ollowing the appointment of First Lady of the Republic as a candidate for the vice presidency in the electoral contest which ends on May 4, 2014, there have been a series of reflections and opinions on Articles 192 and 193 of the Constitution which respectively prohibit choice of relatives within fourth degree of consanguinity or second degree of President of the Republic who has held office in the immediately preceding period. BANKS WILL HAVE TO PROVIDE SPECIFIC ADDITIONAL CREDIT PORTFOLIO IN COLON FREE ZONE

T

he Superintendent of Banks, through General Board Resolution SBP-GJD-0002-2014 of January 7, 2014 resolved to establish a requirement for additional specific provision to banks on the loan portfolio held in Colon Free Zone, from of February 28, 2014 with involvement in his statement. Consequently, the measure shall be applied by the bank, monthly, according to the set parameters so that is reflected in financial information that is submitted to the Superintendent. As for the minimum criteria that banks must use to calculate the additional provision of each of its clients in the Colon Free Zone and the loan portfolio can mention among others: 1. mong the latest fixes to dismiss 2013 and receive 2014, national government announced with great fanfare the approval of Executive Decree No. 182 of December 30, 2013 by which the new minimum wage rates are set at the Republic of Panama and entered into force on 1 January 2014. PUBLIC RESIDENTIAL BASIC SERVICES WILL TAKE PART OF THE CREDIT RECORD

W

ith the passage of Act 135 of December 31, 2013 Act 24 of 2002 which regulates the inquiry on credit history of consumers or customers changed.

ecently, the National Assembly adopted Law 132 of 31 December 2013 creating Limited Liability Microenterprise and incentives for inclusion of informal sector is set to formalized economy.

ast December, the National Assembly passed the Law 134 of 31 December 2013 published in the Official Gazette No. 27450 of January 10, 2014, which aims at economic equality of people with disabilities who are in the country, based on principles of equality, non-discrimination, participation, responsibility, equality of opportunity and respect for human dignity. Law 134 provides that all persons with disability who are duly certified by the Secretary of National Disability within the national territory, are Panamanian, Panamanian residents, temporary residents or nonresidents shall be granted including the following economic benefits and that overall fall of 19 points: 1. ax revenues continue to rise in Latin America but remain low relative to national income compared to most OECD countries, the statement Revenue Statistics in Latin America 19902012, presented today Santiago de Chile.

The average income tax rate of the 18 countries covered by the report [1] increased steadily from 18.9% in 2009 to 20.7% in 2012, after falling from a peak of 19.5% in 2008, indicates the publication produced by the Organization for Economic Cooperation and Development (OECD), the Economic Commission for Latin America and the Caribbean (ECLAC) and the Inter-American Center of Tax Administrations (CIAT). The report, released today under the XXVI Regional Seminar on Fiscal Policy to be held in ECLAC, shows that the tax rate as a share of GDP increased significantly in the region in the past two decades, from 13.9% of GDP in 1990 to 20.7% in 2012. However, this rate is still 14 percentage points below the average of OECD countries (34.6%). There are wide differences between national tax revenue rates in Latin American countries. The list is headed by Argentina (37.3%) and Brazil (36.3%), which are above the OECD average, while at the end Guatemala (12.3%) and Dominican Republic are located (13 , 5%). Among OECD countries, the same range varies between 48.0% and 19.6% in Denmark [2] in Mexico. The report includes a special chapter on the trends of revenue from non-renewable natural resources in Latin American countries are exposed. Key results: Tax revenue as a percentage of GDP • In 2012 , the rate of tax revenue to GDP rose compared to 2011 in 13 of the 18 countries in Latin America and the Caribbean analyzed fell into four (Chile, Guatemala, Mexico and Uruguay ) and one remained unchanged (Costa Rica ). • The difference between the average rate of tax revenue to GDP in the OECD and that for the 18 countries of Latin America and the Caribbean was reduced from 19 to 14 percentage points between 1990 and 2012. • In 2012, the largest increases in the rates of tax revenue to GDP accounted for Argentina (2.6 percent), Ecuador (2.3 percentage points) and Bolivia (1.8).


• The largest declines occurred in Uruguay (1.0 percentage points) and Chile (0.4 percentage points). • In the period 2007-2012, 11 countries recorded increases. Tax structures • After strong growth in the last twenty years, general consumption taxes (mainly VAT and sales tax) accounted for 33.8% of tax revenues in the countries of Latin America and the Caribbean in 2011, compared 20.3% of OECD countries, while the weight of the specific consumption taxes (such as excise taxes or taxes on international trade) has been reduced to 17.7% (in the OECD is 10.7%). • In Latin American countries, taxes on income and profits in 2011 represented on average 25.4% of revenue, while contributions to social security accounted for 16.9% (OECD said percentages are 33 , 5% and 26.2%, respectively).
