The concept of unconstitutionality of Indigenous practices in South Africa A column by Bongani Dinga ka Luvatsha info@pondolandtimes.co.za The concept of unconstitutionality of Indigenous practices in South Africa has been on the lips of many scholars and legal minds in the country; even parliament has been much occupied with the ordeal and touched on the importance of re-evaluating such practices and norms. Section 211 (3) of the Constitution holds that "The courts must apply Customary law when that law is applicable, subject to the Constitution and any legislation that specifically deals with Customary law". This basically means that Customary law will only be recognised if and only if its practices, norms and values are aligned with the Bill of Rights enshrined in the Constitution. The problem we see now in our communities is that South African indigenous people still practice customs and traditions which are not aligned with the Constitution, for example the custom of "ukuthwala" is a clear violation of person's right to dignity, equality, freedom of movement and the right to freedom and security of a person (Section 10, 9, 21 and 12). The are many other cultural and religious practices which are contrary to the Constitution which are still being practiced to this very day and the most remote rural areas in the country are experiencing gross human rights violation on a day-to-day basis without law or government doing anything about it. This has to come to an end and promptly. BACKGROUND REVIEW OF CUSTOMARY LAW. South African Customary law may be described in section 1 of the Recognition of Customary Marriages Act 120 of 1998, defines customary law as: "customs and usages traditionally observed among the indigenous African people of South Africa and which form part of the culture of those people". The definition of customary law as it appears in the Recognition of Customary Marriages Act brings forth three key elements: customs and usages; "Custom is (a) A practice followed as a matter of course among people or society, a conventional mode or form of action. (b) A habitual practice of an individual. (c) Law. A common tradition or usage so long established that it has the force as validity law" South African indigenous practices date back to the beginning of times, they are old as the African Nguni language itself. Indeed, it is clear to see that indigenous practices in South Africa serve as a reminder of the identity and unique culture of South African people, however, it is also clear to see that some of the practices are against the spirit, purport and objectives of the Bill of Rights enshrined in Chapter 2 of the 1996 Constitution. In the next issue we will discuss some common practices of the South African indigenous people which are still practiced today and might have a direct or indirect infringement on certain Human Rights.

Larsen Applauds Team Ef for t As The Lions Of Skoomplaas Hunt For Sur vival By Mawande Genu Bizana Pondo Chiefs coach has lauded his boys for their solid performance against Cape Umoya United after their goalless draw on Wednesday, April 7, 2021 at King Zwelithini Stadium. The Lions of Skoomplaas remain rooted at the bottom of the Glad Africa Championship and are on the hunt for survival as the season nears its end. Clinton Larsen was pleased by the overall performance of his squad and reserved some special praise for his troops. “Jah! I am very pleased with the performance of the boys especially taking into consideration what happened with TS Sporting I thought the boys came back really showed what they capable of.
