A copy of your point of sale generated sales summary must be submitted with the form. D O I PAY U T I L I T I E S ?

A M I R E Q U I R E D TO H AV E A B U S I N E S S P L A N ? Yes, you must have a business plan and it must be included in your QKC Specialty Leasing Application. An outline of the business plan components is provided on page 9.

Yes, in-line spaces pay for utilities such as electric and water. Retail Merchandising Units include utilities. If you select an in-line pop-up shop of 3 days or less, utilities are included. W H AT PAY M E N T S D O YO U A C C E P T ?

Yes, you will be required to provide commercial general liability insurance and add QKC as additional named insured, along with a copy of worker’s compensation insurance, as required by the laws of the State of Hawai’i. Your lease is flexible, negotiable and will vary based on your preferred retail solution, location and length of the license agreement. C A N I P I C K W H I C H L O C AT I O N I W A N T ? QKC will make every effort to accommodate your location request, however spaces may be unavailable due to pending or executed leases. Location selection also includes factors such as mall merchandise mix and market rates for specific locations. ARE THERE VISUAL REQUIREMENTS? Yes, however you must avoid drilling, taping, hammering or screwing items. Keep in mind the leased space should be turned over in the same condition it was provided by the landlord. Specialty Leasing Insurance Requirements Before commencing operation, Licensee shall procure and maintain, at its expense, commercial general liability insurance and shall furnish to Licensor certificates of insurance naming Licensor and Licensor's agent as additional named insured thereunder and indicating that the following coverages are in full force and effect. Licensee shall also procure and maintain, at its expense, and furnish Licensor a certificate of Worker's Compensation insurance, as required by the laws of the State of Hawaii. Coverage Requirements: Commercial General Liability With minimum limits for bodily injury, property damage or personal and advertising injury of $1,000,000 per occurrence and $2,000,000 general aggregate. In the case of food and/or beverage being prepared and sold on-site, these limits shall be $5,000,000 per occurrence, and $5,000,000 general aggregate. Worker’s Compensation With statutory limits for all employees and Employer’s Liability Insurance which affords limits of not less than $1,000,000 each coverage and policy limit. “All Risk” Property Insurance Coverage must include all inventory, trade fixtures, furniture, furnishings, and equipment not affixed to the Licensed Premises, and covering all improvements installed in the Licensed Premises by or for the Licensee in an amount not less than 100% of the replacement cost of such property, without co-insurance. All policies issued are required to provide either that (i) “Should any of the above described policies be cancelled before the expiration date thereof, the issuing insurer will endeavor to mail thirty (30) days written notice to the Certificate Holder”; or (ii) “Should any of the above described policies be cancelled before the expiration date thereof, notice will be delivered in accordance with the policy provisions.” The following must be removed from the cancellation wording: “Endeavor to… but failure to mail such notice shall impose no obligation or liability of any kind upon the company, its agents, or representatives.” All such insurance carriers shall be rated A-VIII or better by Best’s and shall be authorized to do business in the state in which the Shopping Center is located.
