Pedaling For a Purpose Son Honors The Memory of His Mother Rob Adams rides to honor his mother, who died of Throat Cancer in 2011 Under the early morning sun, Rob Adams pedaled his bike along a familiar path heading toward Treetops Park in Davie. The rhythmic whirl of the wheels beneath him provided a comforting soundtrack. But even in this meditative state, his thoughts were focused elsewhere – on his mother, Jean Adams, who left this world too soon, passing away from Throat Cancer in 2011. As he rode, memories of her flooded his mind. “I think a lot about her time working in real estate and living in South Florida. Together we watched the buildup of the county she was so heavily involved in,”

said Adams. “She would be stunned by the amount of growth today.” Bicycling quickly became Adams’ solace, a way to connect with the memories of his mother, while also giving him the drive to prioritize his physical health. Many buyers wonder where their deposits end up as they progress from a seller accepting their offer, to applying for mortgage financing, to handling all the other details involved with buying a house or condo. The answer to our question turns out to be rather simple, though is not that straightforward when you first think about it. Some buyers may ask: Does the seller hold our deposit? Is it sent to our mortgage lender? Do we get it back at closing? Nope, none of the above. Residential real estate contracts used to submit offers to sellers include lines for the following entries: purchase price, initial deposit (accompanying the offer), additional deposit (and date due), mortgage loan proceeds (loan amount) and balance of purchase price (due at closing). (The filled-in amounts only relate to the offered purchase price, not including closing costs.) Money that buyers use to pay deposits and closing costs must be readily available cash (not financed), verified during the mortgage application process. (Note - We use the word “cash,” though green paper money and personal checks are never used in modern real estate transactions. For security, all funds must be wire transfers directly from the buyer’s bank to the transaction’s escrow and closing agents.) Deposits are wired from the buyer’s bank to a third-party escrow agent identified in the accepted contract who holds the money in a protected, secure bank account until closing. At this point, the money’s intended use is not specified. It is being held in escrow to express the buyer’s sincerity in making the offer and intent to continue forward as detailed in the contract. The application of deposit money is not defined until a preliminary Settlement Statement is prepared much later in the deal’s timeline. Deposit money still belongs to the buyer while in an escrow account, though can be subject to forfeiture if the buyer defaults on a contract provision. If a buyer decides to terminate the deal within the designated Inspection period, under the applicable contract terms, and gives proper notice to the seller, the initial deposit can be returned/refunded by the escrow agent. The escrow agent may also be the closing agent for a transaction. Closing (settlement) agents handle the legal transfer and recording of ownership along with disbursement of all money exchanged between buyer and seller (and lender when mortgage financing is used). They also make sure that required transfer taxes, transaction charges, and service provider fees are paid. In Florida, many sellers and buyers prefer to have their own separate closing/settlement agents who cooperate to close the transaction for each side of the deal. (Personally, I prefer this arrangement of seller and buyer each having their own closing agent.) In Florida, escrow and settlement agents can be either attorneys and law firms or licensed title companies. Let’s take a moment to discuss why there are usually 2 separate deposits made at 2 different points in the transaction timeline. The initial deposit accompanies the offer as a show of the buyer’s

Deposit money still belongs to the buyer while in an escrow account, though can be subject to forfeiture if the buyer defaults on a contract provision good faith and intent to proceed. In escrow and closing agent language, buyer deposits are called Earnest Money Deposits (EMDs). Because sellers are more comfortable with higher deposit amounts, a 2nd deposit is usually scheduled to be paid after the Inspection (Due Diligence) period has ended and the buyer decides to continue with the deal. Contract language also details how buyers can terminate the offer/contract if they don’t like something in the Inspection Report, get back their initial deposits, and not have to pay 2nd deposits if they give proper notice to the seller within the required timeframe. Speak with a Florida-licensed attorney for specifics on offer/contract termination and release of deposits. In answering today’s headline question, we need to touch on a basic part of mortgage financing, the Loan-To-Value ratio (LTV). This is the relationship between a property’s market value and the amount loaned to purchase it. The buyer’s down payment amount determines the initial (qualifying) LTV for any given mortgage loan. 10% down payment = 90% initial LTV. Every loan program has its maximum LTV ratio that the lender is willing to accept when making the loan. As part of their risk management, lenders only provide a certain percentage of any property’s value, the rest has to be put up by the buyer. Without enough down payment to meet a specific loan program’s required LTV, the buyer will not be approved. A fairly common buyer misconception

when using mortgage financing is that the down payment is paid to the lender. No, the lender only needs dependable verification that the buyer has paid enough money toward the purchase price to meet the loan’s required maximum LTV. Proof of buyer payments is provided by deposit receipts from the escrow agent and the final Settlement Statement provided to all parties just before closing. At some point before closing and the legal transfer of ownership, the buyer has to get all money for the purchase and transaction costs to the escrow/closing agent. Buyer debit (-) and credit (+) line items are on one side of a Settlement Statement, seller debits and credits are on the other side. Settlement Statements show all the money a buyer has paid (or will be paying) into the deal, including: deposits/earnest money, loan amount from the lender and the net amount due from buyer at closing. The Due from Buyer line is where buyers usually end up paying the remainder of their down payments at closing. Lenders coordinate with closing agents to tell them the remaining amount due to satisfy the loan’s LTV requirement after deposit amounts have been applied. Purchase price minus loan amount = down payment amount. Buyer deposits (and the balance due at closing) pay the required mortgage down payment, along with any other buyer costs due. Remember that higher deposits increase seller comfort and confidence, especially when considering an offer which includes mortgage financing. In

order for offers to be seen more favorably by sellers (and to compete with all-cash offers), some buyers including a Financing Contingency in their offer have been known to pay total deposits equal to their full mortgage down payment amounts. This means that if they are applying for 90% financing on a purchase (90% LTV), total deposits to the escrow agent will equal 10% of the purchase price. The point here is to pay the full down payment in the 2 deposits well before any lump sum balance due at closing. When using this strategy, be sure the seller is aware of your strong deposits, and include a written explanation in the offer. It could make the difference between your offer being accepted or declined. (Of course, only do this if you are completely sure you really want to buy that property!) Look for a future article expanding on Financing Contingencies and successful strategies when including them in an offer. There we are, a bit of clarification to help buyers understand how their deposits are applied, and maybe a touch of strategy to have those deposits better stand out to sellers.

Each year at Thanksgiving, Jonathan ensures that our Kiwanis Club distributes turkeys to 100 needy families that he identifies and raises funds for providing complimentary bicycles and helmets for deserving children. When he and his wife Francys arrived from Colombia six years ago, he knew he would succeed in his chosen career in Structural Engineering, but the couple had both grown up in restaurant families, and it was in their blood. They fell in love with Downtown Hollywood and started exploring the area with the intention of opening a café. And so was born the restaurant with the interesting name of Dos Pecados, which translates to Two Sins, at 2019 Harrison Street, Hollywood, Florida 33020. “When people think of fast, tasty, simple, sometimes inexpensive food, tacos and hamburgers are some of the first ones that come to mind,” he explained. “I had thought of some other names, but I think that this is the best way to say that we have both in one place.” Before starting out, though, Fragozo brainstormed with family, friends, and

investors in the industry. He showed them Harrison Street, the whole area of Downtown Hollywood, and once they got to know it, he said, they all pushed him to open the business. “It is a family effort,” he said, adding that he greatly values all the input and opinions of his team of mentors. “I want to grow, so I have to take advantage of the people around me, their many years of knowledge and experience,” he acknowledged. “I asked for their support, their advice, their opinions, and they said yes, it’s a good idea, we will help you. I want the business to grow, so it’s very important to have that support. I know it’s hard work, but I am ready for it.” In the few weeks since they opened, Dos Pecados has already attracted a strong, local following for the two different but equally crave-worthy menus. have been the Cheese Loaded Burger, a juicy Beef patty topped with Caramelized Onions, two melted cheeses and the Dos Pecados Special Sauce at $14.75 and the Birria Taco, a Tortilla filled with Meat Stew bathed in a mix of Chiles and Spices at $9.00. Hot dogs, Burritos and Bowls are also on the menu, along with Beer and Wine. The bright and colorful interior is complemented by a cozy outdoor patio dining area, where diners can relax, eat, and drink. “I’ve spent the last six years thinking, working, deciding, and now finally opening,” Fragozo explained. “I think the good thing here in Downtown Hollywood is that you have many types of food from different countries right here. One City At A Time Hallandale Beach The CommUnity Family Field Day and Resource Fair Is This Weekend By Hallandale Beach Mayor, Joy Cooper

This Saturday February 10th is the CommUnity Family Field Day and Resource Fair by presenting Sponsor Memorial One City at a Time Initiative will be taking place. The event is also being sponsored by PAL, Hallandale Police Department Advise Athletes, myself, City of Hallandale Beach, Hallandale Beach CRA Atlantic Village, Walgreens and the YMCA. From 10:00 a.m. to 3:00 p.m. at OB Johnson Park 1000 Northwest 8th Avenue and Pembroke Road. Parking is available, overflow parking, and a FREE Shuttle will be at Hallandale High School. All residents are invited to join us for a day of activities, entertainment, and a resource fair with over 40 government agencies and service providers. When I first met with the Police Activities League and Andre MacDonald of Advise Athletes we envisioned a celebration of the life of Alex “Budda” Collins who started his NFL career in HB PAL, a day of entertainment geared to unity and healing and a gathering of providers that can bring service to all our residents. We set off to plan an event with no funding and only the donation of a location granted by the city commission. We all have been working hard to plan a wonderful day of fun, food, and something for every resident just before the Super Bowl! The event will be FREE to the public. We will be kicking off with an entertainment lineup including Gospel Singer Annette Hall and three other national groups. There will be a special memorial for “Budda,” a DJ and special guest speakers will be participating throughout the event. A FREE tailgate lunch will be provided while supplies last. The CRA will be giving out our free trees as part of the city’s greening efforts. Inside we will have a free resource fair where residents will receive a passport. At each table participants will be checked in for a chance to win FREE raffle prizes Including a TV, show tickets, dinners, gift certificates and other free prizes. One City At A Time is an initiative that is a three-year program to help preventive medical care and much more. Their goal is to provide FREE advice and service that fits their model perfectly. Many service

providers including Memorial Health Screenings, Walgreens, YMCA, Kids Care, Water Safety and Drug Prevention including FREE Naloxone. They are in the second phase of their program to improve the lives of residents. It is not simply about physical health but the needs and issues facing our community. The next two years they will provide all types of partnerships which include Mental Health, jobs, housing education and all quality-of-life issues. Many government agencies will be there including Hallandale Hepburn Center, Hallandale Beach CRA, Property Appraiser Office, Broward Housing Authority, Broward Housing Finance, and State Attorney. Broward County Environmental Services, the Supervisor of Elections, Hispanic Unity and other agencies. Many of our residents do not have

the ability to speak directly to agencies due to transportation or simply must work during the week. This is your way to find out more. The following week PAL will be hosting the Annual Comedy Show at Gulfstream Sport of Kings. This show is always an amazing evening filled with national comedians, buffet dinner and great auction to benefit our Police Activity League PAL. Individual tickets are $50 Dollars and there are other sponsorship opportunities. All the proceeds go to the many sports and initiatives for our local children. We hope that all our community partners and residents support our PAL. They

are always looking for financial support but also volunteers. You can support sports teams like flag football, cheerleading baseball basketball and football. Hollywood Celebrates Black History Month The City of Hollywood is celebrating Black History Month with several events happening to commemorate the month. The Speaker is Roberto Fernandez from Broward Trust. The event takes place from 1:00 p.m. to 3:00 p.m. at the Stirling Road Branch Library at 3151 Stirling Road in Hollywood. Hollywood’s African American Advisory Council is hosting an event on Thursday, February 22nd at 6:00 p.m. at the Dr. Martin Luther King, Jr. Community Center. The program will include a fashion show, dance performances, drumming, poetry

and more. Also, be sure to check out the photo gallery on the second floor of Hollywood City Hall highlighting prominent leaders in Black history. The “Celebrating Black History Month” display will be up the entire month of February. Hollywood Beach Sweep Join volunteers Saturday, February 10th from 7:00 a.m. – 11:00 a.m. to gather to collect litter and cigarette butts from the sandy beach. This event happens every second Saturday of the month. Volunteers meet at Charnow Park at Garfield Street and the Broadwalk, at 7

A Cultural Icon Returns Bob Dylan is one of our culture’s most influential and groundbreaking artists. In the decades since he first burst into the public’s consciousness via New York City’s Greenwich Village folk music scene in the early 1960s, Bob Dylan has sold more than 125 million records around the world and amassed a singular body of work that includes some of the greatest and most popular songs the world has ever known. This March Bob Dylan will bring his legendary music to the Broward Center. Born in Duluth, Minnesota, on May 24, 1941, most of Dylan’s childhood was spent in the iron-mining town of Hibbing. Dylan taught himself piano and guitar and played in several bands, attending the University of Minnesota for one year in 1959. He moved to New York in 1961 — heavily influenced by Woody Guthrie and other American folk artists — and began to play at various clubs in the burgeoning folk music scene of Greenwich Village. Signed to Columbia Records by renowned A&R executive John Hammond in 1961, he released his self-titled debut album in 1962. Many of Dylan’s early songs were made famous by other artists, such as Joan Baez and Peter, Paul & Mary, whose versions of his classic compositions “Blowin’ In The Wind” and “The Times They Are A Changin’” helped bring the young artist to a larger audience.

From his earliest performances in Greenwich Village coffee houses, folk festivals and rallies in the early 1960s to his stadium rock concerts of the 1970s and subsequent annual international tours, Dylan established an enduring reputation as one of the world’s great live performers. He has released more than 50 albums and has written more than 600 songs, some of the most famous being the aforementioned “Blowin’ in the Wind,” “Like A Rolling Stone,” “All Along The Watchtower,” “Knockin’ On Heaven’s Door” and “Make You Feel My Love.” His songs have been covered more than 6,000 times by artists as diverse as Duke Ellington, Jimi Hendrix, Guns N’ Roses, Stevie Wonder, Rod Stewart, the Staple Singers, the Red Hot Chili Peppers, Bob Marley, Pearl Jam, Neil Young, Adele and U2. Dylan’s contributions to worldwide culture have been recognized and honored numerous times. He received an honorary doctorate of music from Princeton University, New Jersey, in 1970 and another from the University of St. Andrews, Scotland, in 2004. President Clinton presented him with a Kennedy Center Honor at the White House in 1997, recognizing the excellence of his contribution to American culture. In October 2016, Dylan was awarded the Nobel Prize for Literature by the

Swedish Academy “for having created new poetic expressions within the great American song tradition.” In 2012, he was awarded America’s highest civilian honor, the Presidential Medal of Freedom, by President Barack Obama. In addition to winning 11 Grammy Awards, Dylan has achieved six entries in the Grammy Hall of Fame, which honors recordings of “qualitative or historical significance” at least 25-years-old.
