President’s Message As we sit on our sun-soaked patios in August we have time to reflect and (re)consider things in our past. You might notice that daydreaming is one of my favorite pastimes.

I am musing today about those days as a landlord when we could charge any rent we wanted without facing relocation RHA Oregon President Ron Garcia fees.

The times when we could terminate a rental agreement for our own reasons, without the liability of retaliation.

That era when we could screen a tenant thoroughly and not be obligated to take the first application.

Or how about that quaint notion of using the security deposit to compensate for actual damages?

Back when we (not the government) decided how we should manage our own rental properties.

As I begin to yawn and nod, I suddenly jolt into remembering how hard it was sometimes to get a place rented! I recall how back then, my policy was to keep my rents and terms as favorable as I could for my tenants for fear of having vacancies, because they were not easy to fill. I reflect on how I would actually coddle my tenants (I used to go over and change Thelma’s lightbulbs!) In those days my goal was to keep my tenants for as long as possible and I got to know a lot of them pretty well.

The government’s goal for me claims to want to achieve the same results I had before, even though legislation now requires me to change my behavior and policies. Lawmakers claim that limiting annual rent increases to 9.9% in Portland (or pay $4,000 +/- in relocation fees) has the “benevolent” affect of keeping tenants’ rents low. They believe that eliminating “No Cause” termination and not even requiring tenants to vacate at the end of a lease creates stability. The notion of forcing bad tenants to move has vaporized, unless I can prove it in court. By claiming that criminal records create artificial barriers to “rent-burdened” households, the City of Portland is now paying to have criminals’ records expunged so they no longer show up on my background checks. Now they are in official discussions to both limit the amount of security deposit I can charge, and to regulate the manner in which I may use it when tenants vacate. Where does the safety fall on their agenda, I wonder?

The fallout and the biggest difference between the old days and now is that today, my relationship with my tenants has strained under new regulations.

I can’t risk getting too close for fear of a Fair Housing or retaliation claim.

Frankly, I resent that I cannot control my rents, and because of that I find myself determined to get them as high as I can. I have lost control of my own property. I want the right to reclaim my rental from tenants I no longer (continued on page 10) RENTAL ALLIANCE UPDATE AUGUST 2018

Getting Ready for Summer Maintenance

This time of year can be fun and exciting; it can also be hectic and stressful. In an effort to make summer more exciting and take more off of your plate, here are some time and money-saving tips to do this summer.

Dealing With The Heat

With soaring temperatures, many landlords are dealing not only with keeping air conditioning in the unit running, but also stopping pests and heat from entering. Landlords need to understand how to properly cool as well as seal the entrances to the property.

First thing you should do is change the air filters often and when needed. It’s important to have clear communication about this with your tenants, as well as show them how to change filters so they can do it themselves.

When conducting inspections, check the ducts and provide service to them as necessary. Some landlords and tenants prefer to have the AC or cooling unit off while not at home or on vacation, but this ends up costing both parties more money. If the property is maintained at a constant temperature, it can end up creating a happy tenant and save you a little money.

Also on the inspection, (we recommend doing quarterly or seasonal inspections, about four times a year), make sure to check the doors and windows.

Ensure that there are no gaps where pests and drafts could enter. If you need to secure an exterior gap, door or window, you can use caulk, weather stripping and padding.

Exterior Maintenance

One of the best opportunities summer provides is the ability to work on things that are inaccessible during other seasons. During this optimal time of the year, landlords need to ask themselves two questions- what needs to be fixed and what do I want to upgrade?

Things that immediately need to be fixed are roof leaks, rain gutter build up, unsafe structures and fixes that would be required to sell the property. Once you identify these things, the only step left is to ask yourself how you want to fix it. Do it yourself? Hire someone?

Upgrades

When looking at upgrades, it’s important for a landlord to understand that this is an upgrade to 6

YOUR property; it will keep the tenant happy and you are increasing the value of your investment. Often, landlords will overlook upgrades for whatever reason and pass up the potential to make more money. In the summer, look into re-doing the stucco or buying some blinds. Your tenants will stay longer and it will make it easy to rent in the future.

Create a list of property tasks that could be done.

Organize them by importance and figure out which ones are necessary and finally how many of those things you can afford. Landlords who do this and take advantage of these opportunities not only have a better looking property, but a better bottom line as well.

Landscaping

The yard and garden is often regarded as real estate’s biggest selling point. When evaluating whether or not to rent a house, studies show that renters will look first to the landscape/exterior of the house, then to the kitchen and then to the bathrooms. And like too many landlords know, once a lawn or garden dies, it can take years to get it back to what it was. For effectively maintaining your landscape, use the following tips: • Establish and communicate clear rules on who is responsible for what • Hold individuals strictly accountable for their landscape responsibilies • Make sure general maintenance (lawn cut, weeds pulled, etc.) is done once a week • Clearly define when the lawn is supposed to be watered • Water the lawn at night to avoid losing water to evaporation • Fertilize the lawn regularly • Trim and keep up with trees, bushes and flowers • Plant flowers and other plants and allow your tenants to do the same • Spray weed killer on weeds in the garden, cement and the road • Ensure walkways and driveways are clear of garbage, dirt and hazards • Don’t be afraid to hire a lawn care professional if you need one The most important thing a landlord can do is have regular inspections. By doing this you can stay informed about the property’s condition and know what exactly need to be done. www.rhaoregon.org

Risk Management for Owners of Investment Real Estate

George is a successful real estate investor with over 400 apartment units and four commercial buildings (totaling approximately 100,000 sq. ft.). He is very proud of his investment portfolio, but he has a problem. George is frequently in court, fending off one law suit after another. If it is not a trip and fall, then he is fighting a habitability issue or a discrimination allegation. In addition, the city is continuously inspecting his properties and issuing citations. All of these issues are a serious drain on his time and cash flow.

Developing a Risk Management Strategy

George finally decided to meet with his attorney, Leah.

He complained to her that he needed help dealing with these issues.

She suggested the implementation of a risk management strategy, telling George, “You need to put policies in place that your employees can follow to avoid these issues.

You and your employees need to be trained. They need to take classes on local, state and federal habitability standards and /tenant laws. They also need to understand how to take care of your property, because being a slumlord only opens you up to more claims.”

George countered, “The tenants destroy everything. If I give them a new unit, they just destroy it and I will need to rebuild it from scratch. It’s better if I just give them the unit the way the last tenant returned it to me.”

Leah, responded, “If you treat the tenants with respect, screen well, set high standards, inspect regularly and complete maintenance quickly, you will have a better chance of getting your property back in good condition and significantly reduce your risk of litigation from a dissatisfied tenant.”

She continued “organizations like Rental Housing Northwest, Rental Housing Alliance Oregon, Oregon Rental Housing Association, and Building Owners and Managers Association (BOMA), for commercial properties, all help investment property owners understand changes in the market place and develop training and risk management classes.”

Screening

Leah also pointed out that thorough tenant screening www.rhaoregon.org

was critical. Tenants need to have the money to pay their rent. At minimum, tenants should earn three times the rent in order not to be too financially stressed. The U.S. Housing and Urban Development (HUD) defines ‘cost-burdened’ families as those who pay more than 30% of their income for housing and may have difficulty affording necessities such as food, clothing, transportation and medical care. When tenants pay more than 50% of their income toward housing they are considered ‘severely rent burdened’ and are at the extreme edge of economic survivability.

History has shown that economically stressed tenants struggle to keep rental units in good condition.

Therefore, it is important to screen tenants carefully and obtain previous owner references.

Rule setting

Leah continued, “Rule setting is important. Using a thorough rental agreement with clear rules makes it easier for both the owner and the tenant to be accountable. Being a “nice guy” Owner does not pay off for either the tenants or the Owner. Shaking hands on the rental agreement leaves too much ambiguity.

Rental rates, deposits, clearly specified move in and move out dates, maintenance, habitability and rulesetting are critical for a successful rental agreement.

Use a rental housing association form for your state and augment it by having an attorney experienced in Owner Tenant issues review and modify the rules section. Don’t just print out a form you found online to save money. Pay for one and have it reviewed by an attorney. You can be a “nice” owner but be sure to implement rules and policies that protect the tenant, the owner and the property.”

Site and property inspections

Don’t forget, you get what you inspect, not what you expect. Leah reminded George that his property managers need to regularly inspect the exteriors of properties, including laundry rooms, trash enclosures and car ports, as well as the inside of the apartment units. Properties need to be monitored and pet waste needs to be picked up regularly.

Leah explained her “Oasis” theory. “I have an owner who has a property in a dangerous part of town.

Shootings, drug dealing, and burglary occur frequently around the property. This owner fights back with constant care and attention.

Nicely landscaped grounds, well maintained buildings, regular inspections and thorough tenant screening have kept poor quality tenants out and created a relatively safe haven for the tenants that live there. It’s an oasis in the desert and the existing tenants want to keep it that way. His commitment to the property is reflected by the high tenant retention and lowered crime rate. One rule that helps this and all of his properties, is that weapons are not tolerated onsite.”

Accounting

Leah also explained, “Keep track of your rents and make sure your money does not get lost. In other words, have strict cash management procedures and audit your on–site managers. (Set a policy of not accepting cash for rent). Good rent collection policies and rigorous employment screening for bookkeepers and on-site managers is important. Additionally, consider redundancy and double checking to make sure rents get collected and posted correctly. It’s all part of limiting risk.”

Insurance

“At the same time you are training yourself and your staff, consider your insurance coverage. Take the time to meet with more than one insurance agent to really understand coverage options - it is very complicated.

Possible Insurance coverage options include

Liability insurance

Business Owners policy

Errors and omissions insurance

Employee liability insurance

Tenant discrimination insurance

Flood insurance

Earthquake insurance You may not be able to afford all of these coverages.

However, having good procedures in place can limit risk exposure.

Protecting properties individually is often the best way to protect a portfolio in the event of a lawsuit.

For example, if Fair Oaks Apartments LLC is sued and the LLC only ‘owns’ Fair Oaks Apartments, it often prevents other assets from becoming entangled in the lawsuit. If you package two or three or more properties into an LLC they can all get linked in a lawsuit. If you only have one property in an LLC, then only that property can be sued. In other words, when you get sued at Fair Oaks Apartments (aka Fair Oaks Apartments LLC) they can only sue that property and not any of the other properties in your portfolio.

Summary

George thanked Leah for all of her advice and sat down to think. He was overwhelmed with all this information. He had so much to do. So many policies to write and implement. Maybe it would be better if he hired a property manager who had these systems in place? But first, he had to get organized and Leah was kind enough to send a summary letter, so he could start the process.

Risk management is an important part of being a successful real estate investor. All owners need to set policies and procedures for themselves and their team. Policies and procedures need to be reviewed and updated every year, as laws change and as the portfolio changes. Developing and implementing a risk management policy will help shrink risk exposure and contribute to success as an investor.

Legal Entities

Leah told George, “It may pay to place your assets into separate legal entities, such as a Limited Liability Company or a Subchapter S Corporation. If structured correctly, personal assets may be protected by the corporate veil. Entities may be established for individual properties or investments may be grouped together.”

She detailed, “Combining multiple assets into a single corporate entity may result in enhanced exposure.

Stick to the Facts in Documentation at Your Property

When dealing with accusations of discrimination, documentation at your property is key. The Grace Hill training tip of the week focuses on documentation and what you need to know.

Documentation is extremely important when dealing with accusations of discrimination. Should you or your community ever be accused of discrimination, you must be able to defend your decisions, policies, and practices, as well as demonstrate that all persons were treated equally regardless of membership in one of the protected classes. Accordingly, your documentation should offer a full accounting of facts, including events and actions that were taken, all people involved, and specific dates and times.

As you document, it is important to be mindful of what you write. Even a well-intentioned note you jotted down to jog your memory or that you thought might help you provide more personalized customer service could be problematic. Remember, discrimination doesn’t have to be intentional for it to be illegal.

When filling out any type of documentation used at your property: • Do not include physical descriptions of customers, such as straight hair, or dark skin.

• Do not include references to things that may be related to national origins, such as strong accent.

• Do not include references to things that may be related to a resident’s disability, such as uses a wheelchair or

doesn’t hear very well.

• Do not include descriptions of family, such as small children, or twin daughters, or new baby.

If you find yourself writing something that would identify your customer as a member of a protected class, think again. The seven classes currently protected by the federal Fair Housing Act are race, color, national origin, religion, sex, disability status, and familial status.

Some states, cities, and municipalities have expanded fair housing protection to include additional protected classes such as sexual orientation, ancestry, marital status, age, source of income, or military status. While it’s important to know if there are additional protected classes in your area, it should not change your policies and practices. All people should be treated fairly and equally.

A good rule of thumb for documentation is “just the facts.” Avoid documenting any opinion or observation that is not a fact of the situation at hand. Omit unnecessary references and notes, and just stick to the facts.

want, without having to pay for a lawyer to defend myself.

I have more anxiety about being a landlord today than most anything else (at least financially). Over the years, providing housing used to give me a good feeling about investing in rental properties, even when the housing market fell. “It’s cyclical” was what we said back then.

Today the market has heated up, and that cycle seems to have morphed into a target, while landlords have become its bullseye.

the past is not healthy and daydreaming may not be the best way to meaningfully engage in life, but it does allow a chance to muse.

I would like to encourage everyone to continue to express your thoughts and concerns to the city commissioners and continue to let it be known that the ordinance in and of itself is not going to help provide affordable housing as the commissioners claimed it would.

In the meantime, I hope you’re having a safe and prosperous summer.

Monthly Fire Safety Tip Safety Tip Monthly For Multi-Family Housing

Matches and Lighter Safety Kids and fire can be a tragic combination. It is important to never underestimate your child’s curiosity about fire, nor his/her ability to strike a match or use a lighter.

Store matches and lighters out of reach and sight, preferably in a locked cabinet.

Even “child-resistant” lighters are not childproof, and should be stored properly.

Novelty lighters are toy-like lighters that are easily mistaken for toys. In Oregon, the law now bans the manufacturing, buying, or selling of these toy-like lighters.

Discuss with your child that matches and lighters are tools that should not be played with.

If your kids are showing signs of curiosity with fire, it is important to take the steps to stop this dangerous behavior.

Dear Maintenance Men

Dear Maintenance Men: I have a 100 gallon 79,000 BTU Water heater which is about 5 years old. The heater has trouble maintaining a normal operating temperatures and the flame is yellow.

I would hate to buy another heater, what do you think is wrong?

Greg Dear Greg: I think you have a couple of things at work here. First let’s address the yellow flame as that might solve the entire issue. A yellow flame indicates that the burner is not getting enough air. That means there might be an obstruction from dust or cobwebs in the burner assemble. Follow the gas line into the burner assembly and note where the air comes into the burner. If there is no obstruction at the air duct, remove the gas line from the burner and inspect the gas orifice. It is not unusual to find lint or cobwebs clogging the orifice or the gas line. (Gas line between the thermostat and the burner.) With a brush clean the burner ring. The cleaning should solve the yellow flame issue and greatly improve the efficiency of the burner. A second item to address while maintenance is being done to the water heater is to clean out the water tank. Most 100 gallon water heaters come with a clean out port on the side of the tank.

This port is for cleaning out accumulated calcium and debris from inside the tank. Depending on the hardness of the water being fed to the heater, it is not unusual to remove one or more buckets of debris. The thick deposits on the bottom of the tank greatly impact the ability of the burner to heat the water. The clean out of the tank should be done once a year. This service will greatly lengthen the life of the water heater if done on a regular basis.

Dear Maintenance Men: Pigeons are driving me crazy! I have tried everything to get rid of the pigeons that have taken over eaves and patios at my complex. I have used fake owls, high pitch sound devices, goop to give the pigeons sticky feet and spikes everywhere. They just laugh at the spikes and walk and nest over them. Any advice will be welcome!

Jennifer Dear Jennifer: Although your situation is beyond this; the first line of defense is not letting pigeons get a foot hold at your property in the first place. Talk to your residents and make sure no one is feeding the pigeons! It sounds like you have tried most of the common antidotes for getting rid of established unwanted pigeon flocks. Getting rid of pigeons is a war of wills. If you give up, they will return. www.rhaoregon.org

The key is to make them as uncomfortable as possible and not stopping until they are gone. First thing to do is clean the area with bleach to remove any pigeon nesting smells and spraying any stubborn pigeons with a water hose over and over. If the area lends itself to be closed off, put up netting to keep the birds from entering the area. If the spikes are broken, replace with stronger ones. Check at your local farm supply or the internet for stronger better quality spike strips. The area must be monitored constantly until the birds have found a new nesting area away from your building and remember, this is a daily battle if the campaign is to be successful.

Dear Maintenance Men: Do you have a recommendation for exterior lighting that will make the property stand out from its neighbors?

Jorden Dear Jorden: We are big fans of LED lighting and have used 120 volt half inch LED rope light to great advantage. Install the rope light under the eaves and out of the way. From the ground the light appeared to emanate out from the eaves and down the walls. The light is indirect and made for a very interesting look. The side benefit of the rope light was not only did it look great; it shed light in all the dark corners around the building. LED rope light is more expensive than the incandescent rope light, however, it is economical in the long run, it has a long service life and the rope does not get hot or even warm to the touch. (Although less expensive, we do not recommend incandescent rope light.) LED Rope light comes in 150 foot rolls and with the proper rectifier in place, up to 1200 feet can be used from one electrical source. The light comes in cool white, natural white and warm white along with a variety of colors. The rope light can be installed onto a plastic track to help keep it straight and to eliminate any drooping of the rope. Remember to pre-drill the track before installation. LED rope light is perfect for under stairs, balconies and anywhere you need soft indirect light. Keep in mind, it does not throw light very far and will not light up a courtyard, it is mainly for aesthetics and it will make your building stand out!

As the largest provider of food assistance in the state of Oregon, we help nearly 10,000 people in need each month. SnowCap accomplishes this with the hard work of 1,000 volunteers led by a staff of 9 and without government funding.

Since 1967, SnowCap has made healthy, fresh foods available to those who would otherwise go without. The majority of our clients are children, the elderly, disabled and folks who struggle to make ends meet.
