n the morning of the 18th May 2021 a house break-in went wrong for four suspects that have troubled Bizana residence for a while. It is said that these young men have been breaking-in to a number of households stealing TV’s, demanding money and raping women, on this day these suspects were caught by the community members trying to break-in to a container in Ludeke halt. Suspects were beaten up by the community during the questioning they confessed these break-ins and told the community that an old lady who is the mother to one of them baths them with muti before they go commit these crimes so that people in the house will fall asleep.

FRIDAY 28 MAY—FRIDAY 04 JUNE

These crimes have been committed in villages around Ludeke Halt , Kwandela, Nomlacu, Nyanisweni to mention but just a few. Right after the suspects were taken by the police, residents took a collective decision and went to the home of the very same suspect, ordered his family to pack and leave on the following morning. Apparently, it is not the first time for this family being banned by communities as this is said to be their 4th time. On a meeting held by the above-mentioned villages in Ludeke Halt on Sunday the 23rd of May it was agreed that the communities revisit this family as they did not abide by their decision.

A group of furious community members who have had enough of these boys acts showed up at the boy’s home where there was no one else except for the shameless mother who only left when the villagers surrounded her home, she didn’t get a chance to take all their belongings but only managed to leave unharmed with two small plastic bags and one hand bag leaving the community destroying and vandalizing her home, seemingly the community was not satisfied with all that, when they were about to leave this house they started the fire just before the police arrived.

Photo from derebus.org.za The concept of ukuthwala originates in the African Nguni speaking tribes. It entails a practice where, preliminary to a customary marriage, a young man forcefully takes the girl to his home. This practice has been prevalent in the Eastern Pondoland part of the Eastern Cape. In this region, young females were targeted by older men. The question which arises is whether such practice comes into conflict with the current Constitutional dispensation. Others view it as an out-dated practice which targets young females while others see it as a legitimate cultural practice. In essence, ukuthwala has three variants, which are ukuthwala ngemvumelwano, ukuthwala kobolawu and ukuthwala okungenamvumelwano. This portion of the Article will discuss the distinction between ukuthwala, child marriage and forced marriage. The Article will also discuss whether ukuthwala is a crime based on South African Criminal Jurisprudence and which criminal charges may be brought against the perpetrators.

EXTERNAL ADVERTISEMENT NOTICE NO: 02/2020/2021

The Article will also look at some of the contravening factors of ukuthwala on the provisions enshrined in the Bill of Rights.

FOR MORE INFORMATION GO TO www.anda.org.za / www.andm.gov.za

The tradition of ukuthwala is limited to single women and girls, which is a direct violation of Constitutional rights in terms of section 9(3) of the Constitution, in this regard gender equality comes to play once again. The form of ukuthwala which is done without the woman’s or girl’s consent is also a direct violation of the said person’s right to bodily integrity, freedom and security of the person. The main problem that is faced by indigenous people living in South Africa who practice ukuthwala is that they practice the living customary law which may, in some instances and provided above, be in direct conflict with Constitutional values.

Closing date: 10 June 2021

The concept of hegemony has long been a staple of African society, and now the gender equity clause undermines the very basis of customary law.

LAST KICK OF A DYING HORSE : BIZANA PONDO CHIEFS GO OUT KICKING AND SCREAMING AS THEY RUTHLESSLY THUMP UTHONGATHI FC By: Mawande Genu

Photo taken from: scrolla.africa

The Lions of Skoomplas ran riot over the Cane Cutters this past weekend handing them a 3-0 drabbing in one of their last games in the Glad Africa Championship as they prepare for life in the ABC Motsepe League. Bizana Pondo Chiefs endured a lackluster campaign in the second-tier league having lost more that ten of their games.

It was not a surprise that many football pundits expected the Bizana outfit to lose the game as it had become tradition for them to come second best in their fixtures. Coach Larsen’s charges out did themselves in this game showing glimpse of the once revered ABC Motsepe League champions. The Hunters drew first blood 38 minutes into the game with a terrific strike from Mlungisi Mdwebu. The first stanza ended with the solitary strike from Mdwebu and Uthongathi FC had no answers. Clinton Larsen’s charges picked up where they left of in the first half getting their second goal from veteran winger, Deolon Mekoe in the 60th minute. A goal in injury time added salt to the wound of the Cane Cutters as they suffered a rather embarrassing loss to a team that has al-

ready been relegated. The Hunters will return to the ABC Motsepe League with their tales between their legs after an excruciating season in the Glad Africa Championship where they were unforgivingly donating points with the stats showing that they were only able to collect just a single point in their last five games before Sundays fixture with Uthongathi and they only managed to amass a total of 20 points in the entire campaign. Hopes of survival were high after they roped in Clinton Larsen and made a few good signings in the last half of the season but it proved to be too little too late.
