According to the latest data from Seattle’s Rental Property Registration database, Seattle continues to experience an extreme decline in rental housing with a net loss of 3,407 properties and 11,521 units since May 2021. Looking at 2022 alone, from January through April, Seattle has lost 357 properties equating to 1,762 units. This mass exodus of housing providers is exacerbated by City Council's repeated passage of ordinances that further increase the costs, risks, and onerous burdens on housing providers. Of the properties lost since May 2021, 2,538 were single family homes which are typically owned by small, individual housing providers. The result of the last few years of regulations is an ongoing departure of rental housing as people sell and leave the market. These homes typically become owner occupied, rather than continuing as a rental. The Seattle City Council must stop ignoring small housing providers and work with us to address the problems facing the city. We are in a housing crisis and instead of working towards a solution, the Council continues to push housing providers out of the city.

resources on various topics that may be daunting for those with little to no experience, especially BIPOC individuals. The Frank’s still consider themselves a mom-and-pop business because, as a family, they directly manage as much of the business as they can hands-on. He says from the 2 a.m. phone calls to bookkeeping to simple maintenance requests, they strive to help each resident living in their properties to the best of their ability.

Brett Frank-Looney comes from a rich history of housing providers in the Seattle area. Despite professionally entering the industry in 2018, Brett grew up helping his family maintain their family-owned real estate and commercial leasing company his entire life. Now his mother and grandmother are his business partners as he continues the Frank family legacy in providing quality, affordable housing to Seattleites. “Providing housing in the Seattle area is all I’ve known,” Brett said. “It’s all my family has ever known and it’s all I ever want to know.” TD Frank Family Properties is a Blackowned business operated by the Frank family and consists of over 100 properties in the greater Seattle area. These properties range from single-family homes to 35-unit residential apartment buildings reaching as far south as Columbia City up to Capitol Hill. But this journey began with just one duplex in Seattle’s Central District.

Brett’s grandparents, Gerald and Theresa Frank, had humble beginnings in the rental housing industry. In the 1950s, the couple purchased their first duplex in the Central District and lived on one side while renovating the other side to rent out. The couple continued to live in that same duplex until they could afford to invest in more property. Brett considered their venture into rental housing a highly ambitious move, given the difficulties they faced in receiving bank loans due to redlining, a discriminatory practice in which services are withheld from potential customers who reside in neighborhoods classified as 'hazardous' to investment. Despite that, the Franks persevered, eventually bringing Brett’s mother, Dana Frank, into the industry. Brett’s mother and grandmother became business partners in 1989 when his grandparents divorced. Since then, they have been dedicated to maintaining the quality of their properties while continuing to expand during the last couple of decades.

Despite the path paved by her parents, Dana experienced her troubles with the industry too. Brett recounted stories from his mother’s experience of picketing banks to fight for funding. He considers their effort in working through these hardships a key factor in why the family business has become so successful. Brett says the trials and tribulations his family has endured for generations fuels him to fight for what is best for all housing providers. He was raised helping his mother maintain their rental properties and recognizes that gives him an inside advantage over others with less experience in the industry. As a third-generation housing provider, he acknowledges that individuals curious about investing in rental housing may not have the same guidance he received from his family, which can be discouraging. Brett is passionate about breaking down barriers for those looking to invest in rental housing and providing aspiring housing providers with

When asked to share his favorite parts about being a housing provider, Brett says there are many rewarding factors to the job. The Franks have rented to many families saving up to afford their own home, which Brett calls a “beautiful process of growth that we get to be a part of”. He also mentioned that the residents who have been with them for over 30 years have become “like part of the family”. Brett notes that he knows many people who have shared bad renting experiences and he thinks their long-term renters “make us feel like we’ve got something right”. However, continuing his family’s work with his mom and grandmother takes the cake. “Nothing makes me prouder than to say my family has made room for quality affordable housing for residents in Seattle for decades,” Brett said. “And we’ve done it together as a family.” Brett is interested in local politics and supporting the lobbying efforts of housing provider advocates in the city of Seattle. He shares that it is important to stay informed and vocal about issues plaguing the industry so housing providers can have a seat at the table in these conversations. Brett hopes that sharing his story will help inspire others to get involved and make collaborative efforts to improve the Seattle rental industry for housing providers and residents alike.

Now several local jurisdictions have taken on the role of enforcer by implementing their own laws, enabling them to inflict hefty fines on housing providers. They have also crafted new laws which have spread to other cities and then up to the state level. Attorney, Kaitlyn Jackson will explore these trends and review recently enacted laws in Auburn, Burien, Federal Way, King County and Seattle.

current housing provider, verifying their tenant history with the previous housing provider is also important. A previous housing provider may be a little more forthcoming about what kind of a tenant your applicant is because they are not worried about losing or getting rid of that person as they are no longer in a contract with this applicant. When verifying an applicant’s employment the most important information that you want to verify is how long they have been employed with the place of business and what their income is. Oftentimes a company will verify whether or not a person works at their place of business but will not give you any further information. In this case you might ask to see some of your applicant’s most recent paycheck stubs and perhaps a letter of recommendation. Verifying employment is a good step to take at lease renewal as well. Prior to signing a new lease with an existing tenant, checking to ensure they are still

employed and have the income to support another year of tenancy is a great practice. When verifying tenancy and employment some places will not give you any information unless they have a signed release from the applicant. You can provide them with a copy of the signed rental application. RHAWA’s rental applications are worded so that when an applicant signs the completed document they are authorizing you to check these types of references in addition to credit and background. Election season is beginning to ramp up as we get into the summer. The primaries are right around the corner. While we have to pay attention to this extremely critical election season, we cannot afford to ignore local governments that continue to increase the already onerous burden on housing providers. Across the state, housing providers are leaving the rental housing industry shown most clearly in Seattle. In Seattle, analyzing the city-wide rental housing data that was released on April 25, 2022, we can see that since May 2021, the city has lost over 11,500 rental housing units. The data collected under Seattle’s Rental Registration and Inspection Ordinance shows a staggering 3,407 rental units that have left the market over the last year. 74% of which, equaling 2,538 properties, are single family homes. Those properties are often owned and operated by small, mom and pop housing providers. Based on a survey of our membership, almost half of the housing providers selling their properties do so due to the increased legislative burden. Housing providers across the city, and especially small housing providers, are leaving at unprecedented rates. This trend is likely to continue as long as the City Council continues to pass more and more onerous, costly ordinances. Seattle just recently rejected the resolution to extend the eviction moratorium indefinitely, a hard fought victory for the city’s housing providers. Now, without the eviction moratorium, there has not been the “eviction tsunami” that many were predicting to support increased tenant protections. The City Council passed CB 120305, sponsored by Councilmember Strauss, with a vote of 7-1. Councilmember Nelson was the only Councilmember to vote no and the only one to express concerns with the policy. The ordinance requires housing providers to offer repayment plans in line with RCW 59.18.630 for the length of the city’s civil health emergency, plus an additional six months. Neither the ordinance, nor the city’s emergency have a sunset date. This means that the state’s emergency could end and it would

once again leave Seattle isolated with ongoing eviction bans and restrictions. Additionally, Councilmember Pedersen has proposed an ordinance that with require housing providers to disclose their vacancy status and rent rates as part of RRIO. The proposed ordinance would make it so that you could not enforce your lease unless you provided your private information to a research university or non-profit, designated by the city. This type of compulsory, coercive data collection is highly concerning. As of writing this article, the proposed ordinance CB 120315 has not been passed through the Renter’s Rights Committee. In the King County Council, Councilmember Dunn has proposed a much broader, non-compulsory ordinance to collect rental data. Ordinance 20220164, would authorize the County Executive to create a rental housing report. We are meeting with the King County Councilmembers to discuss this proposal and look into options as to how to gather rental housing data in a non-coercive way. We have had many studies done by third party entities such as the UW Center for Real Estate Research and ECONorthwest. Counties and city’s should focus on partnering with these third party research organizations instead of mandates, such as the Seattle proposal. Finally in Kenmore, for those of you who joined us to fight the King County Ordinance 2021-0131 in June of last year, much of this proposal will be familiar. The City of Kenmore is hearing a proposal on a suite of regulations that are extremely similar to the previous King County policy. We have significant concerns with the drafting of that ordinance and likewise have many concerns with this city policy. Kenmore recently passed a shortened, narrower version of the full suite of regulations. Only including the 1.5% late fee cap, 120 day rent increase notice for increases over 3%, banning the requirement of a prospective tenants SSN. There are more proposed regulations that the council is considering. Now is not the time to be pushing housing providers out of the market with local

policy. We must work collaboratively and support our affordable housing providers if we are going to solve this crisis together.

Per RCW 59.18.660, when a tenant is late in paying rent or accrues rent debt, housing providers must now follow a specific process working with the newly formed Eviction Resolution Pilot Program (ERPP) and any Rental Assistance distribution available in each county. The required ERPP Notice Form provided by the Attorney General's Office includes resource information for all counties. RHAWA has optimized the form with fillable fields and made it available on our forms page at rhawa.org/rental-forms-leases-notices, also linked under step 2 below. If you have tenants currently in rental arrears who are not in Burien, you can proceed with serving notice to resolve debt or end the tenancy following specific new requirements, outlined as follows: Step 1: Send Invoice/Reminder

It is a best practice to communicate with the tenant to confirm there is a problem with paying rent before proceeding with service of notices. For rent due January 1, 2022 or later, the landlord may choose to charge late fees when rent is more than 5 days late. Kenmore extended ban on late fees to 1/15/2022. Seattle and Burien late fee ban is ongoing.

Invoice and Payment Schedule for Past Due Rent. • Note: It is prohibited to proceed with an unlawful detainer action or attempt to collect (including use of security deposit) on rental arrears accrued from 2/29/2020 to six months after the end of the currently ongoing "public health emergency" without first offering reasonable payment plan to the tenant (RCW 59.18.630). • If tenant accepts payment plan offer and pays according to the agreed plan, do not proceed with the following steps. • Do not include late fees or oth-

er incidental charges in payment plan offer. Only unpaid rent and other recurring housing costs. Step 3: Submit Copy of Notice to the ERPP Office

Using email or other designated online system, submit copies of the above served notices and any additional required information to the ERPP administrated by the Dispute Resolution Center (DRC) in the county where the rental property is located. Find contact information on the ERPP Notice and Resource Information. Step 4: Participate in Mediation

Participate in the mediation or conciliation process facilitated by the Dispute Resolution Center (DRC) managing the Eviction Resolution Pilot Program (ERPP) for the county where your property is located. Note: An ERPP specialist should initiate contact with both the landlord and tenant. If you do not hear from them, you may need to contact the county DRC.

The goal of mediation or conciliation is to keep the tenant in the home by reaching a settlement agreement that could include a payment plan schedule, terms for payment of current rent going forward, access to rental assistance, and changes to terms of tenancy. Step 5: Enter Agreement to Retain Tenant or Proceed with Eviction.

If a settlement agreement is reached, and both parties continue to meet the terms of the agreement, no further action is taken. If the housing provider participates in the ERPP process and a settlement agreement is not reached with the tenant, or the tenant fails to meet the terms of the agreement, the mediator will issue a DRC Certification which is required to proceed with an eviction. Work with your attorney or eviction service to move forward from here. Possible Outcomes for ERPP Process

In Spokane and possibly other counties, it is required to send the Invoice and Payment Schedule for Past Due Rent first and wait 14 days before proceeding to the next step. Step 2: Serve ERPP/14-Day Notice Package on the Tenant

If and when it is clear that the tenant is not likely to pay rent, properly serve the following notices on the tenant(s) as one packet, carefully following the instructions provided in the RHAWA 14-Day Pay Rent or Vacate Notice form. Include the following in the notice packet served:

This year is critical due to the redistricting map shifting almost every district. Moderate, data-observing lawmakers have more opportunities than ever to get elected. In addition to the new legislative districts shaking things up, many lawmakers have decided not to run for re-election. We have seen incredible success recently, especially in the 2022 Legislative Session. We must maintain this momentum by continuing our education and grassroots advocacy to candidates and our communities. RHAWA will be hosting a number of elections for key candidates in our most critical districts. Getting a good deal on heating and cooling equipment for your home is all about the timing. If it’s the middle of a heatwave or a freeze and your equipment breaks down, you’re more likely to take what you can get, when you can get it. But if you’re able to anticipate the need, your options grow exponentially. Here are a few tips that should make it easier to determine when and where to buy your equipment.(Due to supply chain issues and prices that are on the rise, this article from our archives has never been a more cautionary tale.) When to Buy

Two of the best times to shop for new or replacement HVAC equipment are late spring and early summer. Summer, fall and winter are typically busy seasons for heating and cooling companies. But a month or two after tax season we usually experience a lull in our workload, and most of us tend to run our best specials during this time to keep our people busy. When things heat up in the summer, prices generally go up and crews fill up. Just getting estimates from a few good companies can be a challenge. The same thing occurs in winter due to the cold, and things get especially expensive if we have a ‘freeze’ for any length of time. A ‘freeze’ to us in the HVAC and plumbing business is basically anytime the temperature stays

below freezing during the daytime for more than 3 or 4 days: not just overnight. Fall can be a busy time too. Vacations are over, the kids are back at school and winter is on the way. Folks turn their attention to home heating and want to get ready with both replacements and maintenances.

Be sure to take the time to read the posted issues and unresolved issues.

Check their Location and time in business: A great economy like ours tends to attract companies that are not local, and/or are brand new start-ups. A tactic that is often employed by larger or new companies is to buy a small local company that has been around for many years. Once they own it they can technically advertise they have been in business for all those years. If you stick with local people and companies that have been working in their field and in this area for at least 5 years, it will automatically save you a lot of headaches when it comes to service and warranty issues with your project and equipment.

Check for good, REAL referrals: With the advent of the Internet, it’s easy to go online for a half-hour, read a bunch of reviews and think you have a ‘feel’ for a person or company. Just remember, anyone can write and post a comment/review; a good or bad one. There is no substitute for a personal ‘Word Of Mouth’ referral from someone you know; family, or work, school, church, realtor or property manager, and/or a name of a customer offered by the company you are considering that you are free to write to or call yourself. Online reviews are normally sorted and ‘graded’ by mathematical algorithms and are not vetted in any reliable, personal way. Keep that in mind when considering them.

These and many more ‘old sayings’ exist because they are basically true. Pricing needs to be a consideration, but it isn’t the most important thing on these kinds of projects. Generally, the price range for a good company is somewhere in the medium to medium-high range; with the value and warranty being excellent. A couple of reasonable things to look for in pricing include… • Good Terms of Payments that fit your situation and exposure. • Reasonable discounts for real considerations…things like a somewhat flexible timetable, paying down payments, progress payments and final balance in cash, and/or agreeing to a larger volume of business with things like future work, and/or agreeing to a Maintenance Contract are things your contractor should value and should grant you discounts for; don’t be afraid to ask!

If you’ve been thinking about adding air-conditioning to your existing central air or upgrading your all-electric heating with a new Ductless System, providing both heating and cooling, this is a great time to have your situation looked at. If you don’t have an HVAC company you already work with and/or you would like a second opinion, design, and pricing; be sure to research them and choose carefully. Choosing a Contractor

Check Licenses and Credentials with the State: In Washington, Labor and Industries makes it very simple to go online to verify a company is properly licensed and insured; https://secure.lni.wa.gov/ verify/ will take you to their search site. Checking the Better Business Bureau is also good but realize that a good/great rating with them may simply mean that the company answers their complaints promptly.

Check Pricing for a good Value: There are lots of ‘old sayings’ about what things cost. • The cheapest price rarely buys the Best Value… • There is no such thing as a free lunch…
