Tenant Fee Ban & Changing Lettings Legislation The rapidly changing demands from the property lettings market today means it is a very different environment today than it was just 5 years ago. Not only have the demographics of tenants changed as first time buyers struggle to save a deposit and the younger generation now considering long term rentals as a more viable option so does the size and style of property in demand change. Gone are the days of HMO properties reminiscent of “The Young Ones� TV series being the only properties available to let. Tenants are not only looking for a higher standard of accommodation but they are also prepared to pay higher rents for the right type of accommodation. Demand is no longer restricted to students with people moving with employment, going through separation or just couples moving in together now taking up so many of our properties. In addition to the changing face of tenants landlords are being bombarded with ever changing legislative requirements. Some may have thought the licensing requirements from Rent Smart Wales would have been the end of matter but with over 150 pieces of legislation covering aspects from legionella risk assessment and electrical safety requirements, through to time scales and paperwork for registering deposits or just how much you can now charge a tenant, many are
simply struggling to keep on top of things, and proposals for the new Housing Act in Wales suggest this is far from the end of the matter. With many property sector commentators believing that the balance of power is moving in favour of tenants more than ever landlords are placing the management of their properties in the hands of property specialists like Williams & Goodwin to not only ensure that a duty of care and compliance with legislation is maintained ensuring landlords are always operating within the law and that their property and tenants are safe, but also the landlords best interests are being served, and a realistic market rent is obtained. Whilst such matters as deposit regulation requirements, Housing Health & Safety Rating Systems, and prescribed section 21 documents have all had an impact recently at the time of going to press it would appear that a Tenant Fee Ban is likely to be implemented by September 1st. Whilst it is frustrating that in early August we have still not been given the final guidelines from Welsh Assembly at Williams & Goodwin we have been training our staff on the implications from the draft proposals which highlight the fact that a tenant cannot be charged any sum other than a permitted payment. It is bordering on amusing that the legislation specifically mentions rent as a permitted payment, but the other permitted payments that are allowed are utility bills, holding deposits, security deposits and tenant default fees, although each one of these have specific rules.
Tim Goodwin, Director Williams Goodwin. relief to see that the legislation allows for a holding deposit to be taken, however specific rules again apply as this cannot be more than 1 weeks rent [and has a specific formula of how to calculate a weeks rent], must be returned if the landlord decides not to proceed, and can only be retained after 15 days on certain grounds. With the banning of tenants fees there was concern that a tenant could apply for a number of properties at the same time so a considerable amount of work could be entailed by landlords and agents to prepare the property and tenancy for the applicant to decide on another property. It is therefore a
