By Mawande Genu group of ANC members lead by Deputy-Secretary General Jesse Duarte took to the streets in a campaign to have William Nicol Drive renamed after Bizana born struggle icon, Winnie Madikizela Mandela as reported by News24 in their website on 26 April. Nicol was a Dutch Reformed minister, member of the National Party and the Broederbond, an Afrikaner nationalist group that existed during apartheid. He was also the co-author of the Regverdige Rasse-Aparthied (Just Racial Aparthied). Despite the fact that on our previous discussion, there are laws which serve to protect women's property rights, Beninger and Williams claim that men are not only una-ble to consider legislation that favours women, but that a lack of understanding about such legislation often hinders the performativity of such papers (Mamashela M and Xaba T, The Practical Implications and Effects of: The Recognition of Customary Marriages Act 120/1998, Re-search Report No.59, 2003). As a result, "Living" cus-tomary law prevails in the absence of understanding of certain laws or a violation of existing gender relations, a condition that the Msinga Case Study confirms;

Msinga is a poorly underdeveloped rural area in Kwa-Zulu Natal where most of its residents, due to poor infra-structure and inadequate service delivery, suffer many ordeals, including having little or no access to water, unemployment, poor education system and very low levels of economic development. Msinga is a rural area where most of its people live in thatched mud houses and live according to the tribal rules of the region, in fact about 69% of the land in Msinga belongs to the Tribal Authority, the remaining 31% is owned by commercial farmers. The Land Laws of Msinga Project was a three year intervention study project in the Mchunu and Mthembu tribal areas that took place between 2009 and 2011. The project was in response to the planned introduction of the Communal Land Rights Act, and it aimed to gain a better understanding of existing land tenure behaviors in order to assess how the Act's implementation could affect living conditions. Interviews, insights and group conversations were included in the project, which culminated in a wealth of knowledge about normative values and decide how land is allocated. This thesis resulted in the publication of yaseMsinga. The Living Rule of Land in Msinga, KZN (June 2011). Msinga as a case study, continues to provide a convincing explanation not only of patriarchal society organisation, but of how such organization is complex and di-verse, and that any land-orientated policies should under-stand local experiences and moral principles before adoption, despite the fact that data collection ended in 2009. While not a main aim of the project, its key findings were gender-centred on family organizations, polygamy, marriages and patrilineal ownership, all which relate to customary practices. This incident is said to have happened in the late hours of Wednesday, 28 April 2021 by individuals who are still unknown. On the 28th of April our reporter was also at the scene outside Bizana Magistrate Court where local residence were fuming, eager to see the suspects but police could not allow unwanted scenes from the angry crowd. One placard wrote “No bail, my brother was number six on the list”, it is alleged that one of the suspects had a list of people to eliminate. This has caused divisions between locals, the ANC and it’s leaders as some are still in shock and disbelief of possibilities of one of their own to have said to be involved in such an act of crime. This incident has come at the time when ward councillors only have 4 months to vacate office and Mbizana locals suspect the murder to be politically connected to the upcoming local government elections. One councillor who does not want her name mentioned to protect her identity said this has put the ANC into an unwanted position but has congratulated the police for acting swiftly. “how many of us were to follow.? - she asked. “No matter what the situation is, no one has a right to participate in acts of crime in our area because torching someone’s house is a serious criminal case. We are aware that community members are angry at what has allegedly happened, but we urge everyone to calm down and let the police do their work,” said Her Worship, the mayor Cllr TD Mafumbatha said on a press release issued on 29th April morning by Winnie Madikizela-mandela Local Municipality.
