Except as provided in this paragraph, neither Northwest Media (Washington), L.P., nor Horvitz Newspapers, Inc., shall be liable for any damages resulting from error in or non-publication of ads, whether paid for or not, including but not limited to, incidental, consequential, special, general, presumed, or punitive damages or lost profits. The sole and exclusive remedy against Northwest Media (Washington), L.P., and Horvitz Newspapers, Inc., for any error in, or non-publication of, an ad shall be a refund of the cost of the ad or the printing of one make-good insertion, at the discretion of the Publisher; provided that Advertiser and/or its agency has paid for the ad containing the error or which was not published; otherwise, the sole remedy shall be one make-good insertion. No claim for repetition shall be allowed. No allowance shall be made for imperfect printing or minor errors. Neither Northwest Media (Washington), L.P., nor Horvitz Newspapers, Inc., shall be liable for failure to print, publish, or circulate all or any portion of an advertisement or of advertising linage contracted for, if such failure is due to acts of God, strikes, accidents, or other circumstances beyond the control of Northwest Media (Washington), L.P. Northwest Media (Washington), L.P., and Horvitz Newspapers, Inc., shall not be liable for errors in or non-publication of advertisements submitted after normal deadlines. Any legal action arising from these terms and conditions or relating to the publication of, or payment for, advertising shall, if filed, be commenced and maintained in any court situated in King or Clallam County, Washington. Other terms and conditions, stated on our Advertising Rate Cards and Contracts, may apply. This service is not to be used to defraud or otherwise harm users or others, and Northwest Media (Washington), L.P., reserves the right to disclose a user's identity where deemed necessary to protect Northwest Media (Washington), L.P., or others or to respond to subpoenas or other lawful demands for information.
