New Year “No Charge” Condo And HOA Estoppel Letters Will Be Changing By Christopher Carter - Real Estate Broker Associate

When selling a Florida residential condominium unit or a house in an HOAGoverned Community, an Estoppel Letter is required before closing to verify any Outstanding Debts or Violations on file with the Owners Association. They are usually prepared by the Property Manager or Management Company on behalf of the Association, then sent to the Closing Attorney or Title Company. Any Balances due are payable either before Closing or as a Seller Cost on the Settlement Statement. Debts and Rule Violations to Owners Associations attach to the property not the owner, so they have to be addressed before the property is sold to a new owner. Fees charged for preparing an Estoppel Letter are Seller Closing Costs because sellers are responsible for providing “clean” transfer of ownership. When a Property Manager works directly for the Association (in some condo buildings rather than HOAs), Estoppel Preparation Fees are paid to the Association. However, when an Association Board (COA or HOA) contracts with a licensed company to provide Property Management Services, Fees paid by selling owners for preparing Estoppel Letters are usually kept by the Management Company, not the Association. This

is in addition to the Regular Fees charged under the Company’s Annual Management Services Contract with the Association. This recent article gives a brief outline and introduction to Association Estoppels. For some background before today’s discussion, I suggest you take a look: What is an Estoppel Letter - and why would you need one? (thefloridarealestateblog.com) Recently, a Florida Senate Bill was introduced which (if passed into State law) will prohibit Associations and Management Companies from charging owners for Estoppel Letters. SB-278 applies to Condominium, Cooperative, and Homeowners Residential Associations. It will be discussed, debated, and voted on during the upcoming 2024 Legislative Session which runs from January 9th, 2024 to March 8th, 2024. Here are a few discussion points: • One of the important obligations of a Residential Owners Association is to facilitate the efficient Legal Transfer of Individual Property Ownership within the Association-Governed Building or Community. • Management companies keep up-to-date Records of the Financial Accounts and any Rule Violations for each individual property in the Associations they manage.

• Preparing an Estoppel Letter involves accurately transferring a selling owner’s account information into a template document when a request comes in from a Closing Attorney or Title Company. • Managers and Management Companies work for the Association, serving as paid Administrative Assistants to the Board of Directors. • Because charging a Separate Fee for preparing Estoppel Letters is currently allowed, most management companies and Associations charge the maximum per Florida Statutes which is now around $300 each, with additional charges allowed for expedited delivery or accounts with Violations or Delinquencies. • Being a required component of all property sales in Condominium Buildings and AssociationGoverned Communities, should preparing Estoppel Letters present an Additional Profit Opportunity and Revenue Stream for an Association or Management Company? Should preparing them be included in an Onsite Manager’s normal duties or in the stated services a Management Company provides under contract to Associations instead of an Additional Fee charged to each selling owner? Legislative Session Debate may answer these questions. • If Management Companies are concerned about losing Individual Estoppel Letter Fees under SB-

278, they may increase Annual Management Contract Charges to offset any Perceived or Expected Revenue Loss. Owners might prefer to absorb a reasonable increase in Budgeted Professional Services Fees to the entire Association instead of being charged separately every time an individual property is sold. Again, we will have to wait and see. Whether you are for or against removing all money charges for preparing an Association Estoppel Letter, contact your Elected Senators and Representatives (along with your Board and Management Company) to let them know your thoughts. Will SB-278 become Florida Law? No one knows at this point. The Bill’s merits and shortfalls have to be debated in the upcoming Legislative Session. Stay tuned in March for the outcome... Happiness can manifest itself in big and small ways

Can Money Buy Happiness? More Than Half Of Americans Say Yes In New Study (BPT) - How much money would make you happy? According to the average American, the price tag comes in around $1.2 Million. New research from Empower, a leader in financial planning, investing and advice, reveals 6 in 10 Americans believe money can buy happiness, though just 17% say financial contentment is about reaching a certain net worth. It turns out that a little goes a long way and incremental financial wins can make a massive impact on Americans’ Well-Being. “Every generation has grappled with questions of how to calculate financial happiness: hard work, a lot of planning, consistent savings, and even a little bit of luck, in just the right measures,” says Carol Waddell, President of Empower Personal Wealth. “A spirit of financial confidence prevails, with 7 in 10 saying they have clear financial goals and Americans continue to envision a bright future.” The financials of happinessWhile the study found that 7 in 10 Americans (71%) believe more money would solve most of their problems, for a third (32%) a relatively attainable gain of $15,000 would

make a meaningful impact in their lives, boosting their feeling of financial happiness for six months. That number surges to 42% with a $25,000 gain, and just $5,000 would do it for 17%. Indeed, happiness manifests in big and small ways. The majority of Americans say it’s on-time bill payment (67%) and living Debt-Free (65%), while roughly half say it’s the ability to afford small luxuries without guilt (54%) and home ownership (45%). Over half say their contentment can be found in spending on experiences with those they cherish (53%) and in optimism for what’s next, including retiring on their own terms (37%). Readying for Retirement: Nearly threequarters of Americans (73%) say they’re currently experiencing Financial Stress, with today’s Economic Pressures like inflation (81%), rising interest rates (66%) and student loans (32%) dampening their sense of prosperity. Half report carrying Debt (54% overall, and 72% of Gen X) and nearly 4 in 10 (36%) say that they couldn’t handle an unforeseen expense over $500 without real worry. In the current financial environment,

Americans now expect to retire three years later, at age 63. Those with a less detailed financial plan (or no plan at all) don’t expect to clock out until age 70, five years later than planned. For about 4 in 10 Americans (37%), and exactly half of Gen Xers, retiring by a certain age is the meaning of financial happiness. The majority (84%) are taking steps to reach this target, including putting more money into Retirement Savings (39%), Short-Term Savings like a HighYield Account (31%), and working with a Financial Advisor (26%). A quarter of savers (25%) are paying off debt more aggressively than they would otherwise and 22% are delaying a major purchase like a car. The power of planning The majority of Americans (73%) say a solid financial plan would bring them happiness, and they would like help to get there: 57% of Americans wish they would have gotten advice sooner. Nearly half of Americans (45%) say they haven’t gotten the financial advice they need, including 55% of Gen Zers and 57% of Millennials.

But those who already have a plan are proof of its power: Americans with a more detailed financial plan are three times as likely as those with a less detailed plan to report greater happiness around financial freedom (75% versus 24%), their plans to achieve financial goals (78% versus 23%), and the overall state of their finances, such as their net worth and debt balances (73% versus 19%). “The financial professionals at Empower combine the power of advice with technology to help Americans get on the path to financial freedom,” explains Waddell. “With their financial goals in mind and a solid plan to reach them, savers can spend more time doing the things that make them happy - in their working years and beyond.” Access the full Financial Happiness report on The Currency™. Hollywood Beach Renourishment Project Update Now that Turtle Nesting Season is over, the U.S. Army Corps of Engineer contractor has resumed work in Broward County. Having just completed work in Hallandale Beach, they have begun work at the south end of Hollywood Beach. They will continue using their staging area in Hallandale Beach to place sand in Hollywood until they reach the Diplomat Beach Resort. Then they’ll shift to the staging area at Keating Park. Sand will be placed from the southern boundary of Hollywood to Iris Terrace. Sand placement will continue from Scott Street to Balboa Street in the north. The schedule intends to have all work completed by April 30th, 2024. Project Details Segment III of the Broward County Shore Protection Project continues through April 2024. The U.S. Army Corps of Engineers (USACE) awarded the Segment III Beach Renourishment Construction Contract to Continental Heavy Civil Corporation. The project area is along the shorelines of Dr. Von D. Mizell-Eula Johnson State Park, Dania, Hollywood, and Hallandale Beaches. This project is expected to place approximately 887,000 cubic yards of Upland Sand along the shoreline, with a 100% cost share by the Federal Government. Where feasible, Shore Protective Dunes may be placed to complement this project. Construction will only occur on Upland Beaches where Property Owners have granted Construction Easement and, where Construction Easement has not

Hollywood’s construction is expected to be completed by April 30, 2024 been granted, Sand will only be placed below the Erosion Control Line, which defines the boundary between State Sovereign Submerged Lands and Upland Ownership. Beach Construction Access and/or Staging will be at the discretionary needs of the Construction Vendor. Thousands of residents and businesses in Broward County will benefit from this Shore Project because Storm Events Erode the Beach rather than dam-

aging or destroying Coastal Infrastructure. Beach Nourishment Projects also have inherent benefits in restoring Critical Habitat for Shorebird and Marine Turtle Nesting. The construction is estimated to cost $7,864,770 and is fully funded by the U.S. Army Corps of Engineers. MLK Hallandale Beach Is Rich In History By Hallandale Beach Mayor, Joy Cooper

This weekend we will be celebrating the life and legacy of Dr. Martin Luther King, Jr. Over the past months the Community Civic Association under the leadership of President Qunea Gordon in partnership with our Parks and Recreation Director Cathy Schanz have been tirelessly working to put together our Annual MLK Parade and Celebration this Monday. On Saturday there will be a Scholarship Fundraising Breakfast at our Community Cultural Center at 9:30 a.m. These events have been taking place for years and have grown into one of four major events we put on as a City. In the past the Civic Association formerly the Northwest Civic Association did the Parade along the side streets in what is now called the Palms Area. Former Vice Mayor Julian brought forth the suggestion from the NWCA to extend that parade route to West Hallandale Beach Boulevard. While it seemed like a huge challenge to close down part of Hallandale Beach Boulevard it turned out to work wonderfully. The route now begins on Northwest 2nd Avenue heads south to HBB then west to Martin Luther King Jr. Boulevard. From there it heads north to OB Johnson Park on Northwest 8th Avenue. The parade route is closed off including West Beach Boulevard to traffic from approximately 10:00 a.m. to 12:00 p.m. It culminates at the park where there is a fes-

tival with food and fun for the entire family, the event is FREE for everyone. It is apropos this event is the pride of the community. The rich history of our African American Culture in Hallandale Beach reaches far back before the City was established. In 1903 the earliest referenced date then referenced in 1910 the first Black school was opened here. The school is still standing and was used as a Union Hall for years. It was restored and was rededicated as a historical site in 2015. Before the City was incorporated in 1897 Luther Halland came and settled along the Flagler Railroad. He opened a trading post on First Avenue and was the first Postmaster. The City was a farming community known for Tomatoes and other Local Crops. In 1927 the Town of Hallandale was incorporated and in 1947 we were incorporated as the City of Hallandale. Around this time Developer E H Foster, namesake of Foster Park and two other developers began to build homes for many Black families from Miami. They believed in supporting ownership and felt it unfair the many families were paying large amounts of rent. As a note these men were all White. Carver Ranches “The Promise in the Palmettos” was born. Many homes both in Carver Ranches and Hallandale Beach were built and became the hub of Black Culture. This was one of the few areas

people of Color could own and live in peace. Back then there was sadly still Segregation. It was not unusual to see Sam Cooke and James Brown along Foster Road in establishments like The Palms. They would come to entertain in Casinos and clubs. This was one of the few areas they could stay. As our City evolves and our country and world are faced with Racism and Antisemitism we need to understand and remember our history. It was only back in 1960 the Lanier James Junior High was an all Black School due to Segregation. This was only 53 years ago! Dr. Martin Luther King, Jr. gave his famous speech in Washington in 1963. So, you can see we often forget simply how fresh the scars are from this bleak history. The horrible face of hatred was not only in our City but our state and nation. As we unite this weekend, I encourage all of our residents to come out and watch the parade and share in this wonderful event. Let us all remember how fragile our Democracy has become over the past few years. Let us all unite and share the support of all our brothers and sisters as we celebrate the life and message of Dr. King.

He stood shoulder to shoulder with many Rabbis and Pastors to speak out against Segregation and Oppression. As Antisemitism is on the rise and there are so many young Americans who are ignorant of the true history of not just Israel but of our country the time is now to unite. As Americans we should always stand against tyrants and groups that want to wipe out Jews. As in WWII not only did Nazis go after Jews they proceeded to go after all minorities and marginalized individuals that were Disabled, Homosexual and Gypsies. While Nazi collaborated with the Arab countries due to their shared hatred towards the Jews, the Christians, the British, the French and Communism they still believe Arabs are inferior. As Dr. Martin Luther King, Jr. so eloquently shared. “When we let freedom ring, when we let it ring from every village and every hamlet, from every state and every city, we will be able to speed up that day when all of God’s children, Black men and White men, Jews and Gentiles, Protestants and Catholics, will be able to join hands and sing in the words of the old Negro spiritual, “Free at last! Free at last! Thank God Almighty, we are free at last!” Lets celebrate his memory.
