State of the

THINGS ARE LOOKING UP! What a ride this has been. Wichita area home sales have fallen by more than 30% over the past 3 years. Starting in late 2008, the market seemed to hit the wall. During the same time, home inventory levels rose, creating a buyer’s market in many of the higher price ranges, but the market seems to be turning the corner. It won’t be a robust recovery, but rather a slow and steady improvement. Buyer confidence and continued economic improvement will keep sales moving.

What Are Interest Rates Doing? The record low rates we’ve had below 5%, aren’t predicted to stay that way over the long term. The Mortgage Bankers Association forecasts the 30-year fixed mortgage rate will rise, but only to 6.3% by the end of 2011.

Are Homes Still Selling? Yes. Home sales from March to April were up 31.4%, according to the latest figures put out by the South Central Kansas MLS. April sales figures of 891 homes were also up 31.8%, over April 2009 sales. April’s pending transactions were the highest, for one month, in recorded history. Will the tax credit bump, cause a late summer slump? We’ll see. WSU Center for Real Estate predicts a 5.1% increase in home sales for 2010.

How About Home Values? This is probably the single biggest question I get. Historically our market has enjoyed a stable and modest home appreciation of 3-5% a year. We never had a value “bubble” that needed to deflate. The 2008 and 2009 market appreciation has hovered around 2.2% and is predicted to remain the same in 2010.* * Year-over-year percentage change in the Federal Housing Finance Agency all-transactions home price index as measured using 4th quarter values.

veryday I get asked the question, “How’s the real estate market?” But to thoroughly answer this seemingly simple question, I begin by asking another question, “Which market?” Are you referring to the $200,000-$250,000 market in West Wichita, the downtown condo market, or the $100,000-$150,000 market in Derby? While the overall market may behave one way, these SUB-markets are each performing differently. The SUB-markets - The most noticeable market shift, in my opinion, is not categorized by location as much as by price range. Homes in higher price ranges aren’t experiencing near the buyer activity as the lower priced homes. The market for homes under $180,000 is still moving along nicely. Home sales above $180,000, and certainly above $200,000, showed the biggest slow down and definitely favors the buyer. Refer to the table above to see how the price range of your home may be affected by current market conditions. Some price ranges are experiencing strong buyers’ markets while Select

others are definitely more favorable to sellers. The price ranges between $100,000 and $160,000 make up 35.1% of the entire market, while only 8.3% of the market is buying homes over $250,000. The past year has seen a slow down in “move up” buyers and a marked increase in people wanting to “downsize” into something smaller. This more conservative mood is what has created the shift to the middle of the market, increasing demand for nice but more affordable homes and leaving some upper end homes to feel a lonely breeze. In a buyer’s market only the nicest, homes that create the greatest value to the buyer will sell. If you are priced properly, you won’t need to deeply discount the price of your home. Existing homes sold in April received 96.62% of their asking price. This means that on average, across all areas and price ranges, sellers were only dropping their asking prices in April by 3.38% during negotiation. Is now a good time to buy or sell? I hope this monthly market report has been helpful in answering that question for you. My job is to provide you the information necessary so that YOU can make an informed decision for you and your family. Low interest rates and reasonable home prices make it a very favorable time to buy. If you’re considering the sale of your home, we highly encourage an aggressive marketing approach, proper strategic pricing, and making all necessary improvements to your home’s presentation and make it rise above the competition. Homes ARE still selling. The combination of these three things will result in a successful sale. This is not the time however, to ‘test’ the market at inflated prices. Use Your IRA To Invest In Real Estate by Tom Lundstedt, CCIM tomlundstedt.com

A short, middle-aged woman wearing red glasses came up to me after one of my real estate seminars. She seemed shy and hesitant, but she’d listened intently and taken lots of notes during the class. She told me her name was Norma and proceeded to ask me several good questions about real estate investing. She happened to mention she had $200,000 in her retirement account. When I congratulated her she said, “Don’t’ be impressed. I had $300,000 a few years ago!” Her retirement account, like many others, has suffered as a result of investment choices. Norma went on to tell me she wished she had bought real estate instead of ‘investing in an IRA.” She was amazed when I told her she could have her cake and eat it too --- or rather, have her IRA and real estate too! Let me explain. First and foremost: A retirement account (traditional IRA, Roth IRA, SIMPLE IRA, SEP, Keogh, 401k, etc.) is not an investment! It’s simply a special account that holds your investments. It can hold many types of investments, such as mutual funds, stocks, bonds, and .... drum roll, please: real estate. Picture a truck with the words “MY RETIREMENT ACCOUNT” painted on the doors. In the back of the truck, you load whichever allowable investments you choose. As you picture this, ask yourself, “Is my retirement truck on the way to becoming a big, heavy-duty monster truck or will I end up with a little, wimpy mini pickup?” When I told Norma her retirement account could own real estate she said, “But I asked the company that administers my account if my IRA could own real estate, and they said ‘no.” Whoa! Instead of merely saying “no,” the person she talked with should have added three important words: “not with us.” The problem is that most companies that hold retirement accounts aren’t geared up to handle real estate. Therefore, they have no incentive to inform their customers that real estate is an alternative investment choice. That’s the main reason for the misconception that real estate can’t be held in a retirement account. Let’s get this straight: retirement accounts can own real estate. In a minute, we’ll get to the basic ins and outs of real estate IRAs. But, first, some advice: This article is designed to be a launching pad for readers to begin their exploration of real estate IRAs. It’s a complicated subject and everyone’s situation is unique, so be sure to talk with your competent advisors before you take any action. OK, here we go. First, establish a self-directed retirement account with a company/custodian that specializes in real estate IRAs. This is a relatively easy process and can be done by either establishing

a new account or rolling over the assets of an existing account. (Be sure there are no surrender charges for rolling over an existing account.) Once you’re the proud owner of a self-directed IRA with a custodian that can handle real estate, what’s next? There are specific rules as tow hat you can and cannot do with your real estate IRA. Some things you CAN do: 1. Your real estate IRA can buy and sell many types of real estate including raw land, rental properties, condos, fixer-uppers, commercial properties, lake shore, etc. Keep in mind it’s the self-directed real estate IRA that buys, owns and sells the property. Not you personally. You don’t withdraw the money from the IRA to buy the property --- the custodian buys the property in the name of your self-directed real estate IRA. 2. The property can be rented but the rental income is paid into your IRA, not to you. 3. All the expenses of renting and operating the property must flow in and out of yourself-directed real estate IRA. 4. It is possible to finance a property that is owned by your IRA. But the financing must be “non-recourse.” That means the property, not the IRA account, is the sold security for the loan. Most traditional lenders won’t provide non-recourse financing. However, seller financing or private loans are possibilities. Let me emphasize again: get good professional advice before taking any action. 5. Your real estate IRA can buy a partial interest in a property. It could be a partner and own a fractional interest. Some things you CANNOT do: 1. Your real estate IRA cannot buy a property that you, your spouse, or certain family members already won. Likewise, your real estate IRA cannot sell a property it owns to you, your spouse or certain family members. 2. You, your spouse or certain family members cannot have any persona use of the property owned by your real estate IRA. 3. Your IRA cannot lease the property to your business. Your business cannot use or occupy any part of the property. Is a Real Estate IRA Right for You? So, now you know you can use your retirement account to buy real estate. But the bigger issue is should you use your retirement account to buy real estate? The answer is, it depends on the type of real estate and your unique situation. You already know your real estate IRA cannot own property that is used by you, certain family members or your business. Therefore, primary residences, second homes and vacation homes are not candidates. In addition, a rental property that produces tax shelter from depreciation deductions would probably not be a good fit because


the tax shelter would go to waste in your retirement account. Other types of real estate, such as raw land, fixer-uppers, and non-leveraged rental properties, are perfect candidates. The profit from these investments would be taxed if you owned the property personally. However, if you real estate IRA buys, owns and sells the property, the profit would compound in your IRA tax-deffered (or tax-free if it’s a Roth IRA)

There is a limit on how much you can contribute each year to your retirement account. But there’s no limit on how much the account can earn! Hubba hubba!

Last But Not Least 1. Before your IRA buys any property, you’ve go to understand how real estate works. There’s a lot to it. Make a commitment to learn how to analyze a property before you buy it, including operating expenses and management consideration. Study the financial benefits such as cash flow, depreciation and appreciation. Learn how to determine cap rates, cash on cash and other rates of return. And so on. The more you know, the better your chance of success. 2. Remember that real estate IRAs are a specialty and not every retirement account administrator/custodian is geared up to handle them. In the “Resources” box I’ve included several real estate IRA custodian (as well as some other resources) to get you started. Bear in mind, there are other custodians and you need to find one that’s right for you. Check out their web sites of call them.

Keep Your Home Sale From Falling Apart Finding a buyer for your home is just the first step on the homeselling path. Tread carefully in the weeks ahead because if you make one of these common seller mistakes, your deal may not close. MISTAKE #1: IGNORE CONTINGENCIES If your contract requires you to do something before the sale, do it. If the buyers make the sale contingent on certain repairs, don’t do cheap patch-jobs and expect the buyers not to notice the fixes weren’t done properly. MISTAKE #2: DON’T BOTHER TO FIX THINGS THAT BREAK The last thing any seller needs is for the buyers to notice on the pre-closing walk-through that the home isn’t in the same conditions as when they made their offer. When things fall apart in a home about to be purchased, sellers must make the repairs. If the furnace fails, get a professional to fix it, and inform the buyers that the work was done. When you fail to maintain the home, the buyers may lose confidence in your integrity and the condition of the home and back out of the sale.

MISTAKE #3: GET LAX ABOUT DEADLINES Treat deadlines as sacrosanct. If you have three days to accept or reject the home inspection, make your decision within three days. If you’re selling, move out a few days early so you can turn over the keys at closing. MISTAKE #4: REFUSE TO NEGOTIATE ANY FURTHER Once you’ve negotiated a price, it’s natural to calculate how much you’ll walk away with from the closing table. However, problems uncovered during inspections will have to be fixed. The appraisal may come in at a price below what the buyers offered to pay. Be prepared to negotiate with the buyers over these bottom-lineinfluencing issues. MISTAKE #5: HIDE LIENS FROM BUYERS Did you neglect to mention that Uncle Sam has placed a tax lien on your home or you owe six months of homeowners association fees? The title search is going to turn up any liens filed on y our house. To sell your house, you have to pay off the lien (or get the borrower to agree to pay it off). If you can do that with the sales proceeds, great. If not, the sale isn’t going to close. G.M. 7 Tips For A Profitable Home Closing When you’re ready to close on the sale of your home and move to your new home, you may be so close to the finish line that you coast, thinking there’s nothing left for you to do. Not so fast. It’s easy to waste a few dollars here, and for mistakes to creep into your closing documents there, all adding up to a bundle of lost profit. Spot money-losing problems with these seven tips.

1. Take Services Out Of Your Name

Avoid a dispute with the buyers after closing over things like fees for the cable service you forgot to discontinue. Contact every utility and service provider to end or transfer service to your new address as of the closing date. If you’re on automatic-fill, schedule for heating oil or propane. Don’t pay for a pre-closing refill that provides free fuel for the new owner. Contact your insurer to terminate coverage on your old home, get coverage on your new home, and ask whether you’re entitled to a refund of prepaid premium.

2. Spread The Work On Your Change Of Address

Provide the post office with your forwarding address two to four weeks before the closing. Also notify credit card companies, publication subscription departments, friends and family, and your financial institutions of your new address.

3. Manage The Movers

Scrutinize your moving company’s estimate. If you’re making a longdistance move, which is often billed according to weight, to the weight of your property and watch so the movers don’t use excessive padding to boost the weight. Also check with your homeowners insurer about coverage for your move. Usually movers cover only what they pack.

4. Do The Settlement Math

Title company employees are only human, so they can make mistakes. The day before your closing, check the math on your HUD-1 Settlement Statement.

5. Review Charges On Your Settlement Statement

Are all mortgages being paid off, and are the payoff amounts correct? If your real estate agent promised you extras -- such as a discounted commission or a home warranty policy -- make sure that’s included. Also check whether your real estate agent or title company added frees that weren’t disclosed earlier. If any party suggests leaving items off the settlement statement, consult a lawyer about wither that might expose you to legal risk.

6. Search For Missing Credits

Be sure the settlement company properly credited you for prepaid expenses, such as property taxes and homeowners association fees, if applicable. If you’ve prepaid taxes for the year, you’re entitled to a credit for the time you no longer own the home. Have you been credited for heating oil or propane left in the tank?

7. Don’t Leave Money In Escrow

End your home sale closing with nothing unresolved. Make sure the title company releases money already held in escrow for you, and avoid leaving sales proceeds in a new escrow to be dickered over later.

THE HOME INSPECTION Why you should MUST get one!

The Money Pit—it’s a movie in which a couple falls in love with their dream home, buys it, and then experiences almost every possible problem. One of the funniest scenes is when the main character falls through a hole in the floor that was covered over by a rug. Of course, this is a complete exaggeration, meant for entertainment; however, it is also an aid in helping us to understand the seriousness of what can actually go wrong if you DON’T get a home inspection. Let’s face it, most of us, when buying a home, are not professionals in identifying potential problem areas. What could happen due to that?

• If there’s been hail damage to the roof, and you didn’t know this, at some point, you might have to get a new roof, at YOUR expense. • The heating or cooling system could have a problem, causing a need to invest in repairs or having higher utility costs as a homeowner. • -You could be buying a home that is a hotspot for moisture and mildew, quickening deterioration of the walls and overall structure. This could affect your health, as well as your pocketbook.

You are in the process of making a very large investment, maybe the largest investment you’ll ever make. For just a small investment now, you may save substantial money in the future. A home inspection will run between $250 - $400 depending on the size of the home and some other factors. NOT getting a home inspection, could, in the long run, cost you thousands of dollars. Can you really afford NOT to have a professional home inspector survey the premises for the integrity of the internal & external components of the dwelling?

A home inspection is one of the only protections a home buyer has!

ROOF Has there been hail damage, wind damage, or some other issue? Structural Home inspectors are not structural engineers but can identify visual defects in the areas requiring immediate repairs. Electrical Do all the outlets work? Does the house use fuses or is there a breaker box? Are there any visible signs of fraying on the wiring? HVAC Does the furnace have a cracked heat exchanger, or some other issue? Plumbing Are there any leaks or annoying drips? Are all the fixtures working properly? Built-in Appliances Are they functioning properly? Safety Hazards Home Inspectors are not environmental specialists, however they can identify many safety hazards or dangerous conditions. Miscellaneous Other items to ask your home inspector about: septic systems, drainage problems, wood decks, patios or other exterior structures. Other inspections available Termite, Mold, Radon and Lead-Paint inspections are also available by many home inspectors.
