director of the Historical Society of Oak Park and River Forest, in Illinois. For instance, a homeowner may find a photo from the 1950s that shows the house before its porch was removed or aluminum siding installed. “You have to put aside the holy grail of the original photographs and original blueprints,” said Lipo, whose area is known as the home of Ernest Hemingway, Frank Lloyd Wright and beautifully preserved old houses. “If you can find some cool, interesting, useful things about people who lived there in different eras, it flushes out the story.” Local government offices, public libraries and historical societies are good places to find documents that detail property ownership, as well as fire insurance maps, property

tax records, Census records, city directories (precursors to phone books), old newspapers and historic photographs. Some of these documents are available online or in databases. But Days, of Santa Barbara, resists the quick, digital fix. “For something that’s really as crucial as an early building permit or an early map, I happen to just love the original documents,” said Days, noting that there can be crucial details on them such as color codes and notes. The original building permit, if it still exists, can be found at municipal government offices. Information such as construction dates, square footage, building materials, type of roof and the architect’s name may be on it. Another way to date your home is to track ownership of the property back to when it was first

built. This practice is called a “chain of title” search and often can be done at a county records’ office.
