Driving Under the Influence of Intoxicants (D.U.I.I.) From the Medford Police Department

The crime of driving under the influence of intoxicants is one that can be committed by any person of any background

regardless of social status or race. Prevention of this crime starts with every driver and knowledge of what a DUII is, how arrests work, and what rights and costs are associated with the act.

Law enforcement officers can pull drivers over for many reasons, including equipment failures such as nonfunctioning

taillights. If the officer suspects the driver is under the influence due to clues like red eyes or breath that smells like alcohol, the driver may be asked to perform sobriety tests, which can include checking movements of the eyes and standing on one leg while maintaining balance. It is important to understand that if the officer decides to arrest the driver that the driver will be handcuffed for security. The driver may then be taken to the police station, jail, or a location for detoxing. Additional sobriety tests may be performed, and if refused, the driver’s license is suspended. If incarcerated, the driver’s belongings will be inventoried and fingerprints collected. The driver has the right to one phone call, to see a judge, to an interpreter, a defense attorney, and to a trial by jury. Release from jail may be on the driver’s own recognizances or by bail.

A DUII arrest may result in verdicts of no contest, guilty, or

innocent. DUII conviction is very expensive and includes loss of privileges, but the greatest costs of all are from the damage done by accidents and lost lives from the dangerous behavior of driving under the influence.
