FINAL DECLARATORY JUDGMENT AND ORDER This case concerns the status and handling o f an account established by Defendant mother at what is now Deutsche Bank Alex Brown in 1991 when Plaintiff was two or three years old (the “Account”). By Order dated February 14, 2012, the Court bifurcated trial o f this action and ordered that the action would proceed to trial first on Count III o f the Complaint, in which Plaintiff demanded that Defendant provide an accounting o f the Account. The issues surrounding the accounting and the objections to it were tried to the Court, without a jury, on August 6, 28, 29, and 30, 2012. On August 31, 2012, the Court entered an Order disposing o f Count III by accepting the accounting provided by Defendant Catherine Randall and overruling all objections by Plaintiff Frederick Gresov, On October 15, 2012, Defendant moved for summary judgm ent on all remaining counts, including Count IV, in which Plaintiff sought a declaratory judgm ent. Plaintiff filed a Line on October 31, 2012 preserving all objections to the relief granted by the Court on Count III but conceding that, based on the C ourt’s findings and conclusions, summary judgm ent is appropriate on the remaining claim s.1 By his Line, Plaintiff has preserved his objections to the C ourt’s findings and conclusions, including this Final Declaratory Judgment.

1In the Line, Plaintiff refers to five counts in the Complaint, but there are only four counts.


This Final Declaratory Judgment and Order disposes o f all claims in this action, including incorporation o f the disposition o f Count III by the Order dated August 31, 2012. For the reasons stated here, in the August 31, 2012 Order, and on the record following the hearing on Count III, this Final Declaratory Judgment and Order is entered this 20th day o f November, 2012, by the Court for Baltimore City, Part 26, and it is hereby: ADJUDGED, ORDERED, AND DECREED that: 1.

Defendant Catherine Randall did not violate the M aryland Uniform Transfers to

Minors Act, Maryland Code, §§ 13-301 et seq, o f the Estates and Trusts Article, or the Pennsylvania Uniform Transfers to Minors Act in her handling o f the Account; and 2.

Defendant Catherine Randall has provided a full and acceptable accounting o f her

handling of the Account; and 3.

Plaintiff:'Frederick G resov’s objections to the accounting provided by Defendant

Catherine Randall are all overruled; and it is further ORDERED that court costs shall be paid by Plaintiff; and it is further ORDERED that the Clerk o f the Court shall enter this Final Declaratory Judgment and Order and then close this case; and it is further ORDERED that the Clerk o f the Court send copies o f this Final Declaratory Judgment and Order to all parties.
