Look at the Past A look back at Hanna Coal’s Euclid
These 50-ton tractor-trailer trucks (Euclid) known at Euc's were powered by 350 HP Diesel engines. They had a rated capacity approximately equal to that of a railroad car (50 tons). The overall length of this unit was 53 feet. It is 12 feet in width and, at its highest point, is 11 feet from the ground. The front tires on these units are 14:00 x 24. The rear tires on the tractor and the tires on the trailer are 18:00 x 25. This "Euc" was hauling coal into the Georgetown Preparation Plat where it was washed, dried and sized. Saving history like this is the goal of the Harrison Coal and Reclamation Historical Park. They will be having their 25th Annual Banquet-Auction Saturday, May 11, 2019. Tickets are $20. Burgett sentenced, Eikleberry’s bond remains at $2 million By JD LONG

CADIZ – A plea agreement was reached Tuesday between the state and Joshua Burgett, the 20 year-old who was involved in the Cadiz robbery attempt, which was basically a drug deal that went bad, as described by Judge, T. Shawn Hervey. This now means that all codefendants have been sentenced for this case. Burgett, who was represented by attorney, Bernie Battistel, will serve three years in prison, which was the recommendation of the state, represented by Assistant Prosecutor, Jeffrey Bruzzese. This was an aggregate sentence combined with the guilty plea to aggravated trafficking in drugs (10-month sentence), a felony of the fourth degree. The robbery charge was amended to a second degree felony. Hervey stated that Community Based Control (CBC) sanctions would be inadequate based on Burgett’s criminal history, but he also noted his Ohio Risk Assessment
(ORAS) results, which he said were of the highest the court has ever seen. “I’m at a loss for words here, you’re 20 years old and you’ve set the record for the highest Ohio Risk Assessment score I’ve ever seen,” Hervey told him. He said he took his young age into consideration but that there was no other place to send him but prison telling him, “you’ve earned it.” Robert Eikleberry, the 77 yearold from Shadyside whose been charged with rape (F1) and gross sexual imposition (F3) for an offense allegedly committed in Cadiz, was arraigned on Tuesday. Prosecutor Owen Beetham asked that bond be kept at $2 million considering Eikleberry, who was represented by James L. Nicholson, is not a resident of Harrison County and the likelihood of a conviction was “very strong.” Nicholson, who entered a not guilty plea on both counts, argued that his client not only had “nowhere to go” and no reason to flee but that the high bond “is not supported by the weight of the charge.” He said the bond was excessive and was
something he’d see in a murder charge. But Beetham responded by stating this case “ranks up there with murder.” He continued by stating that the rape of a child under the age of 10, which is the case here, carries a possible life sentence without the possibility of parole. “So the state’s position is that this is as severe, if not more severe in many respects than a murder case,” Beetham explained. He said there has to be some recognition of a possible flight risk when someone is facing an extreme penalty such as Eikleberry is here. Judge Hervey agreed with the state and the $2 million bond was held in place. Also, Frank Kopras, 46, of Jewett represented by his attorney Peter S. Olivito reached a plea agreement to the charge of unlawful sexual conduct with a minor, a felony of the third degree. Judge Hervey, upon the recommendation from the state, sentenced Kopras to two years of prison time and it also qualifies the offense as Tier 2, which means Kopras would have to register as a sex offender
for the next 25 years of his life. Kopras’s Ohio Risk Assessment (ORAS) resulted in a moderate risk for recidivism and moderate supervision. Prosecutor Beetham stated that the party of the victim was satisfied with the recommendation. Hervey said Kopras would receive credit for time served but upon release, would be prohibited from living within 1,000 feet of a school or daycare center. When addressing Kopras after sentencing as is normal practice, Hervey went lighter on him compared to others who have been convicted of similar crimes. He told Kopras, based upon his lack of criminal history that he didn’t suspect that Kopras would get in trouble again after responses he’s received from people who thought “you’re a good guy.” But, he continued that Kopras committed a crime “that there’s no excuse for.” Hervey acknowledged that Kopras has taken responsibility for the crime and will now pay the price for it. Kopras is eligible for filing for judicial release since the penalty is four years or less, according to Hervey.
