President’s Message The City of Portland enacted its Renter Protection ordinance in February 2016, as a temporary emergency measure to address the city’s housing crisis. When they did this, they decided to leave exempted any owner with only one Portland rental unit from being affected. As this all occurred, there was a lot of discussion, but not an uproar. A lawsuit was RHA Oregon President Ron Garcia filed against the city, however it lost in court.

On March 7, 2018 the Portland City Council voted unanimously to both remove that single owner exemption, and also make the ordinance permanent. Additionally, they have signed off on a program requiring mandatory landlord registration, and there are many questions remaining as to what the collected data will consist of and for what purposes it will be used.

Next on the list, per the mayor’s Residential Services Commission (of which I was formally a member, but resigned due to its overwhelming bias against landlords), three issues remain to be “accomplished”:

1. Revise and regulate landlords’ screening criteria, making it nearly impossible to deny an application, under the guise of “disparate impact”.

(In other words, the thinking is that felons and child molesters deserve housing too!)

2. Revise and regulate landlords’ security deposit requirements, capping the amounts that can be charged and regulating the way they must be refunded. (In other words, the thinking is that the pet stain left on your carpet, is only worth the 8 inch square, pro-rated amount of an already depreciated flooring material, and not the actual cost to replace the damage that was done.)

3. Create and foster a “regional” relationship with neighboring communities designed to make the ordinance consistent across city and county lines because the marginalized tenants most affected by the housing crisis are being pushed further away from the city’s core. (In other words, just because you own rentals in Beaverton, Gresham, or Milwaukie, etc. doesn’t mean you are safe from this rising tide.)

While there was a lot of discussion last year at the state capital during the 2017 legislative session about the housing crisis, (HB 2004 was only narrowly defeated) it is notable that there was almost no mention of it in this year’s just-completed 2018 session. The reasons why are three-fold: 1. The same politicians that voted HB 2004 down are still in power this year.

2. The tenant activists look to this next election cycle and hope it will significantly change the make-up by 2019. (Democratic Senator Rod Monroe is largely credited with holding the line against rent control measure, and he is being aggressively challenged for his seat.) (continued on page 7) 4

Unfortunately, the ears of our elected officials have been plugged by an activist-oriented tenants’ rights coalition, Sincerely, whose sole aim is to adjust the balance of power between Ron Garcia renters and owners. They want to diminish private President, RHA Oregon property rights and justify their actions by claiming discrimination and predatory practices (which, by the way, are already heavily regulated by local, state and federal laws).

This is neither a liberal vs conservative nor a democrat vs republican debate. It’s not even a property owner vs renter argument. While these policies may provide temporary relief for a marginalized demographic of the tenant population, they are destined to make rental units even more scarce and more expensive, which in turn would only serve the current trend of thought to enact even more punitive legislation and thus continue the spiral.

In other words, the solutions being adopted are bad economics for all parties. Look to any city that has rent control. San Francisco, New York City, and Seattle all have the highest rents in the country! Tenants are not winning even with these claimed social victories.

And that’s what this is: A socialist type of power grab which is taking place right now in our community, hurting the very people it claims to be advocating for.

Changes to Tenant Screening Process

We are excited to announce that there will be changes to your screening processes in March. In the past, you may have submitted your report requests to Rental Housing Alliance Oregon, who then submitted them to us at National Tenant Network. We are streamlining the entire process by asking you to send your reports directly to NTN. This will cut down on the turnaround time, and make the process more convenient for you.

Starting in March, you will be able to fax report requests to NTN at 503-635-9392, or you can log on to our web site to submit your requests.

This provides you with the opportunity to give that tenant a Gold Star, or Tenant Worthy recommendation, and will prompt other landlords to call you for more information before renting to that resident if you had a negative experience.

You can use our NTN SecureLease system, which enables you to email an application to the applicant! ntnonline.com/resident-screening/ntn-secure-lease/

Spring Maintenance Checklist

In spring, focus on freshening up your rental property and protecting the dwelling against the season's strong winds and rains. Use this time of the year to thoroughly clean and care for your investment.

Outdoor Tasks:

____Clean gutters and downspouts ____Inspect roof and chimney for cracks and damage ____Wash the exterior of all windows ____ Install missing screens on windows and doors, repair as needed ____ Fertilize the lawn ____ Check decks for loose boards, railings, or stairs ____ Professionally service heating and cooling units ____ Check the foundation for cracking as well as for insect damage ____ Remove foundation vent covers and spigot covers

Indoor Tasks:

____ Test all smoke and carbon monoxide detectors ____ If the basement has a sump pump, test it by dumping a large bucket of water into the basin of the sump pump. This should activate the sump pump. If it does not switch on or if it's not pumping water, it may need to be serviced by a professional. Also, check for and remove any debris and make sure there are no leaks. ____ Assess the need for blind repair, cleaning or replacement ____ Repair or replace broken or missing kitchen cupboard hardware ____ Check the attic for signs of moisture and water stains ____ Check walls for condensation and mildew ____ Check electrical panel for rust, make sure circuit breakers are operating correctly ____ Clean dryer vents ____ Clean or replace furnace filters ____ Check clothes washer hoses for cracks or swelling ____ Check all faucets for leaks or slow drips. Detach and flush aerators. ____ Maintain clean drains by pouring one-half-cup baking soda followed by one-half-cup white vinegar into each. After 10 minutes, flush with boiling water.

Reasonable Accommodation and Modification Requests Under the Fair Housing Act, individuals with disabilities have the right to make reasonable accommodation and modification requests. The Fair Housing Act only applies to an individual’s residence. Other laws apply to employment, public accommodations, and government services. Often, individuals with disabilities have a very difficult time finding housing that meets all of their unique needs. The right to request reasonable accommodations allows individuals with disabilities to identify specific individual housing needs created by their disability and ask housing providers to meet those needs. The goal is to provide individuals with disabilities with as many housing options as possible. Reasonable accommodation requests can also serve as a communication tool and a way to educate housing providers about the needs of individuals with disabilities.

The main limitation on requests is that the change requested must be reasonable. What is reasonable varies depending on the particular housing situation, the housing provider, and the individual making the request. Housing providers can deny a request if the request 1) creates an undue financial and administrative burden or 2) fundamentally alters the nature of the housing provider’s business. What is reasonable is very discretionary; therefore, it can be uncertain whether a court or administrative agency will enforce the request.

What is a reasonable accommodation?

Individuals with disabilities have the right to request exceptions to their housing providers’ rules, policies, and practices. An individual must establish that he/ she has a disability that substantially limits a major life function, and that the accommodation or exception requested is necessary because of his/her disability.

The accommodation requested must be necessary to access housing, maintain housing, or have full use and enjoyment of an individual’s current housing.

Example of a Request to Modify a Rule, Policy, or Procedure: If a landlord has a no-pet policy, a woman who is sight impaired has the right to request an exception to the no-pet policy for her seeing-eye dog. In this situation, the dog is the same as a wheelchair or a cane; it is a tool that helps the tenant to be mobile and active, and it is not a pet. Because the dog is not a pet, the landlord cannot charge the tenant any fees or deposits for the 10

dog, just as the landlord cannot charge a deposit because someone uses a wheelchair. However, the landlord may charge the tenant for any damage her seeing-eye dog does to the property. In addition, if the seeing-eye dog is a safety threat because the dog attacks another tenant, or the dog constantly barks or exhibits other behavioral problems that disturb other tenants, the landlord can tell the tenant she cannot have that particular seeing-eye dog.

However, the tenant still has the right to get a different seeing-eye dog.

Housing providers cannot charge fees or deposits for necessary accommodations because this in effect would allow them to charge individuals more money because they are disabled. Reasonable accommodation requests do not meet wants or desires — they meet needs. The individual making the request is not choosing to make the request; they must make the request in order to satisfy their housing needs.

However, just like any other tenant, if an individual with a disability damages the property directly or through their reasonable accommodation request, the individual must pay for the damages.

What is a reasonable modification?

Individuals with disabilities also have the right to request reasonable modifications to the structure of their residence. The modification must be necessary because of the individual’s disability. In addition, private landlords can require the individual with a disability to make the modification and pay for it.

Private landlords may also request that when the individual moves out, he/she restores the premises to its original condition and pays for any damage caused by the modification.

Example of a Request for a Structural Modification: A man who uses a wheel chair has the right to ask his private landlord to allow him to install a ramp on any inaccessible walkway that he uses in the complex. Most walkways at an apartment complex are not considered to be open to the public, but part of an individual’s residence. If the walkway just provides access to the individual’s residence, then the landlord can require the individual to install and pay for the ramp. The landlord has the right to require the tenant to have the work done in a professional (continued on page 11) www.rhaoregon.org

manner, and obtain a permit if the local building code requires a permit to install the ramp. As under reasonable accommodation requests, the modification cannot create a health or safety risk to other tenants.

Under different laws, federally subsidized landlords are required to make and pay for the necessary modifications.

When is it appropriate to request a reasonable accommodation or modification?

Individuals with disabilities must make a verbal or written request for a reasonable accommodation.

Requests must be reasonable, related to the individual’s disability, and further the individual’s ability to get or keep his/her housing. The request may be made while applying for housing, or at any time during the tenant’s occupancy. Requests can be made after the tenant receives a notice or warning, and often tenants are not aware that there is a potential problem until they receive a warning or notice from the landlord.

However, to prevent stress and conflict, the tenant should make the request as soon as he or she perceives a need.

Verification from a qualified individual may be necessary.

Housing providers have the right to ask for verification from a qualified individual that the tenant is disabled and the change or modification is necessary because of the tenant’s disability.

A qualified individual is anyone with expert knowledge in the area, who has knowledge of the individual’s disability and needs. Although an individual needs verification that the request is related to his disability, this does not mean that a tenant is required to provide a doctor’s prescription for the requested change. If it is possible, the tenant should have the verification available when he/she makes the request.

How do I make a reasonable accommodation request?

The request may be made verbally or in writing.

In general, it is a good idea to document the person requesting a reasonable accommodation’s interaction with the housing provider. Therefore, it is preferable to put the request in writing and to keep a copy of the request on record. The request should include the following: www.rhaoregon.org

“This is a request for a reasonable accommodation.”

“I have a disability that substantially limits the major life function(s) of _______.”

“Because of my limited ability to ________________, I need _______________.”

“Therefore please make an exception to your_________________ policy.”

“I need this accommodation in order to live in this housing.”

“Please respond to my request by _______ (specify a date, generally 10-14 days from the date you send the notice is sufficient time).”

“If I don’t hear back from you by _______ (date specified above), I will assume that you denied my request.”

The individual requesting the reasonable accommodation should be very clear that the needed reasonable accommodation is connected to his or her disability, and that the change is necessary to live in his/her housing.

If the housing provider ignores the request, the individual can pursue an enforcement action (continued on page 17)

Dear Maintenance Men: I have a toilet that runs every ten or twenty minutes. I have replaced the fill valve, the flapper valve and I have even scrubbed under the rim! In other words, all the items I can think of that are replaceable in the tank are new. What else should I be looking at?

Sam Dear Sam: You replaced all the easy ones! When all else fails on a toilet leak down issue; it is time to put on your rubber gloves and get an adjustable wrench. Chances are the problem lies with the Flush Valve Seat. The rubber flapper valve seals against the flush valve seat (the big hole at the bottom of the tank.) to either keep the water in the tank or let the water out of the tank. The seat may have a burr, crack or calcium deposits that allow a small amount of water to seep past the rubber flush valve. Sanding the seat to remove the burr or calcium deposit is a shortterm solution and rarely solves the problem for long. A permanent solution is to replace the flush valve. Start by turning off the water supply, completely empty the tank and remove the water line. Remove the two or three bolts holding the tank to the toilet bowl. Turn the tank upside down and remove the large nylon or brass nut that holds the flush valve to the tank. Install the new flush valve. Be sure the tank bottom is clean and no debris gets between the new valve’s rubber gasket and the tank. Tighten the large nut on the outside of the tank and you are ready to reassemble the tank and bowl and put the toilet back into action. When reassembling the tank to the bowl, install new rubber washers and bolts.

Dear Maintenance Men: I have a number of buildings that have old sliding windows and glass doors where the track is ground down to the point where the slider drops and barely maintains its position in the frame. Is there an insert or rollers that attach to the slider that elevates it and maybe even makes it easier to open and close? With the age of these buildings, I’m finding this is becoming a common problem.

Craig Dear Craig: The best solution would be to replace the window assembly, but that can be costly. What we do is install a nylon or vinyl track insert or rail cap (Brand name: EZSlide) and replace the wheels to match the new insert.

The inserts can be found at local hardware stores or at a company called Prime-Line Products (primeline.net) or Blaine Window Hardware Inc. (blainewindow.com). These 14

companies carry replacement parts for most windows.

It might be best to call the company and tell them what brand windows you have and they might be able to get you exactly what you need.

Dear Maintenance Men: While walking around my building, I found white powdery stuff growing on the surface of the building’s concrete foundation. What is this and do I need to worry about it?

Fred Dear Fred: The effect is called efflorescence and it is a natural occurring condition on wall or floor material such as concrete, brick and stucco. These porous materials absorb water and when the water evaporates, it leaves behind an alkaline salt.

The efflorescence appears as a white, crystalline powder.

Water is always the culprit. First thing to check would be sprinkler locations and if the spray hits the wall, relocate the sprinkler. Another problem is moisture wicking up into the stucco from the ground. Older buildings built before 1974 probably do not have a “weep screed” at the bottom of the wall. A weep screed is a metal flashing designed to act as a vapor barrier and transition between the concrete slab or stem wall & wood framing. Installing a weep screed after the fact is not feasible. A solution would be to locate the transition between the slab or stem wall and the wood framing. Saw cut through the stucco to the base plate. Now fill the saw cut with a bead of silicone sealant. The silicone will act as a vapor barrier, effectively stopping the moisture from wicking up into the stucco.

Refinish your stucco and paint to suit.

because a time limit has been set, and if there is no response by the end of the time period the individual with the disability may proceed as if the housing provider denied the request. The request, should not threaten the housing provider with the possibility of a formal complaint.

Why can a reasonable accommodation request be denied?

Individuals with a disability have the right to determine which change or exception would best meet their needs. However, once a disabled individual establishes that he/she is disabled and the request is necessary because of his/her disability, a request may be denied for two reasons: 1) The change or exception would create an undue financial and administrative burden, 2) The change or exception would fundamentally alter the nature of the landlord’s business.

The landlord cannot deny a request merely because it creates some financial expense or requires the

landlord to do some extra paperwork. The expense or the administrative work must be undue. The same is true if the change requires the landlord to change the way they conduct their business. Most reasonable accommodation requests will require the landlord to change the way he/she conducts his/her business, however for the landlord to deny the request, the change must be fundamental such as requiring the landlord to wash the tenant’s laundry or requiring the landlord to walk the tenant’s service animal.

What does a tenant do if the reasonable accommodation request is denied?

If the request meets the above criteria and the housing provider denies or ignores the request, the individual requesting the reasonable accommodation can pursue enforcement action by filing an agency complaint with either the Federal Department of Housing and Urban Development (HUD) or the Oregon State Bureau of Labor and Industry (BOLI), or you may file a lawsuit.
